Posteriormente por\nel inciso 10) del acuerdo N° AJDIP/086-2023  del 25\nde abril de 2023, \"Establece veda total para la pesca deportiva y pesca\ncomercial en pequeña escala, excepto para la pesca turística comercial de\npequeña escala, en el periodo que va desde el 01 de mayo hasta el 31 de julio\ndel 2023, ambas fechas incluidas\", se acordó dejar sin efecto el presente\nacuerdo)\n\n(Nota de Sinalevi: Mediante acuerdo N° AJDIP/100-2020 del 22 de mayo del 2020,  se indica bajo el\nlema, \"Cuidándome, te cuido\" se aprueba como único trabajo comunal realizable y autorizado para esta\nveda 2020, la aplicación y cumplimiento del protocolo que desarrollará el INCOPESCA ajustado a la\nimplementación de Directrices y Lineamientos Sanitarios para COVID-19. Asimismo en el numeral 4 de\nla norma antes mencionado, se indica dejar sin efecto durante este año 2020 lo establecido en el\npresente acuerdo en lo que expresamente se oponga o resulte incompatible con el contenido del\npresente acuerdo)\n\nAJDIP/166-2017.-Puntarenas, a los veintiún días del mes de abril de dos\nmil diecisiete.\n\ntext-align:center'>Considerando:\n\n1º-Que al amparo de las\natribuciones y competencias establecidas al INCOPESCA mediante la Ley Nº 7384\ndel 16 de marzo de 1994 y la Ley Nº 8436 del 01 de marzo del 2005, se han\nemitido los Acuerdos Nº A.J.D.I.P./274-2005 publicado en el Diario Oficial La\nGaceta Nº 101 del 26 de mayo del 2005, Nº A.J.D.I.P./417-2005 publicado en\nel Diario Oficial La Gaceta Nº 172 del 7 de setiembre del 2005, Nº\nA.J.D.I.P./244-2012 publicado en el Diario Oficial La Gaceta Nº 161 del\n22 de agosto del 2012 y Nº A.J.D.I.P./169-2016 publicado en el Diario Oficial La\nGaceta Nº 150 del 5 de agosto del 2016, en los cuales se han establecido\nlas regulaciones aplicables para los pescadores con Licencia de Pesca Comercial\nvigente inscritos en los períodos de veda y sus pescadores ayudantes\ndebidamente acreditados ante el INCOPESCA.\n\n2º-Que de conformidad con lo dispuesto en el\nartículo 36 de la Ley Nº 8436, Ley de Pesca y Acuicultura y las restantes\ndisposiciones normativas aplicables, el Poder Ejecutivo emitió los Decretos\nEjecutivos N° 35543-MP-S-MAG publicado en el Diario Oficial La Gaceta Nº\n202 del 19 de octubre del 2009 y Nº 36043-MAG-SP-MS publicado en el Diario\nOficial La Gaceta Nº 115 del 15 de junio de 2010, mediante los cuales se\nexplica la situación de pobreza coyuntural y se facultó al Instituto Mixto de\nAyuda Social (IMAS) a otorgar una ayuda temporal a los pescadores y ayudantes\nque cumplan con las condiciones definidas en los decretos de referencia.\n\n3º-Que al otorgar la ayuda temporal, según lo\nindicado en los decretos ejecutivos supra citados y el artículo 36 de la Ley Nº\n8436, implica necesariamente la realización de servicios de trabajo comunal por\nparte de los pescadores beneficiarios, según la regulación que se realice, cuya\nsupervisión y control, durante el período de veda, corresponde al INCOPESCA y\nal IMAS, por lo que se convierte en una necesidad el definir las alternativas\nque resulten razonables, oportunas y convenientes para la realización de ese\ntrabajo comunal y su verificación.\n\n4º-Que los acuerdos indicados en el\nconsiderando 1 deben actualizarse con base en la experiencia obtenida en los\núltimos once años, para cumplir con el objetivo establecido en la Ley de Pesca\ny Acuicultura sobre el trabajo comunal para los meses de veda que establezca el\nINCOPESCA. Por tanto,\n\nLA JUNTA DIRECTIVA DE\nINCOPESCA\n\nACUERDA:\n\nRegulación para el\ncumplimiento del Servicio de Trabajo\n\nComunal por parte del pescador inscrito\nen Veda\n\nArtículo 1º-El\nINCOPESCA de manera oportuna remitirá al IMAS un listado de aquellos pescadores\ny sus ayudantes debidamente acreditados ante este Instituto, que son afectados\npor la veda, de conformidad con lo establecido en el Artículo 36 de la Ley\nN°8436, Ley de Pesca y Acuicultura.\n\nArtículo 2º-Una vez definida y otorgada la\nayuda temporal por parte del IMAS, todo pescador que la reciba, de conformidad\ncon las disposiciones normativas aplicables en la materia, deberá de cumplir\ndurante el período de las vedas establecidas por el INCOPESCA, con la\nrealización de un Servicio de Trabajo Comunal, en adelante STC, definido,\ncoordinado y supervisado por el INCOPESCA y el IMAS como condición de mérito\npor el otorgamiento y disfrute de la ayuda temporal otorgada.\n\nArtículo 3º-Para los efectos de lo\nestablecido en el artículo anterior, los pescadores de las localidades\ncomprendidas en las áreas definidas en la veda se organizarán en grupos para\ncumplir con alguna de las siguientes actividades como STC:\n\n               \nLimpieza y recolección de basura, desechos o cualquier otro\nmaterial contaminante en playas, esteros y desembocaduras de los ríos.\n\n               \nReforestación de áreas públicas.\n\n               \nRealizar obras de construcción, mantenimiento y reparación de\ncaminos, infraestructuras comunales diversas, cementerios, acueductos y otros.\n\n               \nParticipar en talleres, cursos, y otras actividades de\ncapacitación, divulgación e información afines con la actividad pesquera o de\nevidente interés público, impartidos por el INCOPESCA o por cualquier\nInstitución Pública u Organización No Gubernamental, siempre debidamente\ncoordinada con el INCOPESCA.\n\n               \nCualquier tipo de actividad de bien social o comunal en\ninstituciones de carácter benéfico como asilos de adultos mayores, hogares y\ncomedores infantiles, así como entidades públicas, centros educativos,\nreligiosos, culturales, Organizaciones No Gubernamentales, sociales y otros.\n\n               \nParticipar en campañas de limpieza impulsadas por las\norganizaciones de las comunidades y/o Entes Públicos con el objetivo de\ndisminuir los efectos negativos de enfermedades.\n\nPara cumplir con el\nSTC de conformidad con las actividades anteriormente definidas, los pescadores,\ndeberán efectuar un mínimo de 30 horas mensuales efectivas y dentro de las\ncuales no se tomará en cuenta los tiempos utilizados por los pescadores para\ndescansos o comidas, el STC se realizará en días hábiles.\n\nCorresponderá a las organizaciones de\npescadores con personería vigente y debidamente acreditadas ante el INCOPESCA\ny/o a los diferentes entes o instituciones que se vean beneficiadas con el STC\nde la comunidad pesquera correspondiente, aportar los bienes, recursos,\nmateriales, equipos y cualquier otro apoyo logístico necesario y la respectiva\nverificación o supervisión sobre el cumplimiento del STC.\n\nArtículo 4º-Corresponderá a la Comisión Nacional de Vedas del\nINCOPESCA; conocer, analizar y autorizar de forma previa al inicio de cada veda\ny de cada uno de los meses que ésta conlleve, las diferentes actividades de STC\nque los pescadores de manera individual o a través de representantes de\norganizaciones pesqueras debidamente acreditadas ante el INCOPESCA, presenten\nen el formulario establecido para este efecto denominado Programación de\nActividades de Servicio de Trabajo Comunal (Anexo 1).\n\nArtículo 5º-Una vez autorizadas o rechazadas durante cada mes las\ndiferentes actividades que realizarán los pescadores en sus comunidades, la\nComisión Nacional de Vedas a través de su Secretaría y mediante oficio, lo\ncomunicará a los pescadores, organizaciones pesqueras y a las instituciones\nbeneficiadas con dicho trabajo comunal.\n\nArtículo 6º-En aquellos casos en que se requiera reprogramar actividades\nya aprobadas, los interesados deberán de comunicarlo de forma previa a la\nComisión Nacional de Vedas para que se realice el mismo proceso descrito en los\nartículos anteriores, caso contrario las actividades que se realicen no serán\ntenidas en cuenta como STC.\n\nArtículo 7º-La obligatoriedad definida anteriormente no libera a los\npescadores ni les exime de su responsabilidad de informarse ante el\nDepartamento de Protección y Registro, Oficinas Regionales del INCOPESCA o de\nla Gerencia Regional del IMAS, del cumplimiento y de la forma de realización de\nsu STC.\n\nArtículo 8º-Únicamente serán reconocidas como STC aquellas horas\nefectivas las actividades que hayan dado inicio a partir del día 1 de cada mes,\nen otras palabras bajo ninguna circunstancia y sin excepción alguna, no se\nautorizará el adelanto de horas en días previos al mes calendario de veda\ncorrespondiente.\n\nArtículo 9º-Para efecto del reconocimiento de las horas efectivas del\nSTC, únicamente se tendrán como justificaciones válidas para la inasistencia e\nincumplimiento de éste, según las siguientes justificaciones y procedimientos:\n\n9.1. Asistencias a procesos judiciales, los Dictámenes Médicos (en los\núltimos que indique que el pescador no puede realizar actividades físicas),\nIncapacidades y Control de Asistencia Médica, en este último caso, personal o\npor acompañamiento a menores de edad o adultos mayores que estén bajo el cargo del\ninteresado, emitidos en todos los casos descritos por una autoridad de la Caja\nCostarricense de Seguro Social (CCSS).\n\n9.2. Los Dictámenes Médicos, Incapacidades, Asistencia Médica y las\njustificaciones para participar en capacitaciones (cursos, talleres, etcétera),\núnicamente serán permitidos las que sean emitidas o impartidas por una entidad\npública, de previo a su realización deberá ser valorada y aprobadas por la\nComisión Nacional de Vedas del INCOPESCA.\n\n9.3. En las supervisiones realizadas por el INCOPESCA o por el IMAS\ncuando el pescador no se encuentre en las horas que previamente programó, para\nel cumplimiento de su Servicio de Trabajo Comunal, se interpretará como ausente\nsalvo que el interesado presente una justificación que cumpla con las disposiciones\nestablecidas en los párrafos anteriores.\n\n9.4. Cualquier otro tipo de justificación diferente a las indicadas\nanteriormente, deberá ser analizada por la Comisión Nacional de Vedas, misma\nque a su vez tendrá la facultad de ordenarle al interesado la realización de\nlas horas no cumplidas.\n\nArtículo 10.-Es obligación del pescador de\ncumplir con la programación de las actividades y el total de horas efectivas\ndel STC, aprobadas por la Comisión Nacional de Vedas del INCOPESCA, para cuyo\nefecto y registro el pescador o el representante legal de la organización\npesquera que lo representa, presentará el formulario denominado Informe de\nControl del STC (Anexo 2) ante el Departamento de Protección y Registro o en la\nOficina Regional del INCOPESCA del territorio de la jurisdicción del área de\nveda.\n\nEl pescador no podrá hacerse representar por una tercera persona para el\ncumplimiento de horas efectivas de STC.\n\nEl representante legal de la organización pesquera presentará el\nformulario denominado Listado de Entrega de Pescador con STC en Veda con los\nformularios de Informe de Control del STC, en el Departamento de Protección y\nRegistro o en la Oficina Regional del INCOPESCA del territorio de la\njurisdicción del área de veda.\n\nArtículo 11.-El INCOPESCA conformará un Grupo de Supervisión, la\nPresidencia Ejecutiva designará los colaboradores responsables del Grupo\nSupervisor, quienes junto con colaboradores de las Gerencias Regionales del\nIMAS, coordinarán y supervisarán la realización del STC por parte de los pescadores\ninscritos en veda, para lo cual determinarán con las Instancias Públicas,\nOrganizaciones, Grupos de la Sociedad Civil, Centros Educativos, Religiosos,\nCulturales y otros de carácter similar, la forma y ejecución del STC.\n\nArtículo 12.-El Grupo de Supervisión del STC\nal determinar el incumplimiento del STC por parte de los pescadores\nbeneficiarios de la ayuda temporal del IMAS, entregará los reportes por medio\ndel Formulario denominado Informe de Supervisión del STC al Departamento de\nProtección y Registro o de la Oficina Regional del INCOPESCA del territorio de\njurisdicción de la veda, a quienes les corresponderá elaborar el registro de\nlos pescadores que incumplieron con el STC y remitirá la información\ncorrespondiente al IMAS en forma inmediata, para que se proceda con la\nsuspensión de la ayuda temporal.\n\nEl pescador que realice las actividades de pesca en el área de veda y\nque esté en el proceso de veda, también será sujeto de forma inmediata de la\nsuspensión de las ayudas temporales por parte del IMAS, de acuerdo con la\ncomunicación de las Asesorías Legales del INCOPESCA, del Servicio Nacional de\nGuardacostas y la Fiscalía de turno.\n\nArtículo 13.-En caso de disconformidad el pescador por escrito y\naportando las pruebas de descarga que considere pertinentes, podrá presentar un\nRecurso de Revisión ante el Grupo de Supervisión en primera instancia y en caso\nde que éste mantenga su decisión, el interesado podrá presentar un Recurso de\nApelación en Subsidio en segunda instancia ante la Gerencia Regional del IMAS\ndel territorio de la jurisdicción del área de veda, para que analicen las\ncausas de incumplimiento del STC por parte del pescador y definan cada caso de\nacuerdo a la normativa vigente.\n\nArtículo 14.-Este acuerdo deroga los Acuerdos Nº A.J.D.I.P./274-2005\npublicado en el Diario Oficial La Gaceta Nº 101 del 26 de mayo del 2005,\nNº A.J.D.I.P./417-2005 publicado en el Diario Oficial La Gaceta N°172\ndel 7 de setiembre del 2005, Nº A.J.D.I.P./244-2012 publicado en el Diario\nOficial La Gaceta Nº 161 del 22 de agosto del 2012, Nº\nA.J.D.I.P./169-2016 publicado en el Diario Oficial La Gaceta Nº 150 del\n5 de agosto del 2016 y cualquier otro acuerdo del mismo tema.\n\nArtículo 15.-Rige a partir de su publicación.\n\nANEXOS",

Likewise, in numeral 4 of\nthe aforementioned norm, it is indicated that what is established in the\npresent agreement shall be left without effect during this year 2020 insofar as it expressly contradicts or is incompatible with the content of the\npresent agreement)\n\nAJDIP/166-2017.-Puntarenas, on the twenty-first day of the month of April of two\nthousand seventeen.\n\ntext-align:center'>Whereas:\n\n1º-That under the powers and competencies established for INCOPESCA by Law No. 7384 of March 16, 1994, and Law No. 8436 of March 1, 2005, Agreements No. A.J.D.I.P./274-2005 published in the Official Gazette La Gaceta No. 101 of May 26, 2005, No. A.J.D.I.P./417-2005 published in the Official Gazette La Gaceta No. 172 of September 7, 2005, No. A.J.D.I.P./244-2012 published in the Official Gazette La Gaceta No. 161 of August 22, 2012, and No. A.J.D.I.P./169-2016 published in the Official Gazette La Gaceta No. 150 of August 5, 2016, have been issued, in which the applicable regulations have been established for fishermen with a current Commercial Fishing License registered in closed season periods and their duly accredited assistant fishermen before INCOPESCA.\n\n2º-That in accordance with the provisions of Article 36 of Law No. 8436, Fisheries and Aquaculture Law, and the remaining applicable regulatory provisions, the Executive Branch issued Decretos Ejecutivos No. 35543-MP-S-MAG published in the Official Gazette La Gaceta No. 202 of October 19, 2009, and No. 36043-MAG-SP-MS published in the Official Gazette La Gaceta No. 115 of June 15, 2010, by means of which the situation of temporary poverty is explained and the Instituto Mixto de Ayuda Social (IMAS) was empowered to grant temporary aid to fishermen and assistants who meet the conditions defined in the referenced decrees.\n\n3º-That granting temporary aid, as indicated in the aforementioned executive decrees and Article 36 of Law No. 8436, necessarily implies the performance of community work services by the beneficiary fishermen, according to the regulation enacted, the supervision and control of which, during the closed season period, is the responsibility of INCOPESCA and IMAS, making it a necessity to define the alternatives that are reasonable, timely, and convenient for carrying out this community work and its verification.\n\n4º-That the agreements indicated in whereas clause 1 must be updated based on the experience gained over the last eleven years, in order to fulfill the objective established in the Fisheries and Aquaculture Law regarding community work for the closed season months established by INCOPESCA. Therefore,\n\nTHE BOARD OF DIRECTORS OF INCOPESCA\n\nAGREES:\n\nRegulation for the Fulfillment of Community Work\n\nService by the Fisherman Registered in the Closed Season\n\nArticle 1.-INCOPESCA shall timely submit to IMAS a list of those fishermen and their assistants duly accredited before this Institute, who are affected by the closed season, in accordance with the provisions of Article 36 of Law No. 8436, Fisheries and Aquaculture Law.\n\nArticle 2.-Once the temporary aid has been defined and granted by IMAS, every fisherman who receives it, in accordance with the applicable regulatory provisions on the matter, must fulfill, during the period of the closed seasons established by INCOPESCA, the performance of a Community Work Service, hereinafter STC, defined, coordinated, and supervised by INCOPESCA and IMAS as a meritorious condition for the granting and enjoyment of the temporary aid provided.\n\nArticle 3.-For the purposes of the provisions of the preceding article, the fishermen of the localities included in the areas defined in the closed season shall organize into groups to fulfill one of the following activities as STC:\n\n                Cleaning and collection of garbage, waste, or any other contaminating material on beaches, estuaries, and river mouths.\n\n                Reforestation of public areas.\n\n                Carrying out construction, maintenance, and repair works on roads, various community infrastructures, cemeteries, aqueducts, and others.\n\n                Participating in workshops, courses, and other training, outreach, and information activities related to fishing activity or of evident public interest, given by INCOPESCA or by any Public Institution or Non-Governmental Organization, always duly coordinated with INCOPESCA.\n\n                Any type of social or community welfare activity in charitable institutions such as nursing homes, children's shelters and soup kitchens, as well as public entities, educational, religious, cultural centers, Non-Governmental Organizations, social organizations, and others.\n\n                Participating in cleanup campaigns promoted by community organizations and/or Public Entities with the objective of reducing the negative effects of diseases.\n\nTo fulfill the STC in accordance with the activities defined above, fishermen must complete a minimum of 30 effective monthly hours, within which time used by fishermen for rest or meals shall not be counted; the STC shall be carried out on business days.\n\nIt shall be the responsibility of the fishermen's organizations with current legal status and duly accredited before INCOPESCA and/or the different entities or institutions benefiting from the STC of the corresponding fishing community, to provide the goods, resources, materials, equipment, and any other necessary logistical support and the respective verification or supervision of the fulfillment of the STC.\n\nArticle 4.-It shall be the responsibility of the National Closed Season Commission (Comisión Nacional de Vedas) of INCOPESCA to be informed of, analyze, and authorize, prior to the start of each closed season and for each of the months it entails, the different STC activities that the fishermen, individually or through representatives of fishing organizations duly accredited before INCOPESCA, submit on the form established for this purpose called Programming of Community Work Service Activities (Anexo 1).\n\nArticle 5.-Once the different activities that the fishermen will carry out in their communities have been authorized or rejected during each month, the National Closed Season Commission (Comisión Nacional de Vedas), through its Secretariat and by official letter, shall communicate this to the fishermen, fishing organizations, and the institutions benefited by said community work.\n\nArticle 6.-In those cases where it is necessary to reschedule already approved activities, the interested parties must communicate this beforehand to the National Closed Season Commission (Comisión Nacional de Vedas) so that the same process described in the preceding articles can be carried out; otherwise, the activities performed shall not be taken into account as STC.\n\nArticle 7.-The obligation defined above does not release the fishermen nor exempt them from their responsibility to inquire before the Protection and Registration Department (Departamento de Protección y Registro), Regional Offices of INCOPESCA, or the Regional Management of IMAS, about the fulfillment and the manner of carrying out their STC.\n\nArticle 8.-Only those effective hours of the activities that have started from the 1st day of each month onward shall be recognized as STC; in other words, under no circumstances and without any exception, advancing hours in days prior to the corresponding calendar month of the closed season shall not be authorized.\n\nArticle 9.-For the purpose of recognizing the effective hours of the STC, only the following justifications and procedures shall be considered as valid justifications for non-attendance and non-compliance therewith:\n\n9.1. Attendance at judicial proceedings, Medical Opinions (in the latter, indicating that the fisherman cannot perform physical activities), Disabilities, and Medical Attendance Checks, in this last case, personal or to accompany minors or older adults under the care of the interested party, issued in all cases described by an authority of the Costa Rican Social Security Fund (Caja Costarricense de Seguro Social, CCSS).\n\n9.2. Medical Opinions, Disabilities, Medical Attendance, and justifications for participating in training sessions (courses, workshops, etc.) shall only be permitted if they are issued or provided by a public entity; prior to their occurrence, they must be assessed and approved by the National Closed Season Commission (Comisión Nacional de Vedas) of INCOPESCA.\n\n9.3. During supervisions carried out by INCOPESCA or IMAS, when the fisherman is not present during the hours he previously scheduled for the fulfillment of his Community Work Service, it shall be interpreted as an absence unless the interested party presents a justification that meets the provisions established in the preceding paragraphs.\n\n9.4. Any other type of justification different from those indicated above must be analyzed by the National Closed Season Commission (Comisión Nacional de Vedas), which in turn shall have the authority to order the interested party to complete the unfulfilled hours.\n\nArticle 10.-It is the fisherman's obligation to comply with the scheduling of activities and the total effective hours of the STC, approved by the National Closed Season Commission (Comisión Nacional de Vedas) of INCOPESCA, for which purpose and record, the fisherman or the legal representative of the fishing organization that represents him shall submit the form called STC Control Report (Anexo 2) to the Protection and Registration Department (Departamento de Protección y Registro) or the Regional Office of INCOPESCA in the territory of the jurisdiction of the closed season area.\n\nThe fisherman may not be represented by a third party for the fulfillment of effective hours of STC.\n\nThe legal representative of the fishing organization shall submit the form called Delivery List of Fishermen with STC in Closed Season along with the STC Control Report forms, to the Protection and Registration Department (Departamento de Protección y Registro) or the Regional Office of INCOPESCA in the territory of the jurisdiction of the closed season area.\n\nArticle 11.-INCOPESCA shall form a Supervision Group; the Executive Presidency shall designate the collaborators responsible for the Supervision Group, who, together with collaborators from the Regional Managements of IMAS, shall coordinate and supervise the performance of the STC by the fishermen registered in the closed season, for which purpose they shall determine, with the Public Authorities, Organizations, Civil Society Groups, Educational, Religious, Cultural Centers, and others of a similar nature, the form and execution of the STC.\n\nArticle 12.-Upon determining the non-compliance of the STC by the fishermen who are beneficiaries of the temporary aid from IMAS, the STC Supervision Group shall deliver the reports by means of the Form called STC Supervision Report to the Protection and Registration Department (Departamento de Protección y Registro) or the Regional Office of INCOPESCA in the territory of the jurisdiction of the closed season, which shall be responsible for preparing the registry of fishermen who failed to comply with the STC and shall immediately send the corresponding information to IMAS, so that the suspension of the temporary aid may proceed.\n\nThe fisherman who carries out fishing activities in the closed season area and who is in the closed season process shall also be immediately subject to the suspension of the temporary aids by IMAS, according to the communication from the Legal Advisory Departments (Asesorías Legales) of INCOPESCA, the National Coast Guard Service, and the Prosecutor's Office on duty.\n\nArticle 13.-In case of disagreement, the fisherman, in writing and providing the exculpatory evidence he deems pertinent, may file a Recurso de Revisión before the Supervision Group in the first instance, and in the event that it upholds its decision, the interested party may file a Recurso de Apelación in Subsidio in the second instance before the Regional Management of IMAS of the territory of the jurisdiction of the closed season area, so that they may analyze the causes of non-compliance with the STC by the fisherman and decide each case according to the regulations in force.\n\nArticle 14.-This agreement repeals Agreements No. A.J.D.I.P./274-2005 published in the Official Gazette La Gaceta No. 101 of May 26, 2005, No. A.J.D.I.P./417-2005 published in the Official Gazette La Gaceta No. 172 of September 7, 2005, No. A.J.D.I.P./244-2012 published in the Official Gazette La Gaceta No. 161 of August 22, 2012, No. A.J.D.I.P./169-2016 published in the Official Gazette La Gaceta No. 150 of August 5, 2016, and any other agreement on the same subject.\n\nArticle 15.-It shall take effect upon its publication.\n\nANNEXES"
