  "body_es_text": "en la totalidad del texto\n\n                    -\n\n                        Texto Completo Norma 077\n\n                        Monto que se debe aplicar por concepto de traspaso de licencias de pesca\n\nTexto Completo acta: 10CB2E\n\nINSTITUTO COSTARRICENSE DE PESCA\n\nY ACUICULTURA\n\nAJDIP/077-2016.-Puntarenas,\na los veinticinco días del mes de febrero de dos mil dieciséis.\n\nConsiderando:\n\n1º-Se conoce oficio\nDGA-005-02-2016, por medio del cual el Director General Administrativo, remite,\natendiendo lo requerido por ésta Junta Directiva, mediante Acuerdo\nAJDIP-472-2015, criterio y propuesta en relación con la problemática que se\nestá generando al Sector Pesquero sobre el doble cobro por traspaso de una\nlicencia de pesca de un permisionario a otro.\n\n2º-Que en su nota el\nSr. Edwin Fallas Quirós, a efecto de superar la inconsistencia que se ha venido\npresentando de manera reiterada dada la interpretación del monto que se debe\naplicar por concepto de traspaso de licencias de pesca, posterior a la\ncancelación de canon anual correspondiente, se permite presentar dos posibles\nescenarios, como sigue:\n\n1) Si la licencia de\npesca para una determinada embarcación fue cancelada por el permisionario \"X\"\nel 15-03-2015, su vigencia sería: 15-03-2015 al 14-03-2016. En caso de que esa\nembarcación sea comprada por un permisionario \"Y\" y la documentación completa\nse presenta ante la oficina autorizada del INCOPESCA el 15-08-2015, su nueva\nvigencia sería: 15-08-2015 al 14-08-2016, con la salvedad de que al nuevo permisionario\nen este caso \"Y\", se le cobraría solamente 5 meses que corresponden al periodo\ncomprendido entre el 15- 03-2016 al 14-08-2016, y no los 12 meses como\nhabitualmente se ha venido haciendo. Con este procedimiento se evitaría el\ndoble cobro y la licencia mantendría su vigencia de 12 meses.\n\n2) Si la licencia de\npesca para una determinada embarcación fue cancelada por el permisionario \"X\"\nel 15-03-2015, su vigencia sería: 15-03-2015 al 14-03-2016. En caso de que esa\nembarcación sea comprada por un permisionario \"Y\" y la documentación completa\nse presenta ante la oficina autorizada del INCOPESCA el 15-08-2015, su nueva\nvigencia podría ser: 15-08-2015 al 14-03-2016, dejando la licencia con la misma\nfecha de vencimiento, pero con la salvedad de que al nuevo permisionario, en\neste caso \"Y\", no se le cobra la licencia de pesca, porque los 12 meses en que\nse extendió la licencia ya fueron cancelados por el permisionario \"X\", el 15-\n03-2015. Lo que si se debe cobrar es un duplicado de licencia por cambio de\npermisionario por la suma de ¢8.000,00, tal y como lo establece el acuerdo\nAJDIP-318-2014, publicado en La Gaceta N° 205, del viernes 24-10-2014\nrenglón 23 el cual establece el cuadro de tarifas vigente a la fecha de hoy.\nCon este procedimiento, también se evitaría el doble cobro.\n\n3) Estiman los Sres.\nMiembros de Junta Directiva, que en este caso y a efecto de establecer reglas\nclaras y diáfanas, resulta procedente establecer como parámetro de valoración\nde cobro ajustados en las fechas, así como un monto razonable para los casos de\nla emisión de licencias por concepto de traspaso de las licencias debidamente\nautorizadas por el INCOPESCA.\n\n4) Que en esa línea y\nhabiéndose analizado las propuestas citadas, estiman pertinente incorporar\ndentro del Acuerdo de Tarifas vigente, una línea explicativa que atienda en\ndefinitiva el establecimiento del cobro por concepto de traspaso de licencia,\ncuyo canon anual se encuentre debidamente cancelado con anterioridad.\n\n5) Que en ese\nsentido, consideran los Sres.   "body_en_text": "in the entirety of the text\n\n                    -\n\n                        Complete Text of Norm 077\n\n                        Amount to be Applied for the Transfer of Fishing Licenses\n\nComplete Text Record: 10CB2E\n\nCOSTA RICAN INSTITUTE OF FISHERIES\n\nAND AQUACULTURE\n\nAJDIP/077-2016.-Puntarenas,\non the twenty-fifth day of February, two thousand sixteen.\n\nConsidering:\n\n1º-Official communication\nDGA-005-02-2016 is known, whereby the Administrative Director General remits,\nin response to the request of this Board of Directors, via Agreement\nAJDIP-472-2015, a criterion and proposal regarding the issue being\ngenerated in the Fishing Sector concerning the double charge for the transfer of a\nfishing license from one permit holder (permisionario) to another.\n\n2º-That in his note,\nMr. Edwin Fallas Quirós, in order to overcome the inconsistency that has repeatedly\noccurred due to the interpretation of the amount to be applied for the transfer of fishing licenses,\nfollowing the payment of the corresponding annual fee (canon anual), takes the liberty of presenting two possible\nscenarios, as follows:\n\n1) If the fishing\nlicense for a specific vessel was paid for by permit holder \"X\"\non 03-15-2015, its validity would be: 03-15-2015 to 03-14-2016. In the event that this\nvessel is purchased by a permit holder \"Y\" and the complete documentation\nis submitted to the authorized office of INCOPESCA on 08-15-2015, its new\nvalidity would be: 08-15-2015 to 08-14-2016, with the provision that the new permit holder,\nin this case \"Y\", would be charged only for the 5 months corresponding to the period\nbetween 03-15-2016 and 08-14-2016, and not the 12 months as\nhas been customary. With this procedure, the\ndouble charge would be avoided and the license would maintain its 12-month validity.\n\n2) If the fishing\nlicense for a specific vessel was paid for by permit holder \"X\"\non 03-15-2015, its validity would be: 03-15-2015 to 03-14-2016. In the event that this\nvessel is purchased by a permit holder \"Y\" and the complete documentation\nis submitted to the authorized office of INCOPESCA on 08-15-2015, its new\nvalidity could be: 08-15-2015 to 03-14-2016, leaving the license with the same\nexpiration date, but with the provision that the new permit holder, in\nthis case \"Y\", is not charged for the fishing license, because the 12 months for which\nthe license was issued have already been paid for by permit holder \"X\" on 03-15-2015. What must be charged is a duplicate license due to a change\nof permit holder for the sum of ¢8,000.00, as established by agreement\nAJDIP-318-2014, published in La Gaceta No. 205, of Friday, 10-24-2014,\nline 23, which establishes the table of rates in force as of today's date.\nWith this procedure, the double charge would also be avoided.\n\n3) The Members of the Board of Directors estimate, in this case and in order to establish clear\nand transparent rules, that it is appropriate to establish a parameter for assessing charges adjusted to the dates, as well as a reasonable amount for cases involving\nthe issuance of licenses for the transfer of licenses duly\nauthorized by INCOPESCA.\n\n4) That along these lines and\nhaving analyzed the aforementioned proposals, they deem it pertinent to incorporate\nwithin the current Rates Agreement, an explanatory line that definitively\naddresses the establishment of the charge for the transfer of a license\nwhose annual fee has been duly paid beforehand.\n\n5) That in this\nregard, the Board Members consider that the scenario presented by Mr.\nEdwin Fallas Quirós, Administrative Director General, which best meets the\nrequirements and needs, both institutional and of the commercial fishing\nsector, is the so-called scenario 2.\n\n6) That by reason of the\nforegoing, the Board of Directors, Therefore;\n\nRESOLVES:\n\n1º-To establish that\nfor the purposes of the charge for the issuance of licenses due to the transfer of\nvessels, the expiration date of the same\nshall be maintained, as well as the deadline set for the payment of the annual fee, which must\nbe paid by the new permit holder, once the established date arrives.\n\n2º-In the case of license issuances due to transfer, only\nthe cost of issuing the new license in the name of the new\npermit holder shall be charged, for an amount equivalent to ¢8,000.00 (eight thousand colones), just\nas is established for a duplicate license or authorization, in\naccordance with item 23 of the Rates Agreement AJDIP/318-2014; as a\nconsequence, modify item 23 of Agreement AJDIP/318-2014, so that it\ncorrectly reads \"Duplicate in the name of the same permit holder or by reason\nof transfer of the fishing license or authorization\".\n\n3º-Firm Agreement.\n\n4º-Effective upon its adoption, shall be published."
