Catastro y\nRegistro\", Decreto Ejecutivo N° 30106-J, de 6 de diciembre de 2001,\n\"Declara Zona Catastral la Totalidad de los Cantones del Territorio\nNacional\" y Decreto Ejecutivo N° 35509-J de 30 de setiembre de 2009,\n\"Reglamento de Organización del Registro Inmobiliario\".\n\nConsiderando:\n\nI.-Que mediante Ley N° 8710, publicada en La Gaceta\nN° 48 del 10 de marzo de 2009 se reforma el artículo 2 de la Ley N° 5695, Ley\nde Creación del Registro Nacional, y sus reformas, indicando que el Catastro\nNacional pasa a formar parte del Registro Inmobiliario.\n\nII.-Que el Decreto Ejecutivo N° 35509-J de 30 de\nsetiembre de 2009, Reglamento de Organización del Registro Inmobiliario\npublicado en el Diario Oficial La Gaceta N° 198 del 13 de octubre de 2009,\nestablece que el Registro Inmobiliario está conformado por la Subdirección de\nCatastro y la Subdirección Registral.\n\nIII.-Que el Registro Inmobiliario del Registro\nNacional, con fundamento en la Ley de Catastro Nacional N° 6545 de 25 de marzo\nde 1981, en su artículo 13 tiene como potestad exclusiva, la ejecución y\nmantenimiento del Catastro, función que puede delegar parcialmente en otras\ninstituciones estatales.\n\nIV.-Que la Asamblea Legislativa, el 27 de noviembre\nde 2001, aprobó la Ley N° 8154, \"Convenio de Préstamo N° 1284/0C-CR,\nPrograma de Regularización del Catastro y Registro\", suscrito entre el\nGobierno de la República y el Banco Interamericano de Desarrollo (BID), para la\nejecución del Programa de Regularización del Catastro y Registro Nacional, que\npor disposición de la misma ley, está a cargo de una Unidad Ejecutora adscrita\nal Ministro de Hacienda como órgano desconcentrado.\n\nV.-Que el Programa de Regularización del Catastro y Registro Nacional,\ntiene como tarea el levantamiento catastral ton el objetivo de formar el catastro\nnacional y compatibilizar la información catastral y registral de los\ninmuebles, en aplicación de lo que dispone la Ley de Catastro N°6545 de 25 de\nmarzo de 1981.\n\nVI.-Que de conformidad con lo que establece el artículo 1° Decreto\nEjecutivo N° 30106-J donde se \"Declara Zona Catastral la Totalidad de los\nCantones del Territorio Nacional\" publicado en La Gaceta N° 19 de 28 de\nenero de 2002 y el artículo 7 del Reglamento a la Ley del Catastro Nacional,\nDecreto Ejecutivo N° 34331, el cual rige desde el 27 de setiembre de 2008, la\ntotalidad de los cantones del territorio nacional fueron declarados zona\ncatastral.\n\nVII.-Que el Reglamento a la Ley de Catastro Nacional, Decreto Ejecutivo\nN° 34331 el cual rige desde el 27 de setiembre de 2008, establece los requerimientos\ntécnicos para el levantamiento de planos de agrimensura.\n\nVIII.-Que por haber concluido los trabajos de levantamiento catastral\ndel Cantón 03 Buenos Aires, Distrito 01 Buenos Aires de la Provincia de\nPuntarenas, y de conformidad con lo que establece el artículo 19 de la Ley de\nCatastro Nacional y 10 de su reglamento, fueron convocados por el Registro\nInmobiliario del Registro Nacional y la Unidad Ejecutora del Programa de\nRegularización del Catastro y Registro Nacional, los propietarios de inmuebles\nde dichos distritos a una exposición pública para conocer los resultados del\nlevantamiento y manifestar su conformidad o disconformidad.\n\nIX.-Que la convocatoria a la exposición pública de los resultados del\nlevantamiento catastral del Cantón 03 Buenos Aires, Distrito 01 Buenos Aires de\nla Provincia de Puntarenas fue publicada en el Diario Oficial La Gaceta No. 197\ndel 14 de September 30, 2009,\n\"Organization Regulation of the Real Property Registry (Registro Inmobiliario)\".\n\nConsidering:\n\nI.-That through Law No. 8710, published in La Gaceta\nNo. 48 of March 10, 2009, Article 2 of Law No. 5695, Law\nCreating the National Registry, and its amendments, is amended, indicating that the\nNational Cadastre becomes part of the Real Property Registry.\n\nII.-That Executive Decree No. 35509-J of September 30,\n2009, Organization Regulation of the Real Property Registry\npublished in the Official Gazette La Gaceta No. 198 of October 13, 2009,\nestablishes that the Real Property Registry is composed of the Subdirectorate of\nCadastre and the Subdirectorate of Registration.\n\nIII.-That the Real Property Registry of the National\nRegistry, based on the National Cadastre Law No. 6545 of March 25,\n1981, in its Article 13 has the exclusive authority, the execution and\nmaintenance of the Cadastre, a function that may be partially delegated to other\nstate institutions.\n\nIV.-That the Legislative Assembly, on November 27,\n2001, approved Law No. 8154, \"Loan Agreement No. 1284/OC-CR,\nCadastre and Registry Regularization Program\", signed between the\nGovernment of the Republic and the Inter-American Development Bank (IDB), for the\nexecution of the Cadastre and National Registry Regularization Program, which\nby provision of the same law, is in charge of an Executing Unit attached\nto the Minister of Finance as a deconcentrated body.\n\nV.-That the Cadastre and National Registry Regularization Program\nhas as its task the cadastral surveying (levantamiento catastral) with the objective of forming the national\ncadastre and making the cadastral and registry information of the\nproperties compatible, in application of what the Cadastre Law No. 6545 of March 25,\n1981 provides.\n\nVI.-That in accordance with what is established in Article 1 of Executive\nDecree No. 30106-J, which \"Declares the Entirety of the\nCantons of the National Territory a Cadastral Zone,\" published in La Gaceta No. 19 of January 28,\n2002, and Article 7 of the Regulation to the National Cadastre Law,\nExecutive Decree No. 34331, which has been in effect since September 27, 2008, the\nentirety of the cantons of the national territory were declared a cadastral zone.\n\nVII.-That the Regulation to the National Cadastre Law, Executive Decree\nNo. 34331, which has been in effect since September 27, 2008, establishes the technical\nrequirements for the preparation of survey plans (planos de agrimensura).\n\nVIII.-That because the cadastral surveying work\nof Canton 03 Buenos Aires, District 01 Buenos Aires of the Province of\nPuntarenas has concluded, and in accordance with what is established in Article 19 of the\nNational Cadastre Law and Article 10 of its regulation, the owners of properties\nin said districts were summoned by the Real Property Registry of the National\nRegistry and the Executing Unit of the Cadastre and National Registry Regularization Program\nto a public exhibition (exposición pública) to learn the results of the\nsurvey and express their conformity or nonconformity.\n\nIX.-That the call for the public exhibition of the results of the\ncadastral surveying of Canton 03 Buenos Aires, District 01 Buenos Aires of\nthe Province of Puntarenas was published in the Official Gazette La Gaceta No. 197\nof October 14, 2013, and in the nationally circulated newspaper Al Día of October 14\nand 15, 2013, page 27 and 11 respectively.\n\nX.-That in a resolution at eleven o'clock on the twenty-third of February of the year\ntwo thousand sixteen, the Real Property Registry of the National Registry declared\nthe cadastral data resulting from the cadastral surveying carried out\nin Canton 03 Buenos Aires, District 01 Buenos Aires of the Province of\nPuntarenas to be final.\n\nXI.-That the terms of the periods\nestablished in Article 20 of the National Cadastre Law have already elapsed and\nthe claims presented by the owners were resolved by the Directorate of the Real Property Registry of the National Registry.\n\nTherefore:\n\nTHEY DECREE:\n\nTHE FIRST DISTRICT BUENOS
