y la Ley que Declara el Manatí (Trichechus manatus) como símbolo nacional\nde la fauna marina de Costa Rica N° 9264 del 07 de agosto de 2014.\n\nConsiderando:\n\nI.-Que la\nconservación y manejo de la vida silvestre es una necesidad país, ya que\ncontribuye a salvaguardar los procesos ecológicos vitales, aportando\nimportantes beneficios económicos, educativos, culturales, científicos y\nrecreativos tanto a las actuales como a las futuras generaciones.\n\nII.-Que es necesario\npromover en la conciencia nacional el sentido de responsabilidad personal y\ncolectiva, con la preservación de esos equilibrios vitales y la importancia de\ndesarrollar formas de vida más armónicas con la naturaleza.\n\nIII.-Que la Ley de Biodiversidad\nen su artículo 11 desarrolla el criterio del interés público ambiental,\ndisponiendo al efecto que \"...el uso de los elementos de la biodiversidad\ndeberá garantizar las opciones de desarrollo de las futuras generaciones, la\nseguridad alimentaria, la conservación de los ecosistemas, la protección de la\nsalud humana y el mejoramiento de calidad de vida de los ciudadanos...\".\n\nIV.-Que las\npoblaciones de manatíes (Trichechus manatus) presentes a lo largo de la costa\nCaribe de Costa Rica, requieren de una protección especial para su hábitat\ndebido al desarrollo acelerado de diferentes actividades humanas que impactan\ndirecta e indirectamente sus poblaciones, lo cual genera serios problemas para\nsu adecuada conservación.\n\nV.-Que mediante la\nLey que Declara el Manatí (Trichechus manatus) como símbolo nacional de la\nfauna marina de Costa Rica, Ley N° 9264 publicada en La Gaceta N° 183\ndel 24 de septiembre de 2014, se hace un llamado de atención a la sociedad\ncivil para la promoción y el cuidado adecuado de los recursos presentes en el\nterritorio costarricense. Para tal efecto, se utilizó el manatí como un símbolo\nde los recursos con que cuentan las comunidades del Caribe de Costa Rica y de\nla que debe asegurarse su perpetuidad, con el fin de que las generaciones\nfuturas puedan también disfrutar de la presencia de esta especie y la\nbiodiversidad asociada al hábitat del manatí.\n\nVI.-Que la Ley N°\n9264, declara el manatí (Trichechus manatus) símbolo de la fauna marina de\nCosta Rica y de la esperanza e interés de la niñez costarricense en la\nprotección de los recursos naturales presentes en el territorio nacional, y le\nencomienda al Ministerio de Ambiente y Energía hacer cumplir todas las leyes y\nlos convenios internacionales que estén relacionados con la conservación y\nprotección de los manatíes y su hábitat, para lo cual deberá este Ministerio\nliderar, promover y colaborar, programas de educación y sensibilización\ndirigidos a la conservación del manatí y su hábitat.\n\nVII.-Que de\nconformidad con lo anterior, se hace necesario promover en la conciencia\nnacional el sentido de responsabilidad personal y colectiva, con la\npreservación de esos equilibrios vitales y la importancia de desarrollar formas\nde vida más armónicas con la naturaleza, y para tal efecto, se propone declarar\nel 24 de septiembre de cada año, como el Día Nacional del Manatí (Trichechus\nmanatus).\n\nVIII.-Que de\nconformidad con el Reglamento a la Ley de Protección al Ciudadano del Exceso de\nRequisitos y Trámites Administrativos, Decreto Ejecutivo N° 37045-MP-MEIC del\n22 de febrero de 2012 y sus reformas, se determinó que la presente propuesta no\nestablece ni modifica trámites, requisitos o procedimientos, que el\nadministrado deba cumplir, situación por la que no se procedió con el trámite\nde control previo. For this purpose, the manatee was used as a symbol\nof the resources available to the communities of the Caribbean of Costa Rica and whose\nperpetuity must be ensured, so that future\ngenerations may also enjoy the presence of this species and the\nbiodiversity associated with the manatee's habitat.\n\nVI.—That Law No.\n9264 declares the manatee (Trichechus manatus) a symbol of the marine fauna of\nCosta Rica and of the hope and interest of Costa Rican children in the\nprotection of the natural resources present in the national territory, and\nentrusts the Ministry of Environment and Energy to enforce all laws and\ninternational agreements related to the conservation and\nprotection of manatees and their habitat, for which this Ministry must\nlead, promote, and collaborate on education and awareness programs\naimed at the conservation of the manatee and its habitat.\n\nVII.—That in\naccordance with the foregoing, it is necessary to promote in the national\nconsciousness a sense of personal and collective responsibility for the\npreservation of these vital balances and the importance of developing\nways of life more harmonious with nature, and for this purpose, it is proposed to declare\nSeptember 24 of each year as the National Day of the Manatee (Trichechus\nmanatus).\n\nVIII.—That in\naccordance with the Regulation to the Law for the Protection of Citizens from Excessive\nRequirements and Administrative Procedures, Executive Decree No. 37045-MP-MEIC of\nFebruary 22, 2012, and its amendments, it was determined that this proposal does\nnot establish or modify procedures, requirements, or formalities that the\ncitizen must comply with, a situation for which the procedure\nof prior control was not carried out. Therefore,\n\nThey decree:\n\n\"National Day of the\nManatee (Trichechus manatus)\"\n\nArticle 1.—Declare\nSeptember 24 of each year as the National Day of the Manatee (Trichechus\nmanatus),\n\nArticle\n2.—The Ministry of Environment and Energy, through the National System of\nConservation Areas (Sistema Nacional de Áreas de Conservación), shall internally coordinate and determine the plans, programs, or\nactivities through which the National Day of the Manatee\n(Trichechus manatus) is commemorated.\n\nArticle\n3.—Public institutions are authorized to prepare for and commemorate the\nNational Day of the Manatee (Trichechus manatus) through activities that\ncontribute to raising awareness in the protection of the natural resources\npresent in the national territory.\n\nArticle\n4.—Civil society organizations are urged to join in the\npreparation and commemorations of the National Day of the Manatee (Trichechus\nmanatus), without prejudice to their own initiatives.\n\nArticle\n5.—It shall be effective upon its publication.\n\nGiven at the Presidency of the Republic.—San José, the\nfifth of December of the year two thousand sixteen." }
