Establece además un Comité Consultivo (espacio de diálogo con firmantes del Pacto Nacional por los ODS de 2016), un Comité Técnico interministerial y el INEC como órgano asesor estadístico. Ordena a todas las instituciones públicas colaborar en el cumplimiento de los ODS mediante la debida coordinación interinstitucional, e incorpora definiciones amplias de desarrollo sostenible, bienestar, equidad y soberanía.",

All public institutions are ordered to collaborate in achieving the SDGs through proper inter-institutional coordination, and the decree introduces extensive definitions of sustainable development, well-being, equity, and sovereignty.",

DE PLANIFICACIÓN NACIONAL Y\nPOLÍTICA\n\nECONÓMICA Y LOS MINISTROS DE RELACIONES\nEXTERIORES\n\nY CULTO Y DE AMBIENTE Y ENERGÍA\n\nCon fundamento en las atribuciones que les confieren los artículos 139\ninciso 2), 140 incisos 3), 8), 18) y 20) y 146 de la Constitución Política; los\nartículos 1, 5 y 17 de la Ley\nOrgánica del Ministerio de Relaciones Exteriores y Culto (N° 3008 de 18 de julio\nde 1962); los artículos 25 inciso 1), 27 inciso 1), 99, 100 y 113 de la Ley\nGeneral de la Administración Pública (N° 6227 de 2 de mayo de 1978); la Ley de\nPlanificación Nacional (N° 5525 de\n2 de mayo de 1974); el artículo 2 de la Ley Orgánica del Ministerio del\nAmbiente y Energía (N° 7152 del 5 de junio de 1990); el Reglamento\nGeneral del Sistema Nacional de Planificación (Decreto Ejecutivo N° 37735-PLAN\nde 6 de mayo de 2013); los artículos 2 y 3 del Reglamento Orgánico del Poder\nEjecutivo (Decreto Ejecutivo N° 38536-MP-PLAN de 25 de julio del 2014); la Ley\ndel Sistema de Estadística Nacional (N° 7839 de 15 de octubre de 1998) y su\nReglamento (Decreto Ejecutivo N° 28849-PLAN de 24 de agosto de 2000).\n\nCONSIDERANDO:\n\nl.- Que\nmediante resolución número AIRES/70/1 del 25 de setiembre de 2015, la Asamblea\nGeneral de las Naciones Unidas aprobó la \"Agenda 2030 para el Desarrollo\nSostenible\", en la cual se establecen 17 Objetivos de Desarrollo\nSostenible y 169 metas enfocadas a lograr el desarrollo sostenible en sus tres\ndimensiones económica, social y ambiental.\n\n(Así refomado el considerando anterior por el artículo 1° del decreto\nejecutivo N° 44945 del 7 de marzo de 2025)\n\nII.- Que en\nesa misma resolución AIRES/70/1 de la Asamblea General de las Naciones Unidas,\nse hace un llamado en sus párrafos 55 y 72. a que los gobiernos fijen sus\npropias metas nacionales, guiándose por la ambiciosa aspiración general, pero\ntomando en consideración las circunstancias del país.\n\n(Así refomado el considerando anterior por el artículo 1° del decreto\nejecutivo N° 44945 del 7 de marzo de 2025)\n\nIII.- Que en\nconsonancia con los párrafos 55 y 72 de la Resolución supracitada, el Gobierno\nde la Reública de Costa Rica debe adoptar lo que de la Agenda 2030 guarde\nrelación con las prioridades del desarrollo nacional de forma tal que. coadyuve\nen el desarrollo de nuestro país.\n\n(Así refomado el considerando anterior por el artículo 1° del decreto\nejecutivo N° 44945 del 7 de marzo de 2025)\n\nIV.- Que el\nGobierno de Costa Rica suscribió la Agenda 2030 para el Desarrollo Sostenible,\nasí como un conjunto de metas e indicadores puntuales; seleccionados en función\nde la coadyuvancia de estos al impulso a la estrategia nacional de desarrollo y\nque se encuentren conformes con el derecho de la constitución de nuestro país.\n\n(Así refomado el considerando anterior por el artículo 1° del decreto\nejecutivo N° 44945 del 7 de marzo de 2025)\n\nV.- Que se\nhace necesario hacer una propuesta funcional para el caso de la planificación,\nimplementación y seguimiento que haya escogido Costa Rica en cuanto a las metas\ne indicadores referentes a lo que propone la agenda 2030. de forma tal que se\najusten con la estrategia nacional de desarrollo el derecho de la constitución\ncostarricense y los instrumentos internacionales congruentes y correlacionados\ncon ese derecho de la Constitución.\n\n(Así refomado el considerando anterior por el artículo 1° del decreto\nejecutivo N° 44945 del 7 de marzo de 2025)\n\nVI.-\nQue el 9 de setiembre del 2016 los Presidentes de los tres Poderes del Estado y\ndel Tribunal Supremo de Elecciones, junto a representantes de gobiernos\nlocales, del sector privado, de universidades estatales y de la sociedad civil,\nfirmaron el \"Pacto Nacional por el Avance de los ODS en el marco de la\nAgenda 2030 para el Desarrollo Sostenible en Costa Rica\" asumiendo un\ncompromiso público para la consecución de los ODS, en cuanto se constate que se\ns1ue1a al derecho de la Constitución y a la tutela de los derechos humanos, así\ncomo de las metas e indicadores adoptados por el país en consonancia con la\nestrategia nacional de desarrollo.\n\n(Así adicionado el considerando anterior por el artículo 2° del decreto\nejecutivo N° 44945 del 7 de marzo de 2025)\n\nVII.-\nQue es necesaria una estrategia nacional ponderada y racional, que estudie la\nimplementación de los ODS en Costa Rica que reúna a las instituciones públicas,\nel sector privado, la academia, la sociedad civil y los gobiernos locales entre\notras instancias, de manera que se faciliten espacios de diálogo y coordinación\npara el cumplimiento de esos objetivos con sus respectivas metas.\n\n(Así adicionado el considerando anterior por el artículo 2° del decreto\nejecutivo N° 44945 del 7 de marzo de 2025)\n\nVIII.-\nQue de conformidad con el artículo 12 bis del Reglamento a la Ley de Protección\nal Ciudadano del Exceso de Requisitos y Trámites Administrativos, Decreto\nEjecutivo N° 37045-MP-MEIC de 22 de febrero de 2012, se procedió a tramitar el\nFormulario de Evaluación Costo Beneficio en la Sección 1 denominada Control\nPrevio de Mejora Regulatoria. siendo que el mismo dio resultado negativo y que\nla propuesta no contiene trámites ni requerimientos.\n\n(Así adicionado el considerando anterior por el artículo 2° del decreto\nejecutivo N° 44945 del 7 de marzo de 2025)\n\nPor tanto,\n\nDECRETAN:\n\nLA GOBERNANZA E IMPLEMENTACIÓN DE\n\nLOS OBJETIVOS DE DESARROLLO SOSTENIBLE EN COSTA RICA\n\nArtículo 1.-\nObjeto. Este decreto tiene como objeto establecer una estructura organizacional\npara planificar, implementar y dar seguimiento en Costa Rica a los Objetivos de\nDesarrollo Sostenible (ODS) y la Agenda 2030 en aquellas metas e indicadores\nadoptados por el país. en consonancia con la estrategia nacional de desarrollo\ny el derecho de la Constitución y los instrumentos internacionales suscritos y\nratificados por Costa Rica.\n\n(Así refomado por el artículo 1° del decreto ejecutivo N° 44945 del 7 de\nmarzo de 2025)\n\nArtículo 2.- Definiciones. Para los efectos del presente\nDecreto Ejecutivo. se establecen las siguientes definiciones:\n\na) Desarrollo Sostenible: Desarrollo que satisface las necesidades del presente sin comprometer la\ncapacidad de las generaciones futuras para satisfacer sus propias necesidades. integrando las\ndimensiones económica, social y ambiental.\n\nb) Sostenibilidad: Capacidad de mantener o mejorar los sistemas\nnaturales, sociales y económicos para las generaciones actuales y futuras.\n\nc) Inclusión social: Proceso que garantiza que todos los individuos y grupos en la sociedad,\nespecialmente aquellos que están en situaciones de vulnerabilidad, puedan participar plenamente en\nla vida económica, social y política.\n\nd) Resiliencia: Capacidad de un sistema. comunidad o sociedad expuesta a riesgos para resistir,\nabsorber, adaptarse y recuperarse de los efectos de un peligro de manera oportuna y eficiente.\n\ne) Gobernanza: Estructuras, decisiones y procesos diseñados para asegurar la rendición de cuentas,\nla equidad, la transparencia y la inclusión en la toma de decisiones y la implementación de\npolíticas. Para los cuales este cuerpo normativo servirá como base para la aplicación e\ninterpretación de todo instrument de Plantificación Nacional de toda política nacional o directriz\nque elaboren las instituciones públicas centralizadas o descentralizadas y servirá como referencia\ninterpretativa y de aclaración para cualquier aplicación de la Agenda 2030. en cualquiera de los\ndocumentos del Estado.\n\nf) Dignidad: Según la Declaración Universal de los Derechos Humanos se refiere al valor inherente y\nsingular de la vida y de cada ser humano como un todo continuo desde su concepción hasta su ocaso\nnatural, independientemente de su estatus, papel en la sociedad v circunstancias, cuyo cumplimiento\nes la libertad, el amor, la justicia y la paz entre las personas y las naciones.\n\ng) Derecho humano: La dignidad es la fuente natural de los derechos humanos en función de las normas\nmorales, éticas o legales que se promueven y desarrollan en el seno familiar, y se protegen y\ngarantizan por igual a favor de todos los seres humanos constituidos en personas, por el simple\nhecho de ser seres humanos, contra los abusos del Estado o de otros.\n\nDesde la Constitución Política y desde la dignidad se implica el reconocimiento de los Derechos\nfundamentales de cada persona, y de cada nación, el trato humano hacia ambas, independientemente de\nsu origen, creencias, capacidades o cualquier otra característica o circunstancia. La base que\ngarantiza el respeto, la igualdad, y el trato justo para todos los individuos de la familia humana.\nLos derechos son inherentes e inalienables a todas las personas, no siendo un favor ni concesión del\nEstado, son anteriores al mismo, según la Declaración Universal de Derechos Humanos en sus artículos\n1 y 2: \"Todos los seres humanos nacen libres e iguales en dignidad y derechos y, dotados como están\nde razón y conciencia, deben comportarse fraternalmente los unos con los otros» y ''Toda persona\ntiene los derechos y libertades proclamados en esta Declaración, sin distinción alguna de raza.\ncolor, sexo, idioma, religión, opinion política o de cualquier otra índole, origen nacional o\nsocial. posición económica  nacimiento o cualquier otra condición\". Declaración que sustenta la\ninterpretación de este decreto.\n\nh) Cultura: Etimológicamente viene del latín, y tiene raíz común con cultivar habitar y celebrar. Es\naquello que compone la identidad y forma de vida de un grupo de personas que cultivan en ellas\nmismas habitan espacios comunes, honran y celebran su historia compartida incluyendo sus creencias,\ntradiciones, costumbres, arte, música, idioma, y prácticas sociales. Va desde la forma en que se\nvisten y se alimentan, hasta las expresiones artísticas y las normas sociales que rigen sus\nrelaciones. La cultura abarca todo lo que caracteriza a una sociedad, moldeando su forma de pensar,\nactuar, relacionarse y comprender el mundo. Un tejido intrincado que une a las personas en una\ncomunidad y les proporciona un sentido de identidad y pertenencia. La UNESCO en su documento sobre\nEducación Sostenible establece que, «sólo un enfoque del desarrollo centrado en el ser humano y\nbasado en el respeto y el diálogo mutuos entre las culturas puede conducirnos a una paz duradera».\n\ni) Igualdad: Se refiere a la condición o calidad de ser iguales todos los seres humanos, hombres y\nmujeres, en derechos. oportunidades o tratamiento. No significa eliminar las diferencias entre los\nseres humanos, sino garantizar igual trato en razón de su humanidad. A pesar de esas diferencias\nnaturales, o construidas, entre los seres humanos y sus circunstancias. promueve la justicia al\ngarantizar que todas las personas tengan acceso a los mismos derechos y recursos, independientemente\nde sus diferencias en sexo, raza, origen étnico, capacidad, o cualquier otra característica. Según\nla Declaración Universal de los Derechos Humanos, «considerando que los pueblos de las Naciones\nUnidas han reafirmado en la Carta su fe en los derechos fundamentales del hombre, en la dignidad y\nel valor de la persona humana y en la igualdad de derechos de hombres y mujeres; y se han declarado\nresueltos a promover el progreso social y a elevar el nivel de vida dentro de un concepto más amplio\nde la libertad», reafirmando lo dicho en la Carta fundacional de las Naciones Unidas, la igualdad\nsegún la Carta busca eliminar la discriminación entre hombres y mujeres y entre naciones grandes y\npequeñas, y fomentar el respeto mutuo entre todos los individuos de la familia humana: << Nosotros\nlos pueblos de las Naciones Unidas resueltos a preservar a las generaciones venideras del flagelo de\nla guerra que dos veces durante nuestra vida ha infligido a la Humanidad sufrimientos indecibles a\nreafirmar la fe en los derechos fundamentales del hombre. en la dignidad y el valor de la persona\nhumana. en la igualdad de derechos de hombres y mujeres y de las naciones grandes y pequeñas. »\n\nj) Equidad: Se relaciona con la justicia y la imparcialidad, y se refiere a tratar a cada persona de\nacuerdo con sus necesidades individuales. Como un complemento de la igualdad, que busca dar el mismo\ntrato a todos, la equidad reconoce las diferencias entre las personas y busca asegurar que cada\nindividuo reciba lo que necesita para tener oportunidades justas, sin que ello implique violentar\nlos derechos de otros o distorsionar el bien común. La equidad se enfoca en garantizar que todos\ntengan la capacidad de alcanzar el mismo nivel de oportunidades bienestar y éxito. El esfuerzo de todos los\nseres humanos no es igual aunque tengan las mismas o distintas oportunidades y acceso a recursos.\n\nk) Inclusivo: Es una condición de la igualdad equitativa para que nadie se quede por fuera, y se\nrefiere a la cualidad de incluir o abarcar a todos los individuos o entidades, independientemente de\nlas diferencias en sus antecedentes, identidades, características o creencias. La inclusividad\npromueve el acceso equitativo a oportunidades y recursos para todos asegurando que se valoren y\nrepresenten perspectivas y voces distintas, todas sujetas al imperio de la ley y del bien común.\n\nl) Soberanía: Se refiere al principio por el cual una Nación o Estado es independiente, considerada\ncomo un sujeto de derecho libre y soberano. En el ámbito de su territorio, tiene la potestad de\ntomar decisiones y ejercer autoridad sobre su propio territorio, gobierno,  gente y destino en\ncuanto a asuntos internos y externos sin interferencia de ningún tipo. Esto incluye el control sobre\nsu sistema político, económico, social y legal, así como la capacidad de establecer leyes, políticas\ny relaciones internacionales de acuerdo con sus intereses y valores nacionales propios. En el\ncontexto internacional, el principio de soberanía implica el respeto mutuo entre las naciones y la\nno intervención en los asuntos internos de otros estados ni entre naciones ni por parte de\nOrganismos Multilaterales según la propia Carta de las Naciones Unidas, principio de paz, concordia\ny desarrollo colaborativo entre las naciones.\n\nm) Bienestar: Es el estado general mínimo de prosperidad, felicidad, libertad y satisfacción en la\nvida de una persona comunidad o sociedad como la base de la pirámide de Maslow,  no como un fin en\nsí mismo. Se origina en la idea de Estado Benefactor (Welfare State), nacido en la Depresión y la\nposguerra, como correctivos solidarios masivos, la renta básica universal. En un sentido más amplio\nel bienestar también se relaciona con el equilibrio entre las diferentes dimensiones de la vida. la\nfamilia. como el trabajo, el ocio. las relaciones interpersonales, la salud, el desarrollo personal,\nlaboral, el consumo y la contribución a la comunidad. El bienestar se refiere a la búsqueda activa y\nsostenible de una básica calidad de vida en busca de la libertad y de la verdad. Incluye tanto el\nbienestar biológico, como el emocional,  el familiar, vocacional, espiritual, mental y social. El\nbienestar implica vivir en condiciones saludables y seguras, tener acceso a recursos y oportunidades\nque promuevan un desarrollo personal, y así sostener relaciones sostenibles con los demás.\n\n(Así adicionado por el artículo 2° del decreto ejecutivo N° 44945 del 7\nde marzo de 2025)\n\nArtículo 3.- La Administración Pública y los ODS. Todas las\ninstituciones públicas, dentro del ámbito de sus competencias, dependencias y\nautonomías, deberán prestar colaboración para el cumplimiento de los ODS en\nCosta Rica, conforme al principio de la debida coordinación interinstitucional.\n\n(Así modificada su numeración por el\nartículo 2° del decreto ejecutivo N° 44945 del 7 de marzo de 2025, que lo\ntraspasó del antiguo artículo 2 al artículo 3)\n\nArtículo 4.- Consejo de Alto Nivel de los Objetivos de Desarrollo\nSostenible y Secretaría Técnica. Créase el Consejo de\nAlto Nivel de los Objetivos de Desarrollo Sostenible, en adelante\ndenominado \"el Consejo\", como órgano máximo para coordinar las acciones\ndirigidas al cumplimiento de la Agenda 2030 en Costa Rica. El Consejo tendrá\nuna Secretaría Técnica de los Objetivos de Desarrollo Sostenible, en\nadelante denominada \"la Secretaría Técnica\" y será\nejercida por el Ministerio de Planificación Nacional y Política\nEconómica, en adelante denominado \"MIDEPLAN\".\n\n(Así modificada su numeración por el\nartículo 2° del decreto ejecutivo N° 44945 del 7 de marzo de 2025, que lo\ntraspasó del antiguo artículo 3 al artículo 4)\n\nArtículo 5.-Integración del Consejo. El Consejo tendrá las siguientes funciones:\n\na) Estudiar. analizar y en dado caso avalar, una estrategia nacional de desarrollo, planificación,\nimplementación en función de los ODS y sus metas que estén en consonancia con  el derecho de la\nConstitución y los instrumentos internacionales suscritos y ratificados por Costa Rica, dando la\ndebida audiencia y abriendo de manera diáfana y siempre de Buena fe el diálogo por un tiempo\nrazonable a los sectores de la sociedad que deseen aportar mejoras o cambios en la implementación\nque se hace de la Agenda 2030.\n\nb) Establecer las medidas necesarias que permitan la asignación de recursos financieros para la\nimplementación de los ODS.\n\nc) Revisar la agenda 2030, en su contenido y la implementación que se le ha dado, en función del\nordenamiento jurídico, los intereses públicos de más alta envergadura del ordenamiento jurídico\ncostarricense. dándole apertura al diálogo democrático de los diferentes sectores sociales. a la\nconcertación y escuchando y analizando sus observaciones y solicitudes.\n\nd) Aquellas que resulten derivadas del ejercicio de su competencia, dando prioridad a la\nplantificación y metas nacionales, así como al orden jurídico interno.\n\n(Así reformado por el artículo 1° del decreto ejecutivo\nN° 44945 del 7 de marzo de 2025)\n\n(Así modificada su numeración por el artículo 2° del decreto ejecutivo N° 44945\ndel 7 de marzo de 2025, que lo traspasó\ndel antiguo artículo 6 al artículo 7)\n\nArtículo 8º-Comité Consultivo del Consejo\nde Alto Nivel de los Objetivos de Desarrollo Sostenible. Habrá un Comité\nConsultivo del Consejo de Alto Nivel de los Objetivos de Desarrollo Sostenible,\nen adelante denominado \"el Comité Consultivo\", como espacio de\nconcertación y diálogo para asesorar al Consejo en la implementación de los ODS\nen el país. El Comité Consultivo será convocado y dirigido por la o el Ministro\nde Planificación Nacional y Política Económica en su rol de Secretaría Técnica\nde los ODS y estará integrado por los representantes titulares o los suplentes\ndesignados de cada una de las instituciones que suscribieron el \"Pacto\nNacional por el Avance de los ODS en el marco de la Agenda 2030 para el\nDesarrollo Sostenible en Costa Rica\" el 9 de setiembre del 2016 y sus\nderivados.\n\n(Así reformado por el artículo 1° del\ndecreto ejecutivo N° 44077 del 5 de junio del 2023)\n\n(Así modificada su numeración por el\nartículo 2° del decreto ejecutivo N° 44945 del 7 de marzo de 2025, que lo\ntraspasó del antiguo artículo 7 al artículo 8)\n\nArtículo 9.- Conformación de la Secretaría Técnica de los ODS. La Secretaría\nTécnica estará conformada por una o un coordinador y un equipo de trabajo\ninterdisciplinario, todos ellos funcionarios de MIDEPLAN. La Secretaría Técnica\npodrá convocar a otros funcionarios del sector público para consulta y\ncolaboración. La o el Ministro de Planificación Nacional y Política Económica\nestablecerá el funcionamiento de la Secretaría Técnica con el apoyo de las\nSecretarías de Planificación Sectorial establecidas en el Reglamento Orgánico\ndel Poder Ejecutivo.\n\n(Así modificada su numeración por el\nartículo 2° del decreto ejecutivo N° 44945 del 7 de marzo de 2025, que lo\ntraspasó del antiguo artículo 8 al artículo 9)\n\nArtículo 10.-Competencias de la Secretaría Técnica. La Secretaría Técnica tendrá\nlas siguientes competencias:\n\na) Convocar las reuniones del Consejo y del Comité, así como\nelaborar las actas correspondientes.\n\nb) Promover la consulta\na la comunidad nacional ya sea por sectores\no de manera individual, para que los\nciudadanos realicen sus reflexiones y aportes sobre contenidos\nde la Agenda 2030, y su implementación\nen el país, en función de los\nmejores principios y valores basados en democracia búsqueda\ndel bien común buena fe, participación\nciudadana, y desarrollo de\nlas personas y de la sociedad costarricense. Tramitando\ntodos los aportes y reflexiones de manera que la comunidad nacional pueda tener alcance a\nlo que se recibió se haya\no no tomado en cuenta para la revisión de la\nAgenda 2030, y sus ODS.\n\nc) Formular promover y dar seguimiento a las metas nacionales de los ODS al 2030 comprometidas por\nlas administraciones que estén incorporadas en los diferentes instrumentos de planificación, como\npolíticas, planes programas, proyectos, así como en la presupuestación nacional institucional,\nsectorial y regional.\n\nd) Fomentar la participación de representantes del sector público, de la sociedad civil, de\nla academia, del sector privado, de organizaciones internacionales,\nde organismos no gubernamentales.\nde los gobiernos\nlocales y personas expertas en\ntemas relacionados para lograr el cumplimiento de los ODS en Costa Rica, en su particularidad\ny en su condición\nde estado soberano.\n\ne) Facilitar alianzas público-privadas orientadas a alcanzar los\nODS, cuando sea necesario.\n\nj) Implementar una estrategia de seguimiento y evaluación de los ODS, que se haga pública y a la que\npuedan tener acceso los habitantes del país.\n\ng) Establecer mecanismos de rendición de cuentas para conocer sobre los\navances y las brechas en la implementación de las metas relacionadas con los ODS.\n\nh) Elaborar informes sobre los ODS que deba presentar Costa Rica ante\nlas Naciones Unidas y otros organismos internacionales y nacionales.\n\ni) Organizar estrategias de Comunicación para informar sobre los ODS y divulgar los avances\nlogrados.\n\nj) Convocar una vez\nal año a representantes de los Poderes del\nEstado de las instituciones públicas,\nde la sociedad civil, del sector privado,\nde las organizaciones internacionales\ny de los gobiernos locales\npara participar en el Foro Nacional de los ODS.\n\nk) Dar seguimiento a los acuerdos del Consejo\ny del Comité Consultivo.\n\nl) Realizar las funciones que resulten derivadas del ejercicio de su competencia.\n\n(Así reformado por el artículo 1° del decreto ejecutivo\nN° 44945 del 7 de marzo de 2025)\n\n(Así modificada su numeración por el artículo 2° del decreto ejecutivo N° 44945\ndel 7 de marzo de 2025, que lo traspasó\ndel antiguo artículo 9 al artículo 10)\n\nArtículo 11.-\nGrupos de trabajo. articles 1, 5 and 17 of the Organic Law of the Ministry of Foreign Affairs and Worship (N° 3008 of July 18, 1962); articles 25 subsection 1), 27 subsection 1), 99, 100 and 113 of the General Law of Public Administration (N° 6227 of May 2, 1978); articles 2 and 3 of the Organic Regulation of the Executive Branch (Executive Decree N° 38536-MP-PLAN of July 25, 2014); the National Statistics System Law (N° 7839 of October 15, 1998) and its Regulation (Executive Decree N° 28849-PLAN of August 24, 2000).\n\nWHEREAS:\n\nI.- That by resolution number AIRES/70/1 of September 25, 2015, the United Nations General Assembly approved the \"2030 Agenda for Sustainable Development\", which establishes 17 Sustainable Development Goals and 169 targets focused on achieving sustainable development in its three dimensions: economic, social, and environmental.\n\n(Thus amended the preceding recital by article 1 of executive decree N° 44945 of March 7, 2025)\n\nII.- That in that same resolution AIRES/70/1 of the United Nations General Assembly, a call is made in its paragraphs 55 and 72 for governments to set their own national targets, guided by the ambitious global aspiration but taking into account the country's circumstances.\n\n(Thus amended the preceding recital by article 1 of executive decree N° 44945 of March 7, 2025)\n\nIII.- That in accordance with paragraphs 55 and 72 of the aforementioned Resolution, the Government of the Republic of Costa Rica must adopt those parts of the 2030 Agenda that relate to national development priorities in such a way that it contributes to the development of our country.\n\n(Thus amended the preceding recital by article 1 of executive decree N° 44945 of March 7, 2025)\n\nIV.- That the Government of Costa Rica endorsed the 2030 Agenda for Sustainable Development, as well as a set of specific targets and indicators, selected based on their contribution to advancing the national development strategy and their conformity with the law of the constitution of our country.\n\n(Thus amended the preceding recital by article 1 of executive decree N° 44945 of March 7, 2025)\n\nV.- That it is necessary to make a functional proposal for the planning, implementation, and follow-up that Costa Rica has chosen regarding the targets and indicators related to what the 2030 Agenda proposes, in such a way that they align with the national development strategy, the law of the Costa Rican Constitution, and the international instruments that are congruent and correlated with that law of the Constitution.\n\n(Thus amended the preceding recital by article 1 of executive decree N° 44945 of March 7, 2025)\n\nVI.- That on September 9, 2016, the Presidents of the three Branches of Government and the Supreme Electoral Tribunal, together with representatives of local governments, the private sector, state universities, and civil society, signed the \"National Pact for the Advancement of the SDGs within the framework of the 2030 Agenda for Sustainable Development in Costa Rica,\" assuming a public commitment to the achievement of the SDGs, provided it is verified that it adheres to the law of the Constitution and the protection of human rights, as well as the targets and indicators adopted by the country in accordance with the national development strategy.\n\n(Thus added the preceding recital by article 2 of executive decree N° 44945 of March 7, 2025)\n\nVII.- That a weighted and rational national strategy is necessary, which studies the implementation of the SDGs in Costa Rica, bringing together public institutions, the private sector, academia, civil society, and local governments, among other entities, in a manner that facilitates spaces for dialogue and coordination for the fulfillment of these objectives with their respective targets.\n\n(Thus added the preceding recital by article 2 of executive decree N° 44945 of March 7, 2025)\n\nVIII.- That in accordance with article 12 bis of the Regulation to the Law for the Protection of Citizens from Excessive Requirements and Administrative Procedures, Executive Decree N° 37045-MP-MEIC of February 22, 2012, the Cost-Benefit Evaluation Form was processed in Section 1 called Prior Control for Regulatory Improvement, the result of which was negative and that the proposal does not contain procedures or requirements.\n\n(Thus added the preceding recital by article 2 of executive decree N° 44945 of March 7, 2025)\n\nTherefore,\n\nTHEY DECREE:\n\nGOVERNANCE AND IMPLEMENTATION OF\n\nTHE SUSTAINABLE DEVELOPMENT GOALS IN COSTA RICA\n\nArticle 1.- Purpose. The purpose of this decree is to establish an organizational structure to plan, implement, and follow up in Costa Rica on the Sustainable Development Goals (SDGs) and the 2030 Agenda, in those targets and indicators adopted by the country, in accordance with the national development strategy and the law of the Constitution and the international instruments signed and ratified by Costa Rica.\n\n(Thus amended by article 1 of executive decree N° 44945 of March 7, 2025)\n\nArticle 2.- Definitions. For the purposes of this Executive Decree, the following definitions are established:\n\na) Sustainable Development: Development that meets the needs of the present without compromising the ability of future generations to meet their own needs, integrating the economic, social, and environmental dimensions.\n\nb) Sustainability: Capacity to maintain or improve natural, social, and economic systems for current and future generations.\n\nc) Social Inclusion: Process that ensures that all individuals and groups in society, especially those in vulnerable situations, can fully participate in economic, social, and political life.\n\nd) Resilience: Capacity of a system, community, or society exposed to risks to resist, absorb, adapt to, and recover from the effects of a hazard in a timely and efficient manner.\n\ne) Governance: Structures, decisions, and processes designed to ensure accountability, equity, transparency, and inclusion in decision-making and policy implementation. For which this normative body will serve as the basis for the application and interpretation of any National Planning instrument, of any national policy or directive prepared by centralized or decentralized public institutions, and will serve as an interpretive and clarifying reference for any application of the 2030 Agenda, in any of the State's documents.\n\nf) Dignity: According to the Universal Declaration of Human Rights, it refers to the inherent and singular value of life and of each human being as a continuous whole from conception until natural death, regardless of their status, role in society, or circumstances, whose fulfillment is freedom, love, justice, and peace among people and nations.\n\ng) Human Right: Dignity is the natural source of human rights based on the moral, ethical, or legal norms that are promoted and developed within the family, and are protected and guaranteed equally in favor of all human beings constituted as persons, by the simple fact of being human beings, against abuses by the State or others.\n\nFrom the Political Constitution and from dignity, the recognition of the fundamental Rights of each person, and of each nation, is implied, as is humane treatment towards both, regardless of their origin, beliefs, capacities, or any other characteristic or circumstance. The basis that guarantees respect, equality, and fair treatment for all individuals of the human family. Rights are inherent and inalienable to all persons, not being a favor or concession of the State, they are prior to it, according to the Universal Declaration of Human Rights in its articles 1 and 2: \"All human beings are born free and equal in dignity and rights and, endowed as they are with reason and conscience, should act towards one another in a spirit of brotherhood\" and \"Everyone is entitled to all the rights and freedoms set forth in this Declaration, without distinction of any kind, such as race, colour, sex, language, religion, political or other opinion, national or social origin, property, birth or other status.\" A Declaration that sustains the interpretation of this decree.\n\nh) Culture: Etymologically, it comes from Latin, and shares a root with cultivate, inhabit, and celebrate. It is that which composes the identity and way of life of a group of people who cultivate within themselves, inhabit common spaces, honor, and celebrate their shared history, including their beliefs, traditions, customs, art, music, language, and social practices. It ranges from the way they dress and eat to artistic expressions and the social norms that govern their relationships. Culture encompasses everything that characterizes a society, shaping its way of thinking, acting, relating, and understanding the world. An intricate fabric that unites people in a community and provides them with a sense of identity and belonging. UNESCO, in its document on Sustainable Education, states that \"only a human-centred approach to development based on mutual respect and dialogue between cultures can lead us to lasting peace.\"\n\ni) Equality: Refers to the condition or quality of all human beings, men and women, being equal in rights, opportunities, or treatment. It does not mean eliminating differences between human beings, but guaranteeing equal treatment by reason of their humanity. Despite those natural or constructed differences between human beings and their circumstances, it promotes justice by ensuring that all people have access to the same rights and resources, regardless of their differences in sex, race, ethnic origin, ability, or any other characteristic. According to the Universal Declaration of Human Rights, \"Whereas the peoples of the United Nations have in the Charter reaffirmed their faith in fundamental human rights, in the dignity and worth of the human person and in the equal rights of men and women and have determined to promote social progress and better standards of life in larger freedom,\" reaffirming what is stated in the founding Charter of the United Nations, equality according to the Charter seeks to eliminate discrimination between men and women and between large and small nations, and to foster mutual respect among all individuals of the human family: \"We the peoples of the United Nations determined to save succeeding generations from the scourge of war, which twice in our lifetime has brought untold sorrow to mankind, and to reaffirm faith in fundamental human rights, in the dignity and worth of the human person, in the equal rights of men and women and of nations large and small.\"\n\nj) Equity: Relates to justice and impartiality, and refers to treating each person according to their individual needs. As a complement to equality, which seeks to give the same treatment to everyone, equity recognizes the differences between people and seeks to ensure that each individual receives what they need to have fair opportunities, without this implying violating the rights of others or distorting the common good. Equity focuses on ensuring that everyone has the capacity to achieve the same level of opportunity, well-being, and success, recognizing and addressing underlying inequalities and understanding the Matthew effect. The effort of all human beings is not the same even if they have the same or different opportunities and access to resources.\n\nk) Inclusive: It is a condition of equitable equality so that no one is left out, and refers to the quality of including or encompassing all individuals or entities, regardless of differences in their backgrounds, identities, characteristics, or beliefs. Inclusivity promotes equitable access to opportunities and resources for all, ensuring that diverse perspectives and voices are valued and represented, all subject to the rule of law and the common good.\n\nl) Sovereignty: Refers to the principle by which a Nation or State is independent, considered as a free and sovereign subject of law. Within its territory, it has the authority to make decisions and exercise authority over its own territory, government, people, and destiny regarding internal and external affairs without interference of any kind. This includes control over its political, economic, social, and legal system, as well as the capacity to establish laws, policies, and international relations in accordance with its own national interests and values. In the international context, the principle of sovereignty implies mutual respect between nations and non-intervention in the internal affairs of other states, neither between nations nor by Multilateral Organizations, according to the Charter of the United Nations itself, a principle of peace, concord, and collaborative development among nations.\n\nm) Well-being: It is the minimum general state of prosperity, happiness, freedom, and satisfaction in the life of a person, community, or society as the base of Maslow's pyramid, not as an end in itself. It originates in the idea of the Welfare State, born in the Depression and the post-war period, as massive solidarity corrective measures, universal basic income. In a broader sense, well-being is also related to the balance between the different dimensions of life, the family, such as work, leisure, interpersonal relationships, health, personal and professional development, consumption, and contribution to the community. Well-being refers to the active and sustainable pursuit of a basic quality of life in search of freedom and truth. It includes biological well-being, as well as emotional, family, vocational, spiritual, mental, and social well-being. Well-being implies living in healthy and safe conditions, having access to resources and opportunities that promote personal development, and thus sustaining sustainable relationships with others.\n\n(Thus added by article 2 of executive decree N° 44945 of March 7, 2025)\n\nArticle 3.- Public Administration and the SDGs. All public institutions, within the scope of their competencies, dependencies, and autonomies, must provide collaboration for the fulfillment of the SDGs in Costa Rica, in accordance with the principle of due inter-institutional coordination.\n\n(Thus modified its numbering by article 2 of executive decree N° 44945 of March 7, 2025, which transferred it from former article 2 to article 3)\n\nArticle 4.- High-Level Council of the Sustainable Development Goals and Technical Secretariat. The High-Level Council of the Sustainable Development Goals is created, hereinafter referred to as \"the Council,\" as the highest body to coordinate actions aimed at fulfilling the 2030 Agenda in Costa Rica. The Council shall have a Technical Secretariat of the Sustainable Development Goals, hereinafter referred to as \"the Technical Secretariat,\" and shall be exercised by the Ministry of National Planning and Economic Policy, hereinafter referred to as \"MIDEPLAN\".\n\n(Thus modified its numbering by article 2 of executive decree N° 44945 of March 7, 2025, which transferred it from former article 3 to article 4)\n\nArticle 5.- Integration of the Council. The Council shall be composed of:\n\na) the President of the Republic or the Vice President of the Republic to whom it is delegated, who shall preside;\n\n(Thus amended the preceding subsection by article 1 of executive decree N° 44077 of June 5, 2023)\n\nb) the Minister of Foreign Affairs and Worship;\n\nc) the Minister of National Planning and Economic Policy;\n\nd) the Minister of Environment and Energy;\n\ne) the Executive President of the Joint Institute for Social Assistance with the rank of Minister of Human Development and Social Inclusion.\n\n(Thus amended by article 1 of executive decree N° 42127 of December 20, 2019)\n\n(Thus modified its numbering by article 2 of executive decree N° 44945 of March 7, 2025, which transferred it from former article 4 to article 5)\n\nArticle 6.- Operation of the Council. The Council shall meet ordinarily three times a year, upon prior convocation by the President of the Republic or the Vice President of the Republic to whom it is delegated, through the Technical Secretariat, and extraordinarily at the request of the President of the Republic or the Vice President of the Republic to whom it is delegated, when deemed necessary. Minutes of the matters discussed and agreements reached shall be prepared for each session, a function that shall be attended to by the coordinator of the Technical Secretariat.\n\n(Thus amended by article 1 of executive decree N° 44077 of June 5, 2023)\n\n(Thus modified its numbering by article 2 of executive decree N° 44945 of March 7, 2025, which transferred it from former article 5 to article 6)\n\nArticle 7.- Functions of the Council. The Council shall have the following functions:\n\na) To study, analyze, and, where appropriate, endorse a national strategy for development, planning, and implementation based on the SDGs and their targets that are in accordance with the law of the Constitution and the international instruments signed and ratified by Costa Rica, providing due hearing and opening, in a transparent manner and always in Good Faith, a dialogue for a reasonable time to the sectors of society that wish to contribute improvements or changes in the implementation being made of the 2030 Agenda.\n\nb) To establish the necessary measures that allow for the allocation of financial resources for the implementation of the SDGs.\n\nc) To review the 2030 Agenda, its content, and the implementation it has been given, based on the legal order, the highest public interests of the Costa Rican legal order, giving openness to democratic dialogue from different social sectors, to consensus-building, and listening to and analyzing their observations and requests.\n\nd) Those that result from the exercise of its competence, prioritizing national planning and targets, as well as the internal legal order.\n\n(Thus amended by article 1 of executive decree N° 44945 of March 7, 2025)\n\n(Thus modified its numbering by article 2 of executive decree N° 44945 of March 7, 2025, which transferred it from former article 6 to article 7)\n\nArticle 8.- Consultative Committee of the High-Level Council of the Sustainable Development Goals. There shall be a Consultative Committee of the High-Level Council of the Sustainable Development Goals, hereinafter referred to as \"the Consultative Committee,\" as a space for consensus-building and dialogue to advise the Council on the implementation of the SDGs in the country. The Consultative Committee shall be convened and directed by the Minister of National Planning and Economic Policy in their role as Technical Secretariat of the SDGs and shall be composed of the titular representatives or designated alternates of each of the institutions that signed the \"National Pact for the Advancement of the SDGs within the framework of the 2030 Agenda for Sustainable Development in Costa Rica\" on September 9, 2016, and its derivatives.\n\n(Thus amended by article 1 of executive decree N° 44077 of June 5, 2023)\n\n(Thus modified its numbering by article 2 of executive decree N° 44945 of March 7, 2025, which transferred it from former article 7 to article 8)\n\nArticle 9.- Composition of the Technical Secretariat of the SDGs. The Technical Secretariat shall be composed of a coordinator and an interdisciplinary work team, all of whom are officials of MIDEPLAN. The Technical Secretariat may convene other public sector officials for consultation and collaboration. The Minister of National Planning and Economic Policy shall establish the operation of the Technical Secretariat with the support of the Sectoral Planning Secretariats established in the Organic Regulation of the Executive Branch.\n\n(Thus modified its numbering by article 2 of executive decree N° 44945 of March 7, 2025, which transferred it from former article 8 to article 9)\n\nArticle 10.- Competencies of the Technical Secretariat. The Technical Secretariat shall have the following competencies:\n\na) To convene the meetings of the Council and the Committee, as well as to prepare the corresponding minutes.\n\nb) To promote consultation with the national community, whether by sectors or individually, so that citizens can make their reflections and contributions on the contents of the 2030 Agenda and its implementation in the country, based on the best principles and values founded on democracy, pursuit of the common good, good faith, citizen participation, and the development of individuals and Costa Rican society. Processing all contributions and reflections so that the national community can have access to what was received, whether or not it was taken into account for the review of the 2030 Agenda and its SDGs.\n\nc) To formulate, promote, and follow up on the national targets of the SDGs for 2030 committed to by administrations that are incorporated in the different planning instruments, such as policies, plans, programs, projects, as well as in national institutional, sectoral, and regional budgeting.\n\nd) To foster the participation of representatives from the public sector, civil society, academia, the private sector, international organizations, non-governmental organizations, local governments, and expert persons in related topics to achieve the fulfillment of the SDGs in Costa Rica, in its particularity and in its condition as a sovereign state.\n\ne) To facilitate public-private partnerships aimed at achieving the SDGs, when necessary.\n\nj) To implement a follow-up and evaluation strategy for the SDGs, which is made public and accessible to the inhabitants of the country.\n\ng) To establish accountability mechanisms to learn about the progress and gaps in the implementation of the targets related to the SDGs.\n\nh) To prepare reports on the SDGs that Costa Rica must submit to the United Nations and other international and national organizations.\n\ni) To organize Communication strategies to inform about the SDGs and disseminate the progress achieved.\n\nj) To convene once a year representatives of the Branches of the State, public institutions, civil society, the private sector, international organizations, and local governments to participate in the National Forum on the SDGs.\n\nk) To follow up on the agreements of the Council and the Consultative Committee.\n\nl) To perform functions that result from the exercise of its competence.\n\n(Thus amended by article 1 of executive decree N° 44945 of March 7, 2025)\n\n(Thus modified its numbering by article 2 of executive decree N° 44945 of March 7, 2025, which transferred it from former article 9 to article 10)\n\nArticle 11.- Working groups. The Technical Secretariat may create technical working groups for the implementation of the 2030 Agenda in Costa Rica, as well as convene representatives of civil society organizations, academia, the private sector, international organizations, local governments, and relevant individual actors who are experts on topics related to the SDGs, to planning as a tool for building the future and the common good, when deemed necessary.\n\n(Thus amended by article 1 of executive decree N° 44945 of March 7, 2025)\n\n(Thus modified its numbering by article 2 of executive decree N° 44945 of March 7, 2025, which transferred it from former article 10 to article 11)\n\nArticle 12.- Technical Committee of the SDGs. The Technical Committee of the SDGs is created. Chaired by the coordinator of the Technical Secretariat, with the objective of verifying the realization of specific commitments assumed by public organizations for the fulfillment of the SDGs in Costa Rica. The Technical Committee shall be composed of delegates from all the Ministries and may convene representatives of decentralized entities to contribute to their work and decision-making, always under the rule of law.\n\n(Thus amended by article 1 of executive decree N° 44945 of March 7, 2025)\n\n(Thus modified its numbering by article 2 of executive decree N° 44945 of March 7, 2025, which transferred it from former article 11 to article 12)\n\nArticle 13.- Financing of the 2030 Agenda. The Technical Secretariat shall have the advisory services of the National Institute of Statistics and Census, hereinafter referred to as \"the INEC,\" as the technical governing entity of the National Statistics System, hereinafter referred to as \"the SEN,\" for the development of compliance and monitoring indicators for the SDGs. It shall be the responsibility of the INEC to:\n\na) Manage the development of a computer platform for the Indicator System of the SDGs in Costa Rica.\n\nb) Incorporate into the National Statistical Plan the necessary actions so that the institutions of the SEN generate and apply indicators related to the SDGs in Costa Rica.\n\nc) Technically advise the institutions of the SEN in obtaining indicators for the SDGs in Costa Rica, establishing guidelines for the generation and updating of those SDGs.\n\nd) Coordinate with the Technical Secretariat the definition of indicators for the follow-up of the SDG targets in Costa Rica.\n\ne) Coordinate with the institutions of the SEN the timely verification of the indicators defined for the SDGs in Costa Rica.\n\nf) Apply the corresponding corrective and disciplinary regime for non-compliance and delays by the institutions of the SEN in the presentation and verification of reports on SDG indicators in Costa Rica.\n\n(Thus modified its numbering by article 2 of executive decree N° 44945 of March 7, 2025, which transferred it from former article 13 to article 14)\n\nArticle 15.- National Forum on the SDGs. The National Forum on the SDGs is created as a public space for the accountability of actions taken for the fulfillment of the SDGs in Costa Rica.
