al Registro Nacional, la Ley N° 6043 sobre\nla Zona Marítimo Terrestre, y los artículos 62 y 63 del Reglamento de la sobre\nla Zona Marítimo Terrestre, del 2 de marzo de 1977, el Instituto Geográfico\nNacional,\n\nConsiderando:\n\nI.-Que mediante Ley N° 8905, se establece el Instituto\nGeográfico Nacional, como una dependencia del Registro Nacional y que la Junta\nAdministrativa del Registro Nacional administrará el presupuesto del Instituto,\nsuscribirá los contratos y convenios necesarios para el ejercicio de sus\nfunciones. Asimismo, se establece que el Instituto Geográfico Nacional será la\ndependencia científica y técnica rectora de la cartografía nacional, destinada\na la ejecución del Mapa básico oficial y la Descripción básica geográfica de la\nRepública de Costa Rica y a los estudios, las investigaciones o labores y el\ndesarrollo de políticas nacionales de carácter cartográfico, geográfico,\ngeodésico, geofísico y de índole similar que tenga relación con dichas obras,\ncon el fin de apoyar los procesos de planificación.\n\nII.-Que\nla Ley de Creación del Instituto Geográfico Nacional, N° 59, lo constituye de\nmanera permanente y en representación del Estado, como la autoridad oficial en\nmateria geodésica y de la representación espacial de la geografía de la\nRepública, extendiéndose su autoridad a las actividades de cualquier orden que\ntengan por origen los trabajos confiados a su cargo.\n\nIII.-Que\nde conformidad con la Ley de Creación del Instituto Geográfico Nacional, N° 59,\nen el artículos 62 del Reglamento a la Ley N° 6043, se reconoce la competencia\ndel Instituto Geográfico Nacional para la delimitación de la zona pública de la\nZona Marítimo Terrestre, y su oficialización a través de publicación en el\nDiario Oficial La Gaceta, mientras que el artículo 63 del mismo\nReglamento, señala que \"El Instituto Geográfico Nacional deberá publicar\naviso en el Diario Oficial, de cada porción de la zona marítimo-terrestre en\nque haya demarcado la zona pública.\"\n\nIV.-Que\nen el Decreto Ejecutivo No. 36642-MP-MOPT-MINAET \"Reglamento de\nEspecificaciones para la Delimitación de la zona pública de la Zona Marítimo\nTerrestre\", se establece según el artículo 18 que para la delimitación de la\nzona pública de la Zona Marítimo Terrestre, el IGN podrá acudir a dos\nmetodologías de ejecución, que se indican en los artículos 19 y 20,\ncorrespondientes a la delimitación de la zona pública de la Zona Marítimo\nTerrestre a través de la colocación de mojones y/o a la delimitación digital\ngeorreferenciada, esto con el fin de agilizar las delimitaciones y proporcionar\nmayor seguridad técnica a los interesados.\n\nV.-Que\nen el Decreto Ejecutivo No. 33797-MJ-MOPT, el cual entre otros aspectos\ndetermina, a la Red Geodésica Nacional de Referencia Horizontal CR05, y su\nproyección cartográfica asociada CRTM05, como el sistema oficial al cual deben\nestar referidas las coordenadas de todos los trabajos geodésicos, cartográficos\ny catastrales que se ejecuten en nuestro país, señalando específicamente en\nartículo 11 que: \"La Red Geodésica Nacional de Referencia Horizontal CR05 y\nel sistema de proyección cartográfica CRTM05, constituirán el único sistema\noficial de coordenadas para la República de Costa Rica a partir del cual se\ndebe referenciar todos los levantamientos y actividades cartográficos y\ngeodésicos que desarrollen en el Territorio Nacional toda dependencia pública,\npersona o entidad privada nacional o extranjera.\" ; mientras que el artículo 7\nindica que \"Conforme se produzcan datos cartográficos en el nuevo sistema de\nproyección cartográfica CRTM05, el Instituto Geográfico Nacional publicará por\nlos medios adecuados aquella información que se ha oficializado.\"\n\nVI.-Que\nla georreferenciación al sistema nacional de coordenadas como mecanismo para\ndelimitar la zona pública de la Zona Marítimo Terrestre, posibilita la correcta\ndelimitación de la zona pública a los efectos de la elaboración de planes\nreguladores, el visado de planos de agrimensura, el otorgamiento de concesiones\nen la Zona Restringida y otros aspectos de ordenamiento territorial costero.\n\nVII.-Que\nel Instituto Geográfico Nacional, utilizó en el cantón 05 Matina - provincia de\nLimón, la metodología de \"Delimitación Digital Georreferenciada\" para delimitar\nla zona pública de la Zona Marítimo Terrestre en sectores\ncosteros específicos, donde no existe a la fecha, delimitación de la zona\npública a través de la colocación de mojones oficializados vía respectiva\npublicación en el Diario Oficial La Gaceta.\n\nVIII.-Que\nla \"Delimitación Digital Georreferenciada‖ de la zona pública de la Zona\nMarítimo Terrestre del cantón 05 Matina, provincia de Limón, el Instituto\nGeográfico Nacional la realizó dentro del marco de la Licitación Pública N°\n2013LN-000010- 00100 denominada \"Delimitación de la zona pública en el litoral\nCaribe de Costa Rica\".\n\nIX.-Que\nla información digital georreferenciada sobre delimitación de la zona pública\nde la Zona Marítimo Terrestre con que cuenta el Instituto Geográfico Nacional,\nse le denomina Geodatabase Digital Georreferenciada (GDG) del Instituto\nGeográfico Nacional (IGN) sobre la Zona Marítimo Terrestre (ZMT).\n\nX.-Que\nla Geodatabase Digital Georreferenciada (GDG) del Instituto Geográfico Nacional\n(IGN) sobre la Zona Marítimo Terrestre (ZMT) se fundamenta técnicamente en\naplicación de la regulación establecida por: a) el Decreto Ejecutivo N° 7841-P\n\"Reglamento a la Ley N° 6043 sobre la Zona Marítimo Terrestre\", b) el Decreto\nEjecutivo N° 33797-MJ-MOPT \"Declara como datum horizontal oficial para Costa\nRica, el CR05, y su proyección cartográfica asociada, CRTM05\", y c) el Decreto\nEjecutivo N° 36642-MP-MOPT-MINAET \"Reglamento de Especificaciones para la\nDelimitación de la zona pública de la Zona Marítimo Terrestre\".\n\nXI.-Que\nel artículo 140 de la Ley Nº 6227 General de la Administración Pública señala\nque \"el acto administrativo producirá su efecto después de comunicado al\nadministrado, excepto si le concede únicamente derechos, en cuyo caso lo\nproducirá desde que se adopte‖, disposición que necesariamente debe\nrelacionarse con el numeral 204) del mismo cuerpo normativo, mismo que define\nel instrumento idóneo para comunicar actos de naturaleza genérica al señalar\nque: ―Se comunicaran por publicación los actos generales y por\nnotificación, los concretos\".\n\nCOMUNICA:\n\n1°-El Instituto Geográfico Nacional, utilizó en el\ncantón 05 Matina - Likewise, it is established that the Instituto Geográfico Nacional shall be the scientific and technical dependency rector of national cartography, destined for the execution of the official Basic Map and the basic geographic Description of the Republic of Costa Rica and for the studies, investigations or work and the development of national policies of a cartographic, geographic, geodetic, geophysical, and similar nature that are related to said works, with the purpose of supporting planning processes.\n\nII.- That the Law creating the Instituto Geográfico Nacional, No. 59, constitutes it permanently and on behalf of the State, as the official authority in geodetic matters and the spatial representation of the geography of the Republic, its authority extending to activities of any order that originate from the works entrusted to its charge.\n\nIII.- That in accordance with the Law creating the Instituto Geográfico Nacional, No. 59, Article 62 of the Regulation to Law No. 6043 recognizes the competence of the Instituto Geográfico Nacional for the boundary delimitation of the public zone of the Maritime Terrestrial Zone, and its officialization through publication in the Official Gazette (Diario Oficial La Gaceta), while Article 63 of the same Regulation indicates that “The Instituto Geográfico Nacional must publish a notice in the Official Gazette, for each portion of the Maritime Terrestrial Zone in which it has demarcated the public zone.”\n\nIV.- That in Executive Decree No. 36642-MP-MOPT-MINAET “Regulation of Specifications for the Delimitation of the Public Zone of the Maritime Terrestrial Zone,” it is established according to Article 18 that for the boundary delimitation of the public zone of the Maritime Terrestrial Zone, the IGN may use two execution methodologies, indicated in Articles 19 and 20, corresponding to the boundary delimitation of the public zone of the Maritime Terrestrial Zone through the placement of boundary markers (mojones) and/or georeferenced digital delimitation, this with the purpose of expediting the delimitations and providing greater technical security to interested parties.\n\nV.- That in Executive Decree No. 33797-MJ-MOPT, which among other aspects determines the National Geodetic Network of Horizontal Reference CR05, and its associated cartographic projection CRTM05, as the official system to which the coordinates of all geodetic, cartographic, and cadastral works executed in our country must be referenced, specifically indicating in Article 11 that: “The National Geodetic Network of Horizontal Reference CR05 and the cartographic projection system CRTM05 shall constitute the single official coordinate system for the Republic of Costa Rica, based on which all cartographic and geodetic surveys and activities developed within the National Territory by any public dependency, person, or private national or foreign entity must be referenced.” ; while Article 7 indicates that “As cartographic data are produced in the new cartographic projection system CRTM05, the Instituto Geográfico Nacional shall publish, through adequate means, that information which has been officialized.”\n\nVI.- That georeferencing to the national coordinate system as a mechanism to delimit the public zone of the Maritime Terrestrial Zone, enables the correct boundary delimitation of the public zone for the purposes of preparing regulatory plans (planes reguladores), the approval of surveying plans (planos de agrimensura), the granting of concessions (concesiones) in the Restricted Zone, and other aspects of coastal land-use planning (ordenamiento territorial costero).\n\nVII.- That the Instituto Geográfico Nacional, used in canton 05 Matina - province of Limón, the “Georeferenced Digital Delimitation” methodology to delimit the public zone of the Maritime Terrestrial Zone in specific coastal sectors, where to date, no boundary delimitation of the public zone exists through the placement of boundary markers officialized via respective publication in the Official Gazette.\n\nVIII.- That the “Georeferenced Digital Delimitation” of the public zone of the Maritime Terrestrial Zone of canton 05 Matina, province of Limón, was carried out by the Instituto Geográfico Nacional within the framework of Public Tender (Licitación Pública) No. 2013LN-000010-00100 named “Delimitation of the public zone on the Caribbean Coast of Costa Rica.”\n\nIX.- That the georeferenced digital information on the boundary delimitation of the public zone of the Maritime Terrestrial Zone held by the Instituto Geográfico Nacional is called the Georeferenced Digital Geodatabase (Geodatabase Digital Georreferenciada, GDG) of the Instituto Geográfico Nacional (IGN) on the Maritime Terrestrial Zone (ZMT).\n\nX.- That the Georeferenced Digital Geodatabase (GDG) of the Instituto Geográfico Nacional (IGN) on the Maritime Terrestrial Zone (ZMT) is technically based on the application of the regulation established by: a) Executive Decree No. 7841-P “Regulation to Law No. 6043 on the Maritime Terrestrial Zone,” b) Executive Decree No. 33797-MJ-MOPT “Declares the CR05 as the official horizontal datum for Costa Rica, and its associated cartographic projection, CRTM05,” and c) Executive Decree No. 36642-MP-MOPT-MINAET “Regulation of Specifications for the Delimitation of the Public Zone of the Maritime Terrestrial Zone.”\n\nXI.- That Article 140 of Law No. 6227 General Law of Public Administration indicates that “the administrative act shall produce its effect after being communicated to the administered party, except if it grants only rights, in which case it shall produce it from the moment it is adopted,” a provision that must necessarily be related to numeral 204) of the same regulatory body, which defines the suitable instrument to communicate acts of a generic nature by noting that: “General acts shall be communicated by publication, and concrete acts by notification.”\n\nCOMMUNICATES:\n\n1°- The Instituto Geográfico Nacional, used in canton 05 Matina - province of Limón, the “Georeferenced Digital Delimitation” methodology in accordance with Executive Decree No. 36642-MP-MOPT-MINAET “Regulation of Specifications for the Delimitation of the Public Zone of the Maritime Terrestrial Zone” dated June 28, 2011, to delimit the public zone of the Maritime Terrestrial Zone, in coastal sectors where, as of the signing date of this Notice, no boundary delimitation of the public zone exists through the placement of boundary markers officialized via respective publication in the Official Gazette.\n\n2°- The public zone of the Maritime Terrestrial Zone of canton 05 Matina, province of Limón, determined by the Instituto Geográfico Nacional with georeferenced digital delimitation, was carried out in 2014 and corresponds to the coastal sectors whose coordinates of extreme points are indicated below, both in the official cartographic projection system of Costa Rica CRTM05, as well as by reference, in the Lambert North projection of the MBCR-1/50,000 Parismina and Moín Map, namely:\n\n \n\n3°- The coastal sectors of canton 05 Matina, province of Limón, that currently have boundary delimitation of the public zone of the Maritime Terrestrial Zone through the placement of boundary markers and respective publication in the Official Gazette, maintain their official status.\n\n4°- The official technical data of the georeferenced digital delimitation of the public zone of the Maritime Terrestrial Zone, corresponding to canton 05 Matina, province of Limón, have been registered in the Georeferenced Digital Geodatabase (GDG) of the Instituto Geográfico Nacional (IGN) on the Maritime Terrestrial Zone (ZMT), in a vector format shape file, under the coding: RN/IGN_GDG-IGN-ZMT_705/Geolínea_ Versión_01_04/05/2016.-Curridabat, June 20, 2016." }
