Considerando:\n\n1º-Que mediante Directriz Presidencial Número 21-P publicada en el Diario Oficial La Gaceta Nº 101\ndel 27 de mayo del 2015, denominada \"Para la Generación de una Política Nacional de Aprovechamiento\nSostenible de Camarón, Generación de Empleo y Combate a la Pobreza\" en su artículo 4° se solicita e\ninsta al sector semi-industrial camaronero a iniciar un proceso voluntario de una serie de medidas\npropuestas por dicho sector, entre las cuales está el contenido en inciso c) que textualmente indica\n\"el alejamiento de 15 metros de batimetría a lo largo de la Costa Pacífica\".\n\n2º-Que el artículo 50\nde la Constitución Política, en concordancia con los principios precautorio y\npreventivo, así como el principio de acceso democrático a los recursos\npesqueros, determina que es obligación del Estado Costarricense, adoptar las\nmedidas necesarias tendientes a preservar los recursos pesqueros y garantizar\nel desarrollo sostenible de la actividad pesquera.\n\n3º-Que de conformidad\ncon la Ley 7384, Ley de Creación del Instituto Costarricense de Pesca y\nAcuicultura, así como la Ley 8436, Ley de Pesca y Acuicultura, corresponde al\nINCOPESCA como autoridad ejecutora de la Pesca y la Acuicultura: \"Normar el\naprovechamiento racional de los recursos pesqueros, que tiendan a lograr\nmayores rendimientos económicos, la protección de las especies marinas y de la\nacuicultura.\"\n\n4º-Que, en efecto, en\nla mesa de Diálogo Nacional sobre el Ordenamiento de la Pesca de Camarón\ncelebrada el 30 de julio del año en curso, se tomó el acuerdo para proponer se\nregule el del alejamiento de la operación de pesca de la flota cerquera semi-industrial\ncamaronera hasta una distancia a lo largo de la costa en que se determine una\nprofundidad de 15 metros de batimetría.\n\n5º-Que en este sentido, habiendo emitido el correspondiente criterio técnico el Lic. Antonio Porras\nPorras; Director General Técnico del INCOPESCA, por medio de su oficio, DGT-SJ-037-2015 del\n05-11-2015, concluye: \"... que como medida preliminar en relación al ordenamiento de la pesquería de\ncamarón en el litoral Pacífico costarricense, se brinda criterio positivo a la medida de que se\nestablezca la medida de regulación a la pesca semi industrial de arrastre de camarón para que no\npueda realizar faenas de pesca por debajo de la línea batimétrica de 15 metros de profundidad; o sea\nque solo podrán faenar a 15 metros de profundidad o a profundidades mayores.\"\n\n6º-Que conocido el\ncriterio positivo del Lic. Antonio Porras Porras, la\nJunta Directiva, le dio su aprobación y se toma el acuerdo correspondiente para\nque se establezca la obligatoriedad toda la flota pesquera semi-industrial\nde camarón, en el sentido de que no podrán realizar faenas de pesca por debajo\nde la línea batimétrica de 15 metros de profundidad a lo largo de la Costa\nPacífica.\n\n7º-Que habiéndose\nanalizado a profundidad la propuesta de regulación presentada así como\ncontándose para su resolución con los criterios favorables emanados por parte\ndel Director General Técnico y el Asesor Legal, estiman los Sres. Miembros de\nJunta Directiva que resulta procedente atender favorablemente la propuesta\nsupra; razón por la cual, la Junta Directiva. Considering:\n\n1º-That by Presidential Directive Number 21-P published in the Official Gazette La Gaceta No. 101\nof May 27, 2015, called \"For the Generation of a National Policy for the Sustainable Use\nof Shrimp, Job Creation and Combating Poverty\" in its article 4°, the semi-industrial shrimp sector is requested and urged\nto initiate a voluntary process of a series of measures\nproposed by said sector, among which is the content of subsection c) that textually indicates\n\"the withdrawal to 15 meters of bathymetry along the Pacific Coast\".\n\n2º-That article 50\nof the Political Constitution, in accordance with the precautionary and\npreventive principles, as well as the principle of democratic access to fisheries\nresources, determines that it is the obligation of the Costa Rican State to adopt the\nnecessary measures aimed at preserving fishery resources and guaranteeing\nthe sustainable development of the fishing activity.\n\n3º-That in accordance\nwith Law 7384, Law Creating the Costa Rican Institute of Fisheries and\nAquaculture, as well as Law 8436, Fisheries and Aquaculture Law, it corresponds to\nINCOPESCA as the executing authority for Fisheries and Aquaculture: \"To regulate the\nrational use of fishery resources, tending to achieve\ngreater economic yields, and the protection of marine species and\naquaculture.\"\n\n4º-That, in effect, at\nthe National Dialogue table on Shrimp Fishery Management\nheld on July 30 of the current year, an agreement was reached to propose\nregulating the withdrawal of the fishing operation of the semi-industrial shrimp purse-seine fleet\nto a distance along the coast at which a\ndepth of 15 meters of bathymetry is determined.\n\n5º-That in this regard, having issued the corresponding technical opinion, Lic. Antonio Porras\nPorras; General Technical Director of INCOPESCA, by means of his official letter, DGT-SJ-037-2015 of\n05-11-2015, concludes: \"... that as a preliminary measure in relation to the management of the shrimp fishery\non the Costa Rican Pacific coast, a positive opinion is given to the measure of establishing the\nregulation measure for semi-industrial shrimp trawl fishing so that it cannot\nconduct fishing operations below the 15-meter bathymetric line of depth; that is,\nthey may only operate at 15 meters of depth or at greater depths.\"\n\n6º-That having known the\npositive opinion of Lic. Antonio Porras Porras, the\nBoard of Directors gave its approval and the corresponding agreement is taken\nto establish the mandatory requirement for the entire semi-industrial shrimp fishing fleet\n, in the sense that they may not conduct fishing operations below\nthe 15-meter bathymetric line of depth along the Pacific\nCoast.\n\n7º-That having\nanalyzed in depth the proposed regulation presented as well as\nhaving for its resolution the favorable opinions issued by\nthe General Technical Director and the Legal Advisor, the Members of the\nBoard of Directors deem it appropriate to favorably address the\naforementioned proposal; reason for which, the Board of Directors.
