Sesión ordinaria N° 04-03-16, celebrada el día\nmiércoles 2 de marzo del 2016.\n\nConsiderando que:\n\nI.-Desde el 29 de julio del año 1968, el volcán Arenal, inició su última\netapa eruptiva, la cual perduró por más de 42 años, hasta octubre del 2010, con\nfrecuentes explosiones, y emisiones de gases, lavas en bloques y flujos\npiroclásticos.\n\nII.-Durante este periodo eruptivo, el 23 de agosto del año 2000, se dio\nuna sucesión de flujos de piroclástos, que afectaron el flanco norte, dando\ncomo resultado la muerte de dos personas y dejando gravemente herida a una más,\nlo que evidenció la necesidad de establecer regulaciones concretas y estrictas,\ntanto para el acceso a los visitantes, como para orientar un crecimiento de\ninfraestructura con criterios de manejo de la gestión del riesgo volcánico.\n\nIII.-En el año 2001 se publicó en el Diario Oficial La Gaceta el\ndocumento RESTRICCIONES DE USO DEL SUELO EN LOS ALREDEDORES DEL VOLCÁN ARENAL (La\nGaceta Nº 8 del 11 de enero del 2001), el cual fue desarrollado como un\npropuesta conjunta del Observatorio Vulcanológico y Sismológico de Costa Rica\n(OVSICORI), la Red Sismológica Nacional de la UCR y el ICE (RSN: UCR-ICE), en\ncoordinación con la Comisión Nacional de Emergencias (CNE).\n\nIV.-Este documento, a partir de esa fecha, se convirtió en un\ninstrumento que reguló el uso de la tierra en el entorno de influencia de\nposibles erupciones del volcán Arenal, por medio del mecanismo de Resolución Vinculante,\nsegún lo que estableció la Ley Nacional de Emergencia N° 7914 del 28 de\nsetiembre de 1999.\n\nV.-El documento en mención recopiló la información de investigaciones\nhechas por distintos especialistas, e integró una propuesta de manejo del uso\nde las diferentes áreas, utilizando criterios de amenaza volcánica y usos\nhistóricos de la tierra en el entorno de influencia volcánica del Arenal, y que\nson conformes con escenarios potenciales de amenaza a corto plazo.\n\nVI.-En el año 2003, como parte de los compromisos previamente\nadquiridos, se concretó la visita de un experto internacional, la cual se dio\nentre el 12 y 21 de noviembre de ese año, cuando el Dr. Robert Tilling, del\nUnited States Geological Survey (USGS). El Dr. Tilling realizó la evaluación de\nla zonificación establecida, por medio del informe titulado \"Appraisal of the\nLand-Use Restriction Map and Associated Presidential Decree (2001) for Volcán\nArenal, Costa Rica, 2003\", entregado en diciembre de ese mismo año.\n\nVII.-En diciembre del año 2004, se elaboró el documento \"Preparación del\nMapa de Peligros Volcánicos del Volcán Arenal y la Implementación de las\nRecomendaciones al Mapa de Restricción del Uso del Suelo en el volcán Arenal\",\nel cual reforzó la necesidad de mantener la zonificación, pero también apuntó\nacorde con lo planteado entre otros por el Dr. Tilling (2003), que las\nvaloraciones de riesgo volcánico son documentos dinámicos, por lo que deben\nponerse al día y mejorarse periódicamente de acuerdo con la dinámica propia del\ncomportamiento del volcán y la generación de nueva información.\n\nVIII.-Los escenarios que existen de peligros volcánicos del Arenal\nseñalan que este volcán tiene una evaluación de peligro volcánico de 14 según\nel método de Yokohama et al. (1994), la cual se mantiene en la actualidad,\nencontrándose en una categoría de muy peligroso.\n\nIX.-De acuerdo con las investigaciones realizadas, se identificaron los\nsiguientes peligros en los alrededores del volcán Arenal, los cuales tienen\ndiferentes grados de probabilidad dependiendo de los escenarios de corto y\nlargo plazo.\n\na. Salida y dispersión de gases.\n\nb. Caída de balística de bloques.\n\nc. Caída de piroclastos por:\n\ni. Erupciones estrombolianas pequeñas o fuertes.\n\nii. Erupciones vulcanianas.\n\niii. Erupciones subplinianas/plinianas.\n\nd. Flujos de piroclastos.\n\ne. Apertura de nuevas bocas eruptivas laterales.\n\nf. Coladas de lava.\n\ng. Lahares.\n\nh. Deslizamientos y avalanchas de detritos.\n\ni. Seiches.\n\nj. Sismos volcánicos.\n\nk. Grandes deslizamientos.\n\nX.-Esta resolución vinculante vigente hasta la fecha, ha logrado con\nbuen suceso un cambio relativo en las tendencias del crecimiento de\ninfraestructura turística en el entorno del Volcán Arenal, encaminando a la\nMunicipalidad y otros entes de control y permiso, a tomar en cuenta los\ncriterios de riesgo volcánico.\n\nXI.-A finales del año 2010, la actividad efusiva del volcán Arenal ceso,\njunto con otras características propias de un volcán en erupción que indican\nque este volcán se encuentre en una fase de relativa calma, en comparación con\nlas últimas décadas.\n\nXII.-No obstante, a pesar de que el volcán Arenal se encuentra en un\nperiodo de calma relativa, existen mapas de peligro volcánico, vigentes a la\nfecha, que señalan las áreas de potencial afectación por escenarios que pueden\npresentarse en un futuro (décadas y cientos de años).\n\nXIII.-Con base en todo lo anterior, se debe recalcar que este volcán\nhistóricamente activo, es uno de los volcanes más peligrosos de Costa Rica,\nahora en reposo, y que con seguridad hará erupción en un futuro.\n\nXIV.-Que las áreas definidas en el documento RESTRICCIONES DE USO DEL\nSUELO EN LOS ALREDEDORES DEL VOLCÁN ARENAL (2001), como R1, R2, R3 Y R4,\nreflejan los sectores más afectables de manera directa, por los procesos\nseñalados en el punto I. 12, tanto para los escenarios de corto plazo, como de\nlargo plazo, esto es, para futuras erupciones.\n\nXV.-Además, también están contenidas en estas áreas, claramente los\nsectores de afectación directos por la erupción del año 1968 y por otras\nsimilares que podrían ocurrir en el futuro.\n\nXVI.-El círculo de 5,5 km de radio alrededor del cráter activo del\nVolcán Arenal ha planteado una serie de dificultades prácticas en su\nimplementación, particularmente en el momento de otorgar permisos de construcción\ny desarrollo, debido a la generalización de una medida de control, sin tomar en\ncuenta diferentes áreas de exposición que existen dentro de él. Esto se\ndemuestra en el documento PREPARACIÓN DEL MAPA DE PELIGROS VOLCÁNICOS DEL\nVOLCÁN ARENAL Y LA IMPLEMENTACIÓN DE LAS RECOMENDACIONES AL MAPA DE RESTRICCIÓN\nDE USO DEL SUELO EN EL VOLCÁN ARENAL (Soto, G.J., 2004), en el punto 5.2.2\n(página 96), por lo que urge una adaptación de esta área a las condiciones\nactuales.\n\nXVII.-Finalmente, de acuerdo con las conclusiones de varias\ninvestigaciones, a pesar de que el volcán pueda permanecer en un periodo de\ncalma por varios años, cabe la posibilidad de que se reactive o bien cambie su\npatrón de actividad conocida a la fecha en cualquier momento.\n\nAcuerdo N° 040-03-2016\n\nLa Junta Directiva da por conocida y aprueba la modificación a la\nResolución Vinculante del Volcán Arenal presentada por el M.Sc. Lidier Esquivel\nValverde, Jefe de la Unidad de Investigación y Análisis del Riesgo:\n\nI. SE ACUERDA:\n\n1º-Actualizar la resolución vinculante RESTRICCIONES DE USO DEL SUELO EN\nLOS ALREDEDORES DEL VOLCÁN ARENAL, vigente desde el año 2001, en razón que la\ndinámica volcánica del Arenal ha cambiado sustancialmente a partir del año\n2010.\n\n2º-Hacer una propuesta acorde con el conocimiento de este volcán a la\nfecha, la capacidad de vigilancia y seguimiento instalada actualmente.\n\n3º-Tomar en cuenta como base la experiencia acumulada en esta década y\nmedia de implementación de la restricción, considerando las ventajas y\ndesventajas que han existido a la hora de llevar a la práctica la restricción\nseñalada.\n\nII. SE RECOMIENDA:\n\n1º-Mantener la restricción actual en lo referente a las siguientes\nzonas:\n\na. Zona de restricción 1 (R1):\n\ni. Prohibir la construcción de actividades turísticas (alojamientos,\nrestaurantes, balnearios, senderos, campamentos, canopy, tours, montañismo,\nsenderismo, cabalgatas, construcción de caminos, instalaciones complementarias\npara prestar servicios turísticos como bodegas, sitios para acampar, etc.) o\nbien ampliaciones de las ya existentes.\n\nii. Se prohíbe el establecimiento de nuevas viviendas dentro de fincas\nexistentes o en sus segregaciones, que aplica para toda la zona marcada de\nrestricción absoluta.\n\niii. Las autoridades correspondientes deben tomar medidas para que, no\nse permitan actividades que impliquen concentraciones de personas. Esto debido\na que dichas áreas tienen antecedentes históricos y prehistóricos recientes, de\nhaber sido afectadas por flujos piroclásticos y deslizamientos de rocas, y que\npor su uso actual están en conflicto con el nivel de amenaza que se desprende\nde la ocurrencia de los fenómenos mencionados. Las actividades agropecuarias ya\nestablecidas en este sector se regirán por lo que establece la zona de\nrestricción R4.\n\nb. Zona de restricción 2 (R2):\n\ni. Este sector podrá ser utilizado por el Área de Conservación de Arenal\n(ACA), permitiendo el ingreso controlado de pequeños grupos de hasta 10\npersonas al ACA, por tiempo limitado y bajo estricta supervisión de los\nfuncionarios del ACA hasta el sector delimitado por la cota de 600 m.s.n.m.,\nlímite que deberá ser debidamente señalado por funcionarios de la ACA.\n\nTambién se debe poseer un sistema de alarma para ordenar evacuaciones\ndebidamente aprobados por la CNE. Además, las personas no pueden pernoctar o\nacampar. El único servicio turístico que puede darse dentro de la zona es el de\nguía turístico de grupos de personas, así como transporte hacia y fuera de la\nzona. Estos guías deben estar debidamente certificados por el ICT.\n\nii. Se deberá contar con un Plan de Emergencia debidamente aprobado y\nactualizado, demarcación de senderos, salidas de emergencia, información sobre\nla amenazas a los visitantes en varios idiomas (español e inglés al menos). En\neste sector no se deberá construir nueva infraestructura o servicios a los\nturistas, a menos que sean senderos, rotulación u otras facilidades al aire\nlibre.\n\niii. El aprovechamiento de materiales por parte de ACA para cubrir sus\npropias necesidades, es posible, siempre y cuando cumpla con la normativa\nvigente en ese campo.\n\nc. Zona de restricción 3 (R3):\n\ni. Al oeste de la carretera a El Castillo (entre la carretera y borde de\nla Laguna Arenal y el Río Arenal), se permitirá exclusivamente el\nestablecimiento de senderos para la práctica de caminatas o cabalgatas, así\ncomo la pesca en la laguna, de conformidad con las regulaciones existentes en\nesa materia, o bien otras actividades al aire libre, siempre y cuando no\nimpliquen la generación de construcciones de ningún tipo, las cuales deben\nestar ubicadas fuera del área de restricción delimitada. Tampoco se permitirá\nel establecimiento de facilidades para acampar o cualquier actividad que\nrequiera de ello.\n\nii. Actividades de extracción de materiales y agropecuarias, se regirán\nde acuerdo con lo que establece la zona de restricción R4 y concordante con la\nnormativa vigente.\n\nd. Zona de restricción 4 (R4):\n\ni. Son actividades permitidas las de índole forestal, agropecuaria, y\nexplotación de materiales para construcción (tajos), cuando hayan sido\nestablecidos con anterioridad a la declaratoria de la Junta Directiva de la CNE\ny no impliquen concentración superior a las siete (7) personas en sitios de\nalta vulnerabilidad. Las instalaciones para servicios forestales, agropecuarios\ny explotación de materiales existentes (siempre que cuenten con los permisos\nrespectivos), podrán ser reparadas.\n\ne. Radio de 5,5 km alrededor del cráter activo del volcán Arenal.\n\ni. Levantar la necesidad de contar con un estudio de investigación de\nvulcanología avalado por alguno de los centros de investigación, para el\ndesarrollo que pesa sobre este sector alrededor del volcán Arenal (95 km²).\n\nii. Prohibir el desarrollo de instituciones vitales para la comunidad,\ncomo hospitales, clínicas, escuelas y colegios, centrales eléctricas y telefónicas,\ncasas de retiro, casas de descanso u hogares ancianos y otras.\n\niii. Prohibir el desarrollo de centros comerciales, desarrollos\nresidenciales, tales como condominios y urbanizaciones\n\niv. Es posible la explotación de materiales, siempre y cuando impliquen\nla limpieza periódica del cauce, y cumplan con todas las disposiciones que\nestablezca la normativa vigente para este tipo de actividad.\n\nv. Mantener en esta zona una serie de condicionantes (vi, vii, viii),\nque deben ser vigilados estrictamente por la Municipalidad de San Carlos, en\nrazón de la probabilidad de que en el futuro, ante escenarios de riesgo\nvolcánico, puedan presentarse procesos eruptivos que se encaucen por los\nprincipales ríos y quebradas que tienen sus nacientes por encima de los 1000\nm.s.n.m., en el cono volcánico del Arenal.\n\nvi. A lo largo de estos cauces, deberá ampliarse lo propuesto por el\nPlan Regulador de la Fortuna, que establece una zonificación de protección de\n20 metros a ambos lados del cauce (apartado 7.1), independientemente del ancho\ndel mismo. Por ello no se puede construir casas.\n\nvii. Ordinary session No. 04-03-16, held on\nWednesday, March 2, 2016.\n\nConsidering that:\n\nI.—Since July 29, 1968, the Arenal Volcano began its last\neruptive stage, which lasted for more than 42 years, until October 2010, with\nfrequent explosions, and emissions of gases, block lavas, and pyroclastic\nflows (flujos piroclásticos).\n\nII.—During this eruptive period, on August 23, 2000, a\nsuccession of pyroclastic flows (flujos de piroclástos) occurred, which affected the northern flank, resulting\nin the death of two people and leaving one more seriously injured,\nwhich evidenced the need to establish concrete and strict regulations,\nboth for visitor access, and to guide infrastructure\ngrowth with criteria for volcanic risk management.\n\nIII.—In 2001, the document LAND-USE RESTRICTIONS IN THE SURROUNDINGS OF THE ARENAL VOLCANO (RESTRICCIONES DE USO DEL SUELO EN LOS ALREDEDORES DEL VOLCÁN ARENAL) was published in the Official Gazette La Gaceta (La\nGaceta No. 8 of January 11, 2001), which was developed as a\njoint proposal of the Costa Rica Volcanological and Seismological Observatory\n(OVSICORI), the National Seismological Network of the UCR and ICE (RSN: UCR-ICE),\nin coordination with the National Emergency Commission (CNE).\n\nIV.—This document, as of that date, became an\ninstrument that regulated land use in the influence area of\npossible eruptions of the Arenal Volcano, through the mechanism of a Binding Resolution (Resolución Vinculante),\nas established by the National Emergency Law No. 7914 of\nSeptember 28, 1999.\n\nV.—The document in question compiled information from research\nconducted by different specialists, and integrated a management proposal for the use\nof the different areas, utilizing criteria of volcanic hazard (amenaza volcánica) and historical\nland uses in the volcanic influence area of Arenal, and which\nare consistent with potential short-term hazard scenarios.\n\nVI.—In 2003, as part of previously\nacquired commitments, the visit of an international expert was finalized, which took place\nbetween November 12 and 21 of that year, when Dr. Robert Tilling, of the\nUnited States Geological Survey (USGS). Dr. Tilling conducted the evaluation of\nthe established zoning (zonificación), through the report titled \"Appraisal of the\nLand-Use Restriction Map and Associated Presidential Decree (2001) for Volcán\nArenal, Costa Rica, 2003\", submitted in December of that same year.\n\nVII.—In December 2004, the document \"Preparation of the\nVolcanic Hazards Map of Arenal Volcano and the Implementation of\nRecommendations to the Land-Use Restriction Map on Arenal Volcano\" (\"Preparación del\nMapa de Peligros Volcánicos del Volcán Arenal y la Implementación de las\nRecomendaciones al Mapa de Restricción del Uso del Suelo en el volcán Arenal\") was prepared,\nwhich reinforced the need to maintain the zoning (zonificación), but also pointed out,\nin accordance with what was proposed by Dr. Tilling (2003), among others, that\nvolcanic risk assessments are dynamic documents, so they must\nbe periodically updated and improved in accordance with the dynamics of the\nvolcano's own behavior and the generation of new information.\n\nVIII.—The existing scenarios of volcanic hazards (peligros volcánicos) of Arenal\nindicate that this volcano has a volcanic hazard (peligro volcánico) rating of 14 according\nto the method of Yokohama et al. (1994), which is maintained at present,\nplacing it in a very dangerous category.\n\nIX.—In accordance with the research conducted, the\nfollowing hazards (peligros) were identified in the surroundings of the Arenal Volcano, which have\ndifferent degrees of probability depending on short- and\nlong-term scenarios.\n\na. Emission and dispersion of gases.\n\nb. Fall of ballistics (balística) of blocks.\n\nc. Fall of pyroclasts (piroclastos) from:\n\ni. Small or strong strombolian eruptions.\n\nii. Vulcanian eruptions.\n\niii. Subplinian/plinian eruptions.\n\nd. Pyroclastic flows (flujos de piroclastos).\n\ne. Opening of new lateral eruptive vents.\n\nf. Lava flows (coladas de lava).\n\ng. Lahars (lahares).\n\nh. Landslides and debris avalanches.\n\ni. Seiches (seiches).\n\nj. Volcanic earthquakes.\n\nk. Large landslides.\n\nX.—This binding resolution (resolución vinculante), in force to date, has successfully\nachieved a relative change in the growth trends of\ntourist infrastructure in the environment of the Arenal Volcano, directing the\nMunicipality and other control and permitting entities to take into account the\nvolcanic risk criteria.\n\nXI.—At the end of 2010, the effusive activity of the Arenal Volcano ceased,\nalong with other characteristics typical of an erupting volcano that indicate\nthat this volcano is in a phase of relative calm, in comparison\nwith recent decades.\n\nXII.—However, despite the fact that the Arenal Volcano is in a\nperiod of relative calm, there are volcanic hazard maps (mapas de peligro volcánico), in force\nto date, that indicate the areas of potential affectation by scenarios that may\noccur in the future (decades and hundreds of years).\n\nXIII.—Based on all of the above, it must be emphasized that this\nhistorically active volcano is one of the most dangerous volcanoes in Costa Rica,\nnow at rest, and that it will certainly erupt in the future.\n\nXIV.—That the areas defined in the document LAND-USE RESTRICTIONS IN\nTHE SURROUNDINGS OF THE ARENAL VOLCANO (RESTRICCIONES DE USO DEL\nSUELO EN LOS ALREDEDORES DEL VOLCÁN ARENAL) (2001), as R1, R2, R3, and R4,\nreflect the sectors most directly affectable by the\nprocesses indicated in point I. 12, both for short-term and\nlong-term scenarios, that is, for future eruptions.\n\nXV.—Furthermore, also clearly contained within these areas are the\nsectors directly affected by the 1968 eruption and by other\nsimilar ones that could occur in the future.\n\nXVI.—The circle of a 5.5 km radius around the active crater of the\nArenal Volcano has presented a series of practical difficulties in its\nimplementation, particularly at the time of granting construction\nand development permits, due to the generalization of a control measure, without taking\ninto account the different exposure areas that exist within it. This is\ndemonstrated in the document PREPARATION OF THE VOLCANIC HAZARDS MAP OF THE\nARENAL VOLCANO AND THE IMPLEMENTATION OF RECOMMENDATIONS TO THE LAND-USE RESTRICTION\nMAP ON THE ARENAL VOLCANO (PREPARACIÓN DEL MAPA DE PELIGROS VOLCÁNICOS DEL\nVOLCÁN ARENAL Y LA IMPLEMENTACIÓN DE LAS RECOMENDACIONES AL MAPA DE RESTRICCIÓN\nDE USO DEL SUELO EN EL VOLCÁN ARENAL) (Soto, G.J., 2004), in point 5.2.2\n(page 96), which is why an adaptation of this area to current\nconditions is urgent.\n\nXVII.—Finally, according to the conclusions of several\ninvestigations, despite the fact that the volcano may remain in a period of\ncalm for several years, it is possible that it could reactivate or change its\npattern of activity known to date at any time.\n\nAgreement No. 040-03-2016\n\nThe Board of Directors acknowledges and approves the modification to the\nBinding Resolution of the Arenal Volcano (Resolución Vinculante del Volcán Arenal) presented by M.Sc. Lidier Esquivel\nValverde, Head of the Risk Research and Analysis Unit:\n\nI. IT IS AGREED:\n\n1.—To update the binding resolution (resolución vinculante) LAND-USE RESTRICTIONS IN\nTHE SURROUNDINGS OF THE ARENAL VOLCANO (RESTRICCIONES DE USO DEL SUELO EN\nLOS ALREDEDORES DEL VOLCÁN ARENAL), in force since 2001, because the\nvolcanic dynamics of Arenal have changed substantially since\n2010.\n\n2.—To make a proposal in accordance with the knowledge of this volcano to\ndate, and the installed surveillance and monitoring capacity currently.\n\n3.—To take into account as a basis the experience accumulated in this decade and\na half of implementation of the restriction, considering the advantages and\ndisadvantages that have existed when putting the indicated\nrestriction into practice.\n\nII. IT IS RECOMMENDED:\n\n1.—To maintain the current restriction regarding the following\nzones:\n\na. Restriction Zone 1 (R1):\n\ni. Prohibit the construction of tourist activities (lodging,\nrestaurants, spas, trails, camps, canopy, tours, mountaineering,\nhiking, horseback riding, road construction, complementary facilities\nfor providing tourist services such as warehouses, campsites, etc.) or\nexpansions of those already existing.\n\nii. The establishment of new dwellings within existing\nfarms or their segregations is prohibited, which applies to the entire zone marked for\nabsolute restriction.\n\niii. The corresponding authorities must take measures so that\nactivities involving concentrations of people are not permitted. This is because\nsaid areas have recent historical and prehistoric records of having\nbeen affected by pyroclastic flows (flujos piroclásticos) and rock landslides, and that,\ndue to their current use, are in conflict with the level of hazard (amenaza) derived\nfrom the occurrence of the mentioned phenomena. Agricultural activities already\nestablished in this sector shall be governed by what restriction zone R4\nestablishes.\n\nb. Restriction Zone 2 (R2):\n\ni. This sector may be used by the Arenal Conservation Area\n(ACA), allowing the controlled entry of small groups of up to 10\npeople to the ACA, for a limited time and under strict supervision of\nACA officials up to the sector delimited by the 600 m.a.s.l. elevation line,\na limit that must be duly marked by ACA officials.\n\nAn alarm system must also be in place to order evacuations,\nduly approved by the CNE. Furthermore, people cannot stay overnight or\ncamp. The only tourist service that can be provided within the zone is that of\ntourist guide for groups of people, as well as transport to and from the\nzone. These guides must be duly certified by the ICT.\n\nii. There must be a duly approved and\nupdated Emergency Plan, trail marking, emergency exits, information about\nhazards (amenazas) to visitors in several languages (Spanish and English at least). In\nthis sector, no new infrastructure or services for\ntourists shall be built, unless they are trails, signage, or other open-air\nfacilities.\n\niii. The extraction of materials by the ACA to cover its\nown needs is possible, provided it complies with the\nregulations in force in that field.\n\nc. Restriction Zone 3 (R3):\n\ni. To the west of the road to El Castillo (between the road and the edge of\nLaguna Arenal and the Arenal River), only the\nestablishment of trails for hiking or horseback riding\nshall be permitted, as well as fishing in the lake, in accordance with the existing regulations\non that matter, or other open-air activities, provided they do not\nimply the generation of constructions of any type, which must\nbe located outside the delimited restriction area. The\nestablishment of camping facilities or any activity that\nrequires them shall also not be permitted.\n\nii. Material extraction and agricultural activities shall be governed\naccording to what restriction zone R4 establishes and in accordance with\nthe regulations in force.\n\nd. Restriction Zone 4 (R4):\n\ni. Permitted activities are those of a forestry, agricultural, and\nexploitation of construction materials (quarries (tajos)) nature, when they have been\nestablished prior to the declaration of the CNE Board of Directors\nand do not imply concentrations of more than seven (7) persons in sites of\nhigh vulnerability. Existing facilities for forestry, agricultural\nservices, and exploitation of materials (provided they have the respective\npermits), may be repaired.\n\ne. 5.5 km radius around the active crater of the Arenal Volcano.\n\ni. To lift the need to have a vulcanology research\nstudy endorsed by one of the research centers for the\ndevelopment that weighs on this sector around the Arenal Volcano (95 km²).\n\nii. To prohibit the development of institutions vital to the community,\nsuch as hospitals, clinics, schools and high schools, power and telephone\nplants, retirement homes, rest homes, or nursing homes, and others.\n\niii. To prohibit the development of shopping centers, residential\ndevelopments, such as condominiums and subdivisions (urbanizaciones).\n\niv. The exploitation of materials is possible, provided it involves\nthe periodic cleaning of the channel, and complies with all the provisions\nestablished by the regulations in force for this type of activity.\n\nv. To maintain in this zone a series of conditions (vi, vii, viii),\nwhich must be strictly monitored by the Municipality of San Carlos, because\nof the probability that in the future, given volcanic risk\nscenarios, eruptive processes may occur that channel through the\nmain rivers and streams that have their headwaters above 1000\nm.a.s.l., on the volcanic cone of Arenal.\n\nvi. Along these channels, what is proposed by the\nLa Fortuna Regulatory Plan (Plan Regulador de la Fortuna) must be extended, which establishes a protection zone (zonificación) of\n20 meters on both sides of the channel (section 7.1), regardless of the width\nof the same. Therefore, houses cannot be built.\n\nvii. Any tourist development that exists or is built as of\nthis date must have a specific emergency plan for the volcanic\nhazard (amenaza volcánica) of this sector, which must include regular evacuation\ndrills.\n\nviii. It will be mandatory for each of the sites that offer tourist\nservices within this circle to have material in at least the\nSpanish and English languages, informing about the risk conditions of the area and\nprotection measures in case of an eruption.\n\nix. Adequate territorial planning and land use within\nthis area shall be under the responsibility of the Municipality of San\nCarlos, in accordance with what is proposed by the regulations in force on\nLand-Use Planning (Ordenamiento Territorial) (Forestry Law (Ley Forestal) No. 7575, Urban Planning Law (Ley de Planificación Urbana), No.\n4240, Law on the Use, Management, and Conservation of Soils (Ley de Uso, Manejo y Conservación de Suelos), No. 7779, Organic Environmental\nLaw (Ley Orgánica del Ambiente) No. 7554, Water Law (Ley de Aguas) No. 276, and others), considering the different hazards (amenazas)\nimplicit in this territory.\n\nFINAL CONSIDERATIONS\n\ni. In the event that there is additional legislation that stipulates a\ngreater restriction than that indicated in this document, it must be adhered to.\n\nii. This regulation will have effect as long as the Arenal Volcano does not again\nshow symptoms of eruptive reactivation, before which, new\nrestrictive regulations will be issued in accordance with the scenario foreseen or occurring." }
