Que mediante Decreto Ejecutivo N° 8443-A del 20 de abril de 1978, se\ncreó el galardón de la \"Medalla Nacional del Mérito Agrícola\", como\nreconocimiento público para estimular las labores meritorias que se desarrollan\nen el campo agrícola.\n\n2. Que el Poder Ejecutivo considera necesario continuar otorgando este\ngalardón público nacional, como agradecimiento e incentivo para quienes se han\ndistinguido por sus contribuciones, en pro del desarrollo de las actividades\nagrícolas.\n\n3. Que los procedimientos para otorgar este galardón son potestad del\nConsejo Nacional Sectorial Agropecuario (CAN), de conformidad con lo\nestablecido en el artículo 33 de Ley de Fomento a la Producción Agropecuaria\nFODEA y Orgánica del Ministerio de Agricultura y Ganadería, Ley N° 7064 del 29\nde abril de 1987.\n\n4. Que, en el entorno internacional y nacional del sector agropecuario,\ndesde la promulgación de este galardón, se han presentado cambios\nsignificativos, que plantean un nuevo paradigma en la producción agrícola,\norientada hacia una intensificación sostenible de la producción, con valor\nagregado, responsabilidad social y ambiental; por lo cual se requiere un\nreplanteamiento de esta normativa.\n\n5. Que, mediante Acuerdo en firme del CAN, en su Sesión N° 09 del día 17\ndel mes de noviembre de 2016, se aprobó por unanimidad la derogación del\nDecreto Ejecutivo N° 8443-A del 20 de abril de 1978; y sustituirlo por uno más\nacorde con el entorno mundial y nacional del sector agrícola de Costa Rica.\n\n6. Que se procedió a llenar el Formulario de Evaluación Costo Beneficio,\nSección I, denominada Control Previo de Mejora Regulatoria, siendo que el mismo\ndio un resultado negativo y la propuesta no contiene trámites ni requisitos.\n\nPor tanto,\n\nDECRETAN:\n\nREGLAMENTO PARA EL OTORGAMIENTO DE LA MEDALLA\n\nNACIONAL AL MÉRITO AGRÍCOLA\n\nArtículo 1°. La \"Medalla Nacional al Mérito Agrícola\", será conferida a\nuna persona física o jurídica, una sola vez al año, sin distinciones de tipo\nalguno, en cuanto a edad, sexo, profesión, nacionalidad, creencia religiosa,\nresidencia u otros factores, a condición de que su labor haya sido meritoria en\nel campo agrícola nacional, tanto a nivel particular como empresarial.\n\nArtículo 2°. Se entenderá por campo agrícola: los procesos de producción\nprimaria, transformación, mercadeo y comercialización de los productos\nagrícolas, pecuarios, apícolas, acuícolas, pesqueros y otros productos del mar,\nasí como los relacionados con la producción y comercialización de insumos,\nbienes y servicios relacionados con estas actividades.\n\nArtículo 3°. Quedarán comprendidas entre las posibles personas\ncandidatas, todas aquellas personas físicas, productores o productoras y\npersonas jurídicas, cuya labor en el campo agrícola, empresarial, científico,\nprofesional o técnico, se haya desarrollado en las ciencias naturales,\nbiológicas, económicas o sociales.\n\nArtículo 4°. La postulación de las candidaturas deberá hacerse por\nmedio, de los colegios profesionales competentes, asociaciones de personas\nproductoras, cámaras empresariales, cooperativas, corporaciones agrícolas o\ngrupos organizados, los Comités Sectoriales Regionales Agropecuarios (CSRA) y\nla sociedad civil.\n\nArtículo 5°. El CAN, conocerá este tema en la primera sesión ordinaria\ndel año y para iniciar el proceso realizará el pedimento de los postulantes, para\nlo que solicitará a la Oficina de Prensa del Ministerio de Agricultura y\nGanadería (MAG), la publicación del aviso correspondiente en un diario de\ncirculación nacional; especificando los requisitos para postular a tal\ngalardón, así como el lugar y fecha de entrega de la documentación pertinente.\n\nArtículo 6°. El CAN, además en su primera sesión del año nombrará una\nComisión Ad Hoc, que se denominará \"Pro Medalla Nacional del Mérito Agrícola\"\ncon tres de sus miembros, quienes desempeñarán sus funciones ad-honorem, bajo\nla dirección del Ministro Rector del Sector, para darle el carácter\ntransparente que requiere esta selección al referido galardón.\n\nArtículo 7°. Las postulaciones de los candidatos con sus atestados\ndeberán ser remitidos a la Secretaría Ejecutiva de Planificación Sectorial\nAgropecuaria (Sepsa), de conformidad con la fecha establecida para tal fin. No\nse recibirán postulaciones después de la fecha señalada. Posteriormente Sepsa\nremitirá a la Comisión, toda la documentación recibida de los postulantes, con\nel propósito de que se inicie el proceso de selección.\n\nArtículo 8°. Las funciones de la Comisión serán las siguientes:\n\na) Validar los criterios de selección y su ponderación, propuestos por\nla Sepsa, para su aplicación en el proceso de selección a fin de darle mayor\ntransparencia al mismo.\n\nb) Examinar los atestados de los candidatos para verificar sí sus\nméritos han sido realizados en el campo de acción señalados.\n\nc) Hacer un análisis exhaustivo de las cualidades de los postulantes\npara determinar si sus actividades ameritan ser reconocidas oficialmente, con\nbase en los criterios de selección.\n\nd) Seleccionar a los postulantes y proponer una terna al CAN, en la cual\nse incluirá al menos a una productora, la que será analizada en la sesión\nordinaria del mes de marzo, para seleccionar a los galardonados a la \"Medalla\nNacional al Mérito Agrícola\".\n\ne) Proponer al CAN, que declare desierta la \"Medalla Nacional al Mérito\nAgrícola\", si fuere del caso.\n\nArtículo 9°. Las personas seleccionadas para este galardón, deberán\nrecibir comunicación oficial de su designación dentro de los treinta días\nnaturales siguientes a su otorgamiento.\n\nArtículo 10°. El Presidente de la República o su representante,\nentregará oficialmente la \"Medalla Nacional al Mérito Agrícola\", a la o las\npersonas seleccionados por el CAN, en ceremonia especial que deberá llevarse en\nla celebración del \"Día del Agricultor\", 15 de mayo de cada año, en un lugar\ndel territorio nacional seleccionado por el CAN. Al efecto los postulantes\ndistinguidos con el galardón recibirán la medalla y un pergamino que los\nacreditan como poseedores de la misma.\n\nArtículo 11°. La Oficina de Prensa de la Casa Presidencial y del\nMinisterio de Agricultura y Ganadería, deberán dar publicidad a la personalidad\ne imagen de los galardonados, así como del acto de entrega oficial de la\nMedalla Agrícola.\n\nArtículo 12°.   "body_en_text": "in the entirety of the text\n\n                    -\n\n                        Full Text of Regulation 40302\n\n                        Regulation for the Awarding of the National Medal for Agricultural Merit\n\nFull Text of acta: 1169FD\n\nNo. 40302-MAG\n\nTHE PRESIDENT OF THE REPUBLIC\n\nTHE MINISTER OF AGRICULTURE AND LIVESTOCK\n\nIn exercise of the powers conferred by Articles 33 and 140, subsections 3), 18), and 20), and Article 146 of the Political Constitution, Articles 25, 27, first subsection, 28, second paragraph, subsection b of Law No. 6227 of May 2, 1978, General Law of Public Administration, and the Law for the Promotion of Agricultural Production FODEA and Organic Law of the Ministry of Agriculture and Livestock, Law No. 7064 of April 29, 1987.\n\nCONSIDERING\n\n1. That by Executive Decree No. 8443-A of April 20, 1978, the award of the \"National Medal for Agricultural Merit\" was created, as public recognition to stimulate meritorious work carried out in the agricultural field.\n\n2. That the Executive Branch considers it necessary to continue awarding this national public distinction, as gratitude and incentive for those who have distinguished themselves through their contributions to the development of agricultural activities.\n\n3. That the procedures for awarding this distinction are the purview of the National Sectoral Agricultural Council (Consejo Nacional Sectorial Agropecuario, CAN), in accordance with the provisions of Article 33 of the Law for the Promotion of Agricultural Production FODEA and Organic Law of the Ministry of Agriculture and Livestock, Law No. 7064 of April 29, 1987.\n\n4. That, in the international and national environment of the agricultural sector since the enactment of this award, significant changes have occurred, posing a new paradigm in agricultural production oriented towards sustainable intensification of production, with added value and social and environmental responsibility; whereby a rethinking of this regulation is required.\n\n5. That, by final Resolution of the CAN, in its Session No. 09 of November 17, 2016, the repeal of Executive Decree No. 8443-A of April 20, 1978, was unanimously approved; and its replacement with one more in line with the global and national environment of Costa Rica's agricultural sector.\n\n6. That the Cost-Benefit Evaluation Form, Section I, called Prior Control of Regulatory Improvement, was completed, with the result being negative and the proposal containing no procedures or requirements.\n\nTherefore,\n\nTHEY DECREE:\n\nREGULATION FOR THE AWARDING OF THE NATIONAL\n\nMEDAL FOR AGRICULTURAL MERIT\n\nArticle 1. The \"National Medal for Agricultural Merit\" shall be conferred upon a natural or legal person, only once a year, without distinctions of any kind regarding age, sex, profession, nationality, religious belief, residence, or other factors, provided that their work has been meritorious in the national agricultural field, both at the individual and business level.\n\nArticle 2. Agricultural field shall be understood as: the processes of primary production, transformation, marketing, and commercialization of agricultural, livestock, beekeeping, aquaculture, and fishery products and other products of the sea, as well as those related to the production and commercialization of inputs, goods, and services related to these activities.\n\nArticle 3. All natural persons, producers, and legal persons whose work in the agricultural, business, scientific, professional, or technical field has been developed in the natural, biological, economic, or social sciences shall be included among the possible candidates.\n\nArticle 4. The nomination of candidates must be made through the competent professional associations, producer associations, business chambers, cooperatives, agricultural corporations or organized groups, the Regional Sectoral Agricultural Committees (Comités Sectoriales Regionales Agropecuarios, CSRA), and civil society.\n\nArticle 5. The CAN shall address this matter in the first ordinary session of the year and, to initiate the process, shall request nominations, for which it shall request the Press Office of the Ministry of Agriculture and Livestock (Ministerio de Agricultura y Ganadería, MAG) to publish the corresponding notice in a nationally circulated newspaper, specifying the requirements for applying for said award, as well as the place and date for delivering the relevant documentation.\n\nArticle 6. The CAN shall also appoint in its first session of the year an Ad Hoc Commission, to be called \"Pro National Medal for Agricultural Merit,\" with three of its members, who shall perform their duties ad-honorem, under the direction of the Rector Minister of the Sector, to provide the transparent character required for this selection for the referred award.\n\nArticle 7. Nominations of candidates along with their supporting documents must be submitted to the Executive Secretariat for Agricultural Sectoral Planning (Secretaría Ejecutiva de Planificación Sectorial Agropecuaria, Sepsa), in accordance with the date established for such purpose. Nominations will not be accepted after the specified date. Subsequently, Sepsa shall forward to the Commission all documentation received from the nominees, for the purpose of initiating the selection process.\n\nArticle 8. The functions of the Commission shall be as follows:\n\na) Validate the selection criteria and their weighting, proposed by Sepsa, for their application in the selection process in order to provide greater transparency thereto.\n\nb) Examine the supporting documents of the candidates to verify whether their merits have been achieved in the specified field of action.\n\nc) Conduct an exhaustive analysis of the qualities of the nominees to determine if their activities merit official recognition, based on the selection criteria.\n\nd) Select the nominees and propose a shortlist of three to the CAN, which shall include at least one female producer, to be analyzed at the ordinary session of the month of March, to select the recipients of the \"National Medal for Agricultural Merit.\"\n\ne) Propose to the CAN that it declare the \"National Medal for Agricultural Merit\" vacant, should the case arise.\n\nArticle 9. The persons selected for this award shall receive official communication of their designation within the thirty calendar days following its conferral.\n\nArticle 10. The President of the Republic or his representative shall officially award the \"National Medal for Agricultural Merit\" to the person or persons selected by the CAN, in a special ceremony to be held during the celebration of \"Farmer's Day,\" May 15 of each year, at a location within the national territory selected by the CAN. To this effect, the nominees distinguished with the award shall receive the medal and a parchment accrediting them as holders thereof.\n\nArticle 11. The Press Office of the Presidential House and the Ministry of Agriculture and Livestock shall publicize the personality and image of the recipients, as well as the official ceremony for the awarding of the Agricultural Medal.\n\nArticle 12. The MAG shall incorporate each year, within its ordinary budget, the expenses required for the making of the \"National Medal for Agricultural Merit\" and the corresponding parchment.\n\nArticle 13. Executive Decree No. 8443-A of April 20, 1978, published in La Gaceta No. 90 of May 11, 1978, is hereby repealed.\n\nArticle 14. This regulation shall enter into force upon its publication.\n\nGiven at the Presidency of the Republic. —San José, on the twenty-eighth day of the month of February of the year two thousand seventeen."
