Bajo este\nprincipio, los instrumentos financieros deben orientarse a apoyar los pilares\ndel Plan Nacional de Desarrollo; no estableciendo discriminación, sino la\norientación prioritaria a las organizaciones de productores que apoyan los\npequeños y medianos productores forestales; y quienes se ubican en los cantones\nde mayor rezago social, considerando los objetivos de la creación del Fondo\nNacional de Financiamiento Forestal según la citada Ley Forestal, sin dejar de\nlado los criterios de orden técnico establecidos.\n\n3- Que el Plan Nacional de Desarrollo citado considera como una de las\nmetas nacionales es mantener bajo el Programa de Pago por Servicios al menos\ntrescientas mil hectáreas, en sus diferentes modalidades. Además, dispone como\nuno de sus desafios: desarrollar instrumentos financieros novedosos y\nfortalecer los existentes, orientados al manejo forestal sostenible, incluyendo\nla Protección, Regeneración, y el establecimiento de Sistemas Agroforestales y\nPlantaciones Forestales; así como, la industrialización y comercialización de\nlos bienes y servicios generados por los ecosistemas forestales.\n\nCONSIDERANDO\n\n1- Que el presupuesto asignado para ejecución de los nuevos proyectos del\nPrograma de\n\nPago por Servicios\nAmbientales para año 2016, es por un monto de tres mil ochocientos setenta y\ncinco millones ochocientos setenta y tres mil doscientos veintisiete colones.\n\nDicho plan de gastos fue aprobado por la Contraloría General de la\nRepública, mediante el oficio DFOE-AE-0647, del nueve de diciembre del dos mil\nquince.\n\nPOR TANTO:\n\nEL MINISTRO DE AMBIENTE Y ENERGÍA\n\nRESUELVE\n\nArtículo 01. Establecer el límite de gasto al Fondo\nNacional de Financiamiento Forestal, para proyectos nuevos a financiar por\nactividades y determinar los montos de pago por actividad.\n\n1. Actividades a financiar: Para el afio 2016, se considerarán dos\nmodalidades a financiar;\n\na-Recuperación de\nla Cobertura Forestal, que incluye las actividades de Reforestación,\nRegeneración y Sistemas Agroforestales y b-Mantenimiento de la Cobertura\nForestal, que incluye\nProtección y Manejo de Bosque. Para tal fin, se establece la siguiente\ndistribución:\n\n| Modalidades de PSA | Actividad | Cantidad | | --- | --- | --- | | Recuperación de la Cobertura\nForestal | Reforestación con especies de rápido crecimiento | 2.865 hectáreas | | | Reforestación\ncon especies de mediano crecimiento | 2.735 hectáreas | | | Reforestación con especies contenidas\nen los decretos ejecutivos de veda y especies amenazadas o en peligro de extinción (Decreto N°\n25663-MINAE y Decreto N° 25700-MINAE y sus reformas) | 600 hectáreas | | | Regeneración Natural |\n3.000 hectáreas | | | Establecimiento de árboles en Sistemas Agroforestales | 500.400 árboles | |\n| Sistemas Agroforestales establecidos en Plantaciones de Aprovechamiento Forestal (PPAF) | 50.000\nárboles | | Mantenimiento de la Cobertura Forestal | Protección de Bosque | 43.174 hectáreas | | |\nProtección de Bosque para resguardo del Recurso Hídrico | 5.000 hectáreas | | | Manejo de Bosque |\n200 hectáreas. |\n\nEl Fondo Nacional\nde Financiamiento Forestal podrá variar la distribución establecida en el\ncuadro anterior, de acuerdo con la oferta, según las solicitudes recibidas por\ncada una de las actividades, siempre y cuando no sobrepasen el presupuesto\naprobado para el Programa de Pago por Servicios Ambientales.\n\nDe disponer de\nuna mayor asignación de recursos, según el artículo 5 de la Ley de\nSimplificación y Eficiencia Tributarias N° 8114 publicada en La Gaceta N° 131,\ndel día 9 de julio de 2001 y otros recursos financieros que capte el Fonafifo\npara el Pago por Servicios Ambientales, se distribuirán según el criterio de\nlos financiadores y del Fonafifo. En todo caso, los recursos utilizados para\nestos fines, deberán ser incorporados en el presupuesto institucional y ser\naprobados por la Contraloría General de la República.\n\n2. De los\nmontos de pago por actividad y otras condiciones:\n\n2.1. Actividad\nde Reforestación: Las condiciones que regirán para el trámite de solicitudes,\npara el reconocimiento de los servicios ambientales en la actividad de\nReforestación, son las siguientes:\n\nEl monto a pagar\npara las especies de rápido crecimiento referidas a: Gmelina arborea, Acacia\nmangium, Vochysia guatemalensis y Vochysia hondurensis, será de seiscientos\ntreinta y seis mil setecientos treinta y nueve colones con 00/100 (0 636.739)\npor hectárea, desembolsados durante un período de cinco años. Los pagos serán\ndistribuidos de la siguiente forma: 50% el primer año, 20% el segundo año, 15%\nel tercer año, 10% el cuarto año y 5% el quinto año.\n\nEl monto a pagar\npara las especies de mediano crecimiento referidas a: Tectona grandis, Pinus\nsp, Cordia alliodora, Vochysia ferruginea, Eucalyptus sp y Cedrela odorata, será\nde setecientos cincuenta mil ciento treinta y dos colones con 00/100 (0750.132)\npor hectárea, desembolsados durante un período de cinco años. Dichos pagos corresponden al total de años del plazo\nconvenido; no obstante, a fin de permitir el establecimiento de la plantación y\nsu mantenimiento, se adelantará durante los primeros cinco años.\n\ng) El Fonafifo podrá modificar cuando así se\nsolicite aquellos contratos suscritos antes del año 2006, que demuestren haber\nalcanzado una producción mínima de 13 metros cúbicos de incremento medio anual\npor hectárea. Para tales efectos el Fonafifo podrá solicitar la información que\nconsidere pertinente.\n\n2.2. Actividad de Regeneración Natural: Las\ncondiciones que regirán para el trámite de solicitudes, para el reconocimiento\nde los servicios ambientales en la actividad de Regeneración Natural, se\ndetallan a continuación.\n\na) El monto a pagar en Regeneración Natural,\nserá de ciento ocho mil veintiséis colones con 00/100 (0108.026) por hectárea,\ndesembolsados en cinco pagos anuales de 20% durante un período de cinco años.\n\n2.3. Actividad de Sistemas\nAgroforestales: Las condiciones que regirán para el trámite de solicitudes,\npara el reconocimiento de los servicios ambientales en la actividad de Sistemas\nAgroforestales, se detallan a continuación.\n\nEl monto a pagar será de novecientos veintiún\ncolones (0921) por árbol, integrados a Sistemas Agroforestales y desembolsados\ndurante un período de cinco años. Los pagos serán distribuidos de la siguiente\nforma: 50% el primer año, 25% el tercero año y 25% el año quinto.\n\nEl monto a pagar será de mil trescientos\nsesenta y cinco colones con 00/100 (01.365) por árbol, integrados a Sistemas\nAgroforestales, estrictamente con especies nativas contenidas en los Decretos\nEjecutivos N° 25663-M1NAE del 8 de octubre de 1996 y N° 25700-MINAE del 15 de\nnoviembre de 1996, desembolsados durante un período de cinco años.\n\nLos pagos serán distribuidos de la siguiente\nforma: 50% el primer año, 25% el tercero ario y 25% el año quinto.\n\nEl monto a pagar será de mil trecientos\nsesenta y cinco colones con 00/100 (01.365) por árbol bajo la actividad de\nSistemas Agroforestales establecidos en Plantaciones de Aprovechamiento\nForestal (PPAF), financiados mediante el crédito forestal. Los pagos serán\ndistribuidos de la siguiente forma: 80% a la fuma del contrato, una vez que los\nárboles hayan alcanzado los 36 meses de edad y 20% restante en el año quinto\ndel proyecto cuando los árboles hayan alcanzado los 60 meses de edad.\n\n2.4. Actividad de Protección de Bosque: Las\ncondiciones que regirán para el trámite de solicitudes, para el reconocimiento\nde los servicios ambientales en la actividad de Protección de Bosque, se\ndetallan a continuación:\n\na) El monto a pagar será de ciento sesenta y\nocho mil seiscientos veintiséis colones con 00/100 (0168.626), desembolsados en\ncinco pagos anuales de 20% durante un período de cinco años. Cuando se trate de\nsolicitudes que se ubiquen dentro de las zonas de importancia hídrica,\nidentificadas por el Instituto Costarricense de Acueductos y Alcantarillados,\nla Dirección de Aguas y el Fonafifo, se reconocerá un monto adicional de\ncuarenta y dos mil ciento cincuenta y siete colones con 00/100 (042.157),\nsiendo el monto total a pagar de doscientos diez mil setecientos ochenta y tres\ncolones con 00/100 (0210.783) por hectárea, desembolsados en cinco pagos\nanuales de 20% durante un período de cinco años. Este monto adicional se\naplicará hasta agotar el presupuesto asignado en esta actividad.\n\n2.5. Actividad de Manejo de Bosque. Las\ncondiciones que regirán para el trámite de solicitudes para el reconocimiento\nde los servicios ambientales en la actividad de Manejo de Bosque se detallan a\ncontinuación:\n\na) El monto a pagar será de ciento treinta y\nun mil setecientos treinta y nueve colones con 00/100 (0131.739) por hectárea,\ndesembolsados en cinco pagos anuales de 20% durante un período de cinco años.\n\n3. Actualización de los montos a pagar. Los\nmontos establecidos por actividad dentro del Programa de Pago por Servicios\nAmbientales, se actualizarán anualmente con el índice de Precios al Consumidor\n(IPC), calculado por el Instituto Nacional de Estadística y Censo (NEC), al\ncierre del período del año anterior.\n\nArtículo 02. Se\ninstruye al Fondo Nacional de Financiamiento Forestal para que incorpore en los\ncontratos de Pago por Servicios Ambientales las siguientes condiciones:\n\n1. De los plazos de vigencia de los contratos:\nLos plazos de vigencia de los contratos de Pago por Servicios Ambientales,\ngenerados por las modalidades de recuperación y/o mantenimiento de cobertura\nforestal serán los siguientes:\n\na) a)Los contratos correspondientes a la\nactividad de Reforestación mediante el establecimiento de las especies de\nrápido crecimiento, tendrán una vigencia de diez años a partir de su firma. Los\nque incorporen especies de mediano crecimiento y las especies nativas\ncontenidas en los Decretos N° 25663-M1NAE del 8 de octubre de 1996 y N°\n25700-MINAE del 15 de noviembre de 1996, su vigencia será de dieciséis años, a\npartir de su firma y aquellos que incorporen varias especies forestales y con\ndiferentes turnos de cosecha, la vigencia del contrato será igual a la de la especie\nque tenga el turno más largo de cosecha y que éste no exceda de dieciséis años,\nen cuyo caso éste sería el lapso máximo de vigencia.\n\nb)Los contratos correspondientes a la\nactividad de establecimiento de árboles en Sistemas Agroforestales tendrán una\nvigencia de cinco años a partir de su firma. Los contratos correspondientes al\nprograma de Sistemas bajo la actividad de Sistemas Agroforestales establecidos\nen Plantaciones de Aprovechamiento Forestal (PPAF) tendrán la misma vigencia\nsin embargo, dado que ya están plantados se les reconocerán retroactivamente\ntres años por su establecimiento previo.\n\nc)Los contratos correspondientes a la\nactividad de Protección de Bosque tendrán una vigencia de cinco años a partir\nde su firma. No obstante, para los contratos formalizados en los años 2015 y\n2016 cuando procedan los pagos tendrán efectos retroactivo a enero de cada año,\ndurante toda la vigencia del contrato, el beneficiario podrá gestionar la\nmodificación contractual respectiva para realizar este ajuste en el pago.\n\nd)Los contratos correspondientes a la\nactividad de Regeneración Natural tendrán una vigencia de cinco años a partir\nde su firma.\n\ne)Los contratos correspondientes a la\nactividad de Manejo de Bosque, tendrán una vigencia de cinco años a partir de\nsu firma. De previo a la firma del contrato, deberá constar en el expediente la\ncertificación de que fue aprobado el plan de manejo, según los Estándares de\nSostenibilidad para Manejo de Bosques Naturales: Principios, Criterios e\nIndicadores, Código de Prácticas y Manual de Procedimientos, Decreto Ejecutivo\nN\" 27388-MINAE publicado el 2 de noviembre de 1998, y el Decreto Ejecutivo\nN° 34559-MINAE publicado en La Gaceta N° 115, del día 16 de junio de 2008.\n\n2. Consideraciones Especiales. Condiciones\nestablecidas para los montos y actividades de las solicitudes PSA:\n\n2.1. Se faculta al Fondo Nacional de\nFinanciamiento Forestal a establecer actividades y montos diferenciados a los\nseñalados en esta resolución, de conformidad con acuerdos, convenios o\ncontratos o proyectos específicos con entidades, que aporten recursos\nfinancieros al Programa de Pago por Servicios Ambientales, que reconozcan\nmontos y condiciones diferentes a los establecidos para los diferentes\nservicios ambientales; para estos proyectos no aplicarán los criterios de\npriorización que se detallaron anteriormente, sino los pactados en cada\nconvenio. Los pagos se realizarán siempre y cuando se tenga disponibilidad\npresupuestaria para cubrir los compromisos adquiridos mediante el Programa de\nPago por Servicios Ambientales.\n\n2.2. Los montos pendientes por pagar por\ncontratos de años anteriores, se regirán según lo establecido en los Decretos\nEjecutivos respectivos para cada año.\n\n2.3. Para cubrir el costo de inscripción del\ncontrato ante el Registro Público, el Fondo Nacional de Financiamiento Forestal\nretendrá en el primer desembolso del monto total del contrato un 0,6%.\n\n2.4. Los recursos no utilizados por el\nFonafifo y los recursos recuperados en virtud de los incumplimientos\ncontractuales, serán depositados en una cuenta bancaria que al efecto\nestablezca el Fondo Nacional de Financiamiento Forestal y serán presupuestados\npara la ejecución de nuevas actividades de fomento.\n\n2.5. El beneficiario del proyecto deberá\ncontar durante todo el plazo del contrato, con un regente forestal debidamente\ninscrito en el Colegio de Ingenieros Agrónomos. Salvo en aquellos casos que se\nhaya determinado que el proyecto será supervisado directamente por el Fondo\nNacional de Financiamiento Forestal. Sin perjuicio de otras disposiciones, el o\nlos beneficiarios deberán aportar una certificación anual emitida por un\nregente forestal para el trámite de pago. Adicionalmente, para los contratos de\nReforestación de rápido crecimiento, deberá presentar además informes donde\ncertifique el estado de los proyectos en los años 8 y 10; para los proyectos de\nmediano crecimiento y otras especies deberán presentar dichos informes al año\n8, 12 y 16.\n\n2.6. Sin perjuicio de otras acciones que\nrepresenten incumplimiento a las obligaciones del contrato, para los contratos\nde Reforestación de rápido crecimiento o bloques a partir de los 12 meses y\npara las plantaciones de mediano crecimiento o bloques a partir de los 24 meses\nde establecida la plantación, se considera incumplido el contrato si la\nplantación no presenta el crecimiento mínimo establecido en el inciso d del\npunto 2.1 de esta resolución, o el indicado de previo en el estudio técnico\nrespectivo para otras especies. Como consecuencia de este incumplimiento, el\nproductor no recibirá el pago correspondiente a este año, siendo que el Fondo\nNacional de Financiamiento Forestal debe suspender los pagos respectivos y dar\npor terminado el contrato con responsabilidad para el beneficiario previo\ncumplimiento del debido proceso.\n\n2.7. Serán motivo de eximente de\nresponsabilidad por incumplimiento del contrato, el caso fortuito, la fuerza\nmayor, el hecho de un tercero como eximentes generales. De igual forma se\nprocederá cuando el propietario de la plantación demuestre que una plaga o\nenfermedad afectó la plantación y que las acciones oportunamente realizadas no\nlograron erradicarla. Se procederá de igual manera cuando el daño sea producto\nde un incendio que no pudo ser controlado a pesar de las medidas preventivas\nreportadas.\n\n2.8. No podrán ejecutarse proyectos en\nfincas que hayan sido objetos de plagas, enfermedades, o incendios; en tal\nsupuesto la finca no podrá ser sujeto de contratos en Reforestación y/o SAF en\nun plazo de 3 años, a partir del último contrato finalizado por esta causa.\n\n2.9. El Fonafito, será el responsable de\nmonitorear las plantaciones forestales que ingresen al Programa, debiendo no\nsolo hacer un seguimiento a nivel regional, sino un protocolo de control,\nmediante un mecanismo aleatorio de visitas según su capacidad técnica y\nadministrativa. De igual forma, deberá custodiar la información de las parcelas\npermanentes de mediciones de las plantaciones, a fin de sustentar los pagos y\nrespaldar las fijaciones de carbono y otros gases de efecto invernadero.\n\n2.10. Under this principle, financial instruments must be oriented to support the pillars of the National Development Plan; not by establishing discrimination, but by providing priority orientation to producer organizations that support small and medium-sized forest producers, and those located in the cantons with the greatest social lag, considering the objectives of the creation of the National Forest Financing Fund (Fondo Nacional de Financiamiento Forestal) according to the aforementioned Forest Law, without neglecting the established technical criteria.\n\n3- That the cited National Development Plan considers as one of its national goals to maintain at least three hundred thousand hectares under the Payment for Services Program, in its different modalities. Furthermore, it sets out as one of its challenges: to develop innovative financial instruments and strengthen existing ones, oriented towards sustainable forest management, including Protection, Regeneration, and the establishment of Agroforestry Systems and Forest Plantations; as well as the industrialization and commercialization of the goods and services generated by forest ecosystems.\n\nCONSIDERING\n\n1- That the budget assigned for the execution of new projects of the Payment for Environmental Services Program (Programa de Pago por Servicios Ambientales) for the year 2016, is for an amount of three billion eight hundred seventy-five million eight hundred seventy-three thousand two hundred twenty-seven colones. Said spending plan was approved by the Comptroller General of the Republic (Contraloría General de la República), through official communication DFOE-AE-0647, dated December 9, two thousand fifteen.\n\nTHEREFORE:\n\nTHE MINISTER OF ENVIRONMENT AND ENERGY\n\nRESOLVES\n\nArticle 1. To establish the spending limit for the National Forest Financing Fund (Fondo Nacional de Financiamiento Forestal), for new projects to be financed by activity, and to determine the payment amounts per activity.\n\n1. Activities to be financed: For the year 2016, two modalities to be financed will be considered:\n\na-Recovery of Forest Cover (Recuperación de la Cobertura Forestal), which includes the activities of Reforestation, Regeneration, and Agroforestry Systems, and b-Maintenance of Forest Cover (Mantenimiento de la Cobertura Forestal), which includes Forest Protection and Forest Management. In any case, the resources used for these purposes must be incorporated into the institutional budget and approved by the Comptroller General of the Republic (Contraloría General de la República).\n\n2. Regarding the payment amounts per activity and other conditions:\n\n2.1. Reforestation Activity: The conditions that will govern the processing of applications for the recognition of environmental services in the Reforestation activity are as follows:\n\nThe amount to be paid for fast-growing species referring to: Gmelina arborea, Acacia mangium, Vochysia guatemalensis, and Vochysia hondurensis, shall be six hundred thirty-six thousand seven hundred thirty-nine colones with 00/100 (¢636,739) per hectare, disbursed over a period of five years. Payments shall be distributed as follows: 50% the first year, 20% the second year, 15% the third year, 10% the fourth year, and 5% the fifth year.\n\nThe amount to be paid for medium-growth species referring to: Tectona grandis, Pinus sp, Cordia alliodora, Vochysia ferruginea, Eucalyptus sp, and Cedrela odorata, shall be seven hundred fifty thousand one hundred thirty-two colones with 00/100 (¢750,132) per hectare, disbursed over a period of five years. These payments correspond to the total years of the agreed term; however, in order to allow for the establishment of the plantation and its maintenance, it will be advanced during the first five years.\n\ng) Fonafifo may modify, when so requested, those contracts signed before the year 2006 that demonstrate having reached a minimum production of 13 cubic meters of mean annual increment per hectare. For such purposes, Fonafifo may request the information it deems pertinent.\n\n2.2. Natural Regeneration Activity: The conditions that will govern the processing of applications for the recognition of environmental services in the Natural Regeneration activity are detailed below.\n\na) The amount to be paid for Natural Regeneration shall be one hundred eight thousand twenty-six colones with 00/100 (¢108,026) per hectare, disbursed in five annual payments of 20% over a period of five years.\n\n2.3. Agroforestry Systems Activity: The conditions that will govern the processing of applications for the recognition of environmental services in the Agroforestry Systems activity are detailed below.\n\nThe amount to be paid shall be nine hundred twenty-one colones (¢921) per tree, integrated into Agroforestry Systems and disbursed over a period of five years. Payments shall be distributed as follows: 50% the first year, 25% the third year, and 25% the fifth year.\n\nThe amount to be paid shall be one thousand three hundred sixty-five colones with 00/100 (¢1,365) per tree, integrated into Agroforestry Systems, strictly with native species contained in Executive Decrees No. 25663-MINAE of October 8, 1996, and No. 25700-MINAE of November 15, 1996, disbursed over a period of five years. Payments shall be distributed as follows: 50% the first year, 25% the third year, and 25% the fifth year.\n\nThe amount to be paid shall be one thousand three hundred sixty-five colones with 00/100 (¢1,365) per tree under the activity of Agroforestry Systems established in Forest Harvesting Plantations (PPAF), financed through forest credit. Payments shall be distributed as follows: 80% upon contract signing, once the trees have reached 36 months of age, and the remaining 20% in the fifth year of the project when the trees have reached 60 months of age.\n\n2.4. Forest Protection Activity: The conditions that will govern the processing of applications for the recognition of environmental services in the Forest Protection activity are detailed below:\n\na) The amount to be paid shall be one hundred sixty-eight thousand six hundred twenty-six colones with 00/100 (¢168,626), disbursed in five annual payments of 20% over a period of five years. In the case of applications located within areas of water importance, identified by the Costa Rican Institute of Aqueducts and Sewers (ICAA), the Water Directorate, and Fonafifo, an additional amount of forty-two thousand one hundred fifty-seven colones with 00/100 (¢42,157) shall be recognized, making the total amount to be paid two hundred ten thousand seven hundred eighty-three colones with 00/100 (¢210,783) per hectare, disbursed in five annual payments of 20% over a period of five years. This additional amount shall be applied until the budget allocated for this activity is exhausted.\n\n2.5. Forest Management Activity. The conditions that will govern the processing of applications for the recognition of environmental services in the Forest Management activity are detailed below:\n\na) The amount to be paid shall be one hundred thirty-one thousand seven hundred thirty-nine colones with 00/100 (¢131,739) per hectare, disbursed in five annual payments of 20% over a period of five years.\n\n3. Updating of payment amounts. The amounts established per activity within the Payment for Environmental Services Program (Programa de Pago por Servicios Ambientales) shall be updated annually using the Consumer Price Index (CPI), calculated by the National Institute of Statistics and Census (INEC), at the close of the previous year's period.\n\nArticle 2. The National Forest Financing Fund (Fondo Nacional de Financiamiento Forestal) is instructed to incorporate the following conditions into the Payment for Environmental Services contracts:\n\n1. Regarding the effective terms of the contracts: The effective terms of the Payment for Environmental Services contracts, generated by the modalities of recovery and/or maintenance of forest cover (cobertura forestal), shall be as follows:\n\na) Contracts corresponding to the Reforestation activity through the establishment of fast-growing species shall have a term of ten years from their signing. Those incorporating medium-growth species and the native species contained in Decrees No. 25663-MINAE of October 8, 1996, and No. 25700-MINAE of November 15, 1996, shall be effective for sixteen years from their signing, and for those incorporating various forest species with different harvest cycles, the contract term shall be equal to that of the species with the longest harvest cycle, provided this does not exceed sixteen years, in which case this would be the maximum effective period.\n\nb) Contracts corresponding to the tree establishment activity in Agroforestry Systems shall have a term of five years from their signing. Contracts corresponding to the Systems program under the Agroforestry Systems activity established in Forest Harvesting Plantations (PPAF) shall have the same term; however, given that they are already planted, three years shall be retroactively recognized for their prior establishment.\n\nc) Contracts corresponding to the Forest Protection activity shall have a term of five years from their signing. However, for contracts formalized in the years 2015 and 2016, when payments are due, they shall have retroactive effect to January of each year. Throughout the entire term of the contract, the beneficiary may request the respective contractual modification to apply this payment adjustment.\n\nd) Contracts corresponding to the Natural Regeneration activity shall have a term of five years from their signing.\n\ne) Contracts corresponding to the Forest Management activity shall have a term of five years from their signing. Prior to the signing of the contract, the file must contain certification that the management plan was approved, according to the Sustainability Standards for Natural Forest Management: Principles, Criteria and Indicators, Code of Practices and Procedures Manual, Executive Decree No. 27388-MINAE published on November 2, 1998, and Executive Decree No. 34559-MINAE published in La Gaceta No. 115, on June 16, 2008.\n\n2. Special Considerations. Conditions established for the amounts and activities of PSA applications:\n\n2.1. The National Forest Financing Fund (Fondo Nacional de Financiamiento Forestal) is authorized to establish activities and amounts differentiated from those indicated in this resolution, in accordance with agreements, covenants, or specific contracts or projects with entities that contribute financial resources to the Payment for Environmental Services Program, which recognize amounts and conditions different from those established for the various environmental services; for these projects, the prioritization criteria detailed above shall not apply, but rather those agreed upon in each covenant. Payments shall be made provided there is budget availability to cover the commitments acquired through the Payment for Environmental Services Program.\n\n2.2. The amounts pending payment for contracts from previous years shall be governed by the provisions established in the respective Executive Decrees for each year.\n\n2.3. To cover the cost of registering the contract with the Public Registry, the National Forest Financing Fund (Fondo Nacional de Financiamiento Forestal) shall retain 0.6% from the first disbursement of the total contract amount.\n\n2.4. Resources not used by Fonafifo and resources recovered due to contractual breaches shall be deposited in a bank account established for this purpose by the National Forest Financing Fund (Fondo Nacional de Financiamiento Forestal) and shall be budgeted for the execution of new promotion activities.\n\n2.5. The project beneficiary must have, for the entire term of the contract, a forest regent (regente forestal) duly registered with the College of Agronomist Engineers. Except in those cases where it has been determined that the project will be supervised directly by the National Forest Financing Fund (Fondo Nacional de Financiamiento Forestal). Without prejudice to other provisions, the beneficiary or beneficiaries must provide an annual certification issued by a forest regent for the payment process. Additionally, for fast-growing Reforestation contracts, they must also submit reports certifying the status of the projects in years 8 and 10; for medium-growth projects and other species, they must submit these reports in years 8, 12, and 16.\n\n2.6. Without prejudice to other actions that represent a breach of contract obligations, for fast-growing Reforestation contracts or blocks starting from 12 months, and for medium-growth plantations or blocks starting from 24 months after plantation establishment, the contract is considered breached if the plantation does not present the minimum growth established in subsection d of point 2.1 of this resolution, or that previously indicated in the respective technical study for other species. As a consequence of this breach, the producer shall not receive the corresponding payment for that year, and the National Forest Financing Fund (Fondo Nacional de Financiamiento Forestal) must suspend the respective payments and terminate the contract with liability for the beneficiary, following due process.\n\n2.7. Grounds for exemption from liability for breach of contract shall be acts of God, force majeure, and the act of a third party, as general exemptions. The same shall apply when the plantation owner demonstrates that a pest or disease affected the plantation and that the actions taken in a timely manner failed to eradicate it. The same shall apply when the damage is the result of a fire that could not be controlled despite the reported preventive measures.\n\n2.8. Projects may not be executed on farms that have been subject to pests, diseases, or fires; in such case, the farm may not be subject to Reforestation and/or SAF contracts for a term of 3 years, starting from the last contract terminated for this cause.\n\n2.9. Fonafifo shall be responsible for monitoring the forest plantations that enter the Program, and must not only conduct regional follow-up but also a control protocol, through a random visit mechanism according to its technical and administrative capacity. Likewise, it must safeguard the information from the permanent measurement plots of the plantations, in order to support payments and back carbon fixation and other greenhouse gas inventories.\n\n2.10. In the event that the submitted applications are found to have overlaps or displacement among them and/or with other farms, Fonafifo shall evaluate, according to technical and legal criteria, the approval or rejection of the entry applications.\n\nArticle 3.
