  "body_es_text": "en la totalidad del texto\n\n                    -\n\n                        Texto Completo Norma 102\n\n                        Establece las tallas legales de primera captura para peces\n\nTexto Completo acta: 11EA71\n\nINSTITUTO\nCOSTARRICENSE DE PESCA Y ACUICULTURA\n\n \n\n(Esta\nnorma fue derogada por  acuerdo AJDIP/026-2018\ndel 12 de enero de 2018, \"Establece tallas legales de primera captura (TLPC)\nrespondiendo a las tallas de primera madurez sexual\")\n\nAJDIP/102-2017.\nPuntarenas, a los veinticuatro días del mes de febrero de dos mil diecisiete,\n\nConsiderando:\n\n1º-Que el Instituto Costarricense de Pesca y Acuicultura, de conformidad con la Ley 7384, Ley de\nCreación del Instituto Costarricense de Pesca y Acuicultura, Incopesca, y la Ley 8436, Ley de Pesca\ny Acuicultura, es la autoridad ejecutora de dicha ley y por ende le corresponde establecer conforme\ncriterios técnicos, científico, económicos y sociales las medidas de regulación para garantizar el\naprovechamiento sostenible de los recursos pesqueros.\n\n2º-Que por medio del\nacuerdo AJDIP/469-2016, la Junta Directiva del Incopesca,\nsegún criterio técnico emitido por la Dirección General Técnica, por medio del\nBiol. Berni Marín Alpízar, establece las Tallas\nlegales de Primera Captura correspondiendo a la tallas de primera madurez\nsexual, para peces, para lo cual se contó además con el informe del resultado\nde investigación presentado por el Centro de Investigación en Ciencias del Mar\ny Limrtología de la Universidad de Costa Rica.\n\n3º-Que dicho acuerdo\nobedece cumplimiento de las disposiciones de la Contraloría General de la\nRepública, por medio del oficio DFOE-SD-1578 y DFOE-EC-IF-15-2014.\n\n4º-Que el\nestablecimiento de tallas legales de primera captura respondiendo a tallas de\nprimera madurez sexual de peces, es una medida tendiente a garantizar el\naprovechamiento sostenible de los recursos pesqueros existentes en nuestro\npaís, donde no solo de garantiza la reproducción de las especies pesqueras,\nsino que también se contribuye al desarrollo social de las personas que se\nbenefician de las actividades que se generan de la pesca, siendo que se debe\npor igual desestimular la comercialización y consumo de productos pesqueros que\nno cumplan con la norma técnica que establece la talla de primera madurez\nsexual.\n\n5º-Que Costa Rica, ha\nratificado la Convención de Antigua, Guatemala y que por ende las regulaciones\nque se adoptan en el marco de la comisión Interamericana de Atún Tropical,\nCIAT, son de carácter vinculante.\n\n6º-Que la CIAT, aprobó en la 90° reunión celebrada en La Jolla, California, Estados Unidos de\nNorteamérica, del 27 de junio al 1 de julio de 2016, la resolución C-16-06, denominada \"Medidas de\nconservación para las especies de tiburones, con especial énfasis en el tiburón gris o sedoso\n(Carcharhinusfalciforrnis), para los años 2017, 2018 y 2019.\n\n7-Que con el análisis\nde los estudios presentados y en cumplimiento a lo dispuesto por la Contraloría\nGeneral de la República, en cumplimiento de las facultades que otorga el\nordenamiento jurídico al Incopesca, La Junta\nDirectiva del Incopesca, Por tanto,\n\nACUERDA:\n\n1º-Establecer las tallas legales\nde primera captura respondiendo a las tallas de primera madurez sexual de\nconformidad con las recomendaciones emanadas por la Dirección General Técnica\nde Incopesca, de acuerdo a la siguiente tabla:\n\n \n\nAbreviaturas:\n\nAc: Ancho\n\ncaparazón\n\nLe: longitud de cola\n\nLcefalotoráx: longitud de\ncefalotórax\n\nLt: longitud total\n\nLt 50%: longitud total\nal 50 por ciento de la población\n\nMm: milímetros.\n\n2º-Que para el caso específico del tiburón gris o\nsedoso, Carcharhinus falciformis, de conformidad con las disposiciones de la\nCIAT, se establece un rango de tolerancia del 20% de medida por debajo de la\ntalla de primera captura; misma que se determina con base en la captura total\nde individuos de este tipo de tiburón por viaje. En caso de que la fórmula de\ntolerancia arroje cifras no exactas se debería recurrir a la regla de redondeo\ndonde las cifras inferiores o iguales a 0.5 se redondean hacia el número entero\ninmediato anterior y de 0.51 en adelante hacia el número entero inmediato\nsuperior.\n\n3º-Téngase\ncomo incorporadas las tallas legales de primera captura respondiendo a tallas\nde primera madurez sexual, según lo establecido en el artículo anterior, como\nnorma de orden técnico y de cumplimiento obligatorio para todas las personas\nfísicas y jurídicas, que realizan actividades generadas como parte de la\nactividad pesquera emitiéndose está según está definido en la Ley 8436 artículo\n2 inciso 2.\n\n4º-Se\nprohíbe la comercialización, posesión, transporte, industrialización o proceso\nde productos pesqueros que no cumplan las medidas establecidas en este acuerdo.\n\n5º- Para la implementación de los controles en las\nembarcaciones pesqueras, se deberá realizar sobre el producto existente en\ncubierta, neveras o bodega de almacenamiento del producto.\n\n(Así reformado por acuerdo AJDIP/288-2017 del 13 de julio de 2017)\n\n6º-Deróguese\nlos acuerdos AJD1P/105-2013 y AJDIP/469-2016.\n\n7º-Rige\na partir de su publicación.\n\nTransitorio 1.-Para el caso de la especie \"Lutjanus\nperu\" cuyo nombre común es pago seda, se establece que durante los primeros 8\nmeses contados a partir de la entrada en vigencia del presente acuerdo la talla\nlegal de primera captura será de 280.0 mm, cumplido dicho plazo la talla legal\nde primera captura será de 340.0 mm.\n\nTransitorio\n2º-Se solicita a la Presidencia Ejecutiva del Incopesca girar todas las\ninstrucciones y destinar los recursos necesarios, para que en el plazo de un\nmes contado a partir de la aprobación del presente acuerdo se proceda a\ndivulgar este acuerdo entre el sector pesquero así como capacitar a todos los\nfuncionarios que deban velar por el cumplimiento de esta disposición..",

In the event that the tolerance\nformula yields non-exact figures, the rounding rule shall be applied,\nwhere figures less than or equal to 0.5 are rounded down to the immediately preceding whole\nnumber and from 0.51 onward, up to the immediately following whole\nnumber.\n\n3º-The legal sizes of first capture corresponding to sizes\nat first sexual maturity, as established in the previous article, are hereby\nincorporated as a standard of a technical nature and mandatory compliance for all natural\nand legal persons who carry out activities generated as part of the\nfishing activity, this being issued as defined in Ley 8436 article\n2 subsection 2.\n\n4º-The\ncommercialization, possession, transport, industrialization, or processing\nof fishery products that do not meet the measurements established in this agreement is prohibited.\n\n5º- For the implementation of controls on\nfishing vessels, it shall be carried out on the product existing on\ndeck, in iceboxes, or in the product storage hold.\n\n(Thus amended by agreement AJDIP/288-2017 of July 13, 2017)\n\n6º-Agreements AJD1P/105-2013 and AJDIP/469-2016 are hereby repealed.\n\n7º-It takes effect\nupon its publication.\n\nTransitory 1.-For the case of the species \"Lutjanus\nperu\" whose common name is pago seda, it is established that during the first 8\nmonths from the entry into force of this agreement, the legal\nsize of first capture shall be 280.0 mm; once this period has expired, the legal size\nof first capture shall be 340.0 mm.\n\nTransitory\n2º-The Presidencia Ejecutiva of Incopesca is requested to issue all\ninstructions and allocate the necessary resources so that, within one\nmonth from the approval of this agreement, this agreement is\ndisseminated among the fishing sector and all\nofficials who must ensure compliance with this provision are trained."
