  "body_es_text": "Recuerde que Control F es una opción que le permite buscar\n                en la totalidad del texto\n\n                Ir al final del documento\n\n                    - Usted está en la última versión de la norma\n                    -\n\n                        Texto Completo Norma 39747\n\n                        Reglamento de Creación y Funcionamiento del Programa Nacional de Monitoreo\nEcológico (PRONAMEC)\n\nTexto Completo acta: 10E45F\n\nN° 39747- MINA E\n\nLA SEGUNDA VICEPRESIDENTA EN EJERCICIO DE LA PRESIDENCIA DE\n\nLA REPÚBLICA\n\nY\n\nLA MINISTRA A.I DE AMBIENTE Y ENERGÍA\n\nEn ejercicio de\nlas facultades que les confieren el artículo 50, los incisos 3) y 18) del\nartículo 140 y 146 de la Constitución Política; artículo 7 del Convenio sobre\nla Diversidad Biológica, ratificado mediante la Ley N° 7416 del 30 de junio de\n1994; artículos 25, 27 inciso 1),28 inciso 2b) de la Ley General de la\nAdministración Pública, N° 6227, del 02 de mayo de 1978; artículos 2 inciso e)\ny 46 de la Ley Orgánica del Ambiente N° 7554 del 04 de octubre de 1995,\nartículo 7 inciso i) de la Ley de Conservación de la Vida Silvestre N° 7317 del\n30 de octubre de 1992,artículos 22, 5 L y 61 de la Ley de Biodiversidad N° 7788\ndel 30 de abril de 1998; y artículo 69 del Reglamento a la Ley de\nBiodiversidad, Decreto Ejecutivo N° 34433-MINAE del 11 de marzo del 2008 y el\nDecreto N° 37658-MINAET del 29 de enero de 2013.\n\nConsiderando:\n\n1°-  Que de acuerdo con el artículo 50 de la\nConstitución Política de Costa Rica es deber del Estado garantizar el derecho\nciudadano a un ambiente sano y ecológicamente equilibrado, lo cual implica que\nel Estado debe contar con los medios y mecanismos idóneos para evaluar\nperiódicamente la situación nacional del ambiente, incluyendo los componentes\nde la biodiversidad.\n\n2°- Que el\nartículo 7 del Convenio sobre la Diversidad Biológica, ratificado mediante la\nLey N° 7416 del 30 de junio de 1994, publicada en La Gaceta N° 143 del 28 de\njulio de 1994, pide que cada Parte Contratante, en la medida de lo posible y\nsegún proceda: a) identifique los componentes de la diversidad biológica que\nsean importantes para su conservación y utilización sostenible; b) proceda,\nmediante muestreo y otras técnicas, al seguimiento de los componentes de la\ndiversidad biológica una vez identificados, prestando especial atención a los\nque requieran la adopción de medidas urgentes de conservación y a los que\nofrezcan el mayor potencial para la utilización sostenible; c) identifique los\nprocesos y categorías de actividades que tengan, o sea probable que tengan,\nefectos perjudiciales importantes en la conservación y utilización sostenible\nde la diversidad biológica y proceda, mediante muestreo y otras técnicas, al\nseguimiento de esos efectos; y d) mantenga y organice, mediante cualquier\nmecanismo, los datos derivados de las actividades de identificación y\nseguimiento anteriormente referidas.\n\n3°- Que el\nPrograma de Trabajo sobre Áreas Protegidas del Convenio sobre la Diversidad\nBiológica, adoptado por la Sétima Conferencia de las Partes Contratantes en\nfebrero de 2004 mediante la Decisión VIl/28, sugiere\nen su actividad 4.3.1 que las Partes apliquen programas nacionales y regionales\npara supervisar y evaluar la situación y tendencias de la diversidad biológica\nen los sistemas y sitios de áreas protegidas, con miras a la consecución de las\nmetas globales del Convenio.\n\n4°- Que el\nartículo 46 de la Ley Orgánica del Ambiente N° 7554 del 4 de octubre de 1995,\npublicada en La Gaceta N° 215 del 13 de noviembre de 1995, declara de interés\npúblico las actividades destinadas a conservar, mejorar y, en lo posible,\nrecuperar la diversidad biológica del territorio nacional, e indica en su\ninciso d) que deberá recurrirse al uso de la investigación y la monitoria para\ndefinir estrategias y programas de protección y manejo de los hábitat o las\nespecies,\n\n5°- Que el\nartículo 51 de la Ley de Biodiversidad N° 7788 del 30 de abril de 1998,\npublicada en La Gaceta N° 101 del 27 de mayo de 1998, establece que el\nMinisterio de Ambiente y Energía, en colaboración con otros entes públicos y\nprivados, dispondrá de un sistema de parámetros que permita la identificación\nde los ecosistemas y sus componentes, para tomar las medidas apropiadas,\nincluso la mitigación, el control, la restauración, la recuperación y la\nrehabilitación de los mismos.\n\n6°- Que el\nartículo 7, inciso i) de la Ley de Conservación de la Vida Silvestre N° 7317\nestablece como una de las funciones sustantivas del Sistema Nacional de Áreas de\nConservación crear y gestionar programas de manejo, control, vigilancia e\ninvestigación sobre la vida silvestre.\n\n7°- Que el Reglamento a la Ley de Biodiversidad. Decreto Ejecutivo N° 34433- MlNAE del 11 de marzo\nde 2008, publicado en La Gaceta N° 68 del 8 de abril de 2008, dispone en su artículo 69 y en el\ntransitorio IV que el Sistema Nacional de Áreas de Conservación establecerá, en un plazo no mayor de\nseis meses a partir de su publicación, un programa nacional de monitoreo que permita determinar el\ngrado de cumplimiento de los objetivos de creación de las áreas silvestres protegidas y de los\ncorredores biológicos que las interconectan, tanto en los aspectos de efectividad dc la gestión como\nde la integridad ecológica de sus ecosistemas.\n\n8\"- El\nDecreto Ejecutivo N° 37658-MINAET establece el Sistema Nacional de Información\nAmbiental, en adelante denominado SINlA. bajo la\nresponsabilidad del Ministerio de Ambiente y Energía, coordinado por el Centro\nNacional de Información Geo-ambiental (CENIGA), como la plataforma oficial de\ncoordinación y vinculación institucional y sectorial del Estado costarricense\npara facilitar la gestión y distribución del conocimiento de la información\nambiental nacional.\n\n9°- Que en la\ndisposición 4.3. a) del Informe DFOE-AE-IF-12-20ll, la Contraloría General de\nla República ha establecido que el Sistema Nacional de Áreas de Conservación\ndebe elaborar el programa de monitoreo que requiere el artículo 69 del\nReglamento a la Ley de Biodiversidad, de forma que incluya los indicadores necesarios,\nlas responsabilidades y deberes de las instituciones participantes, la\nperiodicidad en la emisión de los informes del estado de conservación de la\nbiodiversidad, así como las estrategias para obtener los recursos de\nimplementación.\n\nPor tanto,\n\nDecretan:\n\n\"Reglamento\nde Creación y Funcionamiento  del\nPrograma Nacional\n\nde\nMonitoreo Ecológico (PRONAMEC)\"\n\nCapítulo 1: Creación y Ámbito de Aplicación\n\nArtículo 1°-\nCréase el Programa Nacional de Monitoreo Ecológico (PRONAMEC) como un programa\ninterinstitucional adscrito al Departamento de Conservación y Uso Sostenible de\nla Biodiversidad y Servicios Ecosistémicos de la\nSecretaría Ejecutiva del Sistema Nacional de Áreas de Conservación (SINAC),\ncuyo fin es generar y difundir información científica confiable sobre el estado\nde la conservación de la biodiversidad del país y sus tendencias, que sea de\nutilidad para la toma de decisiones a escala local y nacional, en los ámbitos\nterrestre, aguas continentales y marinos.\n\n Ficha articulo\n\nArtículo 2°- \nDeclárese de interés público el Programa de Monitoreo Ecológico\n(PRONAMEC) en lo sucesivo denominado El Programa, el cual tendrá un ámbito de\naplicación nacional, pudiendo contemplar también acciones específicas en las\nescalas regional y local.\n\n Ficha articulo\n\nArtículo 3°_ Para efectos del presente decreto se\nutilizaran los siguientes acrónimos:\n\nCENIGA: Centro\nNacional de Información Geo-ambiental.\n\nCONAGEBIO:\nComisión Nacional para la Gestión de la Biodiversidad.\n\nCONAC: Consejo\nNacional de Áreas de Conservación.\n\nFONAFIFO: Fondo\nNacional de Financiamiento Forestal.\n\nMINAE: Ministerio\nde Ambiente y Energía.\n\nSINAC: Sistema\nNacional del Áreas de Conservación.\n\n Ficha articulo\n\nArtículo 4°-Los\nobjetivos específicos de El Programa serán:\n\na) Proveer\ninformación que permita evaluar y conocer el estado y tendencias de la\nbiodiversidad y la salud de los ecosistemas del país para la toma de\ndecisiones.\n\nb) Proveer\ninformación que permita evaluar el cumplimiento de los objetivos de creación,\nefectividad e integridad ecológica de las áreas silvestres protegidas del SlNAC\ny de los corredores biológicos que las interconectan.\n\nc) Generar\ninformación requerida para el desarrollo de indicadores nacionales en\nbiodiversidad. utilizados para la preparación de informes institucionales y de\npaís, e información requerida para evaluar el estado de conservación de\necosistemas y de especies amenazadas, raras o en peligro de extinción.\n\nd) Gestionar\nperiódicamente y de manera sistemática. y de conformidad con metodologías\noficiales la preparación de estadísticas sobre biodiversidad, requeridas para\nevaluar la efectividad de la gestión de aquellas instituciones que realizan\nactividades vinculadas con la conservación de la biodiversidad.\n\n Ficha articulo\n\nArtículo 5°- El\nPrograma será puesto en ejecución por el SINAC-MINAE, con la colaboración de\nFONAFIFO, CONAGEBIO y CENIGA según sus competencias legales.\n\n Ficha articulo\n\nCapítulo II: Organización\n\nArtículo 6°-EI\nPrograma contará con una estructura operativa, para su funcionamiento,\ncompuesta de las siguientes instancias:\n\na) El Comité\nDirectivo.\n\nb) La Secretaría\nTécnica.\n\nc) Foros\nInterpretativos regionales y nacional\n\nd) La Red\nNacional de Monitoreo Ecológico.\n\n Ficha articulo\n\nArtículo 7°.- Del Comité Directivo. El Comité\nDirectivo es de carácter permanente y estará conformado por el Viceministerio\nde Ambiente y los Directores Ejecutivos de SINAC, CONAGEBlO y FONAFIFO.\n\n Ficha articulo\n\nArtículo 8°.- Son funciones del Comité Directivo las\nsiguientes:\n\na) Coordinar la\nconducción general y estratégica del PRONAMEC.\n\nb) Aprobar en\nprimera instancia los informes periódicos emitidos por el PRONAMEC.\n\nc) Aprobar los informes\nanuales de labores sobre el accionar general del PRONAMEC.\n\nd) Emitir\nrecomendaciones estratégicas relativas a monitoreo, cuando sea necesario y de\nacuerdo a sus competencias, a los órganos directivos de las tres instituciones\n(CONAC, CONAGEBIO y FONAFIFO) y ante otras entidades de carácter público\nvinculadas con los procesos de toma de decisiones y formulación de política\npública sobre el manejo del territorio nacional.\n\ne) Elevar al\nConsejo Nacional Ambiental, al CONAC, a la CONAGEBIO, al FONAFIFO, y a Jerarcas\nde otras instituciones públicas, así como privadas, recomendaciones sobre\nacciones requeridas, según sus competencias, para asegurar la conservación de\nla biodiversidad en el largo plazo, y dar seguimiento a la respuesta a estas\nrecomendaciones.\n\nf) Buscar y\ncaptar recursos financieros para el fortalecimiento técnico y tecnológico de El\nPrograma, y de las capacidades de funcionarios públicos que participan en su\nimplementación y desarrollo, o de aquellos miembros de comunidades que\nparticipan en el monitoreo local en las Áreas dc Conservación.\n\n Ficha articulo\n\nArtículo 9°-EI Comité Directivo sesionará\nordinariamente una vez cada tres meses y en forma extraordinaria cuando sea\nnecesario.\n\n Ficha articulo\n\nArtículo 10°- De la Secretaría Técnica. La\nSecretaría Técnica es una instancia de gestión técnica de carácter\ninstitucional incluida dentro de la Secretaría Ejecutiva del SINAC. La Secretaria\nTécnica es de carácter permanente y cuenta con un funcionario a tiempo completo\nque funge como Coordinación del PRONAMEC, más personal de apoyo que asigne el\nSINAC. La Secretaría Técnica puede solicitar el apoyo técnico, cuando se\nrequiera, de funcionarios de la Secretaría Ejecutiva del SINAC, responsables de\ndistintos programas institucionales vinculados con el tema y de funcionarios de\nCONAGEBIO y FONAFIFO, previa coordinación con las Direcciones respectivas.\n\n Ficha articulo\n\nArtículo 11\"- La Secretaría Técnica tiene dentro\nde sus funciones las siguientes:\n\na) Acompañar al\nComité Ejecutivo en la conducción y coordinación general de El Programa, ello\nincluye aspectos técnico - científicos.\n\nb) Planificar el proceso\nde trabajo y coordinar con los Foros Interpretativos (PI).\n\nc) Convocar a las\nreuniones de los órganos del PRONAMEC, mantener un registro de sus acuerdos y\nbrindarles seguimiento.\n\nd) Promover una\nestrecha coordinación e intercambio de información, entre el Comité Ejecutivo,\nla Secretaría Técnica, Foros Interpretativos, la Red Nacional de Monitoreo\nEcológico, el CENIGA, CONAC, y con los enlaces regionales del SINAC\nresponsables del PRONAMEC en las áreas de conservación, y cuando se requiera\ncon los cuerpos técnicos de otras instituciones del MINAE. Todo con el\npropósito de obtener la información requerida, en los plazos definidos, para\npoder construir indicadores y elaborar informes con base científica rigurosa, y\npara socializar de manera oportuna requerimientos de información derivados de\ncompromisos internacionales.\n\ne) Definir con el\napoyo de los Comités Científicos de las Áreas de Conservación, el Foro\nInterpretativo Nacional y el CENIGA, las estadísticas e indicadores oficiales\nde El  Programa, y elaborar las hojas\nmetodológicas de cada indicador. Estas estadísticas e indicadores serán\nevaluados periódicamente y ajustados cada vez que se requiera.\n\nf) Contribuir en\nel análisis, discusión, intercambio y retroalimentación de la información a\npartir del conocimiento científico, la experiencia y estudios de caso\nespecificas desarrollados en campo y que servirá para la toma de decisiones\nestablecidas bajo el marco del monitoreo ecológico. Esto incluye la\nparticipación activa de diferentes sectores de la academia, instituciones\nestatales a nivel regional, organizaciones locales (municipalidades, comités de\ncorredores biológicos, organizaciones comunales, de productores) y del sector\nprivado.\n\ng) Elaborar y\nvelar porque los convenios de cooperación suscritos con instituciones y\norganizaciones relacionados con la implementación de El Programa sean renovados\noportunamente, para garantizar el continuo desempeño de El Programa.\n\nh) Coordinar el\nproceso de preparación de los informes periódicos requeridos por el país para\natender compromisos de Convenios Internacionales, y por las instituciones de\nfiscalización de la gestión institucional.\n\ni) Coordinar la\nRed Nacional de Monitoreo Ecológico.\n\nj) Aprobar\nmetodologías de trabajo, la aprobación de los años seleccionados como línea\nbase para las mediciones y los valores de los activadores (umbrales de\nrespuesta) para cada indicador, así como de las modificaciones sucesivas a los\nindicadores, protocolos y otros elementos técnico-científicos constitutivos de\nEl Programa.\n\nk) Aprobar las\nestadísticas e indicadores que serán utilizados por El Programa para cumplir\ncon sus objetivos general y específico.\n\n Ficha articulo\n\nArtículo 12°- De\nlos Foros Interpretativos. Los Foros Interpretativos son mecanismos consultivos\nad hoc, que funcionan tanto en el nivel regional como a nivel nacional.\n\nLos Comités Científico-Técnicos\nde las Áreas de Conservación, ampliados con la participación de expertos y\notros actores locales relevantes se constituirán en los Foros Interpretativos\nRegionales.\n\n Ficha articulo\n\nArtículo 13°.- La\nSecretaría Técnica en coordinación con la Dirección del Área de Conservación\nconvocarán a los responsables de los programas del área, expel10s y otros\nactores locales relevantes según lo que dispone el artículo 32° de la Ley de\nBiodiversidad N\" 7788.\n\n Ficha articulo\n\nArtículo 14°- Los\nForos Interpretativos Regionales elaborarán un plan de trabajo que incluya los\naños seleccionados como línea base para las mediciones y los valores de los\nactivadores (umbrales de respuesta) para cada indicador, así como de las\nsucesivas modificaciones a los indicadores, protocolos y otros elementos\ntécnico-científicos.\n\nSu función es\nrevisar y brindar criterio sobre metodologías, protocolos, estadísticas e\nindicadores, de tal forma que se cuente con información confiable, oportuna,\nveraz, de buena calidad y viable de generación para la toma de decisiones a\nnivel regional y local.\n\n Ficha articulo\n\nArtículo 15°- El\nForo Interpretativo Nacional será convocado por la Secretaria Técnica, al menos\nuna vez al año. Serán miembros del Foro Nacional los siguientes:\n\na) Un\nrepresentante de cada uno de los Comités Científico-Técnicos de las Áreas de Conservación\nmencionados en el artículo 12.\n\nb) Dos\nrepresentantes de la Oficina Técnica de la Comisión Nacional para la Gestión de\nla Biodiversidad.\n\nc) Dos\nrepresentantes del Fondo Nacional de Financiamiento Forestal FONAFIFO.\n\nd) Dos\nrepresentantes de las organizaciones no gubernamentales que participan en la\nRed Nacional de Monitoreo Ecológico, electos de su seno.\n\ne) Un\nrepresentante del CENIGA.\n\n Ficha articulo\n\nArtículo 16°-Las\nsiguientes son las funciones del Foro Nacional:\n\na) Conocer y\nanalizar los resultados de la aplicación periódica de los indicadores al igual\nque los alineamientos estratégicos del Comité Directivo, y las recomendaciones\ntécnicas que emanen de la Secretaría Técnica y de la Red Nacional de Monitoreo\nEcológico.\n\nb) Participar en\nel proceso de preparación de los informes periódicos sobre el estado de\nconservación de la biodiversidad nacional.\n\nc) Emitir\nrecomendaciones ante la Secretaria Ejecutiva del Sistema Nacional de Áreas de\nConservación, al Consejo Nacional de Áreas de Conservación, ante los Consejos\nRegionales de las Áreas de Conservación, ante la Comisión Nacional para la\nGestión de la Biodiversidad, la Junta Directiva de FONAFIFO y ante otras\nentidades de carácter público vinculadas con los procesos de toma de decisiones\ny formulación de política pública relativa al estado de la biodiversidad y sus\ntendencias.\n\nd) Emitir\nrecomendaciones para la conservación y utilización sostenible de los\necosistemas ubicados en terrenos privados. Para hacer llegar dichas\nrecomendaciones a los propietarios privados podrá recurrir a los medios que\njuzgue idóneos, en coordinación con el Comité Ejecutivo de El Programa.\n\n Ficha articulo\n\nArtículo 17°- La\nRed de Monitoreo Ecológico. La red es una instancia de apoyo al PRONAMEC en\ndonde participan diferentes sectores: sociedad civil (Organizaciones No\nGubernamentales y grupos locales), académicos como centros de investigación y\nuniversidades, privadas y públicas: instituciones públicas: sector privado.\nConstituye un espacio de diálogo abierto y heterogéneo sobre el tema de\nmonitoreo ecológico. La red será un mecanismo de seguimiento del Programa así\ncomo una plataforma de intercambio de recursos e información. La red será de\ncarácter permanente y quienes participen en ella será de manera voluntaria. Su\ncoordinación estará a cargo de la Secretaria Técnica.\n\n Ficha articulo\n\nArtículo\n18°.-  Las funciones de la Red de\nMonitoreo son las siguientes:\n\na) Participar\nactivamente, en el intercambio y difusión de experiencias de monitoreo\necológico en el país a nivel de metodologías, resultados, fortalezas y\ndebilidades, requerimientos técnicos, tecnológicos y costos financieros de\ndichas experiencias, así como recomendaciones para el monitoreo según las\ncompetencias legales y condiciones de la Administración Pública.\n\nb) Contribuir con\nrecomendaciones de carácter metodológico a la Secretaría Técnica, instituciones\ny organizaciones que realizan monitoreo ecológico, a partir del conocimiento\ncientífico y la experiencias locales.\n\n Ficha articulo\n\nCapítulo III: Disposiciones finales\n\nArtículo 19°- La\ninformación generada por El Programa mediante la aplicación de sus indicadores,\nserá de carácter público y de libre acceso, siempre y cuando dicha información no\nponga en riesgo actuaciones de la Administración respecto a la protección de\nespecies de vida silvestre, ni la información de personas o instituciones.\n\nEn caso de\ndenegar el acceso se emitirá un acto fundamentado sobre la denegatoria,\nconforme lo dispuesto por el artículo 274 de la Ley General de la\nAdministración Pública.\n\nEl SINAC-MINAE\ndeberá garantizar el cumplimiento de lo anterior por los medios y\nprocedimientos idóneos, incluyendo la publicación de informes periódicos sobre\nel estado de conservación de la biodiversidad nacional\n\nLos informes\nperiódicos sobre el estado de conservación de la biodiversidad nacional serán\npreparados al menos cada cuatro años, procurando que se produzcan tanto\nversiones técnicas detalladas de los mismos como versiones simplificadas y\nresumidas para los tomadores de decisión y el público en general. En dichos\ninformes se incluirá información agregada para todo el país y también\ninformación desagregada por regiones o localidades, según sea pertinente. 3) and 18) of Article 140, and 146 of the Political Constitution; Article 7 of the Convention on Biological Diversity, ratified by Law No. 7416 of June 30, 1994; Articles 25, 27 subsection 1), 28 subsection 2b) of the General Public Administration Law, No. 6227, of May 2, 1978; Articles 2 subsection e) and 46 of the Organic Environmental Law No. 7554 of October 4, 1995, Article 7 subsection i) of the Wildlife Conservation Law No. 7317 of October 30, 1992, Articles 22, 51 and 61 of the Biodiversity Law No. 7788 of April 30, 1998; and Article 69 of the Regulation to the Biodiversity Law, Executive Decree No. 34433-MINAE of March 11, 2008 and Decree No. 37658-MINAET of January 29, 2013.\n\nConsidering:\n\n1°- That according to Article 50 of the Political Constitution of Costa Rica, it is the State's duty to guarantee the citizen's right to a healthy and ecologically balanced environment, which implies that the State must have the suitable means and mechanisms to periodically evaluate the national environmental situation, including the components of biodiversity.\n\n2°- That Article 7 of the Convention on Biological Diversity, ratified by Law No. 7416 of June 30, 1994, published in La Gaceta No. 143 of July 28, 1994, requests that each Contracting Party, as far as possible and as appropriate: a) identify components of biological diversity important for its conservation and sustainable use; b) monitor, through sampling and other techniques, the components of biological diversity identified, paying particular attention to those requiring urgent conservation measures and those offering the greatest potential for sustainable use; c) identify processes and categories of activities which have or are likely to have significant adverse impacts on the conservation and sustainable use of biological diversity, and monitor their effects through sampling and other techniques; and d) maintain and organize, by any mechanism, data derived from the identification and monitoring activities referred to above.\n\n3°- That the Programme of Work on Protected Areas of the Convention on Biological Diversity, adopted by the Seventh Conference of the Contracting Parties in February 2004 through Decision VII/28, suggests in its activity 4.3.1 that Parties implement national and regional programs to monitor and evaluate the status and trends of biological diversity in protected area systems and sites, with a view to achieving the global goals of the Convention.\n\n4°- That Article 46 of the Organic Environmental Law No. 7554 of October 4, 1995, published in La Gaceta No. 215 of November 13, 1995, declares activities aimed at conserving, improving, and, as far as possible, recovering the biological diversity of the national territory to be of public interest, and indicates in its subsection d) that research and monitoring must be used to define protection and management strategies and programs for habitats or species.\n\n5°- That Article 51 of the Biodiversity Law No. 7788 of April 30, 1998, published in La Gaceta No. 101 of May 27, 1998, establishes that the Ministry of Environment and Energy, in collaboration with other public and private entities, shall have a system of parameters that allows for the identification of ecosystems and their components, in order to take appropriate measures, including mitigation, control, restoration, recovery, and rehabilitation of the same.\n\n6°- That Article 7, subsection i) of the Wildlife Conservation Law No. 7317 establishes as one of the substantive functions of the National System of Conservation Areas to create and manage programs for management, control, surveillance, and research on wildlife.\n\n7°- That the Regulation to the Biodiversity Law, Executive Decree No. 34433-MINAE of March 11, 2008, published in La Gaceta No. 68 of April 8, 2008, provides in its Article 69 and in Transitory Provision IV that the National System of Conservation Areas shall establish, within a period not exceeding six months from its publication, a national monitoring program that allows for determining the degree of compliance with the creation objectives of protected wild areas and the biological corridors that interconnect them, both in terms of management effectiveness and the ecological integrity of their ecosystems.\n\n8°- Executive Decree No. 37658-MINAET establishes the National Environmental Information System, hereinafter referred to as SINIA, under the responsibility of the Ministry of Environment and Energy, coordinated by the National Center for Geo-Environmental Information (CENIGA), as the official platform for institutional and sectoral coordination and linkage of the Costa Rican State to facilitate the management and distribution of national environmental information knowledge.\n\n9°- That in provision 4.3. a) of Report DFOE-AE-IF-12-2011, the Comptroller General of the Republic has established that the National System of Conservation Areas must develop the monitoring program required by Article 69 of the Regulation to the Biodiversity Law, in a manner that includes the necessary indicators, the responsibilities and duties of participating institutions, the periodicity for issuing reports on the state of biodiversity conservation, as well as the strategies to obtain implementation resources.\n\nTherefore,\n\nDecree:\n\n\"Regulation for the Creation and Operation of the National Program\n\nfor Ecological Monitoring (PRONAMEC)\"\n\nChapter 1: Creation and Scope of Application\n\nArticle 1°- The National Program for Ecological Monitoring (PRONAMEC) is hereby created as an inter-institutional program attached to the Department of Conservation and Sustainable Use of Biodiversity and Ecosystem Services of the Executive Secretariat of the National System of Conservation Areas (SINAC), whose purpose is to generate and disseminate reliable scientific information on the state of the country's biodiversity conservation and its trends, useful for decision-making at local and national scales, in terrestrial, continental water, and marine environments.\n\nArticle Record\n\nArticle 2°- The Ecological Monitoring Program (PRONAMEC), hereinafter referred to as the Program, is hereby declared of public interest, which shall have a national scope of application, and may also contemplate specific actions at regional and local scales.\n\nArticle Record\n\nArticle 3°- For the purposes of this decree, the following acronyms shall be used:\n\nCENIGA: National Center for Geo-Environmental Information.\n\nCONAGEBIO: National Commission for Biodiversity Management.\n\nCONAC: National Council of Conservation Areas.\n\nFONAFIFO: National Forestry Financing Fund.\n\nMINAE: Ministry of Environment and Energy.\n\nSINAC: National System of Conservation Areas.\n\nArticle Record\n\nArticle 4°- The specific objectives of the Program shall be:\n\na) To provide information that allows for evaluating and understanding the status and trends of biodiversity and the health of the country's ecosystems for decision-making.\n\nb) To provide information that allows for evaluating compliance with the creation objectives, effectiveness, and ecological integrity of SINAC's protected wild areas and the biological corridors that interconnect them.\n\nc) To generate information required for the development of national biodiversity indicators, used for the preparation of institutional and country reports, and information required to evaluate the conservation status of ecosystems and threatened, rare, or endangered species.\n\nd) To periodically and systematically manage, and in accordance with official methodologies, the preparation of biodiversity statistics required to evaluate the effectiveness of management by those institutions carrying out activities related to biodiversity conservation.\n\nArticle Record\n\nArticle 5°- The Program shall be implemented by SINAC-MINAE, with the collaboration of FONAFIFO, CONAGEBIO, and CENIGA according to their legal competencies.\n\nArticle Record\n\nChapter II: Organization\n\nArticle 6°- The Program shall have an operational structure for its functioning, composed of the following bodies:\n\na) The Steering Committee.\n\nb) The Technical Secretariat.\n\nc) Regional and National Interpretive Forums.\n\nd) The National Ecological Monitoring Network.\n\nArticle Record\n\nArticle 7°.- On the Steering Committee. The Steering Committee is permanent in nature and shall be composed of the Vice-Ministry of Environment and the Executive Directors of SINAC, CONAGEBIO, and FONAFIFO.\n\nArticle Record\n\nArticle 8°.- The functions of the Steering Committee are as follows:\n\na) To coordinate the general and strategic direction of PRONAMEC.\n\nb) To approve in the first instance the periodic reports issued by PRONAMEC.\n\nc) To approve the annual work reports on the general actions of PRONAMEC.\n\nd) To issue strategic recommendations related to monitoring, when necessary and according to their competencies, to the governing bodies of the three institutions (CONAC, CONAGEBIO, and FONAFIFO) and to other public entities linked to decision-making processes and public policy formulation on national territory management.\n\ne) To elevate to the National Environmental Council, to CONAC, to CONAGEBIO, to FONAFIFO, and to the Heads of other public institutions, as well as private ones, recommendations on actions required, according to their competencies, to ensure the long-term conservation of biodiversity, and to follow up on the response to these recommendations.\n\nf) To seek and attract financial resources for the technical and technological strengthening of the Program, and for the capacities of public officials who participate in its implementation and development, or of those community members who participate in local monitoring in the Conservation Areas.\n\nArticle Record\n\nArticle 9°- The Steering Committee shall meet ordinarily once every three months and extraordinarily when necessary.\n\nArticle Record\n\nArticle 10°- On the Technical Secretariat. The Technical Secretariat is a technical management body of an institutional nature included within the Executive Secretariat of SINAC. The Technical Secretariat is permanent in nature and has a full-time official who serves as the Coordinator of PRONAMEC, plus support staff assigned by SINAC. The Technical Secretariat may request technical support, when required, from officials of the Executive Secretariat of SINAC responsible for various institutional programs related to the topic and from officials of CONAGEBIO and FONAFIFO, upon prior coordination with the respective Directorates.\n\nArticle Record\n\nArticle 11°- The Technical Secretariat has the following functions:\n\na) To accompany the Executive Committee in the overall direction and coordination of the Program, this includes technical-scientific aspects.\n\nb) To plan the work process and coordinate with the Interpretive Forums (IF).\n\nc) To convene meetings of the PRONAMEC bodies, maintain a record of their agreements, and follow up on them.\n\nd) To promote close coordination and exchange of information among the Executive Committee, the Technical Secretariat, Interpretive Forums, the National Ecological Monitoring Network, CENIGA, CONAC, and with the SINAC regional liaisons responsible for PRONAMEC in the conservation areas, and when required, with the technical bodies of other MINAE institutions. All with the purpose of obtaining the required information, within the defined timelines, to be able to construct indicators and prepare reports with a rigorous scientific basis, and to socialize information requirements derived from international commitments in a timely manner.\n\ne) To define, with the support of the Scientific Committees of the Conservation Areas, the National Interpretive Forum, and CENIGA, the official statistics and indicators of the Program, and to prepare the methodological sheets for each indicator. These statistics and indicators will be periodically evaluated and adjusted whenever required.\n\nf) To contribute to the analysis, discussion, exchange, and feedback of information based on scientific knowledge, experience, and specific case studies developed in the field, which will support the established decision-making under the ecological monitoring framework. This includes the active participation of different sectors from academia, state institutions at the regional level, local organizations (municipalities, biological corridor committees, community organizations, producer organizations), and the private sector.\n\ng) To prepare and ensure that the cooperation agreements signed with institutions and organizations related to the implementation of the Program are renewed in a timely manner, to guarantee the continuous performance of the Program.\n\nh) To coordinate the preparation process of the periodic reports required by the country to meet commitments under International Conventions, and by oversight institutions for institutional management.\n\ni) To coordinate the National Ecological Monitoring Network.\n\nj) To approve work methodologies, the approval of the years selected as the baseline for measurements and the activator values (response thresholds) for each indicator, as well as successive modifications to the indicators, protocols, and other technical-scientific constituent elements of the Program.\n\nk) To approve the statistics and indicators that will be used by the Program to fulfill its general and specific objectives.\n\nArticle Record\n\nArticle 12°- On the Interpretive Forums. The Interpretive Forums are ad hoc consultative mechanisms, operating both at the regional and national level.\n\nThe Scientific-Technical Committees of the Conservation Areas, expanded with the participation of experts and other relevant local actors, shall constitute the Regional Interpretive Forums.\n\nArticle Record\n\nArticle 13°.- The Technical Secretariat, in coordination with the Directorate of the Conservation Area, shall convene the responsible parties for the area's programs, experts, and other relevant local actors, as provided in Article 32° of the Biodiversity Law No. 7788.\n\nArticle Record\n\nArticle 14°- The Regional Interpretive Forums shall prepare a work plan that includes the years selected as the baseline for measurements and the activator values (response thresholds) for each indicator, as well as successive modifications to the indicators, protocols, and other technical-scientific elements.\n\nTheir function is to review and provide criteria on methodologies, protocols, statistics, and indicators, in such a way that reliable, timely, truthful, good quality, and viable information is available for decision-making at the regional and local level.\n\nArticle Record\n\nArticle 15°- The National Interpretive Forum shall be convened by the Technical Secretariat, at least once a year. The following shall be members of the National Forum:\n\na) One representative from each of the Scientific-Technical Committees of the Conservation Areas mentioned in Article 12.\n\nb) Two representatives from the Technical Office of the National Commission for Biodiversity Management.\n\nc) Two representatives from the National Forestry Financing Fund, FONAFIFO.\n\nd) Two representatives from non-governmental organizations participating in the National Ecological Monitoring Network, elected from among their members.\n\ne) One representative from CENIGA.\n\nArticle Record\n\nArticle 16°- The following are the functions of the National Forum:\n\na) To review and analyze the results of the periodic application of the indicators, as well as the strategic alignments of the Steering Committee, and the technical recommendations emanating from the Technical Secretariat and the National Ecological Monitoring Network.\n\nb) To participate in the preparation process of the periodic reports on the state of national biodiversity conservation.\n\nc) To issue recommendations to the Executive Secretariat of the National System of Conservation Areas, to the National Council of Conservation Areas, to the Regional Councils of the Conservation Areas, to the National Commission for Biodiversity Management, to the Board of Directors of FONAFIFO, and to other public entities linked to the decision-making processes and public policy formulation regarding the state of biodiversity and its trends.\n\nd) To issue recommendations for the conservation and sustainable use of ecosystems located on private lands. To convey these recommendations to private landowners, it may resort to the means it deems suitable, in coordination with the Executive Committee of the Program.\n\nArticle Record\n\nArticle 17°- The Ecological Monitoring Network. The network is a support body for PRONAMEC in which different sectors participate: civil society (Non-Governmental Organizations and local groups), academics such as research centers and universities, private and public; public institutions; private sector. It constitutes an open and heterogeneous dialogue space on the topic of ecological monitoring. The network shall be a follow-up mechanism for the Program as well as a platform for the exchange of resources and information. The network shall be permanent in nature, and those who participate in it shall do so voluntarily. Its coordination shall be the responsibility of the Technical Secretariat.\n\nArticle Record\n\nArticle 18°.- The functions of the Monitoring Network are as follows:\n\na) To actively participate in the exchange and dissemination of ecological monitoring experiences in the country regarding methodologies, results, strengths and weaknesses, technical and technological requirements, and financial costs of such experiences, as well as recommendations for monitoring according to the legal competencies and conditions of the Public Administration.\n\nb) To contribute methodological recommendations to the Technical Secretariat, institutions, and organizations that carry out ecological monitoring, based on scientific knowledge and local experiences.\n\nArticle Record\n\nChapter III: Final Provisions\n\nArticle 19°- The information generated by the Program through the application of its indicators shall be public and freely accessible, provided that said information does not jeopardize Administration actions regarding the protection of wildlife species, nor the information of individuals or institutions.\n\nIn the event of denying access, a reasoned act regarding the denial shall be issued, in accordance with the provisions of Article 274 of the General Public Administration Law.\n\nSINAC-MINAE must guarantee compliance with the foregoing through suitable means and procedures, including the publication of periodic reports on the state of national biodiversity conservation.\n\nPeriodic reports on the state of national biodiversity conservation shall be prepared at least every four years, ensuring that both detailed technical versions thereof and simplified, summarized versions for decision-makers and the general public are produced. Said reports shall include aggregated information for the entire country and also disaggregated information by regions or localities, as pertinent.
