Asimismo, se establece que el Instituto Geográfico Nacional será la\ndependencia científica y técnica rectora de la cartografía nacional, destinada\na la ejecución del Mapa básico oficial y la Descripción básica geográfica de la\nRepública de Costa Rica y a los estudios, las investigaciones o labores y el\ndesarrollo de políticas nacionales de carácter cartográfico, geográfico,\ngeodésico, geofísico y de índole similar que tenga relación con dichas obras,\ncon el fin de apoyar los procesos de planificación.\n\nII.-Que\nla Ley de Creación del Instituto Geográfico Nacional, N° 59, lo constituye de\nmanera permanente y en representación del Estado, como la autoridad oficial en\nmateria geodésica y de la representación espacial de la geografía de la\nRepública, extendiéndose su autoridad a las actividades de cualquier orden que\ntengan por origen los trabajos confiados a su cargo.\n\nIII.-Que\nde conformidad con la Ley de Creación del Instituto Geográfico Nacional, N° 59,\nen el artículos 62 del Reglamento a la Ley N° 6043, se reconoce la competencia\ndel Instituto Geográfico Nacional para la delimitación de la zona pública de la\nZona Marítimo Terrestre, y su oficialización a través de publicación en el\nDiario Oficial La Gaceta, mientras que el artículo 63 del mismo\nReglamento, señala que \"El Instituto Geográfico Nacional deberá publicar\naviso en el Diario Oficial, de cada porción de la zona marítimo-terrestre en\nque haya demarcado la zona pública\".\n\nIV.-Que\nen el Decreto Ejecutivo N° 36642-MP-MOPT-MINAET \"Reglamento de Especificaciones\npara la Delimitación de la zona pública de la Zona Marítimo Terrestre\", se\nestablece según el artículo 18 que para la delimitación de la zona pública de\nla Zona Marítimo Terrestre, el IGN podrá acudir a dos metodologías de\nejecución, que se indican en los artículos 19 y 20, correspondientes a la\ndelimitación de la zona pública de la Zona Marítimo Terrestre a través de la\ncolocación de mojones y/o a la delimitación digital georreferenciada, esto con\nel fin de agilizar las delimitaciones y proporcionar mayor seguridad técnica a\nlos interesados.\n\nV.-Que\nen el Decreto Ejecutivo N° 33797-MJ-MOPT, el cual entre otros aspectos\ndetermina, a la Red Geodésica Nacional de Referencia Horizontal CR05, y su\nproyección cartográfica asociada CRTM05, como el sistema oficial al cual deben\nestar referidas las coordenadas de todos los trabajos geodésicos, cartográficos\ny catastrales que se ejecuten en nuestro país, señalando específicamente en\nartículo 11 que: \"La Red Geodésica Nacional de Referencia Horizontal CR05 y\nel sistema de proyección cartográfica CRTM05, constituirán el único sistema\noficial de coordenadas para la República de Costa Rica a partir del cual se\ndebe referenciar todos los levantamientos y actividades cartográficos y\ngeodésicos que desarrollen en el Territorio Nacional toda dependencia pública,\npersona o entidad privada nacional o extranjera.\" ; mientras que el\nartículo 7 indica que \"Conforme se produzcan datos cartográficos en el nuevo\nsistema de proyección cartográfica CRTM05, el Instituto Geográfico Nacional\npublicará por los medios adecuados aquella información que se ha oficializado.\"\n\nVI.-Que\nla georreferenciación al sistema nacional de coordenadas como mecanismo para\ndelimitar la zona pública de la Zona Marítimo Terrestre, posibilita la correcta\ndelimitación de la zona pública a los efectos de la elaboración de planes\nreguladores, el visado de planos de agrimensura, el otorgamiento de concesiones\nen la Zona Restringida y otros aspectos de ordenamiento territorial costero.\n\nVII.-Que\nel Instituto Geográfico Nacional, utilizó en el cantón 04 Talamanca - provincia\nde Limón, la metodología de -Delimitación Digital Georreferenciada‖ para\ndelimitar la zona pública de la Zona Marítimo Terrestre en sectores costeros\nespecíficos, donde no existe a la fecha, delimitación de la zona pública a\ntravés de la colocación de mojones oficializados vía respectiva publicación en\nel Diario Oficial La Gaceta.\n\nVIII.-Que\nla \"Delimitación Digital Georreferenciada\" de la zona pública de la Zona\nMarítimo Terrestre del cantón 04 Talamanca - Likewise, it is established that the National Geographic Institute shall be the\nscientific and technical dependency governing national cartography, destined\nfor the execution of the official Basic Map and the basic geographic Description of the\nRepublic of Costa Rica and for studies, research or work and the\ndevelopment of national policies of a cartographic, geographic,\ngeodetic, geophysical, and similar nature related to said works,\nwith the purpose of supporting planning processes.\n\nII.-That\nthe Law Creating the National Geographic Institute, No. 59, establishes it permanently\nand in representation of the State, as the official authority in\ngeodetic matters and the spatial representation of the geography of the\nRepublic, its authority extending to activities of any kind that\noriginate from the works entrusted to its charge.\n\nIII.-That\nin accordance with the Law Creating the National Geographic Institute, No. 59,\nin Article 62 of the Regulations to Law No. 6043, the competence\nof the National Geographic Institute is recognized for the delimitation of the public zone of the\nMaritime-Terrestrial Zone, and its officialization through publication in the\nOfficial Gazette La Gaceta, while Article 63 of the same\nRegulations states that \"The National Geographic Institute must publish\na notice in the Official Gazette, for each portion of the maritime-terrestrial zone in\nwhich it has demarcated the public zone.\"\n\nIV.-That\nin Executive Decree No. 36642-MP-MOPT-MINAET \"Regulations of Specifications\nfor the Delimitation of the public zone of the Maritime-Terrestrial Zone\", it is\nestablished according to Article 18 that for the delimitation of the public zone of\nthe Maritime-Terrestrial Zone, the IGN may resort to two execution\nmethodologies, indicated in Articles 19 and 20, corresponding to the\ndelimitation of the public zone of the Maritime-Terrestrial Zone through the\nplacement of milestones (mojones) and/or through georeferenced digital delimitation, this with\nthe purpose of streamlining delimitations and providing greater technical security to\ninterested parties.\n\nV.-That\nin Executive Decree No. 33797-MJ-MOPT, which among other aspects\ndetermines the National Geodetic Network of Horizontal Reference CR05, and its\nassociated cartographic projection CRTM05, as the official system to which\nthe coordinates of all geodetic, cartographic\nand cadastral works executed in our country must be referenced, specifically stating in\nArticle 11 that: \"The National Geodetic Network of Horizontal Reference CR05 and\nthe CRTM05 cartographic projection system shall constitute the only official\ncoordinate system for the Republic of Costa Rica, from which\nall surveys and cartographic and\ngeodetic activities developed in the National Territory by any public agency,\nperson or private national or foreign entity must be referenced.\" ; while\nArticle 7 indicates that \"As cartographic data are produced in the new\nCRTM05 cartographic projection system, the National Geographic Institute\nshall publish by appropriate means that information which has been officialized.\"\n\nVI.-That\ngeoreferencing to the national coordinate system as a mechanism to\ndelimit the public zone of the Maritime-Terrestrial Zone enables the correct\ndelimitation of the public zone for the purposes of preparing regulatory\nplans, approving survey (agrimensura) plans, granting concessions\nin the Restricted Zone, and other aspects of coastal territorial planning (ordenamiento territorial costero).\n\nVII.-That\nthe National Geographic Institute used, in canton 04 Talamanca - province\nof Limón, the \"Georeferenced Digital Delimitation\" methodology to\ndelimit the public zone of the Maritime-Terrestrial Zone in specific coastal\nsectors, where to date there is no delimitation of the public zone through\nthe placement of official milestones (mojones) via respective publication in\nthe Official Gazette La Gaceta.\n\nVIII.-That\nthe \"Georeferenced Digital Delimitation\" of the public zone of the Maritime-Terrestrial\nZone of canton 04 Talamanca - province of Limón, was carried out by the National\nGeographic Institute within the framework of Public Tender No.\n2013LN-000010-00100 called \"Delimitation of the public zone on the Caribbean\ncoast of Costa Rica\".\n\nIX.-That\nthe georeferenced digital information on the delimitation of the public zone\nof the Maritime-Terrestrial Zone held by the National Geographic Institute\nis called the Georeferenced Digital Geodatabase (Geodatabase Digital Georreferenciada, GDG) of the National\nGeographic Institute (IGN) on the Maritime-Terrestrial Zone (ZMT).\n\nX.-That\nthe Georeferenced Digital Geodatabase (Geodatabase Digital Georreferenciada, GDG) of the National Geographic Institute\n(IGN) on the Maritime-Terrestrial Zone (ZMT) is technically based on\napplication of the regulations established by: a) Executive Decree No. 7841-P\n\"Regulations to Law No. 6043 on the Maritime-Terrestrial Zone\", b) the\nExecutive Decree No. 33797-MJ-MOPT \"Declares as official horizontal datum for\nCosta Rica, the CR05, and its associated cartographic projection, CRTM05\", and c) the\nExecutive Decree No. 36642-MP-MOPT-MINAET \"Regulations of Specifications for\nthe Delimitation of the public zone of the Maritime-Terrestrial Zone\".\n\nXI.-That Article 140 of Law\nNo. 6227, General Public Administration Act, states that \"the administrative\nact shall produce its effect after being communicated to the administered party,\nexcept if it grants only rights, in which case it shall produce it from the moment it is adopted\",\na provision that must necessarily be related to numeral 204) of the same\nregulatory body, which defines the suitable instrument for communicating acts\nof a generic nature by stating that: \"General acts shall be communicated by publication\nand specific ones by notification.\"\n\nCommunicates:\n\n1st-The National Geographic Institute used, in\ncanton 04 Talamanca -
