Autorizar a los\npermisionarios de pesca turística y deportiva realizar actividades de pesca, en\nla zona vedada para la pesca en pequeña escala, únicamente en la zona\ncomprendida entre la línea imaginaria que va desde Punta Torres conocida como\nPeñón (09°53´31\"Latitud Norte, 084°43´52\" Longitud Oeste) hasta Guayabo ubicado\nen la parte externa de Isla San Lucas (09°54´54\".1 Latitud Norte, 084°53´15\"\nLongitud Oeste) y de ahí hasta Punta Gigante en la península de Nicoya\n(09°50´41\".2 Latitud Norte, 084°52´45\" Longitud Oeste) y de ahí aguas afuera.\nEsta pesca únicamente se permite utilizando como métodos de pesca el troleo y\ncasting (caña lanzada \"dirigida a especies pelágicas\") y utilizando la\nmodalidad de captura y liberación; por lo que no se podrán retener ningún\nespécimen capturados como producto de esta pesca.\n\n3º-Que con la puesta\nen marcha de ésta veda, tal cual se ha concebido, se atiende la imperiosa\nnecesidad de proteger y garantizar los recursos hidrobiológicos del Golfo de\nNicoya en su etapa más importante de reproducción; además de que gracias a los\nesfuerzos del IMAS en coordinación con el INCOPESCA, se ha logrado además\nextender el subsidio -a los pescadores cuya licencia solo les permite pescar en\ndicha zona-, por un mes adicional la veda en la zona 201 (A); zona que por sus\ncondiciones y características, reviste de gran importancia en el repoblamiento\nde las especies de interés comercial en el Golfo de Nicoya.\n\n4º-Asimismo, aquellos\npescadores que de conformidad con lo dispuesto en el inciso 1) del considerando\n2º) del presente acuerdo, decidan realizar la pesca de barracudas o candado\n(Sphyraena ensis), durante los meses de junio y julio del 2016, deberán\ncomunicarlo con al menos un mes de antelación al Departamento de Protección y\nRegistro del INCOPESCA, en el entendido que no se les reconocerá el derecho a\nrecibir el subsidio durante los meses que realicen labores de pesca, sino que\ntendrán derecho a recibir combustible a precio competitivo para el ejercicio de\nesas labores de pesca, de conformidad con su licencia de pesca.\n\n5º-Escuchada la presentación del Director General Técnico, manifiestan\nlos Sres. Directivos su satisfacción de que ésta propuesta integre no solo los\ncriterios de éstas dos Comisiones, sino que la misma se presenta con la\nantelación debida, lo cual permitirá tomar las previsiones necesarias a efecto\nque su implementación en tiempo y forma en relación a los ámbitos legal y\nsocial, razón por la cual, la Junta Directiva. Por\ntanto,\n\nACUERDA:\n\n1º-Aprobar la veda\n2016 en los siguientes términos y condiciones:\n\n1. Authorize\nsport and recreational fishing permit holders (permisionarios de pesca turística y deportiva) to carry out fishing activities, in\nthe area closed (vedada) to small-scale fishing, only in the zone\nenclosed by the imaginary line running from Punta Torres, known as Peñón\n(09°53´31\" North Latitude, 084°43´52\" West Longitude) to Guayabo located\non the outer part of Isla San Lucas (09°54´54\".1 North Latitude, 084°53´15\"\nWest Longitude) and from there to Punta Gigante on the Nicoya Peninsula\n(09°50´41\".2 North Latitude, 084°52´45\" West Longitude) and from there seaward.\nThis fishing is only permitted using trolling and\ncasting (cast rod \"targeting pelagic species\") as fishing methods and using the\ncatch and release modality; therefore, no\nspecimens caught as a product of this fishing may be retained.\n\n3º-Whereas with the implementation\nof this closure (veda), as it has been conceived, the urgent\nneed to protect and guarantee the hydrobiological resources of the Gulf of Nicoya in their most important stage of reproduction is addressed; in addition to the fact that, thanks to the\nefforts of IMAS in coordination with INCOPESCA, it has also been possible to\nextend the subsidy —to fishers whose license only allows them to fish in\nsaid zone— for an additional month during the closure (veda) in zone 201 (A); a zone which, due to its\nconditions and characteristics, is of great importance for the repopulation\nof commercially important species in the Gulf of Nicoya.\n\n4º-Likewise, those\nfishers who, in accordance with the provisions of subsection 1) of recital (considerando) 2º)\nof this agreement, decide to fish for barracuda or candado\n(Sphyraena ensis), during the months of June and July 2016, must\ncommunicate this at least one month in advance to the Department of Protection and\nRegistration of INCOPESCA, on the understanding that they will not be recognized the right to\nreceive the subsidy during the months they carry out fishing activities, but rather\nwill be entitled to receive fuel at a competitive price for the exercise of\nthose fishing activities, in accordance with their fishing license.\n\n5º-Having heard the presentation of the Technical Director General, the\nBoard Members express their satisfaction that this proposal integrates not only the\ncriteria of these two Commissions, but is also presented with the\ndue advance notice, which will allow the necessary provisions to be made so\nthat its implementation occurs in a timely manner with respect to the legal and\nsocial spheres, reason for which, the Board of Directors. Establish a\ntotal closure (veda) for small-scale fishing, in the area enclosed by an imaginary straight line running from Punta Torres, known as Peñón\n(09°53´31\" North Latitude, 084°43´52\" West Longitude) to the outer lighthouse of Isla Negritos\n(09°49´14\" North Latitude, 084°49´35\" West Longitude) and from there to\nthe eastern part of Punta Cuchillo on the Nicoya Peninsula and from there seaward\nto the imaginary line running from Estero Canjelito (10°01´05\" North Latitude, 085°09´47\" West Longitude) to Estero Moraga (10°8´3\" North Latitude,\n085°03´51\" West Longitude). This fishing prohibition runs from May 1,\n2016, to July 31, 2016, both dates inclusive.\n\nIn this closed (vedada) area,\nwithin the zone enclosed by the imaginary line running from the Cruise Ship Pier (Muelle de Cruceros) in Puntarenas (09°58´34\" North Latitude, 084°51´02\" West Longitude)\nto Punta Cuchillo on the Nicoya Peninsula and from there to the outer lighthouse of Isla Los Negritos (09°49´14\" North Latitude, 084°49´35\" West Longitude) and from there\nto Punta Torres, known as Peñón (09°53´31\" North Latitude, 084°43´52\"\nWest Longitude), small-scale fishing is authorized for those\nfishers whose fishing license allows them to operate in said zone, only\nto fish for barracuda or candado (Sphyraena ensis),\nusing only handline and during the months of June and July\n2016.\n\n2.
