Dicha gestión fue avalada mediante el oficio\nDM-369-2016, de fecha 11 de mayo del 2016, por el Ministro de Ambiente y\nEnergía.\n\n3º-Que\nel monto indicado en el considerando anterior, corresponde ser ampliado por la\nvía del Decreto Ejecutivo, y será financiado con recursos provenientes de\nsuperávit específico. Del monto indicado se usarán ¢3.000.000,00 (tres millones\nde colones exactos) para ajustar el pago de aguinaldo y del salario escolar del\nperiodo 2016; ¢64.872.842,00 (sesenta y cuatro millones ochocientos setenta y\ndos mil ochocientos cuarenta y dos colones exactos) para ajustar las\nsubpartidas correspondientes y cubrir gastos por alquiler de edificio, servicio\nde agua y alcantarillado del periodo que va de junio a diciembre del 2016,\nservicio de energía eléctrica del periodo que va de junio a diciembre del 2016,\nservicio de telecomunicaciones del periodo que va de junio a diciembre del\n2016, servicio de publicación en La Gaceta del periodo que va de junio a\ndiciembre del 2016, pago de la elaboración de folletos y similares del periodo\nque va de junio a diciembre del 2016, servicios de grúa, compra y renovación de\nfirmas digitales, contrato de vigilancia, mantenimiento de jardines, limpieza\nde oficinas, pago al Ministerio de Hacienda de resolución administrativa por\nreajustes de precios a la empresa Asira Sociedad Anónima, gastos en giras,\ntransporte, y viáticos en las giras del periodo que va de junio a diciembre del\n2016, pago de pasajes, hospedaje y alimentación para viaje a Corea a la\nConferencia de las Partes del Convenio de Diversidad Biológica, mantenimiento y\nreparación de vehículos y revisión técnica vehicular, mantenimiento de la\ncentral telefónica de la Oficina Técnica, mantenimiento del equipo de\nfotocopiado y aire acondicionado, y mantenimiento de computadoras, servidor,\nimpresoras y bases de datos de la Oficina Técnica del periodo que va de junio a\ndiciembre del 2016; y ¢5.500.000,00 (cinco millones quinientos mil colones\nexactos) para pago de combustibles y lubricantes para giras del periodo que va\nde junio a diciembre del 2016, compra de tintas y tóner para el periodo que va\nde junio a diciembre del 2016, alimentación en sesiones de la Comisión\nPlenaria, talleres y reuniones de trabajo, compra de materiales y productos\neléctricos y telefónicos, útiles y materiales de oficina y cómputo, productos\nde papel, cartón e impresos, y útiles y materiales de limpieza para el periodo\nque va de junio a diciembre del 2016.\n\n4º-Que\nmediante el Decreto Ejecutivo Nº 38915-H, publicado en La Gaceta Nº 61\ndel 27 de marzo del 2015 y sus reformas, Directrices Generales de Política\nPresupuestaria, Salarial, Empleo, Inversión y Endeudamiento para entidades\npúblicas, ministerios y órganos desconcentrados, según corresponda, cubiertos\npor el ámbito de la Autoridad Presupuestaria, para el año 2016, se estableció\nen el artículo 5º, que el gasto presupuestario de las entidades públicas y\nórganos desconcentrados para el año 2016, no podrá exceder el monto incorporado\nen el presupuesto ordinario 2015, deduciendo los gastos no recurrentes, siempre\ny cuando no correspondan a proyectos de inversión plurianuales, así como las\ntransferencias que deban realizar por mandato de ley. En correspondencia con\ndicha disposición, el monto de gasto presupuestario máximo para el año 2016\nresultante para la Comisión Nacional para la Gestión de la Biodiversidad, fue\nestablecido en la suma de ¢183.418.708,00 (ciento ochenta y tres millones\ncuatrocientos dieciocho mil setecientos ocho colones exactos), el cual fue\ncomunicado mediante el oficio STAP- 0627-2015 del 28 de abril del 2015; cifra\nque no contempla el gasto indicado previamente en este decreto.\n\n5º-Que\nmediante el Decreto Ejecutivo Nº 32452-H, publicado en La Gaceta Nº 130\nde 06 de julio del 2005 y sus reformas, se emite el \"Lineamiento para la\naplicación del artículo 6º de la Ley Nº 8131 de la Administración Financiera de\nla República y Presupuestos Públicos y la regulación de la clase de ingresos\ndel Sector Público denominada Financiamiento\".\n\n6º-Que\nen relación con el superávit específico, el numeral 9º del referido Decreto\nEjecutivo Nº 32452-H, posibilita la utilización de éste, para el pago de gastos\ndefinidos en los fines establecidos en las disposiciones especiales o legales\naplicables a tales recursos.\n\n7º-Que\npor lo anterior, resulta necesario ampliar el gasto presupuestario máximo\nfijado a la Comisión Nacional para la Gestión de la Biodiversidad para el año\n2016, incrementándolo en la suma de ¢73.372.842,00 (setenta y tres millones\ntrescientos setenta y dos mil ochocientos cuarenta y dos colones exactos).   "body_en_text": "in the entirety of the text\n\n                    -\n\n                        Full Text of Norm 39828\n\n                        Increases for the National Commission for Biodiversity Management, the\nmaximum budget expenditure for the year 2016\n\nFull Text of record: 10EB6D\n\nNº 39828-H\n\nTHE PRESIDENT OF THE REPUBLIC\n\nAND THE MINISTER OF FINANCE\n\nPursuant to articles 140 subsections 3) and 18), and 146 of the Political Constitution; articles 25 subsection 1), 27 subsection 1), and 28 subsection 2) sub-item b) of Law Nº 6227, General Law of Public Administration of May 2, 1978, and its amendments; Law Nº 8131, Law of the Financial Administration of the Republic and Public Budgets of September 18, 2001, and its amendments; its Regulation, Executive Decree Nº 32988-H-MP-PLAN of January 31, 2006, and its amendments; Law Nº 7788, Biodiversity Law of April 30, 1998, and its amendments; Executive Decree Nº 32452-H of June 29, 2005, and its amendments; and Executive Decree Nº 38915-H, General Guidelines for Budget, Salary, Employment, Investment, and Indebtedness Policy for public entities, ministries, and decentralized bodies, as applicable, covered by the scope of the Budget Authority, for the year 2016, of March 13, 2015, and its amendments.\n\nConsidering:\n\n1º-That through Law Nº 7788, published in La Gaceta Nº 101 of May 27, 1998, and its amendments, the National Commission for Biodiversity Management (CONAGEBIO) was created, as a decentralized body of the Ministry of Environment and Energy, to perform functions related to the conservation, ecologically sustainable use, and restoration of biodiversity.\n\n2º-That through official communication identified as OT-127-2016 of May 11, 2016, the Executive Director of the National Commission for Biodiversity Management requested the increase of said body's maximum budget expenditure for the year 2016, in the amount of ¢73,372,842.00 (seventy-three million three hundred seventy-two thousand eight hundred forty-two colones exactly), since the amount set as the budget limit proved insufficient to meet the objectives proposed for that period. Said request was endorsed via official communication DM-369-2016, dated May 11, 2016, by the Minister of Environment and Energy.\n\n3º-That the amount indicated in the preceding considering clause is to be increased by way of Executive Decree, and will be financed with resources from specific surplus (superávit específico). Of the indicated amount, ¢3,000,000.00 (three million colones exactly) will be used to adjust the payment of the Christmas bonus (aguinaldo) and the school salary bonus for the 2016 period; ¢64,872,842.00 (sixty-four million eight hundred seventy-two thousand eight hundred forty-two colones exactly) to adjust the corresponding sub-items and cover expenses for building rental, water and sewer service for the period from June to December 2016, electric power service for the period from June to December 2016, telecommunications service for the period from June to December 2016, publication service in La Gaceta for the period from June to December 2016, payment for the preparation of pamphlets and similar materials for the period from June to December 2016, crane services, purchase and renewal of digital signatures, security contract, garden maintenance, office cleaning, payment to the Ministry of Finance of an administrative resolution for price adjustments to the company Asira Sociedad Anónima, expenses for field trips (giras), transportation, and per diems (viáticos) on field trips for the period from June to December 2016, payment for tickets, lodging, and meals for travel to Korea for the Conference of the Parties to the Convention on Biological Diversity, maintenance and repair of vehicles and mandatory vehicle inspection (revisión técnica vehicular), maintenance of the Technical Office's telephone exchange, maintenance of photocopying and air conditioning equipment, and maintenance of computers, server, printers, and databases of the Technical Office for the period from June to December 2016; and ¢5,500,000.00 (five million five hundred thousand colones exactly) for payment of fuels and lubricants for field trips for the period from June to December 2016, purchase of inks and toner for the period from June to December 2016, meals for sessions of the Plenary Commission, workshops, and work meetings, purchase of electrical and telephone materials and products, office and computing supplies and materials, paper, cardboard, and printed products, and cleaning supplies and materials for the period from June to December 2016.\n\n4º-That through Executive Decree Nº 38915-H, published in La Gaceta Nº 61 of March 27, 2015, and its amendments, General Guidelines for Budget, Salary, Employment, Investment, and Indebtedness Policy for public entities, ministries, and decentralized bodies, as applicable, covered by the scope of the Budget Authority, for the year 2016, it was established in Article 5 that the budget expenditure of public entities and decentralized bodies for the year 2016 may not exceed the amount incorporated in the ordinary budget for 2015, deducting non-recurring expenses, provided they do not correspond to multi-year investment projects, as well as transfers that must be made by legal mandate. In accordance with said provision, the maximum budget expenditure amount for the year 2016 resulting for the National Commission for Biodiversity Management was established at the sum of ¢183,418,708.00 (one hundred eighty-three million four hundred eighteen thousand seven hundred eight colones exactly), which was communicated through official communication STAP-0627-2015 of April 28, 2015; a figure that does not include the expenditure previously indicated in this decree.\n\n5º-That through Executive Decree Nº 32452-H, published in La Gaceta Nº 130 of July 6, 2005, and its amendments, the \"Guideline for the application of Article 6 of Law Nº 8131 of the Financial Administration of the Republic and Public Budgets and the regulation of the class of income of the Public Sector called Financing\" was issued.\n\n6º-That in relation to specific surplus (superávit específico), numeral 9 of the referenced Executive Decree Nº 32452-H enables its use for the payment of expenses defined within the purposes established in the special or legal provisions applicable to such resources.\n\n7º-That due to the foregoing, it is necessary to increase the maximum budget expenditure set for the National Commission for Biodiversity Management for the year 2016, by the sum of ¢73,372,842.00 (seventy-three million three hundred seventy-two thousand eight hundred forty-two colones exactly).
