Para efecto\ndel cobro de las licencias de pesca comercial a embarcaciones, deberá tenerse\nen cuenta la clasificación dispuesta en el artículo 43 de la Ley N°8436 Ley de\nPesca y Acuicultura, así como la autonomía autorizada por el MOPT.\n\n2. En cuanto a\nlos carné para capitanes, tripulantes y ayudantes de embarcaciones de pesca\ndeportiva o turística o de observación de cetáceos, estos serán anuales. Para\nsu otorgamiento deberán presentar copia del documento de identificación y una\nfotografía tamaño pasaporte. A los capitanes extranjeros en condición de\nturistas, les estará prohibido el ejercicio como tal en embarcaciones de pesca\nturística de bandera nacional.\n\n3. En el caso del\npago de las licencias de pesca comercial de embarcaciones inactivas, el pago\nindicado será el único que deba realizarse anualmente para mantener la vigencia\nde la inactividad y si el permisionario decide reactivar o activar la\nembarcación para la realización de las faenas de pesca, estando en curso una de\nlas inactividades, deberá abonarse del monto de la inactividad cancelado, el\nporcentaje correspondiente al tiempo transcurrido, y pagarse la diferencia del\ncosto de la licencia de operación de la embarcación en el período anual respectivo.\n\n4. Los\npermisionarios o armadores físicos a nombre de quienes estén otorgadas las\nlicencias de pesca comercial, no estarán obligados a cancelar el rubro\ncorrespondiente por concepto del carné establecido en el artículo 44 de la Ley\nN°8436 Ley de Pesca y Acuicultura, en razón de tenerse por acreditada su\ncondición en la licencia de pesca correspondiente, sin embargo, la institución\ndeberá emitirlo sin costo alguno.\n\n5. Los\ninteresados, las empresas operadoras de tours o las asociaciones, podrán adquirir\nde manera previa y planificada, la cantidad de carné que consideren conveniente\nmantener a disposición de sus clientes y en el entendido de que dichos carné\nINCOPESCA los otorgará con fecha de emisión al día en que son adquiridos y con\nfecha de vencimiento según el plazo de vigencia seleccionado. Cumplido el plazo\nde vencimiento sin que hubiesen sido utilizados por los usuarios, estos\ncaducarán de pleno derecho sin que puedan ser revalidados.\n\n6. No se cobrará\nel monto de la emisión por carné de identificación de pesca comercial y pesca\ndeportiva o turística continental o marina en los casos de solicitantes,\npermisionarios o autorizados que sean costarricenses mayores de 65 años,\ndebidamente verificado contra su cédula de identidad o certificación de nacimiento.\n\n7. En aquellos\nservicios relacionados con inspecciones por descarga de productos\nhidrobiológicos, estadía en muelle o movilización de carga en vehículos, se\naplicará el término fracción de la siguiente manera:\n\na. Cuando el\ntiempo de permanencia de la embarcación o vehículo es igual o menor a treinta\nminutos (30 min o menos), se cobrará el equivalente a 30 minutos.\n\nb. Si el tiempo\nde permanencia de la embarcación o vehículo es mayor a treinta minutos o igual\na 60 minutos (31 min o 60 min), se cobrará el equivalente a 1 hora.\n\nc. Para\npermanencias mayores a una hora y fracción, se aplicarán los conceptos\nindicados en los puntos a) y b) anteriores.\n\nd. En el caso de\nlas inspecciones por descarga de productos hidrobiológicos, cualquier fracción\ndespués de la primera hora se cobrará como media fracción, sea en horario\nordinario o extraordinario.\n\n8. Para las\ninspecciones la tarifa ordinaria corresponde a las realizadas dentro del\nhorario ordinario de trabajo del Instituto, sea de las 8:00 a. m. a las 4:00 p.\nm. La tarifa extraordinaria corresponde a las inspecciones realizadas de 4:01\np. m. a 7:59 a. m. así como las efectuadas en días feriados, sábados, domingos\no asuetos.\n\n9. En el caso de\nlas inspecciones por descarga de producto hidrobiológico, que comprendan\ncamarón, sardina, tiburón, vela, espada y atún, que se realicen en el Muelle\nPúblico de la Terminal Multiservicios Pesqueros del Barrio El Carmen,\nPuntarenas o en cualquier otro muelle, centro de acopio o puesto de recibo\nprivados, debidamente autorizados por el INCOPESCA y el SENASA, la institución\nprocederá de la siguiente manera:\n\nEn horario\nordinario:\n\na. Aquellas\nembarcaciones pertenecientes a la flota nacional mediana escala y avanzada, que\ndesembarquen tiburón, serán objeto del cobro total de las horas que conlleve la\ninspección.\n\nb. Las\nembarcaciones pertenecientes a la flota nacional mediana escala y avanzada que\nno desembarquen tiburón, serán objeto del cobro de las primera hora de\ninspección.\n\nc. En tratándose\nde la flota nacional semiindustrial sardinera, se\ncobrará las dos primeras horas de inspección por descarga, periodo durante el\ncual, los funcionarios del INCOPESCA procederán a tomar la muestra respectiva\npara determinar la longitud total promedio de la sardina capturada, de\nconformidad con el acuerdo AJDIP/215-98.\n\nd. En relación\ncon la flota nacional semiindustrial camaronera de\norilla y de profundidad, se cobrarán las dos primeras horas de inspección por\ndescarga, periodo durante el cual, los funcionarios del INCOPESCA procederán a\ntomar la muestra respectiva para determinar el peso mínimo promedio de captura\ndel camarón blanco, pinky, Fidel; camello, camellito\ny langostino chileno (chicharra) de conformidad con el artículo 48 del\nReglamento a la Ley N° 8436, así como la composición de la fauna de\nacompañamiento, según el Decreto Ejecutivo N° 18795-MAG del 9 de enero de 1989.\n\ne. Las\nembarcaciones pertenecientes a la flota extranjera no atunera, serán objeto del\ncobro total de las horas que conlleve la inspección, independientemente de los\ngrupos comerciales o las especies que desembarque.\n\nf. Se exceptúa de\nla solicitud, inspección y del cobro a las embarcaciones pertenecientes a la\nflota artesanal en pequeña escala.\n\nEn horario\nextraordinario:\n\na. Todas las\ninspecciones por descarga serán cobradas, independientemente de la flota, los\ngrupos comerciales o especies que desembarque.\n\n10. En tratándose\nde la flota atunera extranjera, sea en horario ordinario o extraordinario, se\ncobrarán las dos primeras horas de descarga, periodo durante el cual los funcionarios\ndel INCOPESCA procederán a solicitar de manera aleatoria la descarga de\ndeterminadas bodegas, a efecto de determinar, de conformidad con el artículo 58\nde la Ley 8436, la no existencia de productos hidrobiológicos diferentes al\natún. De igual manera, se cobrará las últimas dos horas de descarga a efecto de\nverificar que las bodegas estén completamente vacías.\n\n11. En aquellos\ncasos en que a solicitud del interesado, el INCOPESCA ha realizado las\ngestiones para la designación del inspector y este se hiciera presente en el\nlugar, hora y fecha establecidos, y el interesado decide posponer la descarga,\nse cobrará una hora de inspección, según sea en horario ordinario o\nextraordinario. Una vez reprogramada la inspección que fue suspendida, se reiniciará\ncomo si se tratase de una nueva inspección, razón por la que se cobrará\nnuevamente el costo de la primera hora y siguientes, sea ordinaria o\nextraordinaria según corresponda.\n\n12. En relación\ncon la estadía de las embarcaciones con fines científicos, de investigación,\ndidácticos y de fomento, mediante acuerdo razonado y justificado, la Junta\nDirectiva podrá eximir el cobro, en aquellos casos en que exista un fin de\nbeneficio público al país o a la institución.\n\n13. En el caso de\nla estadía de las embarcaciones nacionales o extranjeras comerciales para fines\ndistintos a la descarga de productos pesqueros o avituallamiento, previo a la\nautorización correspondiente, la institución debe valorar la naturaleza propia\ndel tipo de actividades que se requieren realizar, a fin de determinar posibles\nefectos negativos sobre los ecosistemas o sobre la actividad de descarga de\nproductos hidrobiológicos que se realicen o se vayan a realizar en el área\ndestinada para ese propósito, de manera que se asegure la inocuidad.\n\n14. Toda\ninspección deberá ser cancelada previamente o a más tardar el día hábil\nsiguiente a que es realizada por los funcionarios del Instituto, sea mediante\ndepósito bancario o transferencia electrónica a una de las cuentas bancarias de\nINCOPESCA o mediante el pago directo en una de las oficinas del instituto. Si\nel pago se realiza por depósito o transferencia, el usuario deberá entregar\ncopia del respectivo comprobante bancario a la oficina más cercana. La\ninstitución no está autorizada para conceder crédito por este servicio, por lo\ntanto, al usuario que no atienda la disposición establecida se le suspenderán\ntodos los servicios que brinda el INCOPESCA y deberá pagar una multa por pago\ntardío de los bienes y servicios equivalente a la tasa de interés activa\npromedio del Sistema Financiero del último mes calculada a partir de los\npréstamos en moneda nacional y en dólares, las cuales serán aplicadas a las\ntarifas fijadas en colones y en dólares, respectivamente.\n\n15. El usuario\ndel servicio de agua, servicio de estadía y muellaje y otros servicios que\nbrinde la institución en la Terminal Pesquera, deberá cancelarlos antes de\ndesatracar la embarcación o a más tardar 30 días naturales posteriores a\nrecibir los servicios, siempre y cuando cuente con crédito autorizado\npreviamente por el INCOPESCA. En caso de no contar con crédito autorizado,\ndeberá pagar los servicios antes de desatracar la embarcación. Al usuario que\nno atienda estas disposiciones se le suspenderán todos los servicios y deberá\npagar adicionalmente una multa por pago tardío de los bienes y servicios\nequivalente a la tasa de interés activa promedio del Sistema Financiero del\núltimo mes calculada a partir de los préstamos en moneda nacional y en dólares,\nlas cuales serán aplicadas a las tarifas fijadas en colones y en dólares,\nrespectivamente.\n\n16. Los vehículos\nque ingresen a cargar y descargar productos cancelarán las horas de permanencia\nantes de salir del área delimitada de muelle.\n\n17. Las\nlicencias, permisos, autorizaciones y todo tipo de servicio que no sean pagado\nen el periodo correspondiente, deberán ser cancelados con el monto de la tarifa\nanual que corresponda a cada año adeudado, más un porcentaje por cada año de\natraso, traído a valor presente hasta el día de pago, por concepto de multa por\npago tardío de los bienes y servicios equivalente a la tasa de interés activa\npromedio del Sistema Financiero del último mes calculada a partir de los\npréstamos en moneda nacional y en dólares, las cuales serán aplicadas a las\ntarifas fijadas en colones y en dólares, respectivamente.\n\n18. El dinero\nrecaudado por las tarifas cobradas será depositado e ingresado en las cuentas\nbancarias que el INCOPESCA tenga en los bancos del Sistema Bancario Nacional.\nDe igual manera, los usuarios podrán pagar el importe por las tarifas mediante\nmedios electrónicos (transferencia, datafono, página web).\n\n19. Las tarifas\nestablecidas estarán sujetas a revisión y ajuste cuando ello fuere procedente,\npor parte del INCOPESCA.\n\n20. For the purpose of charging commercial fishing licenses for vessels, the classification set forth in Article 43 of Law No. 8436, the Fisheries and Aquaculture Law, must be taken into account, as well as the autonomy authorized by the MOPT.\n\n2. Regarding cards for captains, crewmembers, and assistants of sport or tourist fishing vessels or cetacean watching vessels, these shall be annual. For their issuance, a copy of the identification document and a passport-size photograph must be submitted. Foreign captains in tourist status are prohibited from practicing as such on tourist fishing vessels flying the national flag.\n\n3. In the case of payment for commercial fishing licenses for inactive vessels, the indicated payment shall be the only one that must be made annually to maintain the validity of the inactivity, and if the permit holder decides to reactivate or activate the vessel for carrying out fishing operations, while one of the inactivity periods is in progress, the percentage corresponding to the elapsed time must be deducted from the amount of the inactivity payment paid, and the difference in the cost of the vessel's operating license for the respective annual period must be paid.\n\n4. Physical permit holders or shipowners, in whose name commercial fishing licenses have been granted, are not obligated to pay the corresponding item for the card established in Article 44 of Law No. 8436, the Fisheries and Aquaculture Law, because their status is deemed accredited in the corresponding fishing license; however, the institution must issue it at no cost.\n\n5. Interested parties, tour operating companies, or associations may acquire, in a planned and prior manner, the quantity of cards they deem convenient to keep available for their clients, with the understanding that INCOPESCA will issue said cards with an issue date on the day they are acquired and with an expiration date according to the selected validity period. Once the expiration period has passed without having been used by the users, these will automatically expire with no possibility of being revalidated.\n\n6. The issuance amount for commercial fishing identification cards and continental or marine sport or tourist fishing shall not be charged in the cases of applicants, permit holders, or authorized parties who are Costa Rican citizens over 65 years old, duly verified against their identity card or birth certificate.\n\n7. In those services related to inspections for landing hydrobiological products, stay at the dock, or vehicle cargo mobilization, the term fraction shall be applied as follows:\n\na. When the stay time of the vessel or vehicle is equal to or less than thirty minutes (30 min or less), the equivalent of 30 minutes shall be charged.\n\nb. If the stay time of the vessel or vehicle is greater than thirty minutes or equal to 60 minutes (31 min or 60 min), the equivalent of 1 hour shall be charged.\n\nc. For stays longer than one hour and a fraction, the concepts indicated in points a) and b) above shall apply.\n\nd. In the case of inspections for landing hydrobiological products, any fraction after the first hour shall be charged as a half fraction, whether during ordinary or extraordinary schedule.\n\n8. For inspections, the ordinary tariff corresponds to those carried out within the Institute's ordinary working hours, i.e., from 8:00 a.m. to 4:00 p.m. The extraordinary tariff corresponds to inspections carried out from 4:01 p.m. to 7:59 a.m., as well as those carried out on holidays, Saturdays, Sundays, or days off.\n\n9. In the case of inspections for landing hydrobiological products, including shrimp, sardine, shark, sailfish, swordfish, and tuna, carried out at the Public Dock of the Terminal Multiservicios Pesqueros in Barrio El Carmen, Puntarenas, or at any other private dock, collection center, or receiving station, duly authorized by INCOPESCA and SENASA, the institution shall proceed as follows:\n\nDuring ordinary schedule:\n\na. Those vessels belonging to the national medium-scale and advanced fleet that land shark shall be subject to the total charge for the hours required for the inspection.\n\nb. Vessels belonging to the national medium-scale and advanced fleet that do not land shark shall be subject to the charge for the first hour of inspection.\n\nc. In the case of the semi-industrial sardine national fleet, the first two hours of landing inspection shall be charged, a period during which INCOPESCA officials shall proceed to take the respective sample to determine the average total length of the caught sardine, in accordance with agreement AJDIP/215-98.\n\nd. In relation to the coastal and deep-water semi-industrial shrimp national fleet, the first two hours of landing inspection shall be charged, a period during which INCOPESCA officials shall proceed to take the respective sample to determine the minimum average catch weight of white shrimp, pinky, Fidel; camello, camellito, and Chilean langostino (chicharra), in accordance with Article 48 of the Regulation to Law No. 8436, as well as the composition of the bycatch fauna, according to Executive Decree No. 18795-MAG of January 9, 1989.\n\ne. Vessels belonging to the non-tuna foreign fleet shall be subject to the total charge for the hours required for the inspection, regardless of the commercial groups or species landed.\n\nf. Vessels belonging to the small-scale artisanal fleet are exempted from the request, inspection, and charge.\n\nDuring extraordinary schedule:\n\na. All landing inspections shall be charged, regardless of the fleet, commercial groups, or species landed.\n\n10. In the case of the foreign tuna fleet, whether during ordinary or extraordinary schedule, the first two hours of landing shall be charged, a period during which INCOPESCA officials shall proceed to randomly request the opening of certain holds to determine, in accordance with Article 58 of Law 8436, the non-existence of hydrobiological products other than tuna. Likewise, the last two hours of landing shall be charged to verify that the holds are completely empty.\n\n11. In those cases where, at the request of the interested party, INCOPESCA has made the arrangements for the designation of the inspector, and the inspector appears at the established place, time, and date, and the interested party decides to postpone the landing, one hour of inspection shall be charged, according to whether it is during ordinary or extraordinary schedule. Once the suspended inspection has been rescheduled, it shall restart as if it were a new inspection, for which reason the cost of the first hour and subsequent hours shall be charged again, either ordinary or extraordinary as applicable.\n\n12. In relation to the stay of vessels for scientific, research, educational, and development purposes, by means of a reasoned and justified agreement, the Board of Directors may waive the charge in those cases where there is a purpose of public benefit to the country or the institution.\n\n13. In the case of the stay of national or foreign commercial vessels for purposes other than the landing of fishery products or provisioning, prior to the corresponding authorization, the institution must assess the nature of the type of activities required, to determine possible negative effects on ecosystems or on the landing activity of hydrobiological products that are being, or will be, carried out in the area designated for that purpose, in order to ensure safety.\n\n14. Every inspection must be paid in advance or no later than the following business day after it is conducted by the Institute's officials, either by bank deposit or electronic transfer to one of INCOPESCA's bank accounts, or by direct payment at one of the Institute's offices. If payment is made by deposit or transfer, the user must deliver a copy of the respective bank receipt to the nearest office. The institution is not authorized to grant credit for this service; therefore, a user who does not comply with the established provision shall have all services provided by INCOPESCA suspended and must pay a fine for late payment of goods and services equivalent to the average active interest rate of the Financial System for the last month, calculated based on loans in national currency and in dollars, which shall be applied to the tariffs set in colones and in dollars, respectively.\n\n15. The user of the water service, stay and docking service, and other services provided by the institution at the Fishing Terminal must pay for them before unmooring the vessel, or no later than 30 calendar days after receiving the services, provided they have credit previously authorized by INCOPESCA. If they do not have authorized credit, they must pay for the services before unmooring the vessel. A user who does not comply with these provisions shall have all services suspended and must additionally pay a fine for late payment of goods and services equivalent to the average active interest rate of the Financial System for the last month, calculated based on loans in national currency and in dollars, which shall be applied to the tariffs set in colones and in dollars, respectively.\n\n16. Vehicles entering to load and unload products shall pay for the hours of stay before leaving the delimited dock area.\n\n17. Licenses, permits, authorizations, and any type of service that are not paid in the corresponding period must be paid at the annual tariff rate corresponding to each overdue year, plus a percentage for each year of delay, brought to present value up to the day of payment, as a fine for late payment of goods and services equivalent to the average active interest rate of the Financial System for the last month, calculated based on loans in national currency and in dollars, which shall be applied to the tariffs set in colones and in dollars, respectively.\n\n18. The money collected through the charged tariffs shall be deposited and entered into the bank accounts that INCOPESCA holds in the banks of the National Banking System. Likewise, users may pay the amount for the tariffs through electronic means (transfer, POS terminal, web page).\n\n19. The established tariffs shall be subject to review and adjustment when warranted, by INCOPESCA.\n\n20. In the case of Universities and Researchers, obtaining information and copies of statistical data on the behavior, availability, and exploitation of the fishery biomass shall be free of charge, as long as an express request is submitted by the interested party, in which they state their commitment to present to INCOPESCA the partial and/or final results of the studies carried out based on the information provided by the Department of Fisheries Statistics of INCOPESCA.\n\n2- Final Agreement\n\n3- Effective as of January 1, 2017."
