  "body_es_text": "en la totalidad del texto\n\n                    -\n\n                        Texto Completo Norma 40074\n\n                        Nombra miembros de la Comisión Nacional para la Gestión de la Biodiversidad\n\nTexto Completo acta: 11ABEC\n\nNº 40074-MINAE\n\n(Este\ndecreto ejecutivo fue derogado por el artículo 1° del decreto ejecutivo N°\n40648 del 24 de julio del 2017)\n\nEL PRESIDENTE DE LA\nREPÚBLICA\n\nY LA MINISTRA DE AMBIENTE Y ENERGÍA\n\nEn uso de las\nfacultades que les confieren los artículos 140, incisos 3) y 18), y 146 de la Constitución\nPolítica, y la Ley de Biodiversidad Nº 7788 del 30 de abril de 1998.\n\nConsiderando:\n\nI.-Que la Ley de\nBiodiversidad Nº 7788 del 30 de abril de 1998, creó la Comisión Nacional para\nla Gestión de la Biodiversidad como un órgano desconcentrado del Ministerio de\nAmbiente y Energía, con personería jurídica instrumental.\n\nII.-Que la citada Ley\nle asigna a esa Comisión, funciones referentes a la conservación, el uso\necológicamente sostenible y la restauración de la biodiversidad, que son de\nvital importancia para el desarrollo sostenible del país.\n\nIII.-Que el artículo\n15 de la Ley de Biodiversidad, establece la forma en que se integrará la\nComisión, de acuerdo al nombramiento realizado por los entes y organizaciones\nque señala la ley.\n\nIV.-Que el Decreto\nEjecutivo N° 29680-MINAE del 23 de julio del 2001, publicado en La Gaceta N°\n150 del 7 de agosto del 2001, regula el funcionamiento de esta Comisión.\n\nV.-Que mediante\nOficio DM-7386-2016, el Doctor Fernando Llorca Castro\nen su calidad de Ministro de Salud, solicita se prorrogue el nombramiento de la\nseñora Ana Victoria Giusti Méndez, como representante\nsuplente ante la Comisión Nacional para la Gestión de la Biodiversidad, pues su\ndesignación finalizó el 13 de noviembre del 2016, de conformidad con el Decreto\nEjecutivo Nº 37962-MINAE del 01 de julio del 2013, publicado La Gaceta Nº\n219 del 13 de noviembre del 2013.\n\nVI.-Que de\nconformidad con el Reglamento a la Ley de Protección al Ciudadano del Exceso de\nRequisitos y Trámites Administrativos, Decreto Ejecutivo Nº 37045-MP-MEIC y sus\nreformas, se determinó que la presente propuesta no establece ni modifica\ntrámites, requisitos o procedimientos, que el administrado deba cumplir,\nsituación por la que no se procedió con el trámite de control previo.   "body_en_text": "across the entirety of the text\n\n                    -\n\n                        Complete Text of Norm 40074\n\n                        Appoints members of the National Commission for Biodiversity Management\n\nComplete Text of act: 11ABEC\n\nNº 40074-MINAE\n\n(This\nExecutive Decree was repealed by Article 1 of Executive Decree N°\n40648 of July 24, 2017)\n\nTHE PRESIDENT OF THE\nREPUBLIC\n\nAND THE MINISTER OF ENVIRONMENT AND ENERGY\n\nExercising the\npowers conferred by Articles 140, subsections 3) and 18), and 146 of the Political\nConstitution, and the Biodiversity Law Nº 7788 of April 30, 1998.\n\nConsidering:\n\nI.—That the Biodiversity\nLaw Nº 7788 of April 30, 1998, created the National Commission for\nBiodiversity Management as a deconcentrated body of the Ministry of\nEnvironment and Energy, with instrumental legal personality.\n\nII.—That the aforementioned Law\nassigns to this Commission functions related to conservation, ecologically sustainable\nuse, and restoration of biodiversity, which are of vital\nimportance for the country's sustainable development.\n\nIII.—That Article\n15 of the Biodiversity Law establishes how the\nCommission shall be composed, according to appointments made by the entities and organizations\nindicated by law.\n\nIV.—That Executive\nDecree N° 29680-MINAE of July 23, 2001, published in La Gaceta N°\n150 of August 7, 2001, regulates the operation of this Commission.\n\nV.—That through\nOfficial Communication DM-7386-2016, Doctor Fernando Llorca Castro,\nin his capacity as Minister of Health, requests the extension of the appointment of\nMs. Ana Victoria Giusti Méndez as alternate\nrepresentative to the National Commission for Biodiversity Management, since her\nappointment expired on November 13, 2016, in accordance with Executive\nDecree Nº 37962-MINAE of July 1, 2013, published in La Gaceta Nº\n219 of November 13, 2013.\n\nVI.—That in\naccordance with the Regulation to the Law for the Protection of the Citizen from Excess\nRequirements and Administrative Procedures, Executive Decree Nº 37045-MP-MEIC and its\namendments, it was determined that this proposal does not establish or modify\nprocedures, requirements, or formalities that the citizen must comply with, a\nsituation for which the prior control procedure was not conducted.
