C-11-03, adoptada en la\n82° Reunión de esa Comisión, la cual se vuelve vinculante para nuestro país.\n\n2º-Que dicha propuesta señala que la Comisión Interamericana del Atún\nTropical en su 82ª Reunión, celebrada del 4 al 8 de julio de 2011 aprobó la\nResolución C-11-03 mediante la cual se prohíbe la pesca sobre boyas de datos.\n\n3º-Que conscientes de que muchas naciones, incluidos Miembros de la\nComisión, operan y emplazan boyas de datos por todo el Océano Pacífico oriental\ny los océanos del mundo para obtener información usada para generar mejores pronósticos\nmeteorológicos y marinos, brindar ayuda a la pesca mediante la generación de\ndatos sobre temperaturas oceánicas superficiales y subsuperficiales, ayudar\nesfuerzos de búsqueda y rescate en el mar, y obtener datos críticos para la\ninvestigación de temas meteorológicos y oceanográficos y predicción climática;\n\n4º-Que sabiendo que especies altamente migratorias, en particular los\natunes, se agregan cerca de boyas de datos;\n\n5º-Que la Organización Meteorológica Mundial y la Comisión Oceanográfica\nIntergubernamental han determinado que el vandalismo y daños a las boyas de\ndatos por buques pesqueros constituyen un problema importante en el Océano\nPacífico y en todo el mundo;\n\n6º-Que el vandalismo o daño a las boyas de datos resulta en una pérdida\nimportante de datos críticos para la predicción del tiempo, el estudio de\ncondiciones marinas, avisos de tsunamis, y el apoyo de esfuerzos de búsqueda y\nrescate en el mar, y que los Miembros de la Comisión gastan time y recursos\nconsiderables en localizar, reemplazar, y reparar boyas de datos dañadas o\npérdidas debido a actividades de pesca o vandalismo;\n\n7º-Que la pérdida de datos críticos para el estudio de las condiciones\nmarinas debido al vandalismo o daño a las boyas de datos menoscaba los análisis\npor los científicos de la CIAT que buscan mejorar los conocimientos del uso de\nhábitat de los atunes y las relaciones entre el clima y el reclutamiento de los\natunes, y la investigación por científicos ambientales en general; y\n\n8º-Que embarcaciones pesqueras costarricenses han sido detectadas\nhaciendo pesca sobre boyas o las han utilizado para amarrarse a ellas e incluso\nse ha presentado al menos un caso en que se ha tenido que recoger una boya de\ndatos en Puntarenas.\n\n9º-Que las resoluciones de la CIAT son vinculantes para Costa Rica y que\npor lo tanto se debe ir homologando dichas resoluciones a la normativa\nnacional; la Junta Directiva. Por tanto,\n\nACUERDA:\n\n1º-Prohibir a las embarcaciones pesqueras de bandera nacional\ninteractuar con boyas de datos en el Área de la Convención de Antigua (Océano\nPacífico Oriental). Las interacciones incluyen, pero no se limitan a, cercar la\nboya con el arte de pesca, amarrar o sujetar al buque, o cualquier parte o\nporción de la embarcación a una boya de datos o cortar su cable de ancla.\n\n2º-Prohibir a los buques pesqueros nacionales o de bandera extranjera\ncon licencia de pesca de Costa Rica calar sus artes de pesca en un área que\neste a menos de una milla náutica de distancia de una boya de datos anclada en\nel área de la Convención de Antigua.\n\n3º-Prohibir a las embarcaciones pesqueras subir a bordo una boya de\ndatos, a menos que una Parte Contratante o el propietario responsable de esa\nboya lo autorice o solicite específicamente.\n\n4º-Las embarcaciones pesqueras deberán tomar toda medida razonable para\nevitar enmallar en el arte de pesca o interactuar directamente de cualquier\nforma con las boyas de datos que flotan a la deriva.\n\n5º-Se obliga a las embarcaciones pesqueras cuyo arte se haya enmallado\ncon una boya de datos extraer el arte de pesca enmallado con el daño mínimo\nposible a la boya de datos.\n\n6º-Si una embarcación pesquera incurre en lo señalado en el punto 5,\ndeberá notificarlo al regreso de su viaje por escrito ante la Jefatura del\nDepartamento de Protección y Registro, indicando en dicho reporte la fecha,\nposición, y naturaleza del enmallamiento, junto con cualquier información\nidentificadora sobre la boya de datos, a efectos de proceder a realizar la\nremisión respectiva de dicho informe ante la CIAT.\n\n7º-Los programas de investigación científica notificados a la Comisión\npodrán operar buques pesqueros a menos de una milla náutica de una boya de\ndatos serán permitidos, siempre que no interactúen con la misma.\n\n8º-El Departamento de Extensión y Capacitación deberá realizar la\ncomunicación de este acuerdo a las Organizaciones de Pescadores, para su\nconocimiento y aplicación.\n\n9º-Las faltas a esta regulación serán sancionadas conforme se establece\nen la Ley N° 8436, Ley de Pesca y Acuicultura.\n\n10.-Rige a partir de su publicación en el Diario Oficial La Gaceta.\n\n11.-Acuerdo Firme.", "body_en_text": "in the entirety of the text\n\n -\n\n Complete Text of Regulation 181\n\n Prohibits fishing vessels flying the national flag from interacting with\ndata buoys in the Antigua Convention Area (Eastern Pacific Ocean)\n\nComplete Text of act: 10ED1C\n\nCOSTA RICAN INSTITUTE OF FISHERIES\n\nAND AQUACULTURE\n\nAJDIP/181-2016.-Puntarenas, on the twentieth day of May, two thousand\nsixteen.\n\nConsidering:\n\n1.- Mr. Antonio Porras Porras, Technical Director General, submits official communication\nDGT-060-2016, through which he forwards a proposal for the prohibition of fishing\non data buoys, in accordance with what was resolved by Resolution of the\nInter-American Tropical Tuna Commission -IATTC- No. C-11-03, adopted at the\n82nd Meeting of that Commission, which becomes binding for our country.\n\n2.- That said proposal states that the Inter-American Tropical Tuna\nCommission at its 82nd Meeting, held from July 4 to 8, 2011, approved\nResolution C-11-03, by which fishing on data buoys is prohibited.\n\n3.- That aware that many nations, including Members of the\nCommission, operate and deploy data buoys throughout the eastern Pacific Ocean\nand the world's oceans to obtain information used to generate better weather\nand marine forecasts, provide assistance to fisheries by generating\ndata on surface and subsurface ocean temperatures, assist\nsearch and rescue efforts at sea, and obtain critical data for the\nresearch of meteorological and oceanographic topics and climate prediction;\n\n4.- That knowing that highly migratory species, particularly\ntunas, aggregate near data buoys;\n\n5.- That the World Meteorological Organization and the Intergovernmental\nOceanographic Commission have determined that vandalism and damage to data\nbuoys by fishing vessels constitute a significant problem in the Pacific\nOcean and worldwide;\n\n6.- That vandalism or damage to data buoys results in a significant loss\nof critical data for weather prediction, the study of\nmarine conditions, tsunami warnings, and the support of search and\nrescue efforts at sea, and that the Members of the Commission spend considerable time and\nresources locating, replacing, and repairing data buoys damaged or\nlost due to fishing activities or vandalism;\n\n7.- That the loss of critical data for the study of marine\nconditions due to vandalism or damage to data buoys undermines the analyses\nby IATTC scientists seeking to improve knowledge of the habitat use\nof tunas and the relationships between climate and tuna recruitment,\nand research by environmental scientists in general; and\n\n8.- That Costa Rican fishing vessels have been detected\nfishing on buoys or have used them to tie up to them, and even\nat least one case has occurred in which a data\nbuoy had to be retrieved in Puntarenas.\n\n9.- That the IATTC resolutions are binding on Costa Rica and that\ntherefore, said resolutions must be progressively harmonized into national\nregulations; the Board of Directors. Therefore,\n\nRESOLVES:\n\n1.- To prohibit fishing vessels flying the national flag from\ninteracting with data buoys in the Antigua Convention Area (Eastern\nPacific Ocean). Interactions include, but are not limited to, encircling the\nbuoy with fishing gear (arte de pesca), tying or securing the vessel, or any part or\nportion of the vessel, to a data buoy, or cutting its anchor cable.\n\n2.- To prohibit national fishing vessels or foreign-flagged vessels\nwith a Costa Rican fishing license from deploying their fishing gear (artes de pesca) in an area that\nis less than one nautical mile from an anchored data buoy in\nthe Antigua Convention area.\n\n3.- To prohibit fishing vessels from taking on board a data\nbuoy, unless a Contracting Party or the owner responsible for that\nbuoy specifically authorizes or requests it.\n\n4.- Fishing vessels shall take all reasonable measures to\navoid entangling their fishing gear (arte de pesca) or interacting directly in any\nway with data buoys that are adrift.\n\n5.- Fishing vessels whose gear has become entangled\nwith a data buoy are required to remove the entangled fishing gear (arte de pesca) with the minimum possible\ndamage to the data buoy.\n\n6.- If a fishing vessel incurs what is indicated in point 5,\nit must notify the Head of the\nDepartment of Protection and Registry in writing upon the return of its trip, indicating in said report the date,\nposition, and nature of the entanglement, along with any identifying\ninformation about the data buoy, for the purpose of proceeding with the\nrespective submission of said report to the IATTC.\n\n7.- Scientific research programs notified to the Commission\nmay operate fishing vessels at less than one nautical mile from a data\nbuoy, provided they do not interact with it.\n\n8.- The Department of Extension and Training must carry out the\ncommunication of this agreement to the Fishermen's Organizations, for their\nknowledge and application.\n\n9.- Violations of this regulation shall be sanctioned as established\nin Law No. 8436, the Fisheries and Aquaculture Law.\n\n10.- It enters into force upon its publication in the Official Gazette La Gaceta.\n\n11.- Final Agreement." }
