económicas y amenaza a la seguridad alimentaria, al\nproducir una menor disponibilidad de proteína de origen animal con alto valor\nnutritivo y de fácil adquisición.\n\n2º-Que mediante Decreto Ejecutivo N° 25088-MAG del 25 de marzo de 1996, publicado en el Diario\nOficial La Gaceta N° 80 del 24 de abril de 1996, se declaró la totalidad del territorio nacional de\nla República de Costa Rica, libre de la enfermedad Newcastle Velogénico a efecto de que se pudiera\nexportar carne de pollo y sus derivados, a otros países libres de dicha enfermedad.\n\n3º-Que el 22 de abril del 2015\nfue denunciado y reportado al Servicio Nacional de Salud Animal (SENASA) del\nMinisterio de Agricultura y Ganadería, una alta mortalidad en aves de traspatio\nen el poblado de Bella Vista de Santa Cecilia del Cantón de La Cruz y que,\nrealizada la consiguiente investigación epidemiológica, el 26 de abril de dicho\naño, se confirmó el diagnóstico, mediante técnicas de laboratorio altamente\nespecializadas, reflejando que el brote era causado por el virus de Newcastle Velogénico.\n\n4º-Que el Servicio Nacional de\nSalud Animal, en uso de sus competencias establecidas en la Ley N° 8495 del 6\nde abril del 2006, mediante Resoluciones N° SENASA-DG-R015-2015 y N°\nSENASA-DG-R016-2015, ambas del 27 de abril del presente año, declaró estado de\nemergencia menor y ordenó la aplicación de una serie de medidas sanitarias de\ncarácter general y obligatorias para el control de la enfermedad.\n\n5º-Que el Poder Ejecutivo\nmediante Decreto Ejecutivo N° 39100-MAG del 18 de mayo de 2015, declaró estado\nde emergencia sanitaria epidémica nacional por la presencia de la enfermedad de\nNewcastle Velogénico en el territorio nacional y se\ndeclaró de orden público e interés social la prevención, el control y la\nerradicación de dicha enfermedad.\n\n6º-Que como estrategia de\nerradicación de la enfermedad indicada se utilizó el sacrificio sanitario de\ntodas las aves silvestres en cautiverio y domésticas que presentaren la\nenfermedad y el establecimiento de cuarentena sanitaria en aquellas zonas del\npaís donde se detecten casos de mortalidad causada por el virus de Newcastle\nVelogénico además de otras medidas de control como la desinfección, vigilancia\nepidemiológica y control de movilización de animales y mercancías de riesgo.\n\n7º-Que posterior a la aplicación\nde las medidas antes mencionadas por el SENASA para el control del brote y\nrealizada la correspondiente vigilancia epidemiológica de la enfermedad de\nNewcastle Velogénico, siguiendo los lineamientos\ninternacionales establecidos por la Organización Mundial de Sanidad Animal\n(O.I.E.), se ha logrado establecer la ausencia de esa enfermedad en la\ntotalidad del territorio nacional.\n\n8º-Que en virtud de lo antes\nseñalado y siendo que es competencia del SENASA restablecer la salud animal y\nla salud pública veterinaria, así como mantener la condición 6227 of May 2,\n1978, General Law of Public Administration, Law N° 7064 of April 29,\n1987, Law for the Promotion of Agricultural Production, which incorporates the\nOrganic Law of the Ministry of Agriculture and Livestock, and Law N° 8495 of April 6,\n2006, General Law of the National Animal Health Service.\n\nConsidering:\n\n1º-That Velogenic Newcastle disease is an infectious-contagious threatening food security by\nproducing a lower availability of animal-origin protein with high nutritional\nvalue and easy accessibility.\n\n2º-That by Executive Decree N° 25088-MAG of March 25, 1996, published in the Official\nGazette La Gaceta N° 80 of April 24, 1996, the entire national territory of\nthe Republic of Costa Rica was declared free of Velogenic Newcastle disease so that\nchicken meat and its derivatives could be exported to other countries free of said disease.\n\n3º-That on April 22, 2015,\na high mortality rate in backyard birds\nin the town of Bella Vista de Santa Cecilia in the Canton of La Cruz was reported and notified to the National Animal Health Service (Servicio Nacional de Salud Animal, SENASA) of the\nMinistry of Agriculture and Livestock, and that,\nafter the consequent epidemiological investigation was carried out, on April 26 of said\nyear, the diagnosis was confirmed through highly\nspecialized laboratory techniques, revealing that the outbreak was caused by the Velogenic Newcastle virus.\n\n4º-That the National Animal Health Service,\nusing its powers established in Law N° 8495 of April 6,\n2006, through Resolutions N° SENASA-DG-R015-2015 and N°\nSENASA-DG-R016-2015, both of April 27 of the current year, declared a\nminor emergency status (estado de emergencia menor) and ordered the application of a series of general\nand mandatory sanitary measures for the control of the disease.\n\n5º-That the Executive Branch,\nthrough Executive Decree N° 39100-MAG of May 18, 2015, declared a\nnational epidemic sanitary emergency status (estado de emergencia sanitaria epidémica nacional) due to the presence of Velogenic Newcastle\ndisease in the national territory, and\nthe prevention, control, and\neradication of said disease were declared matters of public order and social interest.\n\n6º-That as an eradication strategy\nfor the indicated disease, the sanitary slaughter (sacrificio sanitario) was used for\nall wild birds in captivity and domestic birds presenting the\ndisease, and the establishment of sanitary quarantine in those areas of the\ncountry where mortality cases caused by the Velogenic Newcastle\nvirus were detected, in addition to other control measures such as disinfection, epidemiological\nsurveillance (vigilancia epidemiológica), and control of the movement of animals and risk goods.\n\n7º-That after the application\nof the aforementioned measures by SENASA to control the outbreak and\nafter carrying out the corresponding epidemiological surveillance of the Velogenic Newcastle\ndisease, following the international\nguidelines established by the World Organisation for Animal Health\n(O.I.E.), the absence of that disease in\nthe entire national territory has been established.\n\n8º-That by virtue of the\nforegoing and since it is SENASA's responsibility to re-establish animal health\nand veterinary public health, as well as to maintain the recognized sanitary condition\nin the country, in accordance with the provisions of Chapter 10.9, Infection\nwith Newcastle disease virus of the O.I.E. Terrestrial Animal Health\nCode, it is imperative to issue an Executive Decree\nthat recovers the status of a country free of Velogenic Newcastle\ndisease.\n\n9º-That in accordance with the\nRegulation to the Law for the Protection of Citizens from Excessive\nRequirements and Administrative Procedures, Executive Decree N° 37045-MP-MEIC and its amendments, it was\ndetermined that this proposal does not establish or modify procedures,\nrequirements, or formalities that the administered party must fulfill, a situation for which\nthe prior control procedure was not carried out.
