de setiembre de 2009,\n\"Reglamento de Organización del Registro Inmobiliario\".\n\nConsiderando:\n\nI.-Que mediante Ley N° 8710, publicada en La Gaceta\nN° 48 del 10 de marzo de 2009 se reforma el artículo 2 de la Ley N° 5695,\nLey de Creación del Registro Nacional, y sus reformas, indicando que el Catastro\nNacional pasa a formar parte del Registro Inmobiliario.\n\nII.-Que\nel Decreto Nacional N° 6545 de 25 de marzo de 1981, en su artículo 13 tiene como\npotestad exclusiva, la ejecución y mantenimiento del Catastro, función que\npuede delegar parcialmente en otras instituciones estatales.\n\nIV.-Que\nla Asamblea Legislativa, el 27 de noviembre de 2001, aprobó la Ley N° 8154,\n\"Convenio de Préstamo N° 1284/0C-CR, Programa de Regularización del Catastro y\nRegistro\", suscrito entre el Gobierno de la República y el Banco Interamericano\nde Desarrollo (BID), para la ejecución del Programa de Regularización del\nCatastro y Registro Nacional, que por disposición de la misma ley, está a cargo\nde una Unidad Ejecutora adscrita al Ministro de Hacienda como órgano\ndesconcentrado.\n\nV.-Que\nel Programa de Regularización del Catastro y Registro Nacional, tiene como\ntarea el levantamiento catastral con el objetivo de formar el catastro nacional\ny compatibilizar la información catastral y registral de los inmuebles, en\naplicación de lo que dispone la Ley cual\nrige desde el 27 de setiembre de 2008, establece los requerimientos técnicos\npara el levantamiento de planos de agrimensura.\n\nVIII.-Que por haber concluido los trabajos de levantamiento catastral\ndel Cantón 08 Tilarán, distritos 01 Tilarán, 03 Tronadora, 04 Santa Rosa, 06\nTierras Morenas y 07 Arenal de la provincia de Guanacaste y de conformidad con\nlo que establece el artículo 19 disconformidad.\n\nIX.-Que\nla convocatoria a la exposición pública de los resultados del levantamiento\ncatastral del cantón 08 Tilarán, distritos 01 Tilarán, 03 Tronadora, 04 Santa\nRosa, 06 Tierras Morenas y 07 Arenal de la provincia de Guanacaste fue\npublicada en el Diario Oficial La Gaceta N° 147 del 01 de agosto de\n2013, página 16 y en el diario de circulación nacional al día del 05 de   "body_en_text": "Based on the powers conferred by subsections 3) and 18) of Article 140 and Article 146 of the Political Constitution of Costa Rica, Article 28 subsection 2, paragraph b) of the General Law of Public Administration, Law No. 6227 of May 2, 1978, the Law Creating the National Registry, Law No. 5695 of May 28, 1975 (as amended by Laws No. 8766 of September 1, 2009, No. 8823 of May 5, 2010, No. 8710 of February 3, 2009, No. 7764 of April 17, 1998, No. 6934 of November 28, 1983, and by Law No. 5950 of October 27, 1976). Likewise, Articles 13, 14, 15, 20, 21 of the National Cadastre Law (Ley de Catastro Nacional) No. 6545 of March 25, 1981, Articles 7 and 26 of the Regulation to the National Cadastre Law (Reglamento a la Ley de Catastro Nacional), Executive Decree (Decreto Ejecutivo) No. 34331 of November 29, 2007 (amended by Executive Decree No. 34763 of September 16, 2008), Law No. 8154 of November 27, 2001, \"Loan Agreement No. 1284/OC-CR, Cadastre and Registry Regularization Program (Programa de Regularización de Catastro y Registro),\" Executive Decree No. 30106-J of December 6, 2001, \"Declares the Entirety of the Cantons of the National Territory as a Cadastral Zone,\" and Executive Decree No. 35509-J of September 30, 2009, \"Regulation for the Organization of the Real Estate Registry (Reglamento de Organización del Registro Inmobiliario).\"\n\nConsidering:\n\nI.—That by Law No. 8710, published in La Gaceta No. 48 of March 10, 2009, Article 2 of Law No. 5695, the Law Creating the National Registry, and its amendments, is reformed, indicating that the National Cadastre becomes part of the Real Estate Registry.\n\nII.—That Executive Decree No. 35509-J of September 30, 2009, Regulation for the Organization of the Real Estate Registry, published in the Official Gazette La Gaceta No. 198 of October 13, 2009, establishes that the Real Estate Registry is composed of the Subdirectorate of Cadastre (Subdirección de Catastro) and the Subdirectorate of Registration (Subdirección Registral).\n\nIII.—That the Real Estate Registry of the National Registry, based on the National Cadastre Law No. 6545 of March 25, 1981, in its Article 13, has the exclusive authority for the execution and maintenance of the Cadastre, a function that it may partially delegate to other state institutions.\n\nIV.—That the Legislative Assembly, on November 27, 2001, approved Law No. 8154, \"Loan Agreement No. 1284/OC-CR, Cadastre and Registry Regularization Program,\" signed between the Government of the Republic and the Inter-American Development Bank (IDB), for the execution of the Cadastre and National Registry Regularization Program, which, by provision of the same law, is in charge of an Executing Unit attached to the Minister of Finance as a deconcentrated body.\n\nV.—That the Cadastre and National Registry Regularization Program has the task of cadastral surveying (levantamiento catastral) with the objective of forming the national cadastre and making the cadastral and registry information of properties compatible, in application of the provisions of the Cadastre Law No. 6545 of March 25, 1981.\n\nVI.—That in accordance with the provisions of Article 1 of Executive Decree No. 30106-J, which \"Declares the Entirety of the Cantons of the National Territory as a Cadastral Zone,\" published in La Gaceta No. 19 of January 28, 2002, and Article 7 of the Regulation to the National Cadastre Law, Executive Decree No. 34331, which has been in effect since September 27, 2008, the entirety of the cantons of the national territory were declared a cadastral zone.\n\nVII.—That the Regulation to the National Cadastre Law, Executive Decree No. 34331, which has been in effect since September 27, 2008, establishes the technical requirements for the drafting of survey plans (planos de agrimensura).\n\nVIII.—That because the cadastral surveying works for Canton 08 Tilarán, districts 01 Tilarán, 03 Tronadora, 04 Santa Rosa, 06 Tierras Morenas, and 07 Arenal of the province of Guanacaste have concluded, and in accordance with the provisions of Article 19 of the National Cadastre Law and Article 10 of its regulation, the property owners of said districts were convened by the Real Estate Registry of the National Registry and the Executing Unit of the Cadastre and National Registry Regularization Program to a public exhibition (exposición pública) to learn the results of the surveying and express their agreement or disagreement.\n\nIX.—That the call for the public exhibition of the cadastral surveying results for Canton 08 Tilarán, districts 01 Tilarán, 03 Tronadora, 04 Santa Rosa, 06 Tierras Morenas, and 07 Arenal of the province of Guanacaste was published in the Official Gazette La Gaceta No. 147 of August 1, 2013, page 16, and in the nationally circulated newspaper al día of August 5, 2013, page 27, and August 6, 2013, page 15.\n\nX.—That in a resolution issued at nine hours and twenty minutes on March seventeenth, two thousand sixteen, the Real Estate Registry of the National Registry declared the cadastral data resulting from the cadastral surveying carried out in Canton 08 Tilarán, districts 01 Tilarán, 03 Tronadora, 04 Santa Rosa, 06 Tierras Morenas, and 07 Arenal of the province of Guanacaste as final (firmes).\n\nXI.—That the terms of the periods established in Article 20 of the National Cadastre Law have now elapsed, and the claims filed by the property owners were resolved by the Directorate of the Real Estate Registry of the National Registry.\n\nTherefore:\n\nThey Decree:\n\nTHE DISTRICTS OF FIRST TILARAN, THIRD TRONADORA, FOURTH SANTA ROSA, SIXTH TIERRAS MORENAS, AND SEVENTH ARENAL OF CANTON 08 TILARAN OF PROVINCE 05 GUANACASTE ARE DECLARED A CADASTRED ZONE (ZONA CATASTRADA)\n\nArticle 1.—In accordance with Article 20 of the National Cadastre Law No. 6545 of March 25, 1981, Canton 08 Tilarán, districts 01 Tilarán, 03 Tronadora, 04 Santa Rosa, 06 Tierras Morenas, and 07 Arenal of the province of Guanacaste are declared a cadastred zone.\n\nFicha
