lo dispuesto en la Ley N° 59 de creación del\nInstituto Geográfico Nacional, la Ley N° 8905 de traslado del Instituto\nGeográfico Nacional al Registro Nacional, la Ley N° 6043 sobre la Zona Marítimo\nTerrestre, y los artículos 62 y 63 del Reglamento de la sobre la Zona Marítimo\nTerrestre, del 2 de marzo de 1977, el Instituto Geográfico Nacional,\n\nConsiderando:\n\n1°-Que mediante Ley N° 8905, se establece el Instituto\nGeográfico Nacional, como una dependencia del Registro Nacional y que la Junta\nAdministrativa del Registro Nacional administrará el presupuesto del Instituto,\nsuscribirá los contratos y convenios necesarios para el ejercicio de sus\nfunciones. Asimismo, se establece que el Instituto Geográfico Nacional será la\ndependencia científica y técnica rectora de la cartografía nacional, destinada\na la ejecución del Mapa básico oficial y la Descripción básica geográfica de la\nRepública de Costa Rica y a los estudios, las investigaciones o labores y el\ndesarrollo de políticas nacionales de carácter cartográfico, geográfico,\ngeodésico, geofísico y de índole similar que tenga relación con dichas obras,\ncon el fin de apoyar los procesos de planificación.\n\n2º-Que la Ley de Creación del Instituto Geográfico Nacional, N° 59, lo\nconstituye de manera permanente y en representación del Estado, como la\nautoridad oficial en materia geodésica y de la representación espacial de la\ngeografía de la República, extendiéndose su autoridad a las actividades de\ncualquier orden que tengan por origen los trabajos confiados a su cargo.\n\n3°-Que\nde conformidad con la Ley de Creación del Instituto Geográfico Nacional, N° 59,\nen el artículos 62 del Reglamento a la Ley N° 6043, se reconoce la competencia\ndel Instituto Geográfico Nacional para la delimitación de la zona pública de la\nZona Marítimo Terrestre, y su oficialización a través de publicación en el\nDiario Oficial La Gaceta, mientras que el artículo 63 del mismo\nReglamento, señala que \"El Instituto Geográfico Nacional deberá publicar\naviso en el Diario Oficial, de cada porción de la zona marítimo-terrestre en\nque haya demarcado la zona pública\".\n\n4°-Que\nen el Decreto Ejecutivo N° 36642-MP-MOPT-MINAET \"Reglamento de Especificaciones\npara la Delimitación de la zona pública de la Zona Marítimo Terrestre\", se\nestablece según el artículo 18 que para la delimitación de la zona pública de\nla Zona Marítimo Terrestre, el IGN podrá acudir a dos metodologías de\nejecución, que se indican en los artículos 19 y 20, correspondientes a la\ndelimitación de la zona pública de la Zona Marítimo Terrestre a través de la\ncolocación de mojones y/o a la delimitación digital georreferenciada, esto con\nel fin de agilizar las delimitaciones y proporcionar mayor seguridad técnica a\nlos interesados.\n\n5°-Que\nen el Decreto Ejecutivo N° 33797-MJ-MOPT, el cual entre otros aspectos\ndetermina, a la Red Geodésica Nacional de Referencia Horizontal CR05, y su\nproyección cartográfica asociada CRTM05, como el sistema oficial al cual deben\nestar referidas las coordenadas de todos los trabajos geodésicos, cartográficos\ny catastrales que se ejecuten en nuestro país, señalando específicamente en\nartículo 11 que: \"La Red Geodésica Nacional de Referencia Horizontal CR05 y\nel sistema de proyección cartográfica CRTM05, constituirán el único sistema\noficial de coordenadas para la República de Costa Rica a partir del cual se\ndebe referenciar todos los levantamientos y actividades cartográficos y\ngeodésicos que desarrollen en el Territorio Nacional toda dependencia pública,\npersona o entidad privada nacional o extranjera.\" mientras que el artículo 7\nindica que \"Conforme se produzcan datos cartográficos en el nuevo sistema de\nproyección cartográfica CRTM05, el Instituto Geográfico Nacional publicará por\nlos medios adecuados aquella información que se ha oficializado.\"\n\n6°-Que\nla georreferenciación al sistema nacional de coordenadas como mecanismo para\ndelimitar la zona pública de la Zona Marítimo Terrestre, posibilita la correcta\ndelimitación de la zona pública a los efectos de la elaboración de planes reguladores,\nel visado de planos de agrimensura, el otorgamiento de concesiones en la Zona\nRestringida y otros aspectos de ordenamiento territorial costero.\n\n7°-Que\nel Instituto Geográfico Nacional, utilizó en el cantón 03 Siquirres - Likewise, it is established that the Instituto Geográfico Nacional shall be the\nscientific and technical unit governing national cartography, destined\nfor the execution of the official basic map and the basic geographic description of the\nRepublic of Costa Rica and for the studies, investigations or labors and the\ndevelopment of national policies of a cartographic, geographic,\ngeodetic, geophysical, and similar nature that are related to said works,\nin order to support planning processes.\n\n2º-That the Law Creating the Instituto Geográfico Nacional, No. 59, establishes\nit permanently and in representation of the State, as the\nofficial authority in geodetic matters and the spatial representation of the\ngeography of the Republic, its authority extending to the activities of\nany order that originate from the tasks entrusted to its charge.\n\n3°-That\nin accordance with the Law Creating the Instituto Geográfico Nacional, No. 59,\nin article 62 of the Reglamento to Law No. 6043, the competence\nof the Instituto Geográfico Nacional for the delimitation of the public zone of the\nZona Marítimo Terrestre, and its officialization through publication in the\nDiario Oficial La Gaceta, is recognized, while article 63 of the same\nReglamento states that \"The Instituto Geográfico Nacional must publish a\nnotice in the Diario Oficial, for each portion of the maritime-terrestrial zone in\nwhich it has demarcated the public zone.\"\n\n4°-That\nin Executive Decree No. 36642-MP-MOPT-MINAET \"Reglamento de Especificaciones\nfor the Delimitation of the public zone of the Zona Marítimo Terrestre\", it is\nestablished according to article 18 that for the delimitation of the public zone of\nthe Zona Marítimo Terrestre, the IGN may resort to two methodologies of\nexecution, indicated in articles 19 and 20, corresponding to the\ndelimitation of the public zone of the Zona Marítimo Terrestre through the\nplacement of boundary markers (mojones) and/or through georeferenced digital delimitation, this with\nthe purpose of expediting delimitations and providing greater technical security to\ninterested parties.\n\n5°-That\nin Executive Decree No. 33797-MJ-MOPT, which among other aspects\ndetermines the Red Geodésica Nacional de Referencia Horizontal CR05, and its\nassociated cartographic projection CRTM05, as the official system to which\nthe coordinates of all geodetic, cartographic,\nand cadastral works executed in our country must be referenced, specifically indicating in\narticle 11 that: \"The Red Geodésica Nacional de Referencia Horizontal CR05 and\nthe cartographic projection system CRTM05 shall constitute the only official\ncoordinate system for the Republic of Costa Rica from which\nall cartographic and geodetic surveys and activities carried out in the National Territory by any public unit,\nperson, or national or foreign private entity must be referenced.\" while article 7\nindicates that \"As cartographic data are produced in the new\ncartographic projection system CRTM05, the Instituto Geográfico Nacional shall publish by\nadequate means that information which has been officialized.\"\n\n6°-That\ngeoreferencing to the national coordinate system as a mechanism to\ndelimit the public zone of the Zona Marítimo Terrestre enables the correct\ndelimitation of the public zone for the purposes of drafting regulatory plans (planes reguladores),\napproval of survey plans (planos de agrimensura), the granting of concessions in the Zona\nRestringida, and other aspects of coastal territorial planning (ordenamiento territorial costero).\n\n7°-That\nthe Instituto Geográfico Nacional, used in canton 03 Siquirres - province\nof Limón, the \"Georeferenced Digital Delimitation‖ methodology to\ndelimit the public zone of the Zona Marítimo Terrestre in specific coastal\nsectors, where there is to date no delimitation of the public zone through\nthe placement of boundary markers (mojones) officialized via respective publication in\nthe Diario Oficial La Gaceta\".\n\n8°-That\nthe \"Georeferenced Digital Delimitation\" of the public zone of the Zona\nMarítimo Terrestre of canton 03 Siquirres - province of Limón, the Instituto\nGeográfico Nacional carried out within the framework of Public Bid No.\n2013LN-000010- 00100 called \"Delimitation of the public zone on the Caribbean\ncoast of Costa Rica.\"\n\n9°-That\nthe georeferenced digital information on the delimitation of the public zone\nof the Zona Marítimo Terrestre held by the Instituto Geográfico Nacional,\nis called the Digital Georeferenced Geodatabase (Geodatabase Digital Georreferenciada, GDG) of the Instituto\nGeográfico Nacional (IGN) on the Zona Marítimo Terrestre (ZMT).\n\n10.-That the Digital Georeferenced Geodatabase (GDG) of the Instituto\nGeográfico Nacional (IGN) on the Zona Marítimo Terrestre (ZMT) is technically\nbased on the application of the regulation established by: a) Executive\nDecree No. 7841-P \"Reglamento a la Ley N° 6043 on the Zona Marítimo\nTerrestre\", b) Executive Decree No. 33797-MJ-MOPT \"Declares as official horizontal datum\nfor Costa Rica, CR05, and its associated cartographic projection, CRTM05\", and c) Executive Decree No. 36642-MP-MOPT-MINAET\n\"Reglamento de Especificaciones for the Delimitation of the public zone of the\nZona Marítimo Terrestre\".\n\n11.-That\narticle 140 of Law No. 6227 General de la Administración Pública states\nthat \"the administrative act shall produce its effect after being communicated to the\nadministered party, except if it grants only rights, in which case it\nshall produce it from its adoption\", a provision that must necessarily be\nrelated to numeral 204) of the same normative body, which defines\nthe ideal instrument for communicating acts of a generic nature by stating\nthat: \"General acts shall be communicated by publication and specific ones\nby notification.\"\n\nCOMMUNICATES:\n\n1º-The Instituto Geográfico Nacional, used in\ncanton 03 Siquirres - province of Limón, the \"Georeferenced Digital\nDelimitation\" methodology in accordance with Executive Decree No. 36642-MP-MOPT-MINAET\n\"Reglamento de Especificaciones for the Delimitation of the public zone of the\nZona Marítimo Terrestre\" of June 28, 2011, to delimit the public\nzone of the Zona Marítimo Terrestre, in coastal sectors where there is, as of the signing date of this\nNotice, no delimitation of the public zone through\nthe placement of boundary markers (mojones) officialized via respective publication in\nthe Diario Oficial La Gaceta.\n\n2º-The public zone of the Zona Marítimo Terrestre of canton 03 Siquirres\n- province of Limón, determined by the Instituto Geográfico Nacional with\ngeoreferenced digital delimitation, was carried out in 2014 and corresponds to\nthe coastal sectors whose extreme point coordinates are indicated\nbelow, both in the official cartographic projection system of Costa\nRica CRTM05, as well as for reference, in the Lambert Norte projection of the Mapa\nMBCR- 1/50.000 Parismina, namely:\n\n \n\n \n\n1 Orthophotos produced by the Programa de Regularización de Catastro y\nRegistro (PRCR).\n\n3º-The coastal sectors of canton 03 Siquirres - province of Limón,\nthat currently have delimitation of the public zone of the Zona Marítimo\nTerrestre through the placement of boundary markers (mojones) and respective publication in the\nDiario Oficial La Gaceta, maintain their official status.\n\n4º-The official technical data of the\ngeoreferenced digital delimitation of the public zone of the Zona Marítimo\nTerrestre, corresponding to canton 03 Siquirres - province of Limón, have\nbeen registered in the Digital Georeferenced Geodatabase (GDG) of the\nInstituto Geográfico Nacional (IGN) on the Zona Marítimo Terrestre (ZMT), in\na vector format shape file, under the coding:\nRN/IGN_GDG-IGN-ZMT_703/Geolínea_ Versión_01_04/05/2016." }
