  "body_es_text": "en la totalidad del texto\n\n                    -\n\n                        Texto Completo Norma 210\n\n                        Aprueba el otorgamiento de cinco licencias de pesca de ballyhoo\n\nTexto Completo acta: 1158DF\n\nINSTITUTO COSTARRICENSE DE PESCA Y\nACUICULTURA\n\nAJDIP/210-2016.-Puntarenas,\na los nueve días del mes de junio de dos mil dieciséis.\n\nConsiderando:\n\n1º-Se procede a dar lectura al Informe rendido bajo oficio DRG-102-06-2016,\npor parte del Sr. Ricardo Gutiérrez Vargas, Director Regional de Guanacaste y\nCoordinador de la Comisión Asesora de Guanacaste, por medio del cual en\natención lo dispuesto por el Acuerdo N° AJDI/ 170-2016, remite los acuerdos\nalcanzados por la Comisión Asesora de Guanacaste, en relación con el\naprovechamiento del recurso ballyhoo.\n\n2º-Dichos acuerdos\nson los siguientes:\n\na) Establecer una\nveda para la captura y comercio del Balyhoo\nproveniente de los alrededores del Golfo de Papagayo desde las aguas costeras\nubicadas frente a Flamingo y hasta aquellas que se\nubican frente a Bahía Salinas en la frontera con Nicaragua. Dicha veda sería\ndesde el 1 de diciembre y hasta el 28 de febrero de cada año. De esta manera se\nestaría protegiendo picos de reproducción de la especie.\n\nb) Establecer una\nlongitud total mínima de captura y comercialización del Ballyhoo\nproveniente de la zonas señaladas en el punto a) igual a veintiséis (26) cm.\n\nc) Con relación al\nuso de formaldehído se acordó recomendar a esa honorable Junta que gestione\nante el Ministerio de Salud u otra autoridad competente para que determine la\ncantidad máxima (si fuera que alguna) de formalina que puede utilizarse por los\nextractores de ballyhoo para preservar estos peces.\nIgualmente que se gestione ante laboratorios acreditados el análisis de\npescados de esta especie que son importados de Estados Unidos para suplir la\ndemanda por parte de los pescadores deportivos. Que se tomen las medidas que\ncorresponda.\n\nd) Con relación al\nproceso de trazabilidad que se describe en el punto 2 de las conclusiones y\nrecomendaciones de dicho informe técnico. Se consideró de forma unánime que es\nla única manera de implementar un seguimiento aceptable a los stocks pesqueros\npara su buena administración. Igualmente la única forma de que puedan cumplirse\notras disposiciones tales como la talla mínima que se sugirió arriba para el\ncaso de pescados provenientes de Guanacaste o de 27 cm si los peces provienen\ndel Sur del país. También se acordó que si el sistema propuesto es aceptado por\nla Junta, se brinde un período de gracia de 3 meses hasta fin de año para que\nlos pescadores se puedan acomodar y cumplir con los requisitos que para estos\npropósitos exige el INCOPESCA y SENASA. Sobre este punto don Martín externó su\nanuencia a la trazabilidad pero a la vez también su preocupación de que\nINCOPESCA, dada la carencia crítica de personal, se constituya en obstáculo\npara que los pescadores-comerciantes puedan transportar libremente su producto,\nesto repito porque no acudan a la fecha y hora que los interesados requieren la\ncorrespondiente inspección.\n\ne) Con relación al\nnúmero de posibles licencias a otorgar por parte del INCOPESCA, don Martín\nsugiere a los miembros de la comisión que se otorgue un máximo de 7, fundamentando\nsu posición en que ese es el número de personas que ha venido ejerciendo la\nactividad con cierta regularidad, su posición es apoyada por dos de los\nmiembros de la Comisión, los señores Méndez y García. Por su parte Ricardo\nGutiérrez señala que la investigación que él realizó muestra una fotografía de\nla pesquería en ese momento, que al no contar con información técnica\nadicional, deberá mantener su posición es decir de un máximo de 5 licencias. No\nobstante también agrega que si como se ha sugerido, se puede continuar dando un\nmonitoreo y se pone en práctica el sistema de trazabilidad, estas actividades\npodrían generar información para que posteriormente puedan darse más licencias\npor parte de la Junta. En resumen, sobre este aspecto por mayoría se recomienda\na la Junta valorar el otorgamiento de siete (7) licencias.\n\nf) Finalmente se acordó por unanimidad que si la Junta decide otorgar las licencias de las cuales se\ntrató en el acápite anterior, estas sean sólo para personas físicas que hayan residido por más de\ntres años en las siguientes comunidades costeras que se ubican desde Flamingo hasta Bahía Salinas,\nque tengan a la fecha una embarcación en pequeña escala registrada a su nombre con certificado de\nnavegabilidad al día, que no sean asalariados, que el arte de pesca sea únicamente el cachador o\n\"scoop\" con un diámetro no mayor a 50 cm y sólo 1 por embarcación. Que estas licencias estén\nrestringidas al área estudiada, es decir desde las costas ubicadas frente a Flamingo y de ahí hacia\nel noroeste hasta la frontera con Nicaragua, exceptuando el Parque Nacional y otras zonas protegidas\npor el MINAE. Esto para no afectar otras áreas de Guanacaste ubicadas al Sur de Flamingo en las\ncuales eventualmente pueda desarrollarse una pesquería similar.\n\n3º-Debidamente\nanalizado el Informe supra, consideran los Sres. Directivos que de conformidad\ncon el Informe de rito, se tiene y cuentan con los elementos esenciales\ncontemplados en el Ley 8436, para el otorgamiento de licencias de pesca; en\neste caso, para la extracción del recurso Ballyhoo,\nsiendo que existen en la especie criterios técnicos, sociales, económicos y\ncientíficos que los respaldan, por lo que se debe, bajo esa premisa, acoger\nfavorablemente la recomendación de otorgar licencias de pesca para la extracción\ndel recurso de ballyhoo para la zona establecida en\nel Informe científico elaborado por el Sr. Gutiérrez Vargas y recogido por la\nComisión Asesora de Pesca de Guanacaste.\n\n4º-Que asimismo, debe\nla Junta Directiva, en apego meramente a la recomendación técnica, garantizar\nla sostenibilidad del recurso, por lo que resulta factible a criterio de los\nSres.   "body_en_text": "throughout the entire text\n\n-\n\nFull Text of Regulation 210\n\nApproves the granting of five ballyhoo fishing licenses\n\nFull Text of Act: 1158DF\n\nCOSTA RICAN INSTITUTE OF FISHERIES AND\nAQUACULTURE\n\nAJDIP/210-2016.-Puntarenas,\non the ninth day of June, two thousand sixteen.\n\nWhereas:\n\n1º-The Report rendered under official letter DRG-102-06-2016,\nby Mr. Ricardo Gutiérrez Vargas, Regional Director of Guanacaste and\nCoordinator of the Advisory Commission of Guanacaste, is read, through which, in\ncompliance with the provisions of Agreement N° AJDI/ 170-2016, he forwards the agreements\nreached by the Advisory Commission of Guanacaste, in relation to the\nuse of the ballyhoo resource.\n\n2º-Said agreements\nare the following:\n\na) Establish a\nclosed season (veda) for the capture and trade of ballyhoo\noriginating from the surroundings of the Gulf of Papagayo, from the coastal waters\nlocated off Flamingo to those\nlocated off Bahía Salinas on the border with Nicaragua. Said closed season (veda) would be\nfrom December 1 to February 28 of each year. In this way,\nreproductive peaks of the species would be protected.\n\nb) Establish a\nminimum total length for the capture and commercialization of ballyhoo\noriginating from the areas indicated in point a) equal to twenty-six (26) cm.\n\nc) Regarding the\nuse of formaldehyde, it was agreed to recommend to this honorable Board that it approach\nthe Ministry of Health or another competent authority to determine the\nmaximum amount (if any) of formalin that may be used by\nballyhoo harvesters to preserve these fish.\nLikewise, that the analysis of fish of this species that are imported from the United States to supply\ndemand by sport fishermen be arranged with accredited laboratories. That the appropriate\nmeasures be taken.\n\nd) Regarding the\ntraceability (trazabilidad) process described in point 2 of the conclusions and\nrecommendations of said technical report, it was unanimously considered that it is\nthe only way to implement acceptable monitoring of fish stocks for their sound administration.\nLikewise, the only way that other provisions can be met, such as the minimum size suggested above for the\ncase of fish originating from Guanacaste or 27 cm if the fish come from\nthe South of the country. It was also agreed that if the proposed system is accepted by\nthe Board, a grace period of 3 months until the end of the year be provided so that\nfishermen can adapt and comply with the requirements that\nINCOPESCA and SENASA demand for these purposes. Regarding this point, Mr. Martín expressed his\nagreement with traceability (trazabilidad) but also his concern that\nINCOPESCA, given the critical lack of personnel, might become an obstacle\nfor fishermen-traders to freely transport their product,\nthis, I repeat, because they might not attend at the date and time that the interested parties require the\ncorresponding inspection.\n\ne) Regarding the\nnumber of possible licenses to be granted by INCOPESCA, Mr. Martín\nsuggests to the commission members that a maximum of 7 be granted, based\nhis position on the fact that that is the number of people who have been carrying out the\nactivity with some regularity; his position is supported by two of the\nmembers of the Commission, Messrs. Méndez and García. For his part, Ricardo\nGutiérrez points out that the research he carried out shows a snapshot of\nthe fishery at that time, and that in the absence of additional technical\ninformation, he must maintain his position, that is, a maximum of 5 licenses. That these licenses be\nrestricted to the studied area, that is, from the coasts located off Flamingo and from there to\nthe northwest to the border with Nicaragua, excepting the National Park and other zones protected\nby MINAE. This is so as not to affect other areas of Guanacaste located south of Flamingo where\na similar fishery could eventually develop.\n\n3º-Having duly\nanalyzed the aforementioned Report, the Board Members consider that, in accordance\nwith the Report in question, the essential elements\ncontemplated in Law 8436 for the granting of fishing licenses are present; in\nthis case, for the extraction of the ballyhoo resource,\ngiven that there exist in the matter technical, social, economic, and\nscientific criteria that support them, therefore, under this premise, the\nrecommendation to grant fishing licenses for the extraction\nof the ballyhoo resource for the area established in\nthe scientific Report prepared by Mr. Gutiérrez Vargas and adopted by the\nAdvisory Commission on Fisheries of Guanacaste must be favorably accepted.\n\n4º-Likewise, the\nBoard of Directors must, strictly in adherence to the technical recommendation, guarantee\nthe sustainability of the resource, for which it is feasible, in the opinion of the\nBoard Members, to approve only five licenses for the extraction of\nthis resource, therefore, the Board of Directors, Therefore,\n\nAGREES:\n\n1º-To accept the Report\nrendered by the Advisory Commission on Fisheries of Guanacaste, under official letter\nDRG-102-06-2016, signed by Mr. Ricardo Gutiérrez Vargas, Regional\nDirector of Guanacaste and Coordinator of the Advisory Commission of Guanacaste, wherefore,\nconsequently, and supported by technical, social,\neconomic, and scientific criteria that sustain it, the granting of five\nballyhoo fishing licenses is approved, under the following terms and\nconditions:\n\ni- They shall only be granted to natural persons who have resided for more than three years, duly\ndemonstrated, in the coastal communities located from Flamingo to Bahía Salinas, who currently\nhave a small-scale vessel registered in their name with an up-to-date certificate of\nseaworthiness, who are not salaried employees, and whose fishing gear is solely the \"cachador\" or \"scoop\" with a\ndiameter no greater than 50 cm and only 1 per vessel.\n\nii A minimum total capture length of 27 cm is established for the\ncapture and commercialization of H. saltator originating\nonly from the infralittoral waters comprised\nfrom Punta Descartes (11°02'27.44\" N and 85°44'55.23\" W) to the Southwest to\nthe waters located off Playa Flamingo\n(10°26'51.54\" N and 85°46'55.40\" W), excepting those waters included within\nNational Parks or other protected zones.\n\n(The previous point\nthus amended by point 1) of\nagreement N° AJDIP/103-2017 of February 24, 2017)\n\niii A total closed season (veda) is established for the capture and trade of H. saltator originating from the areas\ndelimited in the previous paragraph during the period from December 1 to February 28\nof each year.\n\n(The previous point\nthus amended by point 1) of\nagreement N° AJDIP/103-2017 of February 24, 2017)\n\nArticle 2. The General Technical Directorate is requested to carry out the corresponding investigations to determine either\nthe maximum amount of formalin that may be used by ballyhoo\nharvesters or alternative mechanisms to achieve the same\nobjective, and to coordinate with the pertinent authorities to\nvalidate the process.\n\n(The previous article\nthus amended by article 2 of agreement N° AJDIP/103-2017 of February 24,\n2017)\n\nArticle 3.
