que ofrece recomendaciones técnicas para el\ndesarrollo de la actividad turística del Parque.\n\nSétimo.-Que\nen el Plan Estratégico Quinquenio 2010-2015 del Sistema Nacional de Áreas de\nConservación, se incluye como una acción estratégica el Desarrollar el programa\nde turismo sostenible en las áreas protegidas.\n\nOctavo.-Que\nresulta necesario dictar una nueva regulación para el uso público del Parque\nNacional Volcán Tenorio y la Zona Protectora Tenorio, acorde a lo establecido\nen el Plan de Manejo de éstas áreas silvestres protegidas en relación con las\nactividades que admiten las categorías de manejo correspondientes.\n\nNoveno.-Que\nmediante Acuerdo Nº 9 de la Sesión ordinaria Nº 12-2013 del 10 de diciembre del\n2013 el Consejo Nacional de Áreas de Conservación (CONAC) aprobó el Plan de\nManejo del Parque Nacional Volcán Tenorio, de conformidad al artículo 12,\ninciso d) del Reglamento a la Ley de Biodiversidad, Decreto Ejecutivo Nº\n34433-MINAE del 11 de marzo del 2008. Por tanto,\n\nDECRETAN:\n\n\"Reglamento\nde Uso Público del Parque Nacional Volcán Tenorio\n\ny la\nZona Protectora Tenorio\"\n\nCAPÍTULO I\n\nDisposiciones\nGenerales\n\nArtículo\n1°-El presente Reglamento establece las disposiciones para el uso de los\nservicios brindados, actividades permitidas, actividades restringidas y\nactividades prohibidas dentro de los límites del Parque Nacional Volcán Tenorio\ny la Zona Protectora Tenorio.\n\nArtículo\n2°-Las disposiciones del presente Reglamento y las indicaciones que emitan los\n(as) funcionarios (as) del Parque Nacional Volcán Tenorio y la Zona Protectora\nTenorio a las personas que ingresen a dichas Áreas Silvestres Protegidas, en\napego a dicho instrumento y la normativa vigente, son de carácter obligatorio.\n\nArtículo\n3°-Toda persona que ingrese al Parque Nacional Volcán Tenorio y Zona Protectora\nTenorio, debe cumplir con las disposiciones indicadas en el presente Reglamento\nde Uso Público, así como, las órdenes que emitan los funcionarios con autoridad\nde policía del Sistema Nacional de Áreas de Conservación de acuerdo a lo\ndispuesto en la normativa vigente así como en las políticas, los lineamientos,\nlas directrices y los planes del área protegida debidamente emitidos de\nconformidad con lo dispuesto en los artículos 25, incisos 5) y 8), y 30,\nincisos 5) y 6) de la Ley de Biodiversidad N° 7788.\n\nArtículo\n4°-El pago de las tarifas correspondientes a las actividades que se autoricen a\nla luz de la presente disposición se realizarán de conformidad con lo dispuesto\nen el Decreto Ejecutivo N° 38295-MINAE denominado \"Tarifas por Derechos de\nIngreso y otros servicios ofrecidos en las Áreas Silvestres Protegidas bajo la\nAdministración del Sistema Nacional de Áreas de Conservación\" y sus\nmodificaciones.\n\nArtículo\n5°-Toda persona que ejerza actividades como guía de turismo dentro del Parque\nNacional Volcán Tenorio y la Zona Protectora Tenorio, deberá contar con la\ncredencial de guía de turismo emitida por el Instituto Costarricense de Turismo\npara lo cual deberá cumplir ante esa instancia el proceso y requisitos de\nacreditación según lo dispuesto en el Decreto Ejecutivo 31030-MEIC-TUR.\n\nSe\nexceptúa de la presente disposición a los baquianos sin escolaridad que de\nforma continua hayan ejercido la actividad de guiado en esta área protegida\ndurante los últimos cinco años contados antes de la emisión del presente\nReglamento; para lo cual deberá llenar el formulario de declaración jurada, la\ncual se rinde ante el funcionario de la Administración del Parque que está\nrecibiendo el trámite.\n\nEl\nuniforme que usen los guías locales, regionales o nacionales en estas áreas\nprotegidas no podrán ser en ningún momento semejante o parecido en color de\ncamisa y pantalón con el de los (as) funcionarios (as) de la Administración del\nParque Nacional Volcán Tenorio y la Zona Protectora Tenorio.\n\nArtículo\n6°-Para efectos del presente Reglamento se utilizarán las siguientes\nnomenclaturas y abreviaturas:\n\na) MINAE: Ministerio de\nAmbiente y Energía\n\nb) SINAC: Sistema Nacional\nde Áreas de Conservación.\n\nc) CORACAT: Consejo Regional\ndel Área de Conservación Arenal Tempisque.\n\nd) ACAT: Área de\nConservación Arenal Tempisque\n\ne) PNVT: Parque Nacional\nVolcán Tenorio\n\nf)\nZPT: Zona Protectora Tenorio\n\nArtículo\n7°-Para efectos del presente Reglamento se definen los siguientes términos:\n\n1. Acosar: Acción de\nacorralar, atrapar, perseguir o tratar de extraer de hábitat natural a un\nanimal.\n\n2. Caza:\nLa acción, con cualquier fin, de acosar, apresar o matar animales\nsilvestres, así como la recolección de productos o subproductos derivados de\nestos.\n\n3. Extraer: Sacar\nvida silvestre, sus partes, productos o derivados.\n\n4. Manipular: Operar\ncon las manos o con cualquier instrumento especies de flora o fauna silvestre.\n\n5. Plan General de\nManejo: Es el instrumento de planificación que permite orientar la gestión\ndel PNVT y la ZPT hacia el cumplimiento de sus objetivos de conservación a\nlargo plazo. Se fundamenta en líneas de acción estratégicas a mediano plazo y\nen objetivos de manejo para los elementos naturales y culturales incluidos\ndentro del área, así como en la relación de estos últimos con su entorno socio\nambiental. Es la base para el desarrollo de otros instrumentos de planificación\ny reglamentación del PNVT y la ZPT.\n\n6. Pesca de subsistencia:\nPesca para el consumo doméstico la que se efectúa desde tierra o en\nembarcaciones pequeñas, únicamente mediante el uso de cañas, carretes o cuerdas\nde mano, sin propósito de lucro y con el único objeto de consumir el producto\npara la subsistencia propia o de la familia.\n\n7. Turismo\nespecializado: Modalidad de turismo sostenible que proporciona al visitante\nun entendimiento ecológico y científico del medio ambiente natural donde el\nobjetivo de la visita persigue el ampliar o compartir conocimientos en temas\nespecíficos de su interés. Se concibe como una modalidad de turismo de bajo impacto\nsobre los recursos naturales.\n\nCAPÍTULO II\n\nDel\nIngreso al Parque Nacional Volcán Tenorio y la Zona Protectora Tenorio\n\nArtículo\n8°-Corresponderá a la Administración del PNVT, aprobar o denegar el ingreso al\nPNVT y la ZPT.\n\nArtículo\n9°-El ingreso al PNVT y la ZPT está permitido únicamente para el ejercicio de\nlas actividades permitidas y restringidas establecidas en el Capítulo IV del\npresente reglamento o para actividades efectuadas por la Administración en el\nejercicio de sus competencias.\n\nArtículo\n10.- El ingreso al PNVT y la ZPT para fines de ecoturismo deberá realizarse por\nla entrada oficial a dicha área protegida, mismo que se encuentra ubicado en la\ncomunidad del Pilón, distrito Bijagua, cantón de Upala, Provincia de Alajuela.\n\nArtículo\n11.-El ingreso al PNVT y la ZPT para fines de filmación o investigación podrá\nrealizarse por sectores distintos a la entrada oficial siempre que se cumplan\nlas siguientes condiciones conjuntamente: a) que se haya dado aviso del ingreso\na la Administración del área silvestre protegida, b) que el ingreso por otro\nsector aumente la efectividad en tiempo para realizar la actividad aprobada, c)\nque el sector por el cual se pretende ingresar no resulte de peligro para la\nintegridad física.\n\nArtículo\n12.-Toda persona física que deseen ingresar por razones de ecoturismo al PNVT y\nla ZPT podrá hacerlo en el siguiente horario los días que corren de lunes a\ndomingo ingresando entre las 8:00 horas y las 14:00 horas. En todo caso la hora\nlímite para presentarse en el sitio de salida oficial lo será las 16:00 horas.\n\nArtículo\n13.-Para efectos el ingreso al PNVT y ZPT; y con el fin de demostrar su\nnacionalidad o lugar de procedencia, los (as) visitantes deberán mostrar a los\n(as) funcionarios (as) de la caseta de ingreso, la cédula de identidad, cédula\nde residencia o pasaporte, según corresponda y cuando se amerite.\n\nArtículo\n14.-En los siguientes casos, para el ingreso al PNVT y ZPT, el interesado\ndeberá realizar solicitudes de permisos adicionales en los términos que\nseguidamente se indican:\n\na) Para la realización de\nfilmación comercial, científica, educativa y turística el interesado deberá,\nrealizar el trámite previsto en el artículo 25 del presente Reglamento.\n\nb)\nPara la realización de investigación y colecta científica o académica deberá\nregirse por lo dispuesto en los artículos 19 y 20 del presente Reglamento.\n\nArtículo 15.-Los funcionarios del PNVT y la ZPT podrán\ndenegar el acceso a personas cuando sea aparente que se encuentren bajo los\nefectos de algún estupefaciente, sustancia psicotrópica o droga de uso no\nautorizado.\n\nArtículo\n16.-La Administración del PNVT y la ZPT, permitirá la presencia de personas en\nestas áreas protegidas, siguiendo las disposiciones que establezcan los\nestudios de capacidad de carga terrestre o flujo de visitación oficializados\npor el CORACAT. La Administración del ACAT, llevará un sistema de control\nactualizado, que le permitirá determinar en todo momento, el número visitantes\npresentes.\n\nCAPÍTULO III\n\nZonificación\n\nArtículo\n17.-Para efectos de autorización y aplicación de las actividades permitidas en\nel presente reglamento se considerará con carácter vinculante la zonificación\nestablecida en el Plan de Manejo del Parque Nacional Volcán Tenorio y la Zona\nProtectora Tenorio; de conformidad con la siguiente clasificación:\n\na)\nZona de protección absoluta (ZPA).\n\nb)\nZona de uso público (ZUP).\n\nc)\nZona de uso especial (ZUE).\n\nd)\nZona de uso restringido (ZUR).\n\nCAPÍTULO IV\n\nActividades\ndentro del Parque Nacional Volcán Tenorio y la Zona Protectora Tenorio\n\nSECCIÓN I\n\nRegulación\nde Actividades Permitidas\n\nArtículo\n18.-Según lo establecido en el Plan de Manejo del Parque Nacional Volcán\nTenorio y la Zona Protectora Tenorio así como la normativa vigente, solo se\npermite a los administrados las actividades de investigación, capacitación y\necoturismo de bajo impacto.\n\nArtículo\n19.-Las actividades de investigación y de colecta científica y académica están\npermitidas dentro de toda la zonificación geográfica del PNVT y la ZPT. Para el\nejercicio de dicha actividad el interesado deberá contar con los permisos y\nlicencias respectivas debidamente emitidas y vigentes.\n\nArtículo\n20.-Las actividades de investigación y de colecta científica y académica se\nregirán según lo establecido en el Decreto Ejecutivo N° 32553-MINAE del 29 de\nmarzo del 2005 denominado \"Manual de Procedimientos para realizar\nInvestigación en Biodiversidad y Recursos Culturales en las Áreas de\nConservación\" y en la Ley de Conservación de Vida Silvestre N°7317 o en su\ndefecto, en la normativa vigente que rija dicha actividad en las áreas\nsilvestres protegidas.\n\nArtículo\n21.-Las actividades de ecoturismo están permitidas en los siguientes términos:\n\na) En la Zona de Protección\nAbsoluta se encuentra totalmente prohibido el ejercicio de la actividad ecoturistica.\n\nb) En la Zona de Uso\nRestringido únicamente se autorizará ecoturismo especializado por excepción y\npara ello deberá contarse con autorización del Administrador del área protegida\nquien definirá los términos y condiciones que deberán cumplirse en caso de\naprobar la actividad.\n\nc) En la Zona de Uso Público\nde uso intensivo se permiten las siguientes actividades de ecoturismo:\ncaminatas, filmación y fotografía.\n\nd)\nEn la Zona de Uso Público de uso extensivo se permiten las siguientes\nactividades de ecoturismo: caminatas efectuadas con guía turístico en grupos no\nmayores a quince personas y turismo especializado.\n\nArtículo 22.-Toda caminata deberá efectuarse en los senderos\ny rutas establecidas por la Administración del PNVT y la ZPT.\n\nArtículo\n23.-En el Lago Cote se permitirá el ingreso de botes de remo, balsas inflables\no kayaks respetando las disposiciones administrativas específicas para el uso\ndel sitio.\n\nArtículo\n24.-De manera obligatoria, todo visitante deberá acatar las indicaciones de\nseguridad y orientación dadas por el funcionario o guía autorizado, a cargo del\ngrupo.\n\nArtículo\n25.-Para realizar las actividades de filmación comercial, científica, educativa\no turística el usuario deberá tramitar con un plazo de antelación de un mínimo\nde 15 días naturales, un permiso ante la Dirección del ACAT y pagar la tarifa\ncorrespondiente. La Dirección del ACAT otorgará o denegará el permiso\nsolicitado mediante resolución debidamente fundamentada la cual se emitirá en\nun plazo máximo de 10 días naturales posterior a la presentación de la\nsolicitud.\n\nDicha solicitud deberá\ncontener los siguientes datos:\n\na) Nombre y calidades del\nsolicitante. En caso de que el solicitante sea una persona jurídica la\nsolicitud deberá estar suscrita por el representante legal o en su defecto por\nquien posea poder general o especial que le otorgue facultades suficientes para\nrealizar la solicitud.\n\nb) Fines del material a ser\nfilmado.\n\nc) Indicación de la cantidad\nde días que se pretende realizar filmación.\n\nd)\nIndicar lugar para notificaciones\n\nAdemás,\ndeberá adjuntarse a la solicitud los siguientes documentos:\n\na) Certificación registral\nde la personería jurídica y copia de cédula de identidad del representante\nlegal en caso de personas jurídicas o copia de cédula de identidad en caso de\npersonas físicas.\n\nb)\nCopia del guión de filmación.\n\nSi\npor razones de mantenimiento, protección o conservación se restringen los\npermisos de filmación, tendrá prioridad la filmación por motivos de\ninvestigación científica y de actividades de manejo sobre la filmación\ncomercial.\n\nArtículo\n26.-Las filmaciones de aficionados que pretendan únicamente la preservación de\nun recuerdo de la visita al Área Silvestre Protegida, estarán exentas de pago\nde tarifa según lo dispuesto en el Decreto Ejecutivo N° 38295-MINAE, con la\nsalvedad de que las mismas no podrán ser utilizadas para fines comerciales o de\nlucro..\n\nArtículo\n27.-Las actividades de voluntariado se regirán según lo establecido en la\nnormativa vigente dictada para regular específicamente el voluntariado en áreas\nsilvestres protegidas.\n\nSECCIÓN II\n\nActividades\nProhibidas\n\nArtículo\n28.-Dentro del área del PNVT y la ZPT, no se permitirá el ingreso de vehículos\nde ningún tipo salvo para labores de control y vigilancia o por autorización\nexpresa de la Administración del PNVT y ZPT o la Dirección del ACAT.\n\nArtículo\n29.-Dentro de los cuerpos de agua, llámese río, quebrada, laguna o aguas\ntermales, del PNVT y la ZPT queda absolutamente prohibido el ingreso, baño y\nnado de los visitantes; a excepción de que se trate de una actividad como parte\nde un proyecto de investigación debidamente autorizado por la administración.\n\nArtículo\n30.-En el Lago Cote queda absolutamente prohibido el ingreso de lanchas, motos\nacuáticas u otro tipo de embarcación con motor; se exceptúan las embarcaciones\ngubernamentales debidamente autorizadas por la Administración del área\nprotegida.\n\nArtículo\n31.-Respecto a las especies de vida silvestre, dentro del PNVT y la ZPT queda\nestrictamente prohibido:\n\na) El comercio y trasiego de\ncualquier producto de vida silvestre de origen acuático y terrestre.\n\nb) Pescar, cazar, extraer,\nmanipular, acosar, y hostigar a individuos de cualquier tipo de especies\nanimales acuáticas o terrestres.\n\nc) Extraer y manipular\norganismos de cualquier tipo de especies vegetales acuáticas o terrestres.\n\nd) Extraer y manipular\ncualquier especie perteneciente al reino Fungi (hongos).\n\ne) Extraer cualquier tipo de\nmaterial orgánico o inorgánico, incluye arcillas para cualquier tipo de uso.\n\nf) El uso de jaulas para la\nobservación de fauna, salvo para fines científicos o educativos, siempre y\ncuando, cuenten con el permiso respectivo otorgado por la autoridad competente.\n\ng)\nAlimentar a los organismos acuáticos y terrestres.\n\nSolamente\nse permitirá el ejercicio de dichas conductas en los siguientes supuestos:\n\na) Cuando se efectúen con\nfines científicos, educativos o de manejo por parte de personal del SINAC o\ninvestigadores, que cuenten con la respectiva autorización.\n\nb)\nLa pesca de subsistencia ejercida en el Lago Cote, para tal efecto deberán\ncontar con la licencia debidamente otorgada por el ACAT. En todo caso y en\nresguardo al máximo las especiales costumbres de la población indígena Maleku,\npodrán autorizarse otras formas de extracción, lo que incluye también las artes\no instrumentos utilizados; velando siempre por que exista un adecuado\nequilibrio entre la protección de los recursos pesqueros y las necesidades y\nprácticas de la población indígena.\n\nArtículo\n32.-En relación con el uso del PNVT y la ZPT, queda absolutamente prohibido:\n\na) Realizar cualquier tipo\nde marca en árboles, rocas y cualquier otro elemento dentro de los límites del\nPNVT.\n\nb) La portación ni el uso de\nningún tipo de arma (sean estas de fuego, aire comprimido o resorte, etc.)\nexcepto que éstas se usen con fines de manejo autorizado por el ACAT, y control\ny vigilancia ejercido por el Estado.\n\nc) La venta y consumo de\ndrogas. Se exceptúan de la presente disposición aquellas sustancias de\ntratamiento médico.\n\nd) Acampar o encender fogatas\ndentro de los límites del área silvestre protegida.\n\ne) El nudismo\n\nf) Cualquier tipo de\ncontaminación ambiental producida por desechos sólidos o aguas servidas.\n\ng)\nLa generación de ruidos excesivos salvo los que se generen por razones\nadministrativas.\n\nArtículo\n33.-Quedan prohibidas de forma general todas aquellas actividades que se\nencuentren así consideradas por la normativa ambiental vigente o que\nconstituyan contravenciones o delitos según el ordenamiento jurídico nacional.\n\nCAPÍTULO V\n\nPotestades\nde la Administración\n\nArtículo\n34.-Los funcionarios (as) de las oficinas centrales del ACAT y los (as)\nfuncionarios (as) del PNVT y la ZPT constituyen el personal encargado de velar\npor el cumplimiento de la normativa jurídica vigente para todas las actividades\nque se realicen dentro de las Áreas Silvestres Protegidas. Sin perjuicio de las\nfacultades de otros cuerpos policiales y órganos judiciales.\n\nArtículo\n35.-La Administración del PNVT y la ZPT podrá realizar evaluaciones periódicas\nsobre la calidad en el servicio de guiado de turistas por parte de guías\ngenerales, especializados y locales; siendo que de encontrar irregularidades\nasí lo comunicará al Departamento respectivo del Instituto Costarricense de\nTurismo para lo que corresponda con respecto a la credencial, y a los\nprocedimientos administrativos y legales a seguir.\n\nArtículo 36.-La Dirección del ACAT, previa recomendación del\nComité Técnico Científico, tiene la potestad de autorizar la apertura de nuevos\nsitios destinados para la realización de las actividades ecoturísticas, así\ncomo cerrar aquellos sitios que considere necesarios para fines de manejo o\nconservación.\n\nArtículo\n37.-La administración del PNVT y la ZPT puede, en cualquier momento, restringir\nlas actividades y sitios de uso público, ello siguiendo los principios que\nrigen en materia ambiental y los objetivos establecidos en el Plan de Manejo de\nambas áreas silvestres protegidas.\n\nArtículo\n38.-El personal del PNVT, debidamente identificado, podrá cuando lo estime\nnecesario, realizar cualquier otra inspección que la Administración considere\nnecesaria para dar cumplimiento al presente reglamento y la normativa conexa.\n\nArtículo\n39.-Funcionarios del ACAT o voluntarios autorizados por el PNVT debidamente\nidentificado, sin previo aviso, podrán acompañar a los ecoturistas, cuando lo\nestimen conveniente, con el fin de fiscalizar, controlar y monitorear las\nactividades que estos realicen. Así como para orientar y brindar información\nambiental a los visitantes.\n\nArtículo\n40.-La Dirección del ACAT tendrá la potestad de ordenar el cierre temporal o\npermanente de las actividades de uso público en el PNVT y la ZPT, si mediante\nel criterio del personal técnico del ACAT, o de especialistas, a través del\nmonitoreo ambiental y otras actividades técnicas propuestas en el Plan de\nManejo, o en otros estudios técnicos necesarios para el adecuado manejo de los\nrecursos biológicos, se detecte algún impacto negativo o deterioro en la\nintegridad de los mismos o en correcta aplicación de los principios preventivo y\nprecautorio que rige la materia. También podrá ordenarse el cierre cuando sea\nnecesario para la ejecución de las acciones recomendadas por los programas de\nmanejo, cuyo buen desarrollo pudiera ser afectado por la presencia de\nvisitantes en el área.\n\nArtículo\n41.-En caso de emergencia la Administración del PNVT y la ZPT tendrá la\npotestad de ejecutar el plan de contingencia establecido para tal fin, con el\npropósito de salvaguardad la integridad física de los usuarios y/o\nfuncionarios, estas disposiciones administrativas podrán incluir el cierre\nparcial o total de una o ambas áreas protegidas por el tiempo que se considere\nconveniente.\n\nArtículo\n42.-Cualquier funcionario del ACAT, podrá expulsar de los límites del PNVT y de\nla ZPT a aquellas personas que, presentes en el área protegida efectúen\nactividades prohibidas u omitan obedecer disposiciones emitidas por los\nfuncionarios en cumplimiento oportuno de sus labores. Así mismo podrá\nsuspenderse la autorización de permanencia y la realización de actividades por\nmotivo de condiciones climáticas adversas o cualquier otra razón debidamente\njustificada sin que ello genere responsabilidad para la Administración.\n\nArtículo\n43.-La administración del PNVT y la ZPT podrá autorizar horarios de ingreso y\nsalida distintos al establecido para el ejercicio del ecoturismo en el artículo\n12 del presente reglamento cuando el objeto de ingreso sea filmación o\ninvestigación; ello previa solicitud debidamente justificada del permisionario.\n\nCAPÍTULO VI\n\nDisposiciones\nfinales\n\nArticulo\n44.-Las prohibiciones dispuestas serán sancionadas conforme a lo establecido en\nla Ley de Servicio de Parques Nacionales N° 6084, en los capítulos XI y XII de\nla Ley de Conservación de Vida Silvestre y sus reformas Nº 7317, así como con\nla aplicación de cualquier otra norma sancionatoria vigente en la fecha de los\nhechos.\n\nArtículo\n45.-Rige a partir de su publicación en el Diario Oficial La Gaceta.\n\nDado en la Presidencia de la República.-San José, 2 de junio del dos mil\nquince.", "body_en_text": "in the entirety of the text\n\n -\n\n Full Text of Norm 39412\n\n Public Use Regulation for the Tenorio Volcano National Park and the Tenorio\nProtective Zone\n\nFull Text act: 10A5D9\n\nN° 39412 - MINAE\n\nTHE PRESIDENT OF THE\nREPUBLIC\n\nAND THE MINISTER OF\nENVIRONMENT AND ENERGY\n\nIn\nexercise of the powers conferred by Article 140, subsections 3) and 18)\nand Article 146 of the Political Constitution, the Organic Environmental Law No. 7554,\nof October 4, 1995, the National Parks Service Law No. 6084, of\nAugust 24, 1977, the Biodiversity Law No. 7788, of April 23, 1998,\nthe Wildlife Conservation Law and its amendments No. 7317 of October 30,\n1992, the Forestry Law No. 7575 of February 13, 1996, Executive\nDecree No. P0169-MIRENEM of January 24, 1991, Executive Decree No.\n24290-MIRENEM of April 27, 1995, and Executive Decree No. 34433-MINAE of March 11,\n2008.\n\nConsidering:\n\nI.-That\nExecutive Decree No. 20172-MIRENEM, published in the official gazette La Gaceta\nnumber 17 of January 24, 1991, defined the Tenorio Protective Zone (Zona Protectora Tenorio).\n\nII.-That\nby means of Executive Decree No. 24290-MIRENEM of April 27, 1995, the\nTenorio Volcano National Park (Parque Nacional Volcán Tenorio) was created.\n\nIII.-That\nthe Biodiversity Law No. 7788 of April 30, 1998, in its Article 22, created\nthe National System of Conservation Areas (Sistema Nacional de Áreas de Conservación, SINAC), as a decentralized and participatory institutional management and coordination system\nthat integrates competencies in forestry, wildlife, protected areas, and the Ministry of Environment and Energy, for the purpose of issuing policies,\nplanning, and executing processes aimed at achieving sustainability in the\nmanagement of Costa Rica's natural resources.\n\nIV.-That\nthe Organic Environmental Law No. 7554 provides that the creation, conservation,\nadministration, development, and surveillance of Protected Areas shall have,\namong other objectives, the conservation of natural environments, ensuring the\nbalance and continuity of the evolutionary and ecological processes on which\nsome wild species depend.\n\nV.-That\nthe Organic Environmental Law No. 7554 determines the Management Categories, as well\nas the competencies, regulations, and responsibilities designated to the\nstate through MINAE and SINAC, to achieve compliance with\nits conservation objectives.\n\nVI.-That\nthe Sustainable Tourism Plan for the Tenorio Volcano National Park exists,\nprepared in 2009, which offers technical recommendations for the\ndevelopment of tourism activity in the Park.\n\nVII.-That\nin the Five-Year Strategic Plan 2010-2015 of the National System of Conservation Areas, developing the sustainable tourism program in protected areas is included as a strategic action.\n\nVIII.-That\nit is necessary to issue a new regulation for the public use of the Tenorio Volcano National Park\nand the Tenorio Protective Zone, in accordance with the provisions\nof the Management Plan for these protected wild areas in relation to the\nactivities permitted by the corresponding management categories.\n\nIX.-That\nby means of Agreement No. 9 of the Ordinary Session No. 12-2013 of December 10,\n2013, the National Council of Conservation Areas (Consejo Nacional de Áreas de Conservación, CONAC) approved the\nManagement Plan of the Tenorio Volcano National Park, in accordance with Article 12,\nsubsection d) of the Regulation to the Biodiversity Law, Executive Decree No.\n34433-MINAE of March 11, 2008. Therefore,\n\nTHEY DECREE:\n\n\"Public Use Regulation for the Tenorio Volcano National Park\n\nand the\nTenorio Protective Zone\"\n\nCHAPTER I\n\nGeneral\nProvisions\n\nArticle\n1°-This Regulation establishes the provisions for the use of the\nservices provided, permitted activities, restricted activities, and\nprohibited activities within the boundaries of the Tenorio Volcano National Park (PNVT)\nand the Tenorio Protective Zone (ZPT).\n\nArticle\n2°-The provisions of this Regulation and the instructions issued by\nthe officials of the Tenorio Volcano National Park and the Tenorio Protective Zone\nto persons entering said Protected Wild Areas, in\ncompliance with said instrument and the regulations in force, are mandatory.\n\nArticle\n3°-Every person entering the Tenorio Volcano National Park and Tenorio Protective Zone\nmust comply with the provisions indicated in this Public Use Regulation, as well as\nthe orders issued by officials with police authority of the National System of Conservation Areas pursuant to\nthe provisions of the regulations in force, as well as the duly issued policies, guidelines,\ndirectives, and plans for the protected area in accordance\nwith the provisions of Articles 25, subsections 5) and 8), and 30,\nsubsections 5) and 6) of the Biodiversity Law No. 7788.\n\nArticle\n4°-Payment of the fees corresponding to the activities authorized under\nthe light of this provision shall be made in accordance with the provisions\nof Executive Decree No. 38295-MINAE denominated \"Fees for Entry Rights and other services offered in the Protected Wild Areas under the\nAdministration of the National System of Conservation Areas\" and its\namendments.\n\nArticle\n5°-Every person who carries out activities as a tour guide within the Tenorio Volcano National Park\nand the Tenorio Protective Zone must have the\ntour guide credential issued by the Costa Rican Tourism Institute (Instituto Costarricense de Turismo),\nfor which they must complete the accreditation process and requirements before that entity\nas provided in Executive Decree 31030-MEIC-TUR.\n\nThe\nfollowing are excepted from this provision: local guides without formal schooling who have\ncontinuously exercised the guiding activity in this protected area\nfor the last five years counted prior to the issuance of this\nRegulation; for which they must complete the sworn statement form, which\nis made before the official of the Park Administration receiving the application.\n\nThe\nuniform worn by local, regional, or national guides in these protected\nareas may not at any time be similar or resemble in shirt\nand pants color that of the officials of the Administration of the\nTenorio Volcano National Park and the Tenorio Protective Zone.\n\nArticle\n6°-For the purposes of this Regulation, the following\nnomenclatures and abbreviations shall be used:\n\na) MINAE: Ministry of\nEnvironment and Energy\n\nb) SINAC: National System\nof Conservation Areas.\n\nc) CORACAT: Regional Council\nof the Arenal Tempisque Conservation Area.\n\nd) ACAT: Arenal Tempisque\nConservation Area\n\ne) PNVT: Tenorio Volcano National Park\n\nf)\nZPT: Tenorio Protective Zone\n\nArticle\n7°-For the purposes of this Regulation, the following terms are defined:\n\n1. Harass (Acosar): The action of cornering, trapping, pursuing, or attempting to remove an animal from its natural habitat.\n\n2. Hunting (Caza):\nThe action, for any purpose, of harassing, capturing, or killing wild\nanimals, as well as the collection of products or by-products derived from\nthem.\n\n3. Extract (Extraer): To remove\nwildlife, its parts, products, or derivatives.\n\n4. Manipulate (Manipular): To operate\nwith hands or any instrument species of wild flora or fauna.\n\n5. General Management Plan (Plan General de\nManejo): Is the planning instrument that allows orienting the management\nof the PNVT and the ZPT towards the fulfillment of their long-term conservation objectives.\nIt is based on medium-term strategic action lines and\non management objectives for the natural and cultural elements included\nwithin the area, as well as the relationship of the latter with their socio-environmental surroundings.\nIt is the basis for the development of other planning and regulatory instruments for the PNVT and the ZPT.\n\n6. Subsistence fishing (Pesca de subsistencia):\nFishing for domestic consumption which is carried out from land or in\nsmall boats, solely using rods, reels, or hand lines,\nwithout profit motive and with the sole purpose of consuming the product\nfor one's own subsistence or that of the family.\n\n7. Specialized tourism (Turismo\nespecializado): A sustainable tourism modality that provides the visitor with an ecological and scientific understanding of the natural environment, where the\nobjective of the visit seeks to broaden or share knowledge on specific\ntopics of interest. It is conceived as a low-impact tourism modality\non natural resources.\n\nCHAPTER II\n\nEntry to the Tenorio Volcano National Park and the Tenorio Protective Zone\n\nArticle\n8°-It shall correspond to the Administration of the PNVT to approve or deny entry to the\nPNVT and the ZPT.\n\nArticle\n9°-Entry to the PNVT and the ZPT is permitted solely for the exercise of\nthe permitted and restricted activities established in Chapter IV of\nthis Regulation or for activities carried out by the Administration in the\nexercise of its competencies.\n\nArticle\n10.- Entry to the PNVT and the ZPT for ecotourism purposes must be made through\nthe official entrance to said protected area, which is located in the\ncommunity of Pilón, Bijagua district, canton of Upala, Province of Alajuela.\n\nArticle\n11.-Entry to the PNVT and the ZPT for filming or research purposes may\nbe made through sectors other than the official entrance, provided that\nthe following conditions are met jointly: a) that notice of the entry has been given\nto the Administration of the protected wild area, b) that entry through another\nsector increases the time effectiveness for carrying out the approved activity, c)\nthat the sector through which entry is intended does not pose a danger to\nphysical integrity.\n\nArticle\n12.-Every individual who wishes to enter the PNVT and\nthe ZPT for ecotourism reasons may do so during the following schedule on days from Monday\nto Sunday, entering between 8:00 a.m. and 2:00 p.m. In any case, the\ndeadline to present oneself at the official exit point shall be 4:00 p.m.\n\nArticle\n13.-For the purposes of entry to the PNVT and ZPT, and in order to prove their\nnationality or place of origin, visitors must show the\nofficials at the entry booth their identity card, residency\ncard, or passport, as applicable and when warranted.\n\nArticle\n14.-In the following cases, for entry to the PNVT and ZPT, the interested party\nmust make requests for additional permits in the terms\nindicated below:\n\na) To carry out commercial, scientific, educational, and tourism\nfilming, the interested party must carry out the procedure provided in Article 25 of this Regulation.\n\nb)\nTo carry out scientific or academic research and collection, they must\nbe governed by the provisions of Articles 19 and 20 of this Regulation.\n\nArticle 15.-Officials of the PNVT and the ZPT may\ndeny access to persons when it is apparent that they are under\nthe influence of any narcotic, psychotropic substance, or drug of unauthorized\nuse.\n\nArticle\n16.-The Administration of the PNVT and the ZPT shall permit the presence of persons in\nthese protected areas, following the provisions established by the\nland-based carrying capacity studies or visitor flow studies officially endorsed\nby CORACAT. The Administration of the ACAT shall keep an updated control\nsystem that will allow it to determine, at all times, the number of visitors\npresent.\n\nCHAPTER III\n\nZoning\n\nArticle\n17.-For the purposes of authorization and application of the activities permitted in\nthis Regulation, the zoning\nestablished in the Management Plan of the Tenorio Volcano National Park and the Zone\nProtectora Tenorio shall be considered binding, in accordance with the following classification:\n\na)\nZone of absolute protection (ZPA).\n\nb)\nPublic use zone (ZUP).\n\nc)\nSpecial use zone (ZUE).\n\nd)\nRestricted use zone (ZUR).\n\nCHAPTER IV\n\nActivities within the Tenorio Volcano National Park and the Tenorio Protective Zone\n\nSECTION I\n\nRegulation of Permitted Activities\n\nArticle\n18.-As established in the Management Plan of the Tenorio Volcano National Park\nand the Tenorio Protective Zone, as well as the regulations in force, only the activities of research, training, and low-impact ecotourism are permitted to the administered parties.\n\nArticle\n19.-Research activities and scientific and academic collection are\npermitted within the entire geographical zoning of the PNVT and the ZPT. For the\nexercise of said activity, the interested party must have the respective\nduly issued and current permits and licenses.\n\nArticle\n20.-Research activities and scientific and academic collection shall be\ngoverned as established in Executive Decree No. 32553-MINAE of March 29,\n2005, denominated \"Procedures Manual for Conducting\nResearch in Biodiversity and Cultural Resources in Conservation Areas\" and in the Wildlife Conservation Law No. 7317, or failing that, in the regulations in force that govern said activity in protected wild areas.\n\nArticle\n21.-Ecotourism activities are permitted under the following terms:\n\na) In the Zone of Absolute Protection, the exercise of ecotourism activity is completely prohibited.\n\nb) In the Restricted Use Zone, only specialized ecotourism by exception shall be authorized, and\nfor this, authorization from the Administrator of the protected area must be obtained,\nwho shall define the terms and conditions to be met in the event\nof approving the activity.\n\nc) In the Public Use Zone\nof intensive use, the following ecotourism activities are permitted:\nwalks (caminatas), filming, and photography.\n\nd)\nIn the Public Use Zone of extensive use, the following\necotourism activities are permitted: walks carried out with a tour guide in groups of no\nmore than fifteen persons, and specialized tourism.\n\nArticle 22.-Every walk must be carried out on the trails\nand routes established by the Administration of the PNVT and the ZPT.\n\nArticle\n23.-In Lake Cote (Lago Cote), the entry of rowboats, inflatable rafts,\nor kayaks is permitted, respecting the specific administrative provisions for the use\nof the site.\n\nArticle\n24.-Mandatorily, every visitor must obey the\nsafety and orientation instructions given by the official in charge or authorized guide\nof the group.\n\nArticle\n25.-To carry out commercial, scientific, educational,\nor tourism filming activities, the user must process, with a minimum advance notice of\n15 calendar days, a permit before the Directorate of the ACAT and pay the\ncorresponding fee. The Directorate of the ACAT shall grant or deny the\nrequested permit by means of a duly reasoned resolution, which shall be issued within\na maximum period of 10 calendar days after the submission of the\napplication.\n\nSaid application must\ncontain the following information:\n\na) Name and qualifications of the\napplicant. If the applicant is a legal entity, the\napplication must be signed by the legal representative or, failing that, by\na person holding a general or special power of attorney that grants them sufficient powers to\nmake the application.\n\nb) Purposes of the material to be\nfilmed.\n\nc) Indication of the number\nof days intended for filming.\n\nd)\nIndicate a place for notifications\n\nFurthermore,\nthe following documents must be attached to the application:\n\na) Registry certification\nof the legal entity and a copy of the identity card of the legal\nrepresentative in the case of legal entities, or a copy of the identity card in the case of\nindividuals.\n\nb)\nCopy of the filming script.\n\nIf\nfor reasons of maintenance, protection, or conservation, the\nfilming permits are restricted, filming for scientific research purposes and management activities shall have priority over commercial\nfilming.\n\nArticle\n26.-Amateur filming intended solely for preserving\na memory of the visit to the Protected Wild Area shall be exempt from paying\na fee as provided in Executive Decree No. 38295-MINAE, with the\nexception that the same may not be used for commercial or profit-making purposes.\n\nArticle\n27.-Volunteer activities shall be governed as established in the\nregulations in force issued to specifically regulate volunteering in protected wild areas.\n\nSECTION II\n\nProhibited\nActivities\n\nArticle\n28.-Within the area of the PNVT and the ZPT, the entry of vehicles\nof any type is not permitted, except for control and surveillance tasks or by express\nauthorization of the Administration of the PNVT and ZPT or the Directorate of the ACAT.\n\nArticle\n29.-Within the bodies of water, be they rivers, streams (quebradas), lagoons, or thermal\nwaters, of the PNVT and the ZPT, entry, bathing, and\nswimming by visitors is absolutely prohibited, except for an activity as part\nof a research project duly authorized by the Administration.\n\nArticle\n30.-In Lake Cote, the entry of launches, jet skis, or any other type of motorized vessel is absolutely prohibited; government vessels\nduly authorized by the Administration of the protected\narea are excepted.\n\nArticle\n31.-Regarding wild species, within the PNVT and the ZPT, the following is\nstrictly prohibited:\n\na) The trade and trafficking of\nany wildlife product of aquatic and terrestrial origin.\n\nb) Fishing, hunting, extracting,\nmanipulating, harassing, and molesting individuals of any type of\naquatic or terrestrial animal species.\n\nc) Extracting and manipulating\norganisms of any type of aquatic or terrestrial plant species.\n\nd) Extracting and manipulating\nany species belonging to the Fungi kingdom.\n\ne) Extracting any type of\norganic or inorganic material, including clays, for any type of use.\n\nf) The use of cages for\nwildlife observation, except for scientific or educational purposes, provided\nthey have the respective permit granted by the competent authority.\n\ng)\nFeeding aquatic and terrestrial organisms.\n\nThe exercise of such conduct is only permitted under the following assumptions:\n\na) When carried out for\nscientific, educational, or management purposes by SINAC personnel or\nresearchers who have the respective authorization.\n\nb)\nSubsistence fishing carried out in Lake Cote, for which purpose they must\nhave the license duly granted by the ACAT. In any case, and to\nmaximally protect the special customs of the Maleku indigenous population,\nother forms of extraction may be authorized, which also includes the arts\nor instruments used; always ensuring that there is an adequate\nbalance between the protection of fishery resources and the needs and\npractices of the indigenous population.\n\nArticle\n32.-In relation to the use of the PNVT and the ZPT, the following is absolutely prohibited:\n\na) Making any type\nof mark on trees, rocks, and any other element within the boundaries of the\nPNVT.\n\nb) The carrying or use of\nany type of weapon (be it firearms, compressed air or spring-loaded, etc.)\nunless used for management purposes authorized by the ACAT, and control\nand surveillance exercised by the State.\n\nc) The sale and consumption of\ndrugs. Those substances for medical treatment are excepted from this provision.\n\nd) Camping or lighting campfires\nwithin the boundaries of the protected wild area.\n\ne) Nudism\n\nf) Any type of\nenvironmental contamination produced by solid waste or wastewater.\n\ng)\nThe generation of excessive noise, except that generated for administrative\nreasons.\n\nArticle\n33.-All activities that are\nconsidered as such by the environmental regulations in force, or that\nconstitute contraventions or crimes according to the national legal system, are generally prohibited.\n\nCHAPTER V\n\nPowers of the Administration\n\nArticle\n34.-The officials of the central offices of the ACAT and the\nofficials of the PNVT and the ZPT constitute the personnel responsible for ensuring\ncompliance with the legal regulations in force for all activities\ncarried out within the Protected Wild Areas. Without prejudice to the\npowers of other police forces and judicial bodies.\n\nArticle\n35.-The Administration of the PNVT and the ZPT may carry out periodic evaluations\nof the quality of the tourist guiding service provided by general,\nspecialized, and local guides; and if irregularities are found,\nit shall communicate them to the respective Department of the Costa Rican Tourism Institute\nfor whatever corresponds regarding the credential, and to the\nadministrative and legal procedures to follow.\n\nArticle 36.-The Directorate of the ACAT, upon prior recommendation of the\nLocal Scientific Technical Committee, has the power to authorize the opening of new\nsites intended for carrying out ecotourism activities, as well\nas to close those sites it deems necessary for management or\nconservation purposes.\n\nArticle\n37.-The administration of the PNVT and the ZPT may, at any time, restrict\nthe activities and public use sites, following the\nprinciples that govern environmental matters and the objectives established in the Management Plan\nfor both protected wild areas.\n\nArticle\n38.-The personnel of the PNVT, duly identified, may, when deemed\nnecessary, carry out any other inspection that the Administration considers\nnecessary to comply with this regulation and related regulations.\n\nArticle\n39.-Officials of the ACAT or volunteers authorized by the PNVT, duly\nidentified, may, without prior notice, accompany ecotourists when deemed\nappropriate, for the purpose of supervising, controlling, and monitoring the\nactivities they carry out. As well as to guide and provide environmental\ninformation to visitors.\n\nArticle\n40.-The Directorate of the ACAT shall have the power to order the temporary or\npermanent closure of public use activities in the PNVT and the ZPT if, through\nthe criteria of the technical personnel of the ACAT, or specialists, through\nenvironmental monitoring and other technical activities proposed in the Management\nPlan, or in other technical studies necessary for the adequate management of\nbiological resources, any negative impact or deterioration in the\nintegrity of the same or in the correct application of the preventive and\nprecautionary principles that govern the matter is detected. Closure may also be ordered when\nnecessary for the execution of the actions recommended by the management programs,\nwhose proper development could be affected by the presence of\nvisitors in the area.\n\nArticle\n41.-In case of emergency, the Administration of the PNVT and the ZPT shall have\nthe power to execute the contingency plan established for this purpose, with the\naim of safeguarding the physical integrity of users and/or\nofficials; these administrative provisions may include the partial\nor total closure of one or both protected areas for the time deemed\nappropriate.\n\nArticle\n42.-Any official of the ACAT may expel from the boundaries of the PNVT and\nthe ZPT those persons who, present in the protected area, carry out\nprohibited activities or fail to obey provisions issued by the\nofficials in timely fulfillment of their duties. Likewise, the authorization for staying and carrying out activities may\nbe suspended due to adverse weather conditions or any other duly\njustified reason, without this generating liability for the Administration.\n\nArticle\n43.-The administration of the PNVT and the ZPT may authorize entry and\nexit schedules different from those established for the exercise of ecotourism in Article\n12 of this Regulation when the purpose of entry is filming or\nresearch; this upon a duly justified prior request from the permit holder.\n\nCHAPTER VI\n\nFinal\nProvisions\n\nArticle\n44.-The prohibitions set forth shall be sanctioned in accordance with the provisions of\nthe National Parks Service Law No. 6084, in Chapters XI and XII of\nthe Wildlife Conservation Law and its amendments No. 7317, as well as\nthe application of any other punitive norm in force at the date of the\nevents.\n\nArticle\n45.-It shall become effective upon its publication in the Official Gazette La Gaceta.\n\nGiven at the Presidency of the Republic.-San José, June 2, two thousand\nfifteen." }
