Es por lo anterior que\ndada dicha transformación surgen políticas como las del actual gobierno, las\ncuales desarrollan diferentes eventos para fortalecer metodologías y\nestrategias en la producción y asistencia técnica de la truchicultura\nen nuestro país, de manera que nuestros productores adquieran mayor información\ny conocimiento, para mejorar la calidad del servicio.\n\nSegundo: Que en el país hay 240 productores dedicados al cultivo de trucha, cuyo\nproducto se utiliza para la comercialización bajo diferentes presentaciones\ncomo son trucha fresca esvicerado, ahumada y filete.\n\nTercero: Que la actividad del cultivo de la trucha, se realiza dentro del\nconcepto de acuicultura familiar integrada, ligada al concepto de turismo\necológico y fincas diversificadas, donde las diferentes actividades que se\nrealizan, sirven como complemento para buscar la rentabilidad de la actividad\nintegral de la finca, mejorando el desarrollo socioeconómico a muchas familias\nde zonas rurales.\n\nCuarto: Que el Ministerio de Agricultura y Ganadería por disposición de la Ley\n7064, es el rector del Sector Agropecuario, que fue constituido como un medio\npara fortalecer y agilizar el sistema de dirección y planificación nacional,\nasí como para coadyudar a la coordinación de las\nactividades del Gobierno y de sus instituciones.   "body_en_text": "in the entirety of the text\n\n                    -\n\n                        Complete Text of Regulation 40389\n\n                        Declares the activity of trout farming to be of public interest\n\nNo. 40389-MAG\n\nTHE PRESIDENT OF THE REPUBLIC\n\nAND THE MINISTER OF AGRICULTURE AND LIVESTOCK\n\nIn exercise of the powers established in articles 140, subsections 3), 8), 18) and 20), 50 and 146 of the Political Constitution; Law No. 6227, General Law of Public Administration of May 2, 1978; Law No. 7064, Law for the Promotion of Agricultural Production, which incorporates the Organic Law of the Ministry of Agriculture and Livestock, of April 29, 1987; Law No. 7384, Law Creating the Costa Rican Institute of Fisheries and Aquaculture of March 16, 1994, Law No. 8436, Fisheries and Aquaculture Law, of March 1, 2005.\n\nConsidering:\n\nFirst: In Costa Rica over the last 15 years, aquaculture has been gaining increasing importance, not only as an alternative for the production of protein of aquatic origin, but also from a business standpoint, given that trout farming has been developing for 27 years in high-altitude areas of the country, becoming an engine of rural development, currently producing more than 800,000 kilos of fresh product for both domestic and foreign market consumption. It is therefore that, given this transformation, policies such as those of the current government emerge, which develop different events to strengthen methodologies and strategies in the production and technical assistance of trout farming (truchicultura) in our country, so that our producers acquire more information and knowledge to improve the quality of the service.\n\nSecond: That in the country there are 240 producers dedicated to trout farming, whose product is used for commercialization in different presentations such as fresh gutted trout, smoked, and fillet.\n\nThird: That the activity of trout farming is carried out within the concept of integrated family aquaculture, linked to the concept of ecological tourism (turismo ecológico) and diversified farms, where the different activities carried out serve as a complement to seek the profitability of the farm's integral activity, improving the socioeconomic development of many families in rural areas.\n\nFourth: That the Ministry of Agriculture and Livestock, by provision of Law 7064, is the governing body of the Agricultural Sector, which was constituted as a means to strengthen and streamline the national direction and planning system, as well as to contribute to the coordination of Government activities and its institutions. In that capacity, the Ministry of Agriculture and Livestock has the responsibility to address the problems affecting agricultural activities and to promote the production of agricultural goods by stimulating producers.\n\nFifth: That through official communication DGT-025-2017, of January 23, 2017, the Technical General Directorate of INCOPESCA gives its approval to the requested declaration.\n\nSixth: That the Cost-Benefit Evaluation Form was completed, Section I, denominated Prior Control of Regulatory Improvement (Control Previo de Mejora Regulatoria), with the result being negative and the proposal containing no procedures or requirements.\n\nTherefore,\n\nTHEY DECREE:\n\nDECLARATION OF PUBLIC INTEREST OF THE\n\nACTIVITY OF TROUT FARMING\n\nArticle 1.- To declare the activity of trout farming to be of public interest.\n\nArticle 2.- The Ministry of Agriculture and Livestock, within the framework of its competencies and through the Costa Rican Institute of Fisheries and Aquaculture, shall provide technical assistance to trout producers for the improvement of the farming.\n\nArticle 3.- The institutions of the Public Sector and the Private Sector, within the respective legal framework, may contribute with any type of alternative collaborative resources to the extent of their possibilities and without prejudice to the fulfillment of their own objectives with the activities and initiatives to promote trout farming and commercialization.\n\nArticle 4.- It shall enter into effect upon its publication.\n\nGiven at the Presidency of the Republic.
