y la Ley Nº 7384 del 16 de marzo de 1994, Ley de Creación del\nInstituto Costarricense de Pesca y Acuicultura, publicada en La Gaceta Nº\n62 el 29 de marzo de 1994.\n\nConsiderando:\n\n1º-Que de conformidad\ncon lo dispuesto en la Ley Nº 7064 del 29 de abril de 1987, que incorpora la\nLey Orgánica del Ministerio de Agricultura y Ganadería, el Ministro de dicha\nCartera, es el Rector del Sector Agropecuario Costarricense, del cual la pesca\ncomo subsector forma parte.\n\n2º-Que Costa Rica es\nmiembro integrante de la Comisión Interamericana del Atún Tropical (CIAT), en\ncuyo seno y en las reuniones de dicho Organismo, deben participar un máximo de\ncuatro Comisionados Oficiales, designados por el Poder Ejecutivo, como\nrepresentantes del país.\n\n3º-Que Costa Rica\ntradicionalmente ha participado en la industrialización del atún y fomentado el\ndesarrollo de dicha actividad, en la cual las resoluciones de la CIAT, revisten\ngran importancia, principalmente por la incidencia en las capturas de atún de\ncerco que afectan la disponibilidad del atún como materia prima para la\nindustria, así como las resoluciones de veda de captura del recurso atunero en\nel Océano Pacífico Oriental (OPO) y las acciones de restricción sobre la operación\nde barcos atuneros que repercuten y afectan las descargas de atún en nuestro\nterritorio.\n\n4º-Que la\nProcuraduría General de la República en su dictamen C-407-2007 concluyó en\nforma contundente que la designación de los comisionados oficiales de Costa\nRica ante la Comisión Interamericana del Atún Tropical corresponde al Poder\nEjecutivo.\n\n5º-Que es política\noficial el mantener y ejercer la óptima representación del país en los\nOrganismos Internacionales, que garantice la mejor defensa de los intereses de\nCosta Rica, lo cual debe mantenerse respecto de la participación del país, en\nla Comisión Interamericana del Atún Tropical.\n\n6º-Que se procedió a\nllenar el Formulario de Evaluación Costo Beneficio, Sección I, denominada\nControl Previo de Mejora Regulatoria, siendo que el mismo dio un resultado\nnegativo y la propuesta no contiene trámites ni requisitos. Therefore;\n\nDecree:\n\nDESIGNATION OF OFFICIAL COMMISSIONERS\n\nPERMANENT BEFORE THE INTER-AMERICAN\n\nTROPICAL TUNA COMMISSION\n\n(CIAT)\n\nArticle 1—To designate as Permanent Official Commissioners before the Inter-American Tropical Tuna Commission (CIAT), the Minister of Agriculture and Livestock, the Executive President of the Instituto Costarricense de Pesca y Acuicultura (hereinafter \"INCOPESCA\") and a representative of the Ministry of Foreign Affairs and Worship, designated by the Minister of that portfolio, so that in representation of Costa Rica they attend the meetings of the Working Groups, as well as the ordinary or extraordinary meetings of the CIAT, held by the Contracting Parties, or any other meeting of Parties or Working Groups convened by the aforementioned Body.
