del acuerdo N° AJDIP/166-2017 del 21 de abril del\n2017, \"Regulación para el cumplimiento del servicio de trabajo comunal por\nparte del pescador inscrito en veda\")\n\nAJDIP/169-2016.-Puntarenas, a los diecinueve días del mes de mayo de dos\nmil dieciséis.\n\nConsiderando:\n\n1º-Que habiéndose recibido presentación del Informe sobre lo acontecido\nen el Veda 2016 hasta el momento, así como lo concerniente al acerca del\nservicio de trabajo comunal, que conforme al Acuerdo de Junta Directiva\nAJDIP/417-2005 y su modificación AJDIP/244-2012, están obligados a prestar\naquellos permisionarios beneficiados a través de la asistencia económica\notorgada por el IMAS con motivo del establecimiento de veda en el Golfo de\nNicoya, se han tenido algunas inconsistencias en cuanto a la aplicación de los\nalcances del artículo 3°, del Acuerdo AJDIP/417-2005, en razón de las\njustificaciones aportadas por los pescadores, con motivo de actividades diversas\nrealizadas, tales como asistencias a centros de salud, educativos y otros, lo\ncual afecta considerablemente la realización del trabajo comunal.\n\n2º-Que en ese mismo sentido, los Sres. Marvin Mora Hernández, Director\nGeneral de Organizaciones Pesqueras y Acuícolas y Jorge López Romero, Jefe del\nDepartamento de Extensión y Capacitación, presentan una propuesta de\nmodificación al Acuerdo AJDIP/417-2005, a efecto que se adicione un artículo\ncon el propósito de que se pueda normar y regular aquella documentación de\nsirve de respaldo para la justificación de la ausencia de un pescador en el\ncumplimiento de su Servicio de Trabajo Comunal, de conformidad con la\nprogramación debidamente acordada.\n\n3º-Que señalan los proponentes que éste tipo de medidas viene a reforzar\nel compromiso adquirido por los pescadores beneficiarios de la asistencia\neconómica dispensada por el IMAS, conforme a la Ley 8436, garantizando el\nefectivo cumplimiento de los fines y objetivos trazados para la obtención de\nesa asistencia.\n\n4º-Que en ese sentido, consideran los Sres. Directores que resulta\nconveniente y de cara a la transparencia que debe dejar patente sobre el doble\nbeneficio que significa el establecimiento de períodos de veda en el Golfo de\nNicoya; sea en primera instancia la recuperación del recurso o biomasa\npesquera, y por otro lado el impacto que representa para las comunidades de\npescadores el aporte al desarrollo comunal la concreción y cumplimiento\nefectivo del plan que sobre trabajo comunal se comprometen los permisionarios de\nuna licencia de pesca artesanal el pequeña escala, durante esos períodos de\nveda.\n\n5º-Que asimismo, es igualmente conveniente para la implementación de la\nmodificación que se presenta, el establecimiento de una Comisión\nInterinstitucional que sea la que se encargue de valorar aquellas\njustificaciones presentadas por los beneficiarios de la asistencia económica, a\nla que le corresponderá por derecho propio aceptar o denegar las mismas, así\ncomo ordenar al permisionario-beneficiario, el cumplimiento de las horas de\ntrabajo comunal no realizadas con motivo de la justificación que se aporta.\n\n6º-Que habiéndose analizado con propiedad la propuesta presentada,\nestiman los Sres. Marvin Mora Hernández, Director General of Fishing and Aquaculture Organizations, and Jorge López Romero, Head of the Department of Extension and Training, present a proposed amendment to Agreement AJDIP/417-2005, in order to add an article with the purpose of being able to regulate and govern the documentation that serves as support for justifying a fisher's absence from fulfilling their Community Work Service, in accordance with the duly agreed-upon schedule.\n\n3°-That the proponents indicate that these types of measures reinforce the commitment acquired by the fishers benefiting from the economic assistance dispensed by the IMAS, in accordance with Ley 8436, guaranteeing the effective fulfillment of the purposes and objectives set for obtaining that assistance.\n\n4°-That in this sense, the Directors consider that it is convenient, and in the interest of the transparency that must be evident regarding the double benefit represented by the establishment of closed season periods in the Golfo de Nicoya; namely, firstly, the recovery of the fishery resource or biomass, and, secondly, the impact that the contribution to community development represents for fishing communities through the realization and effective fulfillment of the community work plan to which the small-scale artisanal fishing license permit holders commit during those closed season periods.\n\n5°-That likewise, it is equally convenient for the implementation of the proposed amendment to establish an Inter-institutional Commission responsible for evaluating those justifications submitted by recipients of the economic assistance, which shall have the inherent authority to accept or deny them, as well as to order the permit holder-beneficiary to fulfill the community work hours not performed due to the justification provided.\n\n6°-That having thoroughly analyzed the proposal presented, the Directors consider that it contributes to greater clarity in fulfilling the purposes and objectives set out in the Community Work Service, regulated by the aforementioned Agreements, for which reason, the Board of Directors, Therefore;\n\nAGREES:\n\n1°-To add an article 7° (bis) to Agreement AJDIP/417-2005 of August 18, 2005, published in La Gaceta N° 172 of September 7, 2005, which will regulate and govern, for the purpose of effective fulfillment of the Community Work Service, the type of documents that INCOPESCA will accept as justification for the partial or total completion of said requirement; said article shall provide:\n\nArticle 7° (bis).-Only Medical Opinions, Disability Certificates, or Medical Attendance Records shall be considered valid justifications for absence from and non-compliance with the Community Work Service; in this last case, whether for the individual or for accompanying minors or older adults under the interested party's care, issued in all described cases by an authority of the Caja Costarricense de Seguro Social.\n\nIn those cases involving training (courses, workshops, etc.), only those provided by a public entity shall be permitted, but prior to their execution, they must be evaluated and approved by the Department of Extension and Training.\n\nDuring supervisions carried out by Incopesca or by IMAS, if the fisher is not present during the hours they previously scheduled for fulfilling their Community Work Service, it shall be interpreted as an absence unless the interested party presents a justification that complies with the provisions established in the first paragraph.\n\nAny other type of justification different from those indicated above must be analyzed by the STC Evaluation Commission, which shall, in turn, have the authority to order the interested party to complete the unfulfilled hours.\n\nSaid STC Evaluation Commission shall be composed of three INCOPESCA officials appointed by the Executive Presidency and two IMAS officials appointed by the Authorities of that Entity.\n\n2°-Firm Agreement.\n\n3°-Effective from its publication." }
