  "body_es_text": "en la totalidad del texto\n\n                    -\n\n                        Texto Completo Norma 404\n\n                        Reforma Acuerdo AJDIP/060-2015 de “Procedimientos de Control para\nDeclaratoria de Vedas para Garantizar la Protección y Sostenibilidad de los Recursos Pesqueros del\nGolfo de Nicoya\"\n\nTexto Completo acta: 10B8E3\n\nINSTITUTOCOSTARRICENSEDEPESCA Y ACUICULTURA\n\nAJDIP/404-2015.-Puntarenas, a los nueve días del mes\nde octubre de dos mil quince.\n\nConsiderando:\n\n1º-Se conoce oficio DFOE-SD-2130, suscrito por la señora\nAlexia Umaña Alvarado, Fiscalizadora de la División de Fiscalización Operativa\ny Evaluativa de la Contraloría General de la República, por medio de la cual, y\nen atención a las Disposiciones 4.5 y 4.6 del Informe N° DFOE-EC-IF-15-2014.\n\n2º-Que\néstas disposiciones versan sobre: \"4.5 Ordenar a la Presidencia Ejecutiva que\ncada propuesta de vedas que se eleve a ese órgano colegiado, de acuerdo con los\nperíodos y zonas de regulación anual, esté respaldada en criterios técnicos,\ncientíficos, económicos y sociales, según se establece en los artículos 34 de\nla Ley N° 8436 y 41 del Decreto Ejecutivo N° 36782, considerando a su vez el\ndictamen de la Comisión de Coordinación Científico Técnica (CCT) que señala el\nartículo 29 de la Ley N° 7384, entre otra normativa. El análisis que realice\nesa Junta Directiva debe verificar que la propuesta de vedas consideró los\ncriterios señalados y el referido dictamen como respaldo para tomar sus\ndecisiones, con el fin de proteger los recursos marinos. Para acreditar el cabal\ncumplimiento de esta disposición, se deberá remitir en un plazo de 10 días\nhábiles el acuerdo correspondiente en donde se gira la orden a la Presidencia\nEjecutiva.\n\n3º-Que\nademás, cada semestre durante los años 2015 y 2016, deberán remitir a ésta\nContraloría General una certificación en que se acredite que en el\nestablecimiento de las vedas de ese período se consideraron los criterios que\nseñala el artículo 34 de la Ley N° 8436.\n\n4º-Que\npor su parte, la Presidencia Ejecutiva, remitió en atención a lo señalado en\neste punto, el oficio PESJ-015-01-2015, acompañándolo del Acuerdo\nAJDIP/031-2015, por medio del cual la Junta Directiva, le ordena a esa\nDependencia la atención de lo dispuesto en el artículo 34 de la Ley 8436,\ncontando para ello con el soporte de la Comisión de Coordinación Científico\nTécnica.\n\n5º-Que\npor su parte, la oficialización de la Comisión de Coordinación Científico\nTécnica, se produce en la sesión ordinaria N° 23-2015, celebrada el 22 de mayo\nde 2015 y el período de veda regía a partir del 15 de mayo al 15 de setiembre\nde 2015, lo cual dada la constitución y juramentación de la Comisión de\nCoordinación Científico Técnica se produce en fecha posterior a la emisión del\nAcuerdo e inicio de la veda del presente año, no fue considerado, ni requerido\ncriterio alguno.\n\n6º-Que en razón de ello y siendo que a la fecha no se ha acreditado el\ncumplimiento de las disposiciones contenidas en el artículo 34 de la Ley 8436,\nsolicita el Ente Contralor la remisión de la certificación correspondiente; así\ncomo la fecha de establecimiento de la veda próxima.\n\n7º-Que\npor su parte, en cuanto a la disposición 4.6, del Informe supra, éste\nestableció la necesidad de que la junta directiva aprobara los Procedimientos\nde Control para Declaratoria de Vedas para Garantizar la Protección y\nSostenibilidad de los Recursos Pesqueros del Golfo de Nicoya\", en estricto\nrespeto y cumplimiento de lo dispuesto en el artículo 34 de la Ley 8436, con la\nconsideración del dictamen que pudiere emanar la Comisión de Coordinación\nCientífico Técnica (Artículo 29, Ley 7384).\n\n8º-Que\nde conformidad con lo requerido por el Informe supra citado, la Junta Directiva\nestableció el mecanismo correspondiente mediante Acuerdo AJDIP/060-2015, que\nestableció Procedimientos de Control para Declaratoria de Vedas para Garantizar\nla Protección y Sostenibilidad de los Recursos Pesqueros del Golfo de Nicoya,\ndicho procedimiento fue ratificado y debidamente comunicado a la Contraloría\nGeneral de la República.\n\n9º-Que\nen ese mismo giro, éste procedimiento, resultó omiso y no estableció la\nconsideración del Dictamen de la Comisión de Coordinación Científico Técnica,\npor lo que requiere que la Junta Directiva, establezca que acciones va a\nadoptar para la atención de éste punto en particular.\n\n10.-Que\ndebidamente analizado el oficio remitido por la señora Alexia Umaña Alvarado,\nFiscalizadora de la División de Fiscalización Operativa y Evaluativa de la\nContraloría General de la República, estiman los Sres.   "body_en_text": "in the entirety of the text\n\n                    -\n\n                        Complete Text of Standard 404\n\n                        Amendment to Agreement AJDIP/060-2015 on “Control Procedures for the\nDeclaration of Closures to Guarantee the Protection and Sustainability of the Fishery Resources of the\nGulf of Nicoya”\n\nComplete Text of Record: 10B8E3\n\nCOSTA RICAN INSTITUTE OF FISHERIES AND AQUACULTURE\n\nAJDIP/404-2015.—Puntarenas, on the ninth day of the month\nof October, two thousand fifteen.\n\nConsidering:\n\n1.—Official communication DFOE-SD-2130 is received, signed by Mrs.\nAlexia Umaña Alvarado, Auditor of the Operative and Evaluative Audit Division of the Office of the Comptroller General of the Republic, through which, and\nin compliance with Provisions 4.5 and 4.6 of Report No. DFOE-EC-IF-15-2014.\n\n2.—That\nthese provisions concern: “4.5 Order the Executive Presidency that\nevery proposal for closures that is elevated to this board, in accordance with the\nannual regulation periods and zones, be supported by technical,\nscientific, economic, and social criteria, as established in articles 34 of\nLaw No. 8436 and 41 of Executive Decree No. 36782, considering in turn the\nopinion of the Technical Scientific Coordination Commission (CCT) as indicated in\narticle 29 of Law No. 7384, among other regulations. The analysis that\nthis Board of Directors carries out must verify that the closure proposal considered the\nindicated criteria and the referred opinion as support for making its\ndecisions, in order to protect marine resources. To certify full\ncompliance with this provision, the corresponding agreement ordering the Executive Presidency\nshall be remitted within a period of 10 business days.\n\n3.—That\nfurthermore, each semester during the years 2015 and 2016, you shall remit to this\nComptroller General a certification accrediting that in the\nestablishment of the closures for that period, the criteria\nindicated in article 34 of Law No. 8436 were considered.\n\n4.—That\nfor its part, the Executive Presidency, in compliance with what was indicated in\nthis point, remitted official communication PESJ-015-01-2015, accompanied by Agreement\nAJDIP/031-2015, through which the Board of Directors orders that\nDepartment to attend to the provisions of article 34 of Law 8436,\nrelying for this purpose on the support of the Technical Scientific Coordination Commission.\n\n5.—That\nfor its part, the formalization of the Technical Scientific Coordination Commission\noccurred in ordinary session No. 23-2015, held on May 22,\n2015, and the closure period was in effect from May 15 to September 15,\n2015, which, given that the constitution and swearing-in of the Technical Scientific Coordination Commission occurred on a date subsequent to the issuance of the\nAgreement and the start of this year’s closure, no criterion was considered or\nrequested.\n\n6.—That by reason of this and being that to date compliance with\nthe provisions contained in article 34 of Law 8436 has not been accredited,\nthe Office of the Comptroller requests the remission of the corresponding certification; as well\nas the date of establishment of the next closure.\n\n7.—That\nfor its part, regarding provision 4.6 of the aforementioned Report, it\nestablished the need for the board of directors to approve the “Control\nProcedures for the Declaration of Closures to Guarantee the Protection and\nSustainability of the Fishery Resources of the Gulf of Nicoya,” in strict\nobservance and compliance of the provisions of article 34 of Law 8436, with\nconsideration of the opinion that may emanate from the Technical Scientific Coordination Commission (Article 29, Law 7384).\n\n8.—That\nin accordance with what was required by the aforementioned Report, the Board of Directors\nestablished the corresponding mechanism through Agreement AJDIP/060-2015, which\nestablished Control Procedures for the Declaration of Closures to Guarantee the\nProtection and Sustainability of the Fishery Resources of the Gulf of Nicoya.\nSaid procedure was ratified and duly communicated to the Office of the Comptroller General of the Republic.\n\n9.—That\nin that same vein, this procedure was found to be neglectful and did not establish\nconsideration of the Opinion of the Technical Scientific Coordination Commission,\nfor which reason it requires that the Board of Directors establish what actions it will\nadopt to attend to this particular point.\n\n10.—That\nhaving duly analyzed the official communication remitted by Mrs. Alexia Umaña Alvarado,\nAuditor of the Operative and Evaluative Audit Division of the Office of the Comptroller General of the Republic, the Directors deem it, in the interest of\nattending to the specific requests established in provisions 4.5 and 4.6,\nabsolutely necessary and convenient to modify Agreement\nAJDIP/060-2015, so that it is understood as being mandatorily integrated beforehand, the\ncriterion of the Technical Scientific Coordination Commission, in the decision-making of the National Closures Commission, regarding the establishment of\nclosure periods. For this reason, the board of directors, Therefore;\n\nAGREES:\n\n1.—To amend Agreement AJDIP/060-2015 on “Control\nProcedures for the Declaration of Closures to Guarantee the Protection and\nSustainability of the Fishery Resources of the Gulf of Nicoya,” so that it is\nunderstood as being mandatorily integrated beforehand, the criterion of the Technical Scientific Coordination Commission, in the decision-making of the National Closures Commission,\nregarding the establishment of the closure periods that it recommends\nto this Board of Directors.\n\n2.—Firm\nagreement."
