Para el\ndistrito 03 Puerto Carrillo, la publicación en La Gaceta Nº 190, se dio en fecha 03 de octubre del\n2013, página 11, y el Diario Al Día del 30 de setiembre del 2013, página 17 y 01 de octubre del\n2013, página 7.   "body_en_text": "Whereas:\n\nI.—That through Law No. 8710, published in La Gaceta No. 48 of March 10, 2009, Article 2 of Law No. 5695, the Law of Creation of the National Registry, and its amendments, was amended, indicating that the National Cadastre becomes part of the Real Property Registry.\n\nII.—That Executive Decree No. 35509-J of September 30, 2009, the Regulations for the Organization of the Real Property Registry published in the Official Gazette La Gaceta No. 198 of October 13, 2009, establishes that the Real Property Registry is composed of the Subdirectorate of Cadastre and the Subdirectorate of Registration.\n\nIII.—That the Real Property Registry of the National Registry, based on the National Cadastre Law No. 6545 of March 25, 1981, in its Article 13, has the exclusive power to execute and maintain the Cadastre, a function that may be partially delegated to other state institutions.\n\nIV.—That the Legislative Assembly, on November 27, 2001, approved Law No. 8154, \"Loan Agreement No. 1284/OC-CR, Program for the Regularization of the Cadastre and Registry\", signed between the Government of the Republic and the Inter-American Development Bank (IDB), for the execution of the Program for the Regularization of the Cadastre and National Registry, which, by provision of the same law, is the responsibility of an Executing Unit attached to the Minister of Finance as a deconcentrated body.\n\nV.—That the Program for the Regularization of the Cadastre and National Registry has the task of cadastral surveying (levantamiento catastral) with the objective of forming the national cadastre and making the cadastral and registration information of properties compatible, in application of the provisions of the Cadastre Law No. 6545 of March 25, 1981.\n\nVI.—That in accordance with the provisions of Article 1 of Executive Decree No. 30106-J, which \"Declares the Entirety of the Cantons of the National Territory as a Cadastral Zone\" published in La Gaceta No. 19 of January 28, 2002, and Article 7 of the Regulations to the National Cadastre Law, Executive Decree No. 34331, which has been in effect since September 27, 2008, the entirety of the cantons of the national territory were declared a cadastral zone (zona catastral).\n\nVII.—That the Regulations to the National Cadastre Law, Executive Decree No. 34331, which has been in effect since September 27, 2008, establishes the technical requirements for the surveying of survey plans (planos de agrimensura).\n\nVIII.—That the cadastral surveying (levantamiento catastral) work for canton 11 Hojancha, district 01 Hojancha, 02 Monte Romo, 03 Puerto Carrillo, and 04 Huacas of the province of Guanacaste having been completed, and in accordance with the provisions of Article 19 of the National Cadastre Law and Article 10 of its regulations, the property owners of said districts were convened by the Real Property Registry of the National Registry and the Executing Unit of the Program for the Regularization of the Cadastre and National Registry to a public exhibition to learn the results of the survey and express their conformity or non-conformity.\n\nIX.—That the call for the public exhibition of the results of the cadastral surveying (levantamiento catastral) for canton 11 Hojancha, district 01 Hojancha, 02 Monte Romo, 03 Puerto Carrillo, and 04 Huacas of the province of Guanacaste was published in the Official Gazette La Gaceta No. 154 of August 10, 2010, page 25, and in the nationally circulated newspapers Al Día of August 3, 2010, page 42 and August 4, 2010, page 39, and the Diario La Teja of August 3, 2010, page 33 and August 4, 2010, page 11, for districts 01 Hojancha and 02 Monte Romo. For district 03 Puerto Carrillo, the publication in La Gaceta No. 190 was on October 3, 2013, page 11, and in Diario Al Día of September 30, 2013, page 17 and October 1, 2013, page 7. In the case of district 04 Huacas, it was published in La Gaceta No. 133 of July 9, 2010, page 9, in the Diarios La Teja of July 13, 2010, page 29 and July 14, 2010, page 15, and in Diario Al Día of July 13, 2010, page 11 and July 14, 2010, page 31.\n\nX.—That in a resolution at nine forty-five in the morning of March seventeenth, two thousand sixteen, the Real Property Registry of the National Registry declared the cadastral data resulting from the cadastral surveying (levantamiento catastral) conducted in Canton 11 Hojancha, district 01 Hojancha, 02 Monte Romo, 03 Puerto Carrillo, and 04 Huacas of the Province of Guanacaste to be firm (firmes).\n\nXI.—That the terms of the deadlines established in Article 20 of the National Cadastre Law have already elapsed, and the claims filed by the owners have been resolved by the Directorate of the Real Property Registry of the National Registry.\n\nTherefore,\n\nThey decree:\n\nTHE FIRST DISTRICT HOJANCHA, SECOND MONTE ROMO, THIRD PUERTO CARRILLO, AND FOURTH HUACAS OF CANTON 11 HOJANCHA OF PROVINCE 05 GUANACASTE ARE DECLARED A CADASTRAL ZONE (ZONA CATASTRADA)\n\nArticle 1.—In accordance with Article 20 of the National Cadastre Law No. 6545 of March 25, 1981, canton 11 Hojancha, district 01 Hojancha, 02 Monte Romo, 03 Puerto Carrillo, and 04 Huacas of the province of Guanacaste is declared a cadastral zone (zona catastrada).\n\nArticle 2.—For this declaration, the same legal effects and technical specifications issued in Executive Decree No. 36830-JP of September 12, 2011, published in the official newspaper La Gaceta No. 208 of Monday, October 31, 2011, Articles 2 through 6, shall govern.\n\nArticle 3.—It shall be effective from its publication.\n\nIssued at the Presidency of the Republic.—San José, the thirty-first of May of two thousand sixteen."
