Para efectos de recibir la\ncapacitación supracitada, el capitán o el tripulante de la embarcación\npesquera, deberá inscribirse en el Departamento de Extensión y Capacitación del\nIncopesca y el requisito de estar inscrito como pescador activo, para lo cual\ndeberá de presentar el carné de pescador vigente y constancia del armador de\nque es capitán o parte de la tripulación de la embarcación objeto de este\nartículo.\n\nArtículo 18.-Los capitanes y la tripulación de las embarcaciones\npesqueras comerciales de mediana escala y comerciales avanzada, deberán llevar\nen cada viaje de pesca desenganchador de anzuelos, cortador de anzuelos y\npascón para extraer la tortuga del agua al barco, que permita poner en práctica\nla manipulación de tortugas marinas anzueladas y su reanimación y liberación de\nforma segura. Adicionalmente deberán llevar un registro de las interacciones de\nla pesca con tortugas, mamíferos y aves marinas.\n\n2º-Que la Comisión Interamericana del Atún Tropical (CIAT) aprobó las\nResoluciones C-07-03 para mitigar el impacto de la pesca atunera sobre las\ntortugas marinas y C-11-08 sobre observadores en los buques de palangre, y las\nrecomendaciones de conservación del Personal Científico de la CIAT para\nmanipulación de tortugas marinas en operaciones de palangre presentadas en la\n89 reunión;\n\n3º-Que la Organización de las Naciones Unidas para la Alimentación y la\nAgricultura (FAO) adoptó, en la 26ª Sesión de su Comité de Pesca, celebrada en\nmarzo de 2005, Directrices para reducir la mortalidad de tortugas marinas\ndebida a las operaciones de pesca, y recomendó su aplicación por los organismos\nregionales de pesca y organizaciones de ordenación;\n\n4º-Que la Convención Interamericana para la Protección y Conservación de\nlas Tortugas Marinas Tercera Conferencia de las Partes (CIT) aprobó la\nResolución CIT-COP7-2015-R2 sobre la Conservación de la Tortuga Baula\n(Dermochelys coriacea) del Pacífico Oriental, que establece en su estrategia 1)\nReducir capturas incidentales de adultos y sub adultos de tortuga baula en las\npesquerías, b) Promover la implementación de mejores prácticas de manipulación\ny liberación de tortugas marinas incidentalmente capturadas y llevar a cabo talleres\npara divulgar esta información y c) Continuar y aumentar el monitoreo de\ncapturas incidentales, con observadores a bordo de embarcaciones (cuando y\ndonde sea posible) en puertos en la región del Pacífico Oriental y asegurar que\nse colecte la información de manera que se pueda comparar a nivel regional, y\nla resolución COP3/2006/R-1 sobre la Conservación de la tortuga carey\n(Eretmochelys imbricata) que insta a las Partes a evaluar y mitigar la captura\nincidental de tortugas carey en sus aguas jurisdiccionales;\n\n5º-Que se ha realizado capacitaciones para el sector pesquero palangrero\nde Cuajiniquil, Playas del Coco, Puntarenas, Quepos y Golfito) del pacifico de\nCosta Rica del 14 al 31 de marzo, sobre denominados \"Técnicas para incrementar\nla supervivencia post-captura de tortugas capturadas incidentalmente en las\npesquerías costarricenses\".\n\n6º-Considerando que para el ejercicio de la pesca responsable es\nimportante implementar medidas en procura de incrementar la supervivencia de\nlas tortugas marinas que presentan interacción incidental con las pesquerías\ncostarricenses.\n\nSE ACUERDA:\n\n1º-Aprobar las capacitaciones sobre técnicas para incrementar la\nsupervivencia post captura de tortugas marinas capturadas incidentalmente por\nla flota palangrera de Costa Rica.\n\n2º-Girar las instrucciones necesarias al Departamento de Extensión y\nCapacitación para que elabore un programa permanente de capacitación sobre\ntécnicas de manipulación y liberación de\n\ntortugas marinas en\nla flota comercial de mediana escala y avanzada.\n\n3º-Se instruye al Departamento de Extensión y Capacitación para que en\ncoordinación con cada uno los propietarios o armadores de las embarcaciones de\nla Flota Comercial de Media Escala y Avanzada coordine las capacitaciones para\nlas tripulaciones de las embarcaciones palangreras, a efectos de cumplir con lo\nestablecido sobre esta temática en el Decreto Ejecutivo 38681- MAG- MINAE.\nCoordinando el entrenamiento denominado \"Técnicas para incrementar la\nsupervivencia post-captura de tortugas capturadas incidentalmente en las\npesquerías costarricenses\". For purposes of receiving the aforementioned training, the captain or crew member of the fishing vessel must register with the Department of Outreach and Training of Incopesca, and must meet the requirement of being registered as an active fisher, for which they must present a valid fisher's license and certification from the vessel owner that they are the captain or part of the crew of the vessel subject to this article.\n\nArticle 18.-The captains and crew of medium-scale commercial and advanced commercial fishing vessels must carry on each fishing trip a hook remover (desenganchador de anzuelos), hook cutter (cortador de anzuelos), and a dip net (pascón) for lifting the turtle from the water onto the boat, which shall enable the practice of safe handling of hooked sea turtles and their resuscitation and release. Additionally, they must keep a record of fishing interactions with turtles, mammals, and seabirds.\n\n2º-That the Inter-American Tropical Tuna Commission (IATTC) approved Resolutions C-07-03 to mitigate the impact of tuna fishing on sea turtles and C-11-08 on observers on longline vessels, and the conservation recommendations of the IATTC Scientific Staff for handling sea turtles in longline operations presented at the 89th meeting;\n\n3º-That the Food and Agriculture Organization of the United Nations (FAO) adopted, at the 26th Session of its Committee on Fisheries, held in March 2005, Guidelines to Reduce Sea Turtle Mortality in Fishing Operations, and recommended their implementation by regional fishery bodies and management organizations;\n\n4º-That the Inter-American Convention for the Protection and Conservation of Sea Turtles, Third Conference of the Parties (CIT), approved Resolution CIT-COP7-2015-R2 on the Conservation of the Eastern Pacific Leatherback Turtle (Dermochelys coriacea), which establishes in its strategy 1) Reduce incidental catch of adult and sub-adult leatherback turtles in fisheries, b) Promote the implementation of best practices for the handling and release of incidentally caught sea turtles and conduct workshops to disseminate this information, and c) Continue and increase monitoring of incidental catch, with observers on board vessels (when and where possible) in ports in the Eastern Pacific region and ensure that information is collected in a manner that allows regional comparison, and Resolution COP3/2006/R-1 on the Conservation of the Hawksbill Turtle (Eretmochelys imbricata), which urges Parties to evaluate and mitigate the incidental catch of hawksbill turtles in their jurisdictional waters;\n\n5º-That training sessions have been conducted for the longline fishing sector of Cuajiniquil, Playas del Coco, Puntarenas, Quepos, and Golfito on the Pacific coast of Costa Rica from March 14 to 31, on sessions called \"Techniques to increase the post-capture survival of turtles incidentally caught in Costa Rican fisheries.\"\n\n6º-Considering that for the exercise of responsible fishing it is important to implement measures aimed at increasing the survival of sea turtles that have incidental interaction with Costa Rican fisheries.\n\nIT IS AGREED:\n\n1º-To approve the training on techniques to increase the post-capture survival of sea turtles incidentally caught by the Costa Rican longline fleet.\n\n2º-To issue the necessary instructions to the Department of Outreach and Training to develop a permanent training program on handling and release techniques for\n\nsea turtles in the medium-scale and advanced commercial fleet.\n\n3º-The Department of Outreach and Training is instructed, in coordination with each of the owners or vessel operators (armadores) of the Medium-Scale and Advanced Commercial Fleet vessels, to coordinate the training for the crews of longline vessels, in order to comply with the provisions on this subject established in Executive Decree 38681-MAG-MINAE. This shall be done by coordinating the training called \"Techniques to increase the post-capture survival of turtles incidentally caught in Costa Rican fisheries.\" For this task, the Department of Outreach and Training shall have the support of the Technical General Directorate for the contribution of specialists with the appropriate training and experience to teach these courses, whether with its own personnel or from other institutions.\n\n4º-The training received by fishers shall be valid for three years and must include an evaluation of the knowledge acquired, which may be an oral or written evaluation, at the discretion of INCOPESCA in coordination with the trainer.\n\n5º-The Department of Outreach and Training shall maintain a record of crew members who have received and passed the training, which shall include the crew member's first name, last name, and identity document number, and the date of receipt of the training.
