  "body_es_text": "en la totalidad del texto\n\n                    -\n\n                        Texto Completo Norma 40165\n\n                        Amplía para el Sistema Nacional de Áreas de Conservación (SINAC),  el gasto\npresupuestario máximo fijado para el 2017\n\nTexto Completo acta: 1150C7\n\nN°\n40165-H\n\nEL PRESIDENTE DE LA\nREPÚBLICA\n\nY EL MINISTRO DE HACIENDA\n\nCon fundamento en las\natribuciones que les confieren los artículos 140 incisos 3) y 18) y 146 de la\nConstitución Política; los artículos 25 inciso 1), 27 inciso 1) y 28 inciso 2) acápite\nb) de la Ley N° 6227, Ley General de la Administración Pública de 2 de mayo de\n1978 y sus reformas; la Ley N° 8131, Ley de la Administración Financiera de la\nRepública y Presupuestos Públicos de 18 de setiembre de 2001 y sus reformas; su\nReglamento, el Decreto Ejecutivo N° 32988-H-MP-PLAN de 31 de enero de 2006 y\nsus reformas; la Ley N° 7317, Ley de Conservación de la Vida Silvestre de 30 de\noctubre de 1992 y sus reformas; la Ley N° 7575, Ley Forestal de 13 de febrero\nde 1996 y sus reformas; la Ley N° 7554, Ley Orgánica del Ambiente del 4 de\noctubre de 1995 y sus reformas; la Ley N° 6084 de 24 de agosto de 1977 y sus\nreformas; la Ley N° 5417, Ley de Emisión de Monedas Conmemorativas sobre\nConservación de la Naturaleza de 14 de noviembre de 1973 y su reforma; la Ley\nN° 7788, Ley de Biodiversidad de 30 de abril de 1998 y sus reformas; el Decreto\nEjecutivo N° 32452-H de 29 de junio de 2005 y sus reformas; y el Decreto\nEjecutivo N° 39613-H de 3 de marzo de 2016.\n\nConsiderando:\n\nI.-Que mediante la\nLey N° 7788, publicada en La Gaceta N° 101 de 27 de mayo de 1998 y sus\nreformas, se crea el Sistema Nacional de Áreas de Conservación (SINAC) como un\nsistema de gestión y coordinación institucional, desconcentrado y\nparticipativo, que integrará las competencias en materia forestal, vida\nsilvestre, áreas protegidas y el Ministerio del Ambiente y Energía, con el fin\nde dictar políticas, planificar y ejecutar procesos dirigidos a lograr la\nsostenibilidad en el manejo de los recursos naturales de Costa Rica.\n\nII.-Que mediante el\noficio SINAC-DE-1757-2016 de 20 de octubre de 2016, el Director Ejecutivo a. i.\ndel Sinac solicitó incrementar el gasto\npresupuestario máximo de dicha institución para el ario 2017, por un monto\ntotal de ¢7.236.279.204,00 (siete mil doscientos treinta y seis millones\ndoscientos setenta y nueve mil doscientos cuatro colones exactos), con la\nfinalidad de financiar 130 puestos que se trasladan del Fondo de Parques\nNacionales al Fondo SINAC en el año 2016, más 124 puestos a trasladar en el año\n2017, así como gastos del Proyecto Turismo Sostenible, cuyo presupuesto no fue\nconsiderado en el cálculo del límite, dado que se esperaba que este proyecto\nfinalizara en el año 2016, así como para incorporar recursos adicionales. Dicha\nsolicitud fue avalada por el señor Ministro de Ambiente y Energía, mediante el\noficio DM- 1040-2016 de 8 de noviembre de 2016 y además el replanteamiento de\nla solicitud de ampliación fue autorizada por el Consejo Nacional de Áreas de\nConservación (CONAC) en el acuerdo N° 9 tomado en la sesión N° 12-2016 del 12\nde diciembre del ario en curso.\n\nIII.-Que de dicho\nmonto, corresponde ser ampliada por la vía de Decreto Ejecutivo la suma de\n¢1.070.291.088,00 (mil setenta millones doscientos noventa y un mil ochenta y\nocho colones exactos), misma que será sufragada con recursos provenientes de\nsuperávit libre y específico, que le darán contenido a gastos sustantivos,\nrecurrentes, esenciales y necesarios para los fines institucionales, requeridos\npara financiar los gastos de viajes de los funcionarios de las Unidad Ejecutora\ndel Proyecto de Turismo Sostenible, así como las diversas obras de\ninfraestructura y marítimas en algunas de las Áreas Silvestres Protegidas del\npaís.\n\nIV.-Que mediante el\nDecreto Ejecutivo N° 39613-H, publicado en el Alcance N° 46 a La Gaceta N°\n61 de 30 de marzo de 2016, se emitieron las Directrices Generales de Política\nPresupuestaria, Salarial, Empleo, Inversión y Endeudamiento, para el año 2017,\nestableciéndose en el artículo 12, que para las entidades públicas y órganos\ndesconcentrados, el gasto presupuestario máximo del año 2017, se establecerá\ncon base en la proyección de ingresos totales (corrientes, capital y\nfinanciamiento) 2017, definida por las entidades públicas y órganos\ndesconcentrados en coordinación con la STAP. Para tal efecto, la STAP utilizará\ncomo insumo la serie histórica de ingresos del periodo 2013-2015, así como la\nestimación de ingresos para los años 2016 y 2017 que suministren las entidades\ny órganos desconcentrados a más tardar el último día del mes de marzo del año\n2016. En correspondencia con dicha disposición, el monto de gasto\npresupuestario máximo para el ario 2017 resultante para el SINAC, fue\nestablecido en la suma de ¢31.431.040.983,00 (treinta y un mil cuatrocientos\ntreinta y un millones cuarenta mil novecientos ochenta y tres colones exactos),\nel cual fue comunicado en el oficio STAP-0616-2016 del 27 de abril de 2016;\nmismo que se modifica mediante el oficio STAP-2555-2016 de 16 de diciembre de\n2016, fijándose en la suma de ¢37.306.605.940,21 (treinta y siete mil\ntrescientos seis millones seiscientos cinco mil novecientos cuarenta colones\ncon veintiún céntimos); cifra que no contempla el gasto indicado previamente en\neste decreto.\n\nV.-Que mediante el\nDecreto Ejecutivo N° 32452-H, publicado en La Gaceta N° 130 de 6 de\njulio de 2005 y sus reformas, se emite el \"Lineamiento para la aplicación del\nartículo 6° de la Ley N° 8131, Ley de la Administración Financiera de la\nRepública y Presupuestos Públicos y la regulación de la clase de ingresos del\nSector Público denominada Financiamiento\".\n\nVI.-Que el artículo\n7° del Decreto citado en el considerando anterior, dispone que los recursos de\nfinanciamiento que provienen de vigencias anteriores -superávit libre- son\nparte del patrimonio de los órganos y las entidades y pueden utilizarlos en\nperíodos subsiguientes para financiar gastos que se refieran a la actividad\nordinaria de éstas, con los cuales se atienda el interés de la colectividad, el\nservicio público y los fines institucionales, siempre que no tengan el carácter\npermanente o generen una obligación que requiera financiarse a través del\ntiempo, como la creación de plazas para cargos fijos, o cualquier otro\ncompromiso de la misma naturaleza.\n\nVII.-Que en relación\ncon el superávit específico, el numeral 9° del referido Decreto Ejecutivo N°\n32452-H, posibilita la utilización de éste, para el pago de gastos definidos en\nlos fines establecidos en las disposiciones especiales o legales aplicables a\ntales recursos.\n\nVIII.-Que por lo\nanterior, resulta necesario ampliar el gasto presupuestario máximo fijado al\nSINAC para el año 2017, incrementándolo en la suma de ¢1.070.291.088,00 (mil\nsetenta millones doscientos noventa y un mil ochenta y ocho colones exactos).   "body_en_text": "in the entirety of the text\n\n                    -\n\n                        Full Text of Standard 40165\n\n                        Increases for the National System of Conservation Areas (SINAC), the maximum\nbudgetary expenditure set for 2017\n\nFull Text of record: 1150C7\n\nN°\n40165-H\n\nTHE PRESIDENT OF THE\nREPUBLIC\n\nAND THE MINISTER OF FINANCE\n\nBased on the\npowers conferred by articles 140 subsections 3) and 18) and 146 of the\nPolitical Constitution; articles 25 subsection 1), 27 subsection 1) and 28 subsection 2) heading\nb) of Law N° 6227, General Law of Public Administration of 2 May\n1978 and its amendments; Law N° 8131, Law of Financial Administration of the\nRepublic and Public Budgets of 18 September 2001 and its amendments; its\nRegulation, Executive Decree N° 32988-H-MP-PLAN of 31 January 2006 and\nits amendments; Law N° 7317, Wildlife Conservation Law of 30\nOctober 1992 and its amendments; Law N° 7575, Forestry Law (Ley Forestal) of 13 February\n1996 and its amendments; Law N° 7554, Organic Environmental Law of 4\nOctober 1995 and its amendments; Law N° 6084 of 24 August 1977 and its\namendments; Law N° 5417, Law on the Issuance of Commemorative Coins on\nNature Conservation of 14 November 1973 and its amendment; Law\nN° 7788, Biodiversity Law of 30 April 1998 and its amendments; Executive\nDecree N° 32452-H of 29 June 2005 and its amendments; and Executive\nDecree N° 39613-H of 3 March 2016.\n\nConsidering:\n\nI.-That through\nLaw N° 7788, published in La Gaceta N° 101 of 27 May 1998 and its\namendments, the National System of Conservation Areas (SINAC) was created as a\ndeconcentrated and participatory institutional management and coordination\nsystem, which will integrate competencies in forestry, wildlife, protected areas, and the Ministry of Environment and Energy, in order\nto issue policies, plan, and execute processes aimed at achieving\nsustainability in the management of Costa Rica's natural resources.\n\nII.-That through\nofficial communication SINAC-DE-1757-2016 of 20 October 2016, the Acting Executive Director\nof SINAC requested an increase to the maximum budgetary\nexpenditure of said institution for the year 2017, for a total\namount of ¢7,236,279,204.00 (seven thousand two hundred thirty-six million\ntwo hundred seventy-nine thousand two hundred four colones exactly), with the\npurpose of financing 130 positions being transferred from the National Parks\nFund to the SINAC Fund in 2016, plus 124 positions to be transferred in 2017, as well as expenses of the Sustainable Tourism Project, whose budget was not\nconsidered in the calculation of the limit, given that this project was\nexpected to conclude in 2016, as well as to incorporate additional resources. Said\nrequest was endorsed by the Minister of Environment and Energy, through\nofficial communication DM-1040-2016 of 8 November 2016, and furthermore the restatement of\nthe increase request was authorized by the National Council of Conservation\nAreas (CONAC) in agreement N° 9 taken at session N° 12-2016 of 12\nDecember of the current year.\n\nIII.-That of said\namount, the sum of\n¢1,070,291,088.00 (one thousand seventy million two hundred ninety-one thousand eighty-\neight colones exactly) is to be increased via Executive Decree, which will be covered with resources from\nfree and specific surplus (superávit libre y específico), which will give substance to substantive,\nrecurrent, essential, and necessary expenditures for institutional purposes, required\nto finance travel expenses for officials of the Executing Unit\nof the Sustainable Tourism Project, as well as various\ninfrastructure and maritime works in some of the country's Protected Wild Areas.\n\nIV.-That through\nExecutive Decree N° 39613-H, published in Supplement (Alcance) N° 46 to La Gaceta N°\n61 of 30 March 2016, the General Guidelines for Budgetary, Salary,\nEmployment, Investment, and Indebtedness Policy for 2017 were issued,\nestablishing in article 12 that for public entities and deconcentrated\norgans, the maximum budgetary expenditure for 2017 will be established\nbased on the projection of total revenues (current, capital, and\nfinancing) for 2017, defined by the public entities and deconcentrated\norgans in coordination with the STAP. For this purpose, the STAP will use\nas input the historical series of revenues from the 2013-2015 period, as well as the\nrevenue estimate for 2016 and 2017 provided by the entities\nand deconcentrated organs no later than the last day of March 2016. In accordance with said provision, the resulting maximum budgetary\nexpenditure amount for SINAC for the year 2017 was\nestablished at the sum of ¢31,431,040,983.00 (thirty-one thousand four hundred\nthirty-one million forty thousand nine hundred eighty-three colones exactly),\nwhich was communicated in official communication STAP-0616-2016 of 27 April 2016;\nthe same is modified by official communication STAP-2555-2016 of 16 December\n2016, being set at the sum of ¢37,306,605,940.21 (thirty-seven thousand\nthree hundred six million six hundred five thousand nine hundred forty colones\nwith twenty-one cents); a figure that does not include the expenditure previously indicated in\nthis decree.\n\nV.-That through\nExecutive Decree N° 32452-H, published in La Gaceta N° 130 of 6\nJuly 2005 and its amendments, the \"Guideline for the application of\narticle 6 of Law N° 8131, Law of the Financial Administration of the\nRepublic and Public Budgets and the regulation of the class of revenues of the\nPublic Sector called Financing (Financiamiento)\" was issued.\n\nVI.-That article\n7 of the Decree cited in the preceding whereas clause provides that financing\nresources originating from prior fiscal years—free surplus—are\npart of the equity of the organs and entities and may be used in\nsubsequent periods to finance expenditures that relate to their ordinary\nactivity, which serve the interest of the community, the\npublic service, and institutional purposes, provided they are not permanent\nin nature or generate an obligation requiring financing over\ntime, such as the creation of positions for fixed posts, or any other\ncommitment of the same nature.\n\nVII.-That in relation\nto the specific surplus, numeral 9 of the referenced Executive Decree N°\n32452-H enables its use for the payment of expenditures defined in\nthe purposes established in the special or legal provisions applicable to\nsuch resources.\n\nVIII.-That due to the\nforegoing, it is necessary to increase the maximum budgetary expenditure set for\nSINAC for 2017, increasing it by the sum of ¢1,070,291,088.00 (one\nthousand seventy million two hundred ninety-one thousand eighty-eight colones exactly).
