  "body_es_text": "en la totalidad del texto\n\n                    -\n\n                        Texto Completo Norma 047\n\n                        Reforma Procedimiento para el Sistema de Reservaciones al Parque Nacional\nChirripó\n\nTexto Completo acta: 10AE39\n\nSISTEMA NACIONAL DE ÁREAS DE CONSERVACIÓN\n\nResolución Nº\nSINAC-ACLA-P-D-047-2016.-Ministerio del Ambiente y Energía, Sistema Nacional de\nÁreas de Conservación, Área de Conservación La Amistad Pacífico.-San Isidro de El\nGeneral, a las ocho horas treinta minutos del ocho de febrero del dos mil\ndieciséis.\n\nResultando:\n\n1º-Que el 27 de enero\ndel 2016, en La Gaceta N° 18 se publicó la Resolución Nº\nACLA-P-D-598-2015 de las quince horas del dieciocho de diciembre del dos mil\nquince que estableció el Procedimiento para el Sistema de Reservaciones al\nParque Nacional Chirripó.\n\nConsiderando:\n\nI.-Que la\nAdministración promovió mejorar la accesibilidad del proceso de reservaciones\nal Parque Nacional Chirripó mediante el portal web institucional (reservaciones\nen línea), procurando el acceso en igualdad de condiciones, para el ingreso de\nvisitantes nacionales e internacionales a esta área silvestre protegida.\n\nLa Administración, en\nel eventual caso que el sistema de Reservaciones en Línea no esté operando, por\nrazones comprobadas de fallo en el sistema, deja previsto como un sistema\nauxiliar la modalidad de reservación telefónica utilizando el número\n905-Chirrip (905-2447747) para todos los usuarios a nivel Nacional y al número\n506-2742-5348 para los usuarios a nivel internacional, exclusivamente.\n\nEl sistema auxiliar\nde reservaciones por la vía telefónica funcionará en el horario comprendido de\nlunes a viernes de ocho de la mañana al medio día y de la una a las cuatro de\nla tarde. No aplica para días feriados de ley o asuetos declarados por el Poder\nEjecutivo.\n\nUna vez puesto en\nvigencia el Sistema auxiliar, únicamente podrá reservarse hasta con un mes de\nanticipación para el ingreso al Parque Nacional Chirripó.\n\nII.-Que la Dirección\ndel Área de Conservación La Amistad Pacífico (ACLA-P), dispuso mediante la\nResolución Nº ACLA-P-D-598-2015 la entrada en vigencia del nuevo sistema de\nreservaciones en línea a partir del 15 de febrero del 2016 así como otras\ndisposiciones que es necesario modificar en razón de fallos detectados en el\nsistema.\n\nIII.-Que por motivos\nde falla en el sistema detectadas durante los procesos de prueba, la\nAdministración no puede poner en funcionamiento el nuevo sistema de\nreservaciones en línea en los plazos establecidos. Por lo tanto,\n\nSE MODIFICAN LAS\nSIGUIENTES DISPOSICIONES\n\nDEL PROCEDIMIENTO PARA EL SISTEMA DE\n\nRESERVACIONES AL PARQUE NACIONAL\n\nCHIRRIPÓ\n\n1º-Se modifica el\npunto 1º del Procedimiento para que en adelante se lea así:\n\n\"1º-Las personas\nfísicas o jurídicas que deseen obtener espacios para el ingreso de turistas al\nParque Nacional Chirripó, podrán hacer sus reservaciones a través del sistema\nde gestión de reservaciones en línea accesando a la dirección electrónica\nwww.sinac.go.cr. O en su defecto, en el eventual caso que el sistema de\nReservaciones en Línea no esté operando debido a razones comprobadas de fallo\nen el sistema, por la vía telefónica llamando al número 905-Chirrip\n(905-2447747) para todos los usuarios a nivel Nacional y al número 506-2742-5348\npara los usuarios a nivel internacional, exclusivamente.\n\nEl sistema auxiliar\nde reservaciones por la vía telefónica funcionará en el horario comprendido de\nlunes a viernes de ocho de la mañana al medio día y de la una a las cuatro de\nla tarde. No aplica para días feriados de ley o asuetos declarados por el Poder\nEjecutivo.\n\nUna vez puesto en\nvigencia el Sistema auxiliar, únicamente podrá reservarse hasta con un mes de\nanticipación para el ingreso al Parque Nacional Chirripó. \"\n\n2º-Se modifica el punto 4º del Procedimiento para que\nen adelante se lea así:\n\n\"4º-Los\nturistas que desean ingresar al parque por un día, únicamente por el sendero\nprincipal y que no requieren pernoctar en el Albergue Crestones, deberán\ncancelar sus derechos de admisión conforme al trámite de reservación indicado en\nla presente resolución\".\n\n3º-Se crea el punto 9º del Procedimiento que dice:\n\n\"9º-En\ncaso de fallo del sistema de reservaciones en línea, una vez que se haya\ndeterminado que no se puede iniciar o restaurar el funcionamiento normal del\nSistema, el Encargado de Tecnologías de Información de la Secretaría Ejecutiva\no del Área de Conservación la Amistad Pacífico del Sistema Nacional de Áreas de\nConservación, según sea el caso, comunicará vía oficio al Director del ACLA-P\nlas razones técnicas de fallo y la recomendación de iniciar el procedimiento\nauxiliar de reservaciones previsto por la Administración por la vía telefónica\npara llamadas nacionales e internacionales.\n\nRecibida\nla comunicación, el Director del ACLA-P instruirá mediante oficio al\nAdministrador y al Encargado de Reservaciones del Parque Nacional Chirripó para\nque den inicio al sistema auxiliar de reservaciones.\n\nLa\nAdministración dispondrá del tiempo necesario para resolver las fallas del\nsistema y en caso de imposibilidad de restablecerlo, podrá tomar la decisión de\nutilizar el sistema auxiliar de reservaciones por la vía telefónica.\n\nUna\nvez resueltos los problemas del sistema de reservaciones en línea, el encargado\nde Tecnología de Información de la Secretaría Ejecutiva o del ACLA-P del\nSistema Nacional de Áreas de Conservación, comunicará por oficio a la Dirección\nRegional del ACLA-P para que se retome el proceso de reservaciones en línea,\nquien a su vez hará las comunicaciones correspondientes.\"\n\n4º-Se modifica el punto 4º de las Disposiciones Generales\npara que en adelante se lea así:\n\n\"4º-Cuando\nel turista encontrándose en Base Crestones y existiendo disponibilidad de\nespacio desee permanecer en el área protegida y alojarse por más tiempo, podrá\ndesarrollar el procedimiento de reservaciones, siempre y cuando no exceda los\nintervalos de tiempo establecido para cada temporada (alta y baja). En este\ncaso deberá realizar el registro de permanencia ante el funcionario del SINAC\ndestacado en Base Crestones y el Concesionario.\"\n\n5º-Se modifica el punto 5º de las Disposiciones\nGenerales para que en adelante se lea así:\n\n\"5º-Para\nlas reservaciones al Parque Nacional Chirripó, el turista podrá adquirir su\nderecho de admisión hasta con seis meses de antelación, siempre y cuando\ndesarrolle el procedimiento en su totalidad incluyendo el trámite de\ncancelación de los servicios de hospedaje ante el Concesionario o de\nactividades ecoturísticas en los casos de permisos de uso vigentes.\n\nEste\nplazo de seis meses de antelación no opera en los casos en que entre en funcionamiento\nel sistema auxiliar de reservaciones mediante la vía telefónica\".\n\n6º-Se modifica el punto 8º de las Disposiciones\nGenerales para que en adelante se lea así:\n\n\"8º-La\nadministración del Parque Nacional Chirripó pondrá a disposición de los usuarios\nla cantidad de 52 (cincuenta y dos) espacios por día para permanecer en el\nAlbergue Base Crestones de lunes a domingo, los cuales podrán ser reservados en\nsu totalidad para las rutas autorizadas mediante el sistema de reservaciones.\"\n\n7º-Se modifica el punto 10º de las Disposiciones\nGenerales para que en adelante se lea así:\n\n\"10º.-La\nAdministración del Parque Nacional Chirripó dispondrá de 10 espacios diarios\npara los visitantes que deseen ingresar al parque solo por un día, por el\nsendero principal y que no requieren alojamiento en el Albergue Base Crestones,\nlos cuales deberán desarrollar el procedimiento de reservaciones previo a su\ningreso y de registro ante la Administración conforme a esta resolución.\"\n\n8º-Se modifica el punto 14º de las Disposiciones\nGenerales para que en adelante se lea así:\n\n\"14º.-El\nusuario deberá pagar al Concesionario los derechos correspondientes al\nalojamiento en un plazo máximo de diez días naturales posteriores a la\nreservación, de lo contrario se cancelará la reservación de la admisión y el\nusuario deberá proceder a realizar la solicitud de reembolso del dinero pagado\npor derecho de admisión, dentro del plazo establecido según el decreto de\ntarifas.\"\n\n9º-Se modifica el punto 15º de las Disposiciones\nGenerales para que en adelante se lea así:\n\n\"15º.-El\nusuario que ingrese por las rutas autorizadas mediante permiso de uso deberá\npagar los derechos de alojamiento al Concesionario ajustándose a lo que indica\nel punto anterior y los derechos por actividades ecoturísticas a la organización\nPermisionaria dentro de un plazo de diez días naturales posteriores a la\nreservación, bajo la advertencia de que se le cancelará el derecho de admisión\nsi no lo hace y el usuario deberá proceder a realizar la solicitud de reembolso\ndel dinero, en los plazos establecidos.\"\n\n10.-Se deja sin efecto el Transitorio I de la\nResolución Nº ACLA-P-D-598-2015.\n\n11.-En\ntodo lo demás queda vigente la resolución Nº ACLA-P-D-598-2015.\n\n12.-Se\ndictan las siguientes disposiciones transitorias para la puesta en vigencia del\nnuevo sistema de Reservaciones:\n\nTRANSITORIO I: Por\núnica vez, a partir del 15 de febrero del 2016, los interesados podrán realizar\nsu reservación para ingresar al Parque Nacional Chirripó durante los meses de\nabril, mayo y junio del 2016 haciendo uso del sistema auxiliar por la vía telefónica.\n\nTRANSITORIO II: A\npartir del 15 de mayo del 2016 el Sistema de Reservaciones del Parque Nacional\nChirripó operará en línea accesando a la dirección electrónica www.\nsinac.go.cr. En esta fecha se pondrá a disposición de los usuarios, los\nespacios para ingresar al Parque a partir del 1 de julio del 2016.\n\nRige a partir de su\npublicación.",
  "body_en_text": "in the entire text\n\n                    -\n\n                        Complete Text of Norm 047\n\n                        Reform of the Procedure for the Reservation System for Chirripó National Park\n\nComplete Text of Record: 10AE39\n\nNATIONAL SYSTEM OF CONSERVATION AREAS\n\nResolution No. SINAC-ACLA-P-D-047-2016.-Ministry of Environment and Energy, National System of Conservation Areas, La Amistad Pacífico Conservation Area.-San Isidro de El General, at eight hours thirty minutes on February eighth, two thousand sixteen.\n\nWhereas:\n\n1º-That on January 27, 2016, in La Gaceta No. 18, Resolution No. ACLA-P-D-598-2015 of fifteen hours on December eighteenth, two thousand fifteen was published, which established the Procedure for the Reservation System for Chirripó National Park.\n\nConsidering:\n\nI.-That the Administration promoted improving the accessibility of the reservation process for Chirripó National Park through the institutional web portal (online reservations), seeking access under equal conditions for the entry of national and international visitors to this protected wild area.\n\nThe Administration, in the eventual case that the Online Reservation system is not operating, for proven reasons of system failure, provides as an auxiliary system the telephone reservation modality using the number 905-Chirrip (905-2447747) for all users at the National level and the number 506-2742-5348 for users at the international level, exclusively.\n\nThe auxiliary telephone reservation system will operate during the hours of Monday through Friday from eight in the morning to noon and from one to four in the afternoon. It does not apply on legal holidays or days off declared by the Executive Branch.\n\nOnce the auxiliary System is put into effect, reservations may only be made up to one month in advance for entry to Chirripó National Park.\n\nII.-That the Directorate of the La Amistad Pacífico Conservation Area (ACLA-P), through Resolution No. ACLA-P-D-598-2015, ordered the entry into force of the new online reservation system as of February 15, 2016, as well as other provisions that it is necessary to modify due to failures detected in the system.\n\nIII.-That for reasons of system failure detected during the testing processes, the Administration cannot put the new online reservation system into operation within the established deadlines. Therefore,\n\nTHE FOLLOWING PROVISIONS ARE MODIFIED\n\nOF THE PROCEDURE FOR THE RESERVATION SYSTEM FOR\n\nCHIRRIPÓ NATIONAL PARK\n\n1º-Point 1º of the Procedure is modified so that it shall henceforth read as follows:\n\n\"1º-Individuals or legal entities wishing to obtain spaces for the entry of tourists to Chirripó National Park may make their reservations through the online reservation management system by accessing the electronic address www.sinac.go.cr. Or failing that, in the eventual case that the Online Reservation system is not operating due to proven reasons of system failure, by telephone by calling the number 905-Chirrip (905-2447747) for all users at the National level and the number 506-2742-5348 for users at the international level, exclusively.\n\nThe auxiliary telephone reservation system will operate during the hours of Monday through Friday from eight in the morning to noon and from one to four in the afternoon. It does not apply on legal holidays or days off declared by the Executive Branch.\n\nOnce the auxiliary System is put into effect, reservations may only be made up to one month in advance for entry to Chirripó National Park.\"\n\n2º-Point 4º of the Procedure is modified so that it shall henceforth read as follows:\n\n\"4º-Tourists who wish to enter the park for one day, solely by the main trail and who do not require lodging overnight at the Crestones Shelter, must pay their admission fees in accordance with the reservation process indicated in this resolution.\"\n\n3º-Point 9º of the Procedure is created, which states:\n\n\"9º-In the event of a failure of the online reservation system, once it has been determined that normal operation of the System cannot be initiated or restored, the Information Technology Officer of the Executive Secretariat or of the La Amistad Pacífico Conservation Area of the National System of Conservation Areas, as the case may be, shall communicate by official letter to the Director of the ACLA-P the technical reasons for the failure and the recommendation to initiate the auxiliary reservation procedure provided by the Administration by telephone for national and international calls.\n\nUpon receiving the communication, the Director of the ACLA-P shall instruct, by official letter, the Administrator and the Reservation Officer of Chirripó National Park to initiate the auxiliary reservation system.\n\nThe Administration shall have the necessary time to resolve the system failures, and in the event of impossibility of restoring it, may make the decision to use the auxiliary telephone reservation system.\n\nOnce the problems with the online reservation system are resolved, the Information Technology Officer of the Executive Secretariat or of the ACLA-P of the National System of Conservation Areas shall communicate by official letter to the Regional Directorate of the ACLA-P so that the online reservation process may be resumed, who in turn shall make the corresponding communications.\"\n\n4º-Point 4º of the General Provisions is modified so that it shall henceforth read as follows:\n\n\"4º-When a tourist, being at Crestones Base and there being space availability, wishes to remain in the protected area and stay for a longer time, they may carry out the reservation procedure, provided they do not exceed the established time intervals for each season (high and low). In this case, they must complete the stay registration before the SINAC official stationed at Crestones Base and the Concessionaire.\"\n\n5º-Point 5º of the General Provisions is modified so that it shall henceforth read as follows:\n\n\"5º-For reservations to Chirripó National Park, the tourist may acquire their right of admission up to six months in advance, provided they complete the procedure in its entirety, including the payment process for lodging services to the Concessionaire or for ecotourism activities in the cases of current use permits.\n\nThis six-month advance period does not apply in cases where the auxiliary telephone reservation system is put into operation.\"\n\n6º-Point 8º of the General Provisions is modified so that it shall henceforth read as follows:\n\n\"8º-The administration of Chirripó National Park shall make available to users the quantity of 52 (fifty-two) spaces per day to stay at the Crestones Base Shelter from Monday to Sunday, which may be reserved in their entirety for the authorized routes through the reservation system.\"\n\n7º-Point 10º of the General Provisions is modified so that it shall henceforth read as follows:\n\n\"10º.-The Administration of Chirripó National Park shall have 10 daily spaces available for visitors who wish to enter the park for only one day, by the main trail, and who do not require lodging at the Crestones Base Shelter, who must complete the reservation procedure prior to their entry and the registration before the Administration in accordance with this resolution.\"\n\n8º-Point 14º of the General Provisions is modified so that it shall henceforth read as follows:\n\n\"14º.-The user must pay the Concessionaire the corresponding lodging fees within a maximum period of ten calendar days subsequent to the reservation; otherwise, the admission reservation will be canceled, and the user must proceed to request a refund of the money paid for the admission fee, within the period established according to the fee decree.\"\n\n9º-Point 15º of the General Provisions is modified so that it shall henceforth read as follows:\n\n\"15º.-The user who enters through the authorized routes via a use permit must pay the lodging fees to the Concessionaire in accordance with the preceding point, and the fees for ecotourism activities to the Permittee organization within a period of ten calendar days subsequent to the reservation, under the warning that their admission right will be canceled if they do not do so, and the user must proceed to request a refund of the money, within the established periods.\"\n\n10.-Transitory Provision I of Resolution No. ACLA-P-D-598-2015 is rendered without effect.\n\n11.-In all other respects, Resolution No. ACLA-P-D-598-2015 remains in effect.\n\n12.-The following transitory provisions are dictated for the entry into force of the new Reservation system:\n\nTRANSITORY PROVISION I: For one time only, as of February 15, 2016, interested parties may make their reservation to enter Chirripó National Park during the months of April, May, and June 2016 using the auxiliary telephone system.\n\nTRANSITORY PROVISION II: As of May 15, 2016, the Chirripó National Park Reservation System will operate online by accessing the electronic address www.sinac.go.cr. On this date, spaces to enter the Park as of July 1, 2016, will be made available to users.\n\nIt shall be effective upon its publication."
