Asimismo, artículos 13, 14, 15, 20, 21 de la Ley de Catastro Nacional N°\n6545 de 25 de marzo de 1981, artículos 7 y 26 de Reglamento a la Ley de\nCatastro Nacional, Decreto Ejecutivo N° 34331 de 29 de noviembre de 2007\n(reformado por Decreto Ejecutivo N° 34763 de 16 de setiembre de 2008), Ley N°\n8154 de 27 de noviembre de 2001, \"Convenio de Préstamo N° 1284/0C-CR, Programa\nde Regularización Catastro y Registro\", Decreto Ejecutivo N° 30106-J, de 6 de\ndiciembre de 2001, \"Declara Zona Catastral la Totalidad de los Cantones del\nTerritorio Nacional\" y Decreto Ejecutivo N° 35509-J de 30 de setiembre de 2009,\n\"Reglamento de Organización del Registro Inmobiliario\".\n\nConsiderando:\n\nI.-Que mediante Ley N° 8710, publicada en La Gaceta N°\n48 del 10 de marzo de 2009 se reforma el artículo 2 de la Ley N° 5695, Ley de\nCreación del Registro Nacional, y sus reformas, indicando que el Catastro\nNacional pasa a formar parte del Registro Inmobiliario.\n\nII.-Que\nel Decreto Ejecutivo N° 35509-J de 30 de setiembre de 2009, Reglamento de\nOrganización del Registro Inmobiliario publicado en el Diario Oficial La\nGaceta N° 198 del 13 de octubre de 2009, establece que el Registro\nInmobiliario está conformado por la Subdirección de Catastro y la Subdirección\nRegistral.\n\nIII.-Que\nel Registro Inmobiliario del Registro Nacional, con fundamento en la Ley de\nCatastro Nacional N° 6545 de 25 de marzo de 1981, en su artículo 13 tiene como\npotestad exclusiva, la ejecución y mantenimiento del Catastro, función que\npuede delegar parcialmente en otras instituciones estatales.\n\nIV.-Que\nla Asamblea Legislativa, el 27 de noviembre de 2001, aprobó la Ley N° 8154, \"Convenio\nde Préstamo N° 1284/OC-CR, Programa de Regularización del Catastro y Registro\",\nsuscrito entre el Gobierno de la República y el Banco Interamericano de\nDesarrollo (BID), para la ejecución del Programa de Regularización del Catastro\ny Registro Nacional, que por disposición de la misma ley, está a cargo de una\nUnidad Ejecutora adscrita al Ministro de Hacienda como órgano desconcentrado.\n\nV.-Que\nel Programa de Regularización del Catastro y Registro Nacional, tiene como\ntarea el levantamiento catastral con el objetivo de formar el catastro nacional\ny compatibilizar la información catastral y registral de los inmuebles, en\naplicación de lo que dispone la Ley de Catastro N° 6545 de 25 de marzo de 1981.\n\nVI.-Que\nde conformidad con lo que establece el artículo 1° Decreto Ejecutivo N° 30106-J\ndonde se \"Declara Zona Catastral la Totalidad de los Cantones del Territorio\nNacional\" publicado en La Gaceta N° 19 de 28 de enero de 2002 y el artículo 7\ndel Reglamento a la Ley del Catastro Nacional, Decreto Ejecutivo N° 34331, el\ncual rige desde el 27 de setiembre de 2008, la totalidad de los cantones del\nterritorio nacional fueron declarados zona catastral.\n\nVII.-Que\nel Reglamento a la Ley de Catastro Nacional, Decreto Ejecutivo N° 34331 el cual\nrige desde el 27 de setiembre de 2008, establece los requerimientos técnicos\npara el levantamiento de planos de agrimensura.\n\nVIII.-Que por haber concluido los trabajos de levantamiento catastral del Cantón 02 Nicoya,\nDistritos 03 San Antonio, 04 Quebrada Honda y 07 Belén de Nosarita de la Provincia de Guanacaste y\nde conformidad con lo que establece el artículo 19 de la Ley de Catastro Nacional y 10 de su\nreglamento, fueron convocados por el Registro Inmobiliario del Registro Nacional y la Unidad\nEjecutora del Programa de Regularización del Catastro y Registro Nacional, los propietarios de\ninmuebles de dichos distritos a una exposición pública para conocer los resultados del levantamiento\ny manifestar su conformidad o disconformidad.\n\nIX.-Que\nla convocatoria a la exposición pública de los resultados del levantamiento\ncatastral del Cantón 02 Nicoya, Distritos 03 San Antonio, 04 Quebrada Honda y\n07 Belén de Nosarita de la Provincia de Guanacaste\nfue publicada en el Diario Oficial La Gaceta Nº 208 de 29 de octubre del\n2013, página 2 y 3, y en el Diario de Circulación Nacional Al Día, de fecha 29\nde octubre del 2013, página 13 y 30 de octubre del 2013, página 13, para el\ndistrito 03 San Antonio; Likewise, articles 13, 14, 15, 20, 21 of the National Cadastre Law N°\n6545 of March 25, 1981, articles 7 and 26 of the Regulation to the National\nCadastre Law, Executive Decree N° 34331 of November 29, 2007\n(amended by Executive Decree N° 34763 of September 16, 2008), Law N°\n8154 of November 27, 2001, \"Loan Agreement N° 1284/0C-CR, Cadastre and Registry Regularization\nProgram\", Executive Decree N° 30106-J, of December 6,\n2001, \"Declares the Entirety of the Cantons of the National Territory a Cadastral Zone\", and Executive Decree N° 35509-J of September 30, 2009,\n\"Regulation for the Organization of the Real Property Registry\".\n\nConsidering:\n\nI.-That through Law N° 8710, published in La Gaceta N°\n48 of March 10, 2009, article 2 of Law N° 5695, Law Creating\nthe National Registry, and its amendments, is reformed, indicating that the National Cadastre\nbecomes part of the Real Property Registry.\n\nII.-That\nExecutive Decree N° 35509-J of September 30, 2009, Regulation for the\nOrganization of the Real Property Registry published in the Official Journal La\nGaceta N° 198 of October 13, 2009, establishes that the Real Property\nRegistry is composed of the Deputy Directorate of Cadastre and the Deputy Directorate\nof Registration.\n\nIII.-That\nthe Real Property Registry of the National Registry, based on the National\nCadastre Law N° 6545 of March 25, 1981, in its article 13 has the\nexclusive power for the execution and maintenance of the Cadastre, a function\nthat it may partially delegate to other state institutions.\n\nIV.-That\nthe Legislative Assembly, on November 27, 2001, approved Law N° 8154, \"Loan\nAgreement N° 1284/OC-CR, Cadastre and Registry Regularization Program\",\nentered into between the Government of the Republic and the Inter-American\nDevelopment Bank (IDB), for the execution of the Cadastre and National Registry\nRegularization Program, which by provision of the same law, is in charge of an\nExecuting Unit attached to the Minister of Finance as a deconcentrated body.\n\nV.-That\nthe Cadastre and National Registry Regularization Program has the\ntask of cadastral surveying (levantamiento catastral) with the objective of forming the national cadastre\nand making the cadastral and registry information of real properties compatible, in\napplication of the provisions of the Cadastre Law N° 6545 of March 25, 1981.\n\nVI.-That\nin accordance with the provisions of article 1 of Executive Decree N° 30106-J\nwhereby \"The Entirety of the Cantons of the National Territory is Declared a Cadastral Zone\"\npublished in La Gaceta N° 19 of January 28, 2002, and article 7\nof the Regulation to the National Cadastre Law, Executive Decree N° 34331, which\nhas been in effect since September 27, 2008, the entirety of the cantons of the\nnational territory were declared a cadastral zone (zona catastral).\n\nVII.-That\nthe Regulation to the National Cadastre Law, Executive Decree N° 34331, which\nhas been in effect since September 27, 2008, establishes the technical requirements\nfor the surveying of cadastral plans (planos de agrimensura).\n\nVIII.-That because the cadastral surveying (levantamiento catastral) work for Canton 02 Nicoya,\nDistricts 03 San Antonio, 04 Quebrada Honda, and 07 Belén de Nosarita of the Province of Guanacaste has been completed, and\nin accordance with the provisions of article 19 of the National Cadastre Law and article 10 of its\nregulation, the owners of\nreal properties in said districts were summoned by the Real Property Registry of the National Registry and the\nExecuting Unit of the Cadastre and National Registry Regularization Program to a public exhibition to learn the results of the surveying\nand express their conformity or non-conformity.\n\nIX.-That\nthe call for the public exhibition of the results of the cadastral surveying\nof Canton 02 Nicoya, Districts 03 San Antonio, 04 Quebrada Honda, and\n07 Belén de Nosarita of the Province of Guanacaste\nwas published in the Official Journal La Gaceta Nº 208 of October 29,\n2013, pages 2 and 3, and in the National Circulation Newspaper Al Día, dated October 29,\n2013, page 13, and October 30, 2013, page 13, for\ndistrict 03 San Antonio;
