  "body_es_text": "en la totalidad del texto\n\n                    -\n\n                        Texto Completo Norma 082\n\n                        Faculta a los oficiales del Servicio Nacional de Guardacostas o de la Fuerza\nPública para proceder al decomiso de las artes de pesca prohibidas o ilegales que determinen en el\ncumplimiento de sus funciones\n\nTexto Completo acta: 112069\n\nINSTITUTO COSTARRICENSE DE PESCA\n\ntext-align:center;\ntext-indent:24.0pt'>Y ACUICULTURA\n\nAJDIP/082-2015.-Puntarenas,\na los trece días del mes de febrero de dos mil quince.\n\nConsiderando:\n\n(Este\nAcuerdo fue así modificado mediante Acuerdo AJDIP/329-2016).\n\n1º-Que\nde conformidad con la presentación realizada por el Sr. Edwin Salazar Serrano,\nJefe del Departamento de Protección y Registro, sobre las acciones realizadas\npara la atención del control y vigilancia en el Golfo de Nicoya, presenta\npropuesta de Acuerdo a efecto que permita el decomiso de artes de pesca, que de\nconformidad con la normativa vigente, se consideren ilegales, lo cual\npermitiría contar con una herramienta efectiva de control sobre esas artes de\npesca ilegales, en resguardo del recurso pesquero del Golfo de Nicoya.\n\n2º-Que\nde conformidad con lo regulado en la ley 7384 y en la ley 8436, el Instituto\nCostarricense de la Pesca y Acuacultura tiene las competencias y facultades\npertinentes para establecer las regulaciones de protección, control y\nregulación de las actividades de pesca marítima.\n\n3º-Que\nla actividad pesquera fue considerada y declarada de utilidad pública e interés\nsocial, siendo responsabilidad y atribución del INCOPESCA ejercer el efectivo\ncontrol como autoridad ejecutora de lo establecido en la Ley 8436.\n\n4º-Que de conformidad con las disposiciones de la Ley de Pesca y\nAcuicultura, la utilización, el uso o la tenencia de artes de pesca ilegales o\nprohibidas en la realización de las faenas extractivas de los productos del\nmar, son reputadas como infracciones de naturaleza penal y su uso afecta\nnotablemente la conservación del recurso marino.\n\n5º-Que\nsegún lo establecido en la Ley 8436 en su artículo 133 y la Ley 8000,\ncorresponde al Servicio Nacional de Guardacostas y de la Fuerza Pública decomisar\nbienes, equipos, artes de pesca y productos del mar, así como velar por el\nlegítimo aprovechamiento y la protección de los recursos naturales existentes\nen las aguas marítimas jurisdiccionales y en las aguas interiores del Estado,\nsegún la legislación vigente, nacional e internacional, para ello podrá\nsuscribir convenios o establecer mecanismos de coordinación y cooperación con\nel INCOPESCA.\n\n6º-Que\nbajo esa premisa, consideran los Sres. Directivos, que resulta conveniente\nacoger la recomendación propuesta sobre artes de pesca ilegales, a fin de que\nse cuente con una herramienta jurídica que permita a las Autoridades del\nServicio Nacional de Guardacostas y de la Fuerza Pública, el decomiso de artes\nde pesca considerados ilegales, razón por la cual, la Junta Directiva, por\ntanto;\n\nACUERDA:\n\n1º-Los\noficiales del Servicio Nacional de Guardacostas o de la Fuerza Pública que en\naplicación de la legislación pesquera y disposiciones normativas y\nreglamentarias existentes en la materia, determinen en el cumplimiento de sus\nfunciones, el hallazgo, la existencia, la posesión, la portación, venta,\nimportación, fabricación, almacenaje o utilización de artes de pesca prohibidas\no ilegales, por parte de cualquier persona, quedan plenamente autorizados y\nfacultados para proceder en forma inmediata al decomiso de las mismas.\n\n2º-La\nautoridad policial que proceda al decomiso de un arte de pesca ilegal estará en\nla obligación de levantar un acta, en presencia de dos testigos. Ese documento\ndeberá contener la fecha, el lugar, el nombre y los apellidos de las personas\nque actúan, con indicación de las diligencias realizadas y la firma de todos\nlos intervinientes o la mención de que alguno no puede o no quiere firmar.\n\nDeberá\nentregarse copia del acta a la persona, a quien se le decomise el arte o a\nquien se encuentre en el lugar del decomiso.\n\nLas\nartes de pesca por hallazgo o decomisadas serán puestas a la orden de la\nautoridad judicial competente, junto con la denuncia respectiva o del INCOPESCA\ny el informe pertinente, según corresponda.\n\n3º-Son\nartes de pesca permitidas únicamente aquellas que se encuentren debidamente\nestablecidas y consignadas en la licencia de pesca o autorización para cada\npermisionario. No se permite de conformidad con el artículo primero ningún arte\nde pesca no autorizado expresamente por el INCOPESCA.\n\n4º-Aparte\nde lo mencionado en el artículo anterior son artes de pesca total y\nabsolutamente prohibidas las siguientes:\n\nLa red agallera que estirada la medida de distancia interna entre\nlos dos nudos opuestos de la abertura de una medida menor de 3 pulgadas.\n\nLa red agallera con una altura mayor de 50 mallas de alto o con un\nlargo mayor de 600 metros lineales, que se encuentre en la zona A del Golfo de\nNicoya, entendida ésta como aquella que se encuentra comprendida entre una\nlínea recta imaginaria que va desde el Muelle de Cruceros de Puntarenas\n(9º58´26\" Latitud Norte, 84º49´51\" Longitud Oeste), hasta el Faro ubicado en la\nparte más oriental de las Islas Negritos (09º49´14\" Latitud Norte, 84º49´35\"\nLongitud Oeste) y de esta línea bordeando la costa hacia el interior del Golfo\nhasta llegar a una línea recta imaginaria entre Puerto Níspero (10º12´7\"\nLatitud Norte, 85º13´9\" Longitud Oeste) y Puerto Moreno (10º12´4\" Latitud\nNorte, 85º14´75\" Longitud Oeste) en la desembocadura del Río Tempisque.\n\nLa red agallera con una altura mayor de 70\nmallas de alto o con un largo mayor de 600 metros lineales que se encuentre en\nel área comprendida entre una línea recta imaginaria que va desde el extremo de\nla punta de Puntarenas (9°57´59\",43 latitud norte y 84°51´01\",31 longitud\noeste) hasta Playa Blanca en el Golfo de Nicoya (9°54´52\",91 latitud norte y\n84°55´11\",64 longitud oeste) y de ahí aguas externas hasta la línea imaginaria\nque parte del faro ubicado en la parte más oriental de las Islas Negritos\n(9°49´21\",76 latitud norte y 84°49´30\",43 longitud oeste) hasta el Muelle de\nCruceros en Puntarenas (9°58´18\",51 latitud norte y 84°49´53\",58 longitud\noeste).\n\nLa\nrastra\n\n5º-Las artes\nde pesca que se pongan a disposición del INCOPESCA y no habiéndose presentado\nreclamo alguno por parte de particulares, le quedará permitido al instituto\nrealizar cualquiera de las siguientes gestiones:\n\nA)\nDonar las artes de pesca a instituciones públicas u organizaciones no\ngubernamentales, en tal caso la solicitud debe indicar con claridad los fines\npara los que serán utilizados.\n\nB)\nDonar las artes de pesca a organizaciones no gubernamentales dedicadas a la\ncooperación en materia ambiental.   "body_en_text": "across the entirety of the text\n\n                    -\n\n                        Complete Text of Norm 082\n\n                        Empowers officers of the National Coast Guard Service or the Public Force\nto proceed with the seizure of prohibited or illegal fishing gear that they identify in the\nperformance of their duties\n\nComplete Text of record: 112069\n\nCOSTA RICAN INSTITUTE OF FISHERIES\n\ntext-align:center;\ntext-indent:24.0pt'>AND AQUACULTURE\n\nAJDIP/082-2015.-Puntarenas,\non the thirteenth day of February, two thousand fifteen.\n\nWhereas:\n\n(This\nAgreement was thus amended by Agreement AJDIP/329-2016).\n\n1º-That\nin accordance with the presentation made by Mr. Edwin Salazar Serrano,\nHead of the Protection and Registration Department, regarding the actions carried out\nfor addressing control and surveillance in the Gulf of Nicoya, he presents a proposal for an Agreement to allow the seizure of fishing gear that,\nin accordance with current regulations, is considered illegal, which\nwould allow for an effective control tool over said illegal fishing gear,\nin safeguard of the fishery resource of the Gulf of Nicoya.\n\n2º-That\nin accordance with what is regulated in Law 7384 and Law 8436, the Costa Rican\nInstitute of Fisheries and Aquaculture has the pertinent competencies and powers\nto establish regulations for the protection, control, and\nregulation of maritime fishing activities.\n\n3º-That\nthe fishing activity was considered and declared of public utility and social\ninterest, it being the responsibility and attribution of INCOPESCA to exercise effective\ncontrol as the executing authority of what is established in Law 8436.\n\n4º-That in accordance with the provisions of the Fisheries and\nAquaculture Law, the use or possession of illegal or\nprohibited fishing gear in carrying out extractive operations for sea\nproducts is deemed an offense of a criminal nature and its use\nsignificantly affects the conservation of marine resources.\n\n5º-That\naccording to what is established in Law 8436 in its Article 133 and Law 8000,\nit corresponds to the National Coast Guard Service and the Public Force to seize\ngoods, equipment, fishing gear, and sea products, as well as to ensure the\nlegitimate exploitation and protection of the natural resources existing\nin the jurisdictional maritime waters and the internal waters of the State,\nin accordance with current national and international legislation; to this end, it may\nenter into agreements or establish coordination and cooperation mechanisms with\nINCOPESCA.\n\n6º-That\nunder this premise, the Directors consider it advisable\nto accept the proposed recommendation regarding illegal fishing gear, so as\nto have a legal tool that allows the Authorities of the\nNational Coast Guard Service and the Public Force to seize\nfishing gear considered illegal, wherefore, the Board of Directors,\ntherefore;\n\nAGREES:\n\n1º-The\nofficers of the National Coast Guard Service or the Public Force who, in\napplication of the fisheries legislation and the existing regulatory and normative\nprovisions on the matter, identify in the performance of their\nduties the discovery, existence, possession, carrying, sale,\nimportation, manufacture, storage, or use of prohibited\nor illegal fishing gear by any person, are fully authorized\nand empowered to proceed immediately with the seizure thereof.\n\n2º-The\npolice authority proceeding with the seizure of illegal fishing gear shall be\nunder the obligation to draw up a record, in the presence of two witnesses. This document\nmust contain the date, the place, the first name and last names of the persons\ninvolved, indicating the proceedings carried out, and the signature of all\nthe participants or the mention that some cannot or do not want to sign.\n\nA\ncopy of the record must be delivered to the person from whom the gear is seized or\nto whomever is at the location of the seizure.\n\nFishing\ngear found or seized shall be placed at the disposal of the\ncompetent judicial authority, together with the respective complaint, or of INCOPESCA\nand the pertinent report, as applicable.\n\n3º-Only\nthose fishing gears that are duly\nestablished and recorded in the fishing license or authorization for each\npermit holder are permitted. Pursuant to article one, no\nfishing gear not expressly authorized by INCOPESCA is permitted.\n\n4º-Apart\nfrom what is mentioned in the preceding article, the following\nfishing gears are totally and absolutely prohibited:\n\nThe gillnet that, when stretched, has an internal distance measurement between\nthe two opposite knots of the mesh opening of less than 3 inches.\n\nThe gillnet with a height greater than 50 meshes high or with a\nlength greater than 600 linear meters, when found in zone A of the Gulf of\nNicoya, understood as that area which lies between an\nimaginary straight line running from the Puntarenas Cruise Ship Pier\n(9º58´26\" North Latitude, 84º49´51\" West Longitude), to the Lighthouse located on the\neasternmost part of the Islas Negritos (09º49´14\" North Latitude, 84º49´35\"\nWest Longitude), and from this line skirting the coast towards the interior of the Gulf\nuntil reaching an imaginary straight line between Puerto Níspero (10º12´7\"\nNorth Latitude, 85º13´9\" West Longitude) and Puerto Moreno (10º12´4\" North\nLatitude, 85º14´75\" West Longitude) at the mouth of the Tempisque River.\n\nThe gillnet with a height greater than 70\nmeshes high or with a length greater than 600 linear meters when found in\nthe area comprised between an imaginary straight line running from the tip of\nthe Puntarenas point (9°57´59\",43 north latitude and 84°51´01\",31 west\nlongitude) to Playa Blanca in the Gulf of Nicoya (9°54´52\",91 north latitude and\n84°55´11\",64 west longitude) and from there, external waters to the imaginary line\nthat runs from the lighthouse located on the easternmost part of the Islas Negritos\n(9°49´21\",76 north latitude and 84°49´30\",43 west longitude) to the Cruise Ship Pier\nin Puntarenas (9°58´18\",51 north latitude and 84°49´53\",58 west\nlongitude).\n\nThe\ntrawl net\n\n5º-For fishing\ngear placed at the disposal of INCOPESCA where no\nclaim whatsoever has been filed by private parties, the institute is permitted\nto carry out any of the following actions:\n\nA)\nDonate the fishing gear to public institutions or non-governmental\norganizations; in such case, the request must clearly indicate the purposes\nfor which they will be used.\n\nB)\nDonate the fishing gear to non-governmental organizations dedicated to\ncooperation in environmental matters.
