Asimismo,\nse establece que el Instituto Geográfico Nacional será la dependencia\ncientífica y técnica rectora de la cartografía nacional, destinada a la\nejecución del Mapa básico oficial y la Descripción básica geográfica de la\nRepública de Costa Rica y a los estudios, las investigaciones o labores y el\ndesarrollo de políticas nacionales de carácter cartográfico, geográfico,\ngeodésico, geofísico y de índole similar que tenga relación con dichas obras,\ncon el fin de apoyar los procesos de planificación.\n\n2º-Que\nla Ley de Creación del Instituto Geográfico Nacional, Nº 59, lo constituye de\nmanera permanente y en representación del Estado, como la autoridad oficial en\nmateria geodésica y de la representación espacial de la geografía de la\nRepública, extendiéndose su autoridad a las actividades de cualquier orden que\ntengan por origen los trabajos confiados a su cargo.\n\n3°-Que\nde conformidad con la Ley de Creación del Instituto Geográfico Nacional, Nº 59,\nen el artículos 62 del Reglamento a la Ley Nº 6043, se reconoce la competencia\ndel Instituto Geográfico Nacional para la delimitación de la zona pública de la\nZona Marítimo Terrestre, y su oficialización a través de publicación en el\nDiario Oficial La Gaceta, mientras que el artículo 63 del mismo\nReglamento, señala que \"El Instituto Geográfico Nacional deberá publicar\naviso en el Diario Oficial, de cada porción de la zona marítimo-terrestre en\nque haya demarcado la zona pública\".\n\n4°-Que\nen el Decreto Ejecutivo Nº 36642-MP-MOPT-MINAET \"Reglamento de Especificaciones\npara la Delimitación de la zona pública de la Zona Marítimo Terrestre\", se\nestablece según el artículo 18 que para la delimitación de la zona pública de\nla Zona Marítimo Terrestre, el IGN podrá acudir a dos metodologías de\nejecución, que se indican en los artículos 19 y 20, correspondientes a la\ndelimitación de la zona pública de la Zona Marítimo Terrestre a través de la\ncolocación de mojones y/o a la delimitación digital georreferenciada, esto con\nel fin de agilizar las delimitaciones y proporcionar mayor seguridad técnica a\nlos interesados.\n\n5°-Que\nen el Decreto Ejecutivo Nº 33797-MJ-MOPT, el cual entre otros aspectos\ndetermina, a la Red Geodésica Nacional de Referencia Horizontal CR05, y su\nproyección cartográfica asociada CRTM05, como el sistema oficial al cual deben\nestar referidas las coordenadas de todos los trabajos geodésicos, cartográficos\ny catastrales que se ejecuten en nuestro país, señalando específicamente en\nartículo 11 que: \"La Red Geodésica Nacional de Referencia Horizontal CR05 y\nel sistema de proyección cartográfica CRTM05, constituirán el único sistema\noficial de coordenadas para la República de Costa Rica a partir del cual se\ndebe referenciar todos los levantamientos y actividades cartográficos y\ngeodésicos que desarrollen en el Territorio Nacional toda dependencia pública,\npersona o entidad privada nacional o extranjera.\"; mientras que el artículo\n7 indica que \"Conforme se produzcan datos cartográficos en el nuevo sistema\nde proyección cartográfica CRTM05, el Instituto Geográfico Nacional publicará\npor los medios adecuados aquella información que se ha oficializado.\"\n\n6°-Que\nla georreferenciación al sistema nacional de coordenadas como mecanismo para\ndelimitar la zona pública de la Zona Marítimo Terrestre, posibilita la correcta\ndelimitación de la zona pública a los efectos de la elaboración de planes\nreguladores, el visado de planos de agrimensura, el otorgamiento de concesiones\nen la Zona Restringida y otros aspectos de ordenamiento territorial costero.\n\n7°-Que\nel Instituto Geográfico Nacional, utilizó en el cantón 02 Pococí - Likewise,\nit is established that the National Geographic Institute shall be the scientific\nand technical dependency governing national cartography, destined for the\nexecution of the official basic Map and the basic geographic Description of the\nRepublic of Costa Rica, and for the studies, investigations or labors and the\ndevelopment of national policies of a cartographic, geographic,\ngeodetic, geophysical, and similar nature related to said works,\nwith the aim of supporting planning processes.\n\n2º—That\nthe Law Creating the National Geographic Institute, No. 59, permanently constitutes it\nand in representation of the State, as the official authority in\ngeodetic matters and the spatial representation of the geography of the\nRepublic, its authority extending to activities of any order that\noriginate from the works entrusted to its charge.\n\n3°—That\nin accordance with the Law Creating the National Geographic Institute, No. 59,\nin Article 62 of the Regulations to Law No. 6043, the competence\nof the National Geographic Institute for the delimitation of the public zone of the\nMarine Terrestrial Zone, and its officialization through publication in the\nOfficial Gazette La Gaceta, is recognized, while Article 63 of the same\nRegulations states that: \"The National Geographic Institute must publish a\nnotice in the Official Gazette, for each portion of the marine-terrestrial zone in\nwhich it has demarcated the public zone.\"\n\n4°—That\nin Executive Decree No. 36642-MP-MOPT-MINAET \"Regulations for Specifications\nfor the Demarcation of the public zone of the Marine Terrestrial Zone\", it is\nestablished according to Article 18 that for the delimitation of the public zone of\nthe Marine Terrestrial Zone, the IGN may resort to two execution\nmethodologies, which are indicated in Articles 19 and 20, corresponding to the\ndemarcation of the public zone of the Marine Terrestrial Zone through the\nplacement of markers (mojones) and/or through georeferenced digital demarcation, this with\nthe aim of streamlining demarcations and providing greater technical security to\ninterested parties.\n\n5°—That\nin Executive Decree No. 33797-MJ-MOPT, which among other aspects\ndetermines the National Geodetic Network Horizontal Reference CR05, and its\nassociated cartographic projection CRTM05, as the official system to which\nthe coordinates of all geodetic, cartographic,\nand cadastral works executed in our country must be referenced, specifically stating in\nArticle 11 that: \"The National Geodetic Network Horizontal Reference CR05 and\nthe cartographic projection system CRTM05 shall constitute the only official\ncoordinate system for the Republic of Costa Rica, from which\nall cartographic and geodetic surveys and activities carried out in the National Territory by any public dependency,\nperson, or national or foreign private entity must be referenced.\"; whereas Article\n7 indicates that \"As cartographic data is produced in the new cartographic\nprojection system CRTM05, the National Geographic Institute shall publish\nby adequate means that information which has been officialized.\"\n\n6°—That\ngeoreferencing to the national coordinate system as a mechanism for\ndemarcating the public zone of the Marine Terrestrial Zone enables the correct\ndemarcation of the public zone for the purposes of elaborating regulatory\nplans, the approval (visado) of survey plans, the granting of concessions\nin the Restricted Zone (Zona Restringida), and other aspects of coastal land-use planning (ordenamiento territorial costero).\n\n7°—That\nthe National Geographic Institute used in canton 02 Pococí - province of\nLimón, the methodology of \"Georeferenced Digital Demarcation\" to demarcate\nthe public zone of the Marine Terrestrial Zone in specific coastal sectors\nwhere, to date, there is no demarcation of the public zone through the\nplacement of markers officialized via respective publication in the Official\nGazette La Gaceta.\n\n8°—That\nthe \"Georeferenced Digital Demarcation\" of the public zone of the Marine\nTerrestrial Zone of canton 02 Pococí - province of Limón, was carried out by the National Geographic\nInstitute within the framework of Public Tender No. 2013LN-000010-\n00100 denominated \"Demarcation of the public zone on the Caribbean coast of Costa\nRica.\"\n\n9°—That\nthe georeferenced digital information on the demarcation of the public zone\nof the Marine Terrestrial Zone held by the National Geographic Institute\nis called the Digital Georeferenced Geodatabase (GDG) of the National\nGeographic Institute (IGN) on the Marine Terrestrial Zone (ZMT).\n\n10.—That the Digital Georeferenced Geodatabase (GDG) of the National\nGeographic Institute (IGN) on the Marine Terrestrial Zone (ZMT) is technically\nbased on the application of the regulations established by: a) Executive\nDecree No. 7841-P \"Regulations to Law No. 6043 on the Marine Terrestrial\nZone\",\n\nb) Executive Decree No.\n33797-MJ-MOPT “Declares as the official horizontal datum for Costa Rica,\nCR05, and its associated cartographic projection, CRTM05”, and c) Executive\nDecree No. 36642-MP-MOPT-MINAET \"Regulations for Specifications for the\nDemarcation of the public zone of the Marine Terrestrial Zone.\"\n\n11.—That\nArticle 140 of Law No. 6227, the General Public Administration Act, states\nthat \"the administrative act shall produce its effect after being communicated to\nthe interested party, unless it grants only rights, in which case it\nshall produce them from the moment it is adopted,\" a provision that must necessarily\nbe related to numeral 240 of the same normative body, which defines\nthe suitable instrument for communicating acts of a generic nature by stating\nthat: \"General acts shall be communicated by publication and specific acts,\nby notification.\"\n\nCOMMUNICATES:\n\nFirst.—The National Geographic Institute used in\ncanton 02 Pococí - province of Limón, the methodology of \"Georeferenced\nDigital Demarcation\" in accordance with Executive Decree No. 36642-MP-MOPT-MINAET\n\"Regulations for Specifications for the Demarcation of the public zone of the\nMarine Terrestrial Zone\" of June 28, 2011, to demarcate the public\nzone of the Marine Terrestrial Zone, in coastal sectors where, as of\nthe signing date of this Notice, there is no demarcation of the public zone through\nthe placement of markers officialized via respective publication in the\nOfficial Gazette La Gaceta.\n\nSecond.—The public zone of the Marine Terrestrial Zone of canton 02\nPococí - province of Limón, determined by the National Geographic Institute\nthrough georeferenced digital demarcation, was carried out in 2014 and\ncorresponds to the coastal sectors whose extreme point coordinates are\nindicated below, both in the official cartographic projection system\nof Costa Rica CRTM05, as well as for reference, in the Lambert Norte projection\nof Map MBCR- 1/50,000 Tortuguero, California, and Parismina, as follows:\n\n \n\n \n\nThird.—The\ncoastal sectors of canton 02 Pococí - province of Limón, which currently\nhave demarcation of the public zone of the Marine Terrestrial Zone through\nthe placement of markers and respective publication in the Official\nGazette La Gaceta, maintain their official status.\n\nFourth.—The\nofficial technical data of the georeferenced digital demarcation of the public\nzone of the Marine Terrestrial Zone, corresponding to canton 02 Pococí -\nprovince of Limón, have been recorded in the Digital Georeferenced\nGeodatabase (GDG) of the National Geographic Institute (IGN) on the Marine\nTerrestrial Zone (ZMT), in a vector shape-format file, under the\ncodification: RN/IGNˍGDG-IGN-ZMTˍ702/ GeolíneaˍVersionˍ01ˍ04/05/2016.\n\nCurridabat, on the 20th day of the month of June 2016." }
