Nacional N° 6545 de 25 de marzo\nde 1981, en su artículo 13 tiene como potestad exclusiva, la ejecución y\nmantenimiento del Catastro, función que puede delegar parcialmente en otras\ninstituciones estatales.\n\nIV.-Que la Asamblea Legislativa, el 27 de noviembre\nde 2001, aprobó la Ley N° 8154, \"Convenio de Préstamo N° 1284/0C-CR,\nPrograma de Regularización del Catastro y Registro\", suscrito entre el\nGobierno de la República y el Banco Interamericano de Desarrollo (BID), para la\nejecución del Programa de Regularización del Catastro y Registro Nacional, que\npor disposición de la misma ley, está a cargo de una Unidad Ejecutora adscrita\nal Ministro de Hacienda como órgano desconcentrado.\n\nV.-Que el Programa de Regularización del Catastro y Registro Nacional,\ntiene como tarea el levantamiento catastral con el objetivo de formar el catastro\nnacional y compatibilizar la información catastral y registral de los\ninmuebles, en aplicación de lo que dispone la Ley de Catastro N° 6545 de 25 de\nmarzo de 1981.\n\nVI.-Que de conformidad con lo que establece el artículo 1° Decreto\nEjecutivo N° 30106-J donde se \"Declara Zona Catastral la Totalidad de los\nCantones del Territorio Nacional\" publicado en La Gaceta N° 19 de 28 de\nenero de 2002 y el artículo 7 del Reglamento a la Ley del Catastro Nacional,\nDecreto Ejecutivo N° 34331, el cual rige desde el 27 de setiembre de 2008, la\ntotalidad de los cantones del territorio nacional fueron declarados zona\ncatastral.\n\nVII.-Que el Reglamento a la Ley de Catastro Nacional, Decreto Ejecutivo\nN° 34331 el cual rige desde el 27 de setiembre de 2008, establece los requerimientos\ntécnicos para el levantamiento de planos de agrimensura.\n\nVIII.-Que por haber concluido los trabajos de levantamiento catastral\ndel Cantón 03 Grecia, Distritos 01 Grecia, 02 San Isidro, 03 San José, 04 San\nRoque, 05 Tacares y 08 Bolívar, de la Provincia de Alajuela y de conformidad\ncon lo que establece el artículo 19 de la Ley de Catastro Nacional y 10 de su\nreglamento, fueron convocados por el Registro Inmobiliario del Registro\nNacional y la Unidad Ejecutora del Programa de Regularización del Catastro y\nRegistro Nacional, los propietarios de inmuebles de dichos distritos a una\nexposición pública para conocer los resultados del levantamiento y manifestar\nsu conformidad o disconformidad.\n\nIX.-Que la convocatoria a la exposición pública de los resultados del\nlevantamiento catastral del Cantón 03 Grecia, Distritos 01 Grecia, 02 San\nIsidro, 03 San José, 04 San Roque, 05 Tacares y 08 Bolívar, de la Provincia Program\n(Programa de Regularización del Catastro y Registro)\", Executive Decree No. 30106-J, of December 6, 2001,\n\"Declares the Entirety of the Cantons of the National Territory as a Cadastral Zone\n(Zona Catastral)\" and Executive Decree No. 35509-J of September 30,\n2009, \"Regulation for the Organization of the Real Estate Registry (Registro Inmobiliario)\".\n\nConsidering:\n\nI.—That through Law No. 8710, published in La Gaceta\nNo. 48 of March 10, 2009, article 2 of Law No. 5695, the Law\nCreating the National Registry, and its amendments, is reformed, indicating that the National\nCadastre becomes part of the Real Estate Registry.\n\nII.—That Executive Decree No. 35509-J of September 30, 2009,\nRegulation for the Organization of the Real Estate Registry published in the Official\nGazette La Gaceta No. 198 of October 13, 2009, establishes that the Real Estate\nRegistry is composed of the Subdirectorate of Cadastre and the Subdirectorate of\nRegistration.\n\nIII.—That the Real Estate Registry of the National\nRegistry, based on the National Cadastre Law No. 6545 of March 25,\n1981, in its article 13 has as its exclusive power, the execution and\nmaintenance of the Cadastre, a function that it may partially delegate to other\nstate institutions.\n\nIV.—That the Legislative Assembly, on November 27,\n2001, approved Law No. 8154, \"Loan Agreement No. 1284/OC-CR,\nCadastre and Registry Regularization Program\", signed between the\nGovernment of the Republic and the Inter-American Development Bank (IDB), for the\nexecution of the Cadastre and Registry Regularization Program, which\nby provision of the same law, is in charge of an Executing Unit attached\nto the Minister of Finance as a deconcentrated body.\n\nV.—That the Cadastre and Registry Regularization Program,\nhas the task of carrying out the cadastral survey with the objective of forming the national\ncadastre and making the cadastral and registry information of the\nreal estate compatible, in application of what the Cadastre Law No. 6545 of March 25,\n1981 provides.\n\nVI.—That in accordance with what is established in article 1 of Executive\nDecree No. 30106-J whereby the \"Entirety of the Cantons of the National Territory is Declared a Cadastral Zone\"\npublished in La Gaceta No. 19 of January 28,\n2002 and article 7 of the Regulation to the National Cadastre Law,\nExecutive Decree No. 34331, which has been in force since September 27, 2008, the\nentirety of the cantons of the national territory were declared a cadastral zone.\n\nVII.—That the Regulation to the National Cadastre Law, Executive Decree\nNo. 34331 which has been in force since September 27, 2008, establishes the technical\nrequirements for the surveying of cadastral survey plans.\n\nVIII.—That because the cadastral survey work\nof Canton 03 Grecia, Districts 01 Grecia, 02 San Isidro, 03 San José, 04 San\nRoque, 05 Tacares and 08 Bolívar, of the Province of Alajuela has been concluded and in accordance\nwith what is established in article 19 of the National Cadastre Law and article 10 of its\nregulation, the real estate owners of said districts were summoned by the Real Estate Registry of the National\nRegistry and the Executing Unit of the Cadastre and Registry Regularization Program to a\npublic exhibition to learn the results of the survey and express\ntheir conformity or disagreement.\n\nIX.—That the summons to the public exhibition of the results of the\ncadastral survey of Canton 03 Grecia, Districts 01 Grecia, 02 San\nIsidro, 03 San José, 04 San Roque, 05 Tacares and 08 Bolívar, of the Province of\nAlajuela, was published in the Official Gazette La Gaceta No. 190 of October 2,\n2012, page 4 and in the nationally circulated newspapers Al Día and La\nTeja of September 23 and 24, 2012.\n\nX.—That in a resolution issued at nine o'clock on the twenty-third of February of the\nyear two thousand sixteen, the Real Estate Registry of the National Registry declared\nthe cadastral data resulting from the cadastral survey carried out\nin Canton 03 Grecia, Districts 01 Grecia, 02 San Isidro, 03 San José, 04 San\nRoque, 05 Tacares and 08 Bolívar, of the Province of Alajuela to be final.\n\nXI.—That the terms of the periods\nestablished in article 20 of the National Cadastre Law have already elapsed and\nthe claims filed by the owners were resolved by the Directorate of the Real Estate Registry of the National Registry.\n\nTherefore:\n\nTHEY DECREE:\n\nTHE FIRST GRECIA, SECOND SAN ISIDRO, THIRD
