las disposiciones establecidas en de Creación del INCOPESCA, Ley\nN° 7384, en concordancia con la Ley de Pesca y Acuicultura, Ley N° 8436, el\nINCOPESCA tiene competencia y facultad legal para normar lo concerniente al\naprovechamiento, explotación y comercialización de los recursos pesqueros, el\notorgamiento de los permisos de pesca, construcción de embarcaciones y permisos\nde inactividad.\n\n2º-Que al amparo\nde esa potestad legal se han adoptado a lo, largo del tiempo una serie de\nacuerdos que regulan el otorgamiento de permisos de inactividad, como política\npara garantizar una adecuada y racional explotación de los recursos pesqueros y\nun óptimo rendimiento de las actividades pesqueras, así como para otorgar al\npermisionario de las licencias de pesca comercial, garantía de poder afrontar\nsituaciones imprevistas, difíciles o producto de acciones de fuerza mayor o\ncaso fortuito que pongan en peligro su patrimonio o el medio para realizar las\nacciones de pesca para las cuales se encuentra debidamente autorizado.\n\n3º-Que a efecto\nde lograr una mayor y mejor aplicación y comprensión de la figura de la\ninactividad de embarcaciones, se ha estimado oportuno y conveniente regular\nesta situación de manera que su interpretación y aplicación sean acordes con\nlos principios de fomento y desarrollo de la actividad pesquera y protección de\nlos recursos pesqueros y acuícola, en franco asocio con criterios técnicos,\ncientíficos, económicos y sociales.\n\n4º-Que bajo esa\npremisa, consideran los Sres. Directivos que resulta procedente establecer con\nclaridad meridiana la uniformidad de la reglamentación para el otorgamiento de\npermisos de inactividad para las licencias de pesca de embarcaciones de la\nflota pesquera nacional con fines comerciales, reafirmando asimismo, los\nconceptos de motivación sobre la base de la cual podrá invocarse la aplicación\nde períodos de inactividad por parte de los permisionarios; sean éstas\ncondiciones de índole técnico, científico, económico y social, entre los que se\ndestaca en éste último apartado, la posibilidad de solicitar inactividades en\naquellos casos en los cuales existan deudas con la seguridad social que impidan\nla renovación de las licencias de pesca, hasta tanto no se allegue, demuestre y\nacredite un arreglo o la cancelación definitiva de la deuda debidamente\ndemostradas, razón por la cual la Junta Directiva, Por tanto,\n\nACUERDA:\n\n1º-Establecer el\nReglamento para el Otorgamiento de Permisos de Inactividad para Licencias de\nPesca de embarcaciones de la Flota Pesquera Nacional con Fines comerciales,\nbajo las siguientes condiciones:\n\nREGLAMENTO\nPARA EL OTORGAMIENTO DE PERMISOS\n\nDE\nINACTIVIDAD PARA LICENCIAS DE PESCA\n\nDE\nEMBARCACIONES DE LA FLOTA\n\nPESQUERA\nNACIONAL CON FINES\n\nCOMERCIALES\n\n1º-Definición de\ninactividad de licencia de pesca. faenas de pesca.\n\n5º-Vencido el\ntérmino permitido de la inactividad según se hubiere concedido al interesado y\nno se reactiva la licencia de pesca por un plazo no menor de un año el permiso\no licencia de pesca caducará de pleno derecho y el Instituto procederá a su\ncancelación administrativa.\n\n6º-El\npermisionario al que se le hubiere otorgado permiso de inactividad de la\nlicencia de (Agreement AJDIP/146-2016)\n\nFull Text of Minutes: 10ECCC\n\nCOSTA RICAN INSTITUTE\nOF FISHERIES\n\nAND\nAQUACULTURE\n\nAJDIP/146-2016.-Puntarenas,\non the fourteenth day of April, two thousand sixteen.\n\nConsidering:\n\nI.-That in accordance with the provisions established in the Creation Law of INCOPESCA, Law No. 7384, in conjunction with the Fisheries and Aquaculture Law, Law No. 8436, INCOPESCA has the legal competence and authority to regulate matters concerning the use, exploitation, and commercialization of fishery resources, the granting of fishing permits, vessel construction, and inactivity permits.\n\nII.-That under this legal authority, a series of agreements have been adopted over time that regulate the granting of inactivity permits, as a policy to guarantee an adequate and rational exploitation of fishery resources and optimal performance of fishing activities, as well as to grant the permit holder of commercial fishing licenses the guarantee of being able to face unforeseen, difficult situations, or those resulting from force majeure or fortuitous events that endanger their assets or the means to carry out the fishing activities for which they are duly authorized.\n\nIII.-That in order to achieve a greater and better application and understanding of the concept of vessel inactivity, it has been deemed opportune and convenient to regulate this situation so that its interpretation and application are consistent with the principles of promotion and development of fishing activity and protection of fishery and aquaculture resources, in close association with technical, scientific, economic, and social criteria.\n\nIV.-That under this premise, the Members of the Board of Directors consider that it is appropriate to establish with utmost clarity the uniformity of the regulations for the granting of inactivity permits for fishing licenses of vessels of the national fishing fleet for commercial purposes, also reaffirming the concepts of justification on the basis of which the application of inactivity periods by permit holders may be invoked; whether these are conditions of a technical, scientific, economic, or social nature, among which the latter category highlights the possibility of requesting inactivity in those cases where there are debts with the social security system that prevent the renewal of fishing licenses, until an arrangement or the definitive cancellation of the debt is provided, demonstrated, and duly accredited, reason for which the Board of Directors, Therefore,\n\nAGREES:\n\n1.-To establish the Regulation for the Granting of Inactivity Permits for Fishing Licenses of Vessels of the National Fishing Fleet for Commercial Purposes, under the following conditions:\n\nREGULATION\nFOR THE GRANTING OF INACTIVITY PERMITS\n\nFOR\nFISHING LICENSES\n\nOF\nVESSELS OF THE NATIONAL\n\nFISHING FLEET\nFOR COMMERCIAL\n\nPURPOSES\n\n1.-Definition of fishing license inactivity. Fishing license inactivity is that special condition in which the active administration authorizes the administered party not to make effective use of their fishing permit for a determined period, thereby preventing the cancellation of the fishing license or permit, without prejudice to the rights and obligations imposed by the respective fishing license, with the fishing license remaining in force.\n\n2.-Regarding the request for fishing license inactivity. When the owner of a national vessel with a current fishing license, before the expiration of the commercial fishing license, requires an inactivity period for their vessel of more than sixty business days, whether for reasons of repair, replacement, casualty, accidents, low profitability in the production or extraction of fishery resources, or others such as duly verified debts with the Social Security system, INCOPESCA, through the Head of the Protection and Registry Department, the Regional Directors, the Heads of Regional Offices, and Heads of Auxiliary Offices, may grant, upon prior assessment of the respective application that the interested party must submit and in which they will set forth the reasons for their request, the respective justification or proof, and a place for receiving notifications or a fax number to receive them, an initial inactivity permit for a maximum period of one calendar year counted from the date of issuance of the respective authorization by said Department, Directorate, or Office, which shall be communicated immediately to the interested party; in any case, the authorization shall enter into force from the moment it is duly notified to the applicant.\n\n3.-The term of the granted fishing license inactivity permit may be extended for annual periods up to a maximum of nine extensions, by the aforementioned administrative units.\n\n4.-In the case of inactivity granted due to low profitability in the extraction or production of fishery resources, the permit holder must annually provide the documentation certifying such condition, and it must also be verified that the vessel is maintained in conditions suitable for carrying out fishing tasks.\n\n5.-Once the allowed inactivity term has expired as granted to the interested party and the fishing license is not reactivated for a period of no less than one year, the fishing permit or license shall expire ipso jure and the Institute shall proceed with its administrative cancellation.\n\n6.-The permit holder to whom a fishing license inactivity permit has been granted may, at any time during its validity, notify INCOPESCA in writing of the resumption of their fishing activities or tasks, in which case the granted term and the inactivity shall cease ipso jure.\n\n7.-During the validity of the inactivity permit, the permit holder may not carry out fishing tasks; otherwise, and through the respective procedure, they may be subject to the corresponding administrative sanctions.\n\n8.-The Protection and Registry Department and the Heads of the Regional Directorates and Offices shall permanently provide the Fuel Control and Administration Section with the pertinent information on the inactivity permits granted to the Institute for the purposes of controlling said benefit.\n\n9.-Interested parties may appeal before the competent body in accordance with the law, against resolutions that deny the requested inactivity procedure, on grounds of legality or appropriateness, and the pertinent appeal must be filed within a term of three business days, counted from the notification of the act of denial.\n\n10.-Those who enjoy inactivity permits must keep the fee corresponding to the fishing license up to date, even though they are not carrying out fishing work.\n\n11.-Repeal. Agreements AJDIP/569-2007 and AJDIP/388-2010 are hereby repealed, as well as any legal provision of equal or lesser rank that opposes it.\n\n12.-Let it be published." }
