Que mediante escritura pública número ciento veinte, del 22 de\nagosto del dos mil dieciséis, otorgada ante el Notario del Estado Jonathan Bonilla\nCórdoba, Radiográfica Costarricense S.A. traspasó al Ministerio de Hacienda, la\nfinca del partido de Guanacaste, folio real 124599-000, denominada \"El\nCerrito\", ubicada en la provincia de Guanacaste, cantón 7 Abangares, distrito\nde 1 Las Juntas, con un área de 5.058.681.00 metros cuadrados, plano catastrado\nG-0717569-2001, que es inmueble con varias edificaciones, plantaciones\nmaderables, áreas de regeneración natural de bosque secundario y pastos.\n\nIV. Que mediante oficio número 08339 (DAGJ-1985-2005) del 12 de julio de\n2005, la División de Asesoría y Gestión Jurídica de la Contraloría General de\nla República consideró que toda institución pública, para disponer de sus\nbienes y trasladarlos a otras carteras ministeriales, o entes descentralizados,\nentes públicos no estatales o empresas públicas, puede hacerlo siempre y cuando\nexista una norma legal que en forma expresa le autorice a incurrir en actos de\nliberalidad en beneficios de tales entidades.\n\nV. Que mediante oficio número 06525 (DCA-1385) del 23 de mayo de 2006,\nla División de Contratación Administrativa de la Contraloría General de la\nRepública reconsideró el criterio vertido en el oficio número 08339 y señaló\nque cuando se trate del traspaso entre los mismos órganos del Poder Ejecutivo\nno es indispensable la existencia de una ley, ya que el inmueble no saldrá del\npatrimonio del Estado, por lo que para cambiar la naturaleza indicando quien\nserá el nuevo administrador del bien se requiere la emisión de un decreto.\n\nVI. A. to the Ministry of\nFinance, so that it would become part of the State's Natural Heritage (Patrimonio Natural del Estado).\n\nII. Whereas, by resolution number 0568-2016 at eleven hours\ntwenty-six minutes on June tenth, two thousand sixteen, from this Office,\nwhich accepts the proposal for dation in payment (dación en pago) submitted by\nRadiográfica Costarricense S.A. regarding the delivery of the farm of the Guanacaste\ndistrict, real folio 124599-000, property located in the province of\nGuanacaste, canton 7 Abangares, district of 1 Las Juntas, with an area of\n5,058,681.00 square meters, cadastral plan G-0717569-2001, for a value of\n₡2,306,265,930.20 (two billion three hundred six million two hundred sixty-five\nthousand nine hundred thirty colones with twenty céntimos), in partial payment of the\nsums owed for the concept of Penalty (general sales tax),\nperiods 2008, 2009, and 2010.\n\nIII. Whereas, by public deed number one hundred twenty, of August 22,\ntwo thousand sixteen, executed before State Notary Jonathan Bonilla\nCórdoba, Radiográfica Costarricense S.A. transferred to the Ministry of Finance the\nfarm of the Guanacaste district, real folio 124599-000, called \"El\nCerrito\", located in the province of Guanacaste, canton 7 Abangares, district\nof 1 Las Juntas, with an area of 5,058,681.00 square meters, cadastral plan\nG-0717569-2001, which is a property with several buildings, timber\nplantations, areas of natural regeneration of secondary forest and pastures.\n\nIV. Whereas, by official letter number 08339 (DAGJ-1985-2005) of July 12,\n2005, the Legal Advisory and Management Division of the Office of the Comptroller General of\nthe Republic considered that any public institution, in order to dispose of its\nassets and transfer them to other ministerial portfolios, or decentralized entities,\nnon-state public entities or public enterprises, can do so as long as\nthere is a legal norm that expressly authorizes it to incur acts of\nliberality for the benefit of such entities.\n\nV. Whereas, by official letter number 06525 (DCA-1385) of May 23, 2006,\nthe Administrative Procurement Division of the Office of the Comptroller General of the\nRepublic reconsidered the criterion set out in official letter number 08339 and indicated\nthat when it involves a transfer between the same organs of the Executive Branch,\nthe existence of a law is not essential, since the property will not leave the\nState's assets, so to change the nature by indicating who\nwill be the new administrator of the asset, the issuance of a decree is required.\n\nVI. That by virtue of the foregoing, and addressing reasons of public\ninterest, it is appropriate to assign the administration of the described farm to the Ministry\nof Environment and Energy.\n\nTHEREFORE,\n\n \n\nTHEY DECREE:\n\nArticle One.- To assign to the Ministry of Environment and Energy the\nfollowing real estate asset for its use, surveillance, and maintenance, which\nhas the following characteristics:\n\n1.
