de\nnoviembre de 2007 (reformado por Decreto Ejecutivo N º 34763 de 16 de\nsetiembre de 2008), Ley N º 8154 de 27 de noviembre de 2001,\n\"Convenio de Préstamo N º 1284/0C-CR, Programa de Regularización\nCatastro y Registro\", Decreto Ejecutivo N º 30106-J, de 6 de\ndiciembre de 2001, \"Declara Zona Catastral la Totalidad de los Cantones\ndel Territorio Nacional\" y Decreto Ejecutivo N º 35509-J de 30 de\nsetiembre de 2009, \"Reglamento de Organización del Registro Inmobiliario\".\n\nConsiderando:\n\nI.-Que mediante Ley Nº 871 O, publicada en La\nGaceta Nº 48 del 1 O de marzo de 2009 se reforma el artículo 2 de la Ley Nº\n5695, Ley de Creación del Registro Nacional, y sus reformas, indicando que el\nCatastro Nacional pasa a formar parte del Registro Inmobiliario.\n\nII.-Que el Decreto\nEjecutivo Nº 35509-J de 30 de setiembre de 2009, Reglamento de Organización del\nRegistro Inmobiliario publicado en el Diario Oficial La Gaceta Nº 198\ndel 13 de octubre de 2009, establece que el Registro Inmobiliario está\nconformado por la Subdirección de Catastro y la Subdirección Registra!.\n\nIII.-Que el Registro\nInmobiliario del Registro Nacional, con fundamento en la Ley de Catastro\nNacional N º 6545 de 25 de marzo de 1981, en su artículo 13 tiene como\npotestad exclusiva, la ejecución y mantenimiento del Catastro, función que\npuede delegar parcialmente en otras instituciones estatales.\n\nIV.-Que la Asamblea\nLegislativa, el 27 de noviembre de 2001, aprobó la Ley Nº 8154, \"Convenio\nde Préstamo Nº 1284/0C-CR, Programa de Regularización del Catastro y\nRegistro\", suscrito entre el Gobierno de la República y el Banco Interamericano de\nDesarrollo (BID), para la ejecución del Programa de Regularización del Catastro\ny Registro Nacional, que por disposición de la misma ley, está a cargo de una\nUnidad Ejecutora adscrita al Ministro de Hacienda como órgano desconcentrado.\n\nV.-Que el Programa de Regularización del Catastro y Registro Nacional,\ntiene como tarea el levantamiento catastral con el objetivo de formar el\ncatastro nacional y compatibilizar la información catastral y registral de los\ninmuebles, en aplicación de lo que dispone la Ley de Catastro N°6545 de 25 de\nmarzo de 1981.\n\nVI.-Que de conformidad con lo que establece el artículo 1° Decreto\nEjecutivo N° 30106-J donde se \"Declara Zona Catastral la Totalidad de los\nCantones del Territorio Nacional\" publicado en La Gaceta N° 19 de 28 de\nenero de 2002 y el artículo 7 del Reglamento a la Ley del Catastro Nacional,\nDecreto Ejecutivo N° 34331, el cual rige desde el 27 de setiembre de 2008, la\ntotalidad de los cantones del territorio nacional fueron declarados zona\ncatastral.\n\nVII.-Que el Reglamento a la Ley de Catastro Nacional, Decreto Ejecutivo\nN° 34331 el cual rige desde el 27 de setiembre de 2008, establece los\nrequerimientos técnicos para el levantamiento de planos de agrimensura.\n\nVIII.-Que por haber concluido los trabajos de levantamiento catastral\ndel Cantón 05 San Rafael, Distritos 01 San Rafael, 02 San Josecito, 03\nSantiago, 04 Ángeles y 05 Concepción y de conformidad con lo que establece el\nartículo 19 de la Ley de Catastro Nacional y 10 de su reglamento, fueron\nconvocados por el Registro Inmobiliario del Registro Nacional y la Unidad\nEjecutora del Programa de Regularización del Catastro y Registro Nacional, los\npropietarios de inmuebles de dichos distritos a una exposición pública para\nconocer los resultados del levantamiento y manifestar su conformidad o\ndisconformidad.\n\nIX.-Que la convocatoria a la exposición pública de los resultados del\nlevantamiento catastral del Cantón 05 San Rafael, Distritos 01 San Rafael, 02\nSan Josecito, 03 Santiago, 04 Ángeles y 05 Concepción de la Provincia de\nHeredia fue publicada en el Diario Oficial La Gaceta No. 123 del 26 de junio\ndel 2012, página 5 y en los diarios de circulación nacional Al Día y La Teja de\nfechas 17 y 18 de junio del 2012.\n\nX.-Que en resolución de las diez horas cuarenta y cinco minutos del\nveintitrés de febrero del año dos mil dieciséis, el Registro Inmobiliario del\nRegistro Nacional declaró firmes los datos catastrales resultantes del\nlevantamiento catastral efectuado en el Cantón 05 San Rafael, Distritos 01 San\nRafael, 02 San Josecito, 03 Santiago, 04 Ángeles y 05 Concepción de la\nProvincia de Heredia.\n\nXI.-Que ya transcurrieron los términos de los plazos\nestablecidos en el artículo 20 de la Ley del Catastro Nacional y fueron\nresueltos, por la Dirección del Registro Inmobiliario del Regulation of the Real Property Registry\".\n\nConsidering:\n\nI.—That through Law N° 8710, published in La\nGaceta N° 48 of March 10, 2009, Article 2 of Law N°\n5695, the Law Creating the National Registry, and its amendments, is reformed, indicating that\nthe National Cadastre becomes part of the Real Property Registry.\n\nII.—That Executive\nDecree N° 35509-J of September 30, 2009, Organization Regulation of the\nReal Property Registry published in the Official Gazette La Gaceta N° 198\nof October 13, 2009, establishes that the Real Property Registry is\ncomprised of the Sub-directorate of Cadastre (Subdirección de Catastro) and the Sub-directorate of Registration (Subdirección Registral).\n\nIII.—That the Real Property\nRegistry of the National Registry, based on the National Cadastre\nLaw N° 6545 of March 25, 1981, in its Article 13 has as an\nexclusive power, the execution and maintenance of the Cadastre, a function that it\nmay partially delegate to other state institutions.\n\nIV.—That the Legislative\nAssembly, on November 27, 2001, approved Law N° 8154, \"Loan\nAgreement N° 1284/OC-CR, Cadastre and Registry Regularization\nProgram\", signed between the Government of the Republic and the Inter-American\nDevelopment Bank (IDB), for the execution of the Cadastre and\nNational Registry Regularization Program, which by provision of the same law, is in charge of an\nExecuting Unit (Unidad Ejecutora) attached to the Minister of Finance as a deconcentrated body.\n\nV.—That the Cadastre and National Registry Regularization Program,\nhas as its task the cadastral survey (levantamiento catastral) with the objective of forming\nthe national cadastre and making the cadastral and registry information of\nproperties compatible, in application of the provisions of the Cadastre Law N° 6545 of March 25,\n1981.\n\nVI.—That in accordance with the provisions of Article 1 of Executive\nDecree N° 30106-J whereby \"the Entirety of the Cantons of the\nNational Territory are Declared a Cadastral Zone\" published in La Gaceta N° 19 of January 28,\n2002, and Article 7 of the Regulation to the National Cadastre Law,\nExecutive Decree N° 34331, which has been in force since September 27, 2008,\nthe entirety of the cantons of the national territory were declared a cadastral\nzone (zona catastral).\n\nVII.—That the Regulation to the National Cadastre Law, Executive Decree\nN° 34331, which has been in force since September 27, 2008, establishes the\ntechnical requirements for the survey of agrimensura plans (planos de agrimensura).\n\nVIII.—That because the cadastral survey works\nof Canton 05 San Rafael, Districts 01 San Rafael, 02 San Josecito, 03\nSantiago, 04 Ángeles and 05 Concepción have been completed and in accordance with the provisions of\nArticle 19 of the National Cadastre Law and Article 10 of its regulation, the\nproperty owners of said districts were convened by the Real Property\nRegistry of the National Registry and the Executing Unit of the Cadastre\nand National Registry Regularization Program to a public exhibition (exposición pública) to\nreview the survey results and express their conformity or\nnon-conformity.\n\nIX.—That the call to the public exhibition of the\ncadastral survey results of Canton 05 San Rafael, Districts 01 San Rafael, 02\nSan Josecito, 03 Santiago, 04 Ángeles and 05 Concepción of the Province of\nHeredia was published in the Official Gazette La Gaceta No. 123 of June 26,\n2012, page 5, and in the nationally circulated newspapers Al Día and La Teja on\ndates June 17 and 18, 2012.\n\nX.—That in a resolution at ten forty-five hours on\nFebruary twenty-third, two thousand sixteen, the Real Property Registry of the\nNational Registry declared firm the cadastral data resulting from the\ncadastral survey carried out in Canton 05 San Rafael, Districts 01 San\nRafael, 02 San Josecito, 03 Santiago, 04 Ángeles and 05 Concepción of the\nProvince of Heredia.\n\nXI.—That the terms of the periods\nestablished in Article 20 of the National Cadastre Law have already elapsed and the\nclaims filed by the property owners were resolved by the Directorate of the\nReal Property Registry of the National Registry.\n\nTherefore:\n\nTHEY DECREE:\n\nTHE FIRST DISTRICT SAN RAFAEL,\n\nSECOND SAN JOSECITO, THIRD SANTIAGO, FOURTH LOS ANGELES AND\n\nFIFTH
