además, según lo\n·dispuesto en el inciso g) del citado artículo, le corresponde \"Promover\nla efectividad de la gestión de las instituciones del sector y su rendición de\ncuentas\".\n\n3°-Que mediante el Oficio Nº DM-3862-06 del 10 de julio de 2006, el\nMinisterio de Obras Públicas y Transportes solicitó a las instituciones que\nconforman el sector, coordinar con la Dirección de Planificación Sectorial todo\nlo relacionado con el Plan Nacional de Desarrollo, planes operativos\ninstitucionales y todos los asuntos relacionados con el accionar del Sector\nTransporte.\n\n4°-Que en la Directriz Nº 5527-10 emitida por el Ministro de Obras Públicas\ny Transportes, publicada en el Alcance Nº 29 a La Gaceta Nº 224 del 18 de\nnoviembre de 2010, se establece que las instituciones que conforman el Sector\nTransporte e Infraestructura deberán responder a los acuerdos del Consejo\nSectorial y a los lineamientos generales de dirección política que dicte el\nMinistro Rector.\n\n5°-Que mediante el Decreto Ejecutivo No. 39173 del 9 de julio del 2015\nse creó la Secretaria de Planificación Sectorial, como órgano de asesoría y\napoyo técnico al Ministro (a) Rector del Sector Transporte e Infraestructura.\n\n6°- Que de conformidad con lo establecido en el artículo 50 de la\nConstitución Política el Estado debe procurar el mayor bienestar a todos los\nhabitantes del país, organizando y estimulando la producción y el más adecuado\nreparto de la riqueza. Asimismo, dicha norma establece que el Estado debe\ngarantizar el derecho de las personas. a un ambiente sano y ecológicamente\nequilibrado.\n\n7°- Que la Ley para la Gestión Integral de los Residuos No. 8839,\nestablece en su artículo 28 que las instituciones de la Administración Pública\nimplementarán sistemas de gestión ambiental en todas sus dependencias, así como\nprogramas de capacitación para el desempeño ambiental en la prestación de servicios\npúblicos y el desarrollo de hábitos de consumo y el manejo adecuado que tendrán\npor objeto prevenir y minimizar la generación de residuos.\n\n8°-Que de conformidad con lo establecido en el artículo 3 del Reglamento\npara la Elaboración de Programas de Gestión Ambiental Institucional en el\nSector Público de Costa Rica, todas las instituciones de la Administración\nPública implementarán un Programa de Gestión Ambiental Institucional (PGAI).\n\n9°- Que según lo dispuesto en el artículo 7 del Reglamento para la Elaboración\nde Programas de Gestión Ambiental Institucional en el Sector Público de Costa\nRica, cada institución de la Administración Pública deberá conformar una\ncomisión institucional, para elaborar e implementar su PGAI. Asimismo, según lo\ndispuesto en dicha norma, se deberá establecer una persona responsable de la\ncoordinación del PGAI.\n\n10°- Que en el Plan Nacional de Desarrollo 2015-2018 \"Alberto Cañas\nEscalante\", el Sector Ambiente, Energía, Mares y Ordenamiento Territorial\nincorporó el programa de \"Fortalecimiento de los Planes de Gestión\nAmbiental Institucional (PGAI) en mejora de la eficiencia en el consumo de\nenergía eléctrica en las instituciones de mayor consumo de electricidad del\nsector público\", cuyo objetivo se orienta a: \"Mejorar la eficiencia\ndel uso de la energía eléctrica en el sector público en el marco de los\nPGAI\".\n\n11 °- Que de conformidad con lo dispuesto en el artículo 1 de la\nDirectriz O 11-MINAE, publicada en La Gaceta No. 163 del 26 de agosto del 2014,\nes obligación de todas las instituciones de la Administración Pública elaborar\ny ejecutar los Programas de Gestión Ambiental Institucional (PGAI) para la\ngestión de la calidad ambiental, energía y cambio climático; así como los\nmecanismos de control y seguimiento. Estos programas contendrán, entre\notros aspectos, las regulaciones para las adquisiciones de equipos, luminarias\ny artefactos con requerimientos de alta eficiencia energética.\n\nPor tanto;\n\nEmiten la siguiente:\n\nDIRECTRIZ\n\nDIRIGIDA A LAS INSTITUCIONES QUE\n\nCONFORMAN EL SECTOR TRANSPORTE E\n\nINFRAESTRUCTURA\n\nArtículo 1 º- Se insta a todas las instituciones del Sector Transporte e\nInfraestructura para que, conforme lo dispuesto en el artículo 3 del Reglamento\npara la Elaboración de Programas de Gestión Ambiental Institucional en el Sector\nPúblico de Costa Rica, elaboren el \"Programa de Gestión Ambiental\nInstitucional\" (PGAI) que establece dicha norma, el cual incluirá sus\ncomponentes estratégicos, tales como: gestión de la calidad ambiental, gestión\nde la energía y gestión de cambio climático y los temas transversales, tales\ncomo: sensibilización, capacitación y comunicación, métrica y adquisición de\nbienes y transferencia tecnológica. Articles 25 subsection 1), 27 subsection\n1), 28 subsection 2) subparagraph b), 99, and 100 of Law No. 6227 of May 2,\n1978 and its amendments, General Law of Public Administration; Law No. 3155 of\nAugust 5, 1963 and its amendments, Law for the Creation of the Ministry of Public\nWorks and Transport; Article 28 of Law No. 8839 of June 24,\n2010, Law for Integrated Waste Management; Executive Decree No.\n36499-S-MINAET of March 17, 2011, Regulation for the Preparation of\nInstitutional Environmental Management Programs in the Public Sector of Costa Rica;\nand Executive Decree No. 38536-MP-PLAN of July 25, 2014, Organic Regulation\nof the Executive Branch.\n\nWHEREAS:\n\n1st- That according to the provisions of Article 5 subsection i) of the Organic Regulation of the Executive Branch (Executive Decree No. 38536-MP-PLAN), the Minister of Public Works and Transport is charged with the stewardship of the Transport and Infrastructure Sector, which, as established in Article 15 subsection i) of said Regulation, is composed of the Ministry of Public Works and Transport (MOPT), the Costa Rican Railway Institute (INCOFER), the Costa Rican Institute of Pacific Ports (INCOP), and the Board of Port Administration and Economic Development of the Atlantic Slope (JAPDEVA).\n\n2nd- That subsection a) of Article 6 of the cited Executive Decree No. 38536-MP-PLAN establishes that it is the responsibility of the Minister with sector stewardship to: \"Direct and coordinate the respective sector\"; furthermore, according to the provisions of subsection g) of the cited article, the Minister is responsible for \"Promoting the effectiveness of the management of the institutions of the sector and their accountability\".\n\n3rd- That through Official Letter No. DM-3862-06 of July 10, 2006, the Ministry of Public Works and Transport requested the institutions that comprise the sector to coordinate with the Sectoral Planning Directorate all matters related to the National Development Plan, institutional operational plans, and all issues related to the actions of the Transport Sector.\n\n4th- That in Guideline No. 5527-10 issued by the Minister of Public Works and Transport, published in Supplement No. 29 to La Gaceta No. 224 of November 18, 2010, it is established that the institutions comprising the Transport and Infrastructure Sector must respond to the agreements of the Sectoral Council and to the general political direction guidelines issued by the Minister with sector stewardship.\n\n5th- That through Executive Decree No. 39173 of July 9, 2015, the Sectoral Planning Secretariat was created as an advisory and technical support body to the Minister with stewardship of the Transport and Infrastructure Sector.\n\n6th- That in accordance with the provisions of Article 50 of the Political Constitution, the State must strive for the greatest well-being of all the country's inhabitants, organizing and stimulating production and the most adequate distribution of wealth. Likewise, said provision establishes that the State must guarantee the right of individuals to a healthy and ecologically balanced environment.\n\n7th- That the Law for Integrated Waste Management No. 8839 establishes in its Article 28 that the institutions of the Public Administration shall implement environmental management systems in all their departments, as well as training programs for environmental performance in the provision of public services and the development of consumption habits and proper management that will have the objective of preventing and minimizing waste generation.\n\n8th- That in accordance with the provisions of Article 3 of the Regulation for the Preparation of Institutional Environmental Management Programs in the Public Sector of Costa Rica, all institutions of the Public Administration shall implement an Institutional Environmental Management Program (PGAI).\n\n9th- That according to the provisions of Article 7 of the Regulation for the Preparation of Institutional Environmental Management Programs in the Public Sector of Costa Rica, each institution of the Public Administration must form an institutional commission to prepare and implement its PGAI. Likewise, according to the provisions of said provision, a person responsible for coordinating the PGAI must be appointed.\n\n10th- That in the National Development Plan 2015-2018 \"Alberto Cañas Escalante\", the Environment, Energy, Seas, and Land-Use Planning Sector incorporated the program for \"Strengthening of Institutional Environmental Management Plans (PGAI) in improving efficiency in electrical energy consumption in the institutions with the highest electricity consumption in the public sector,\" whose objective is aimed at: \"Improving the efficiency of electrical energy use in the public sector within the framework of the PGAI\".\n\n11th- That in accordance with the provisions of Article 1 of Guideline O 11-MINAE, published in La Gaceta No. 163 of August 26, 2014, it is the obligation of all institutions of the Public Administration to prepare and execute the Institutional Environmental Management Programs (PGAI) for the management of environmental quality, energy, and climate change; as well as the control and monitoring mechanisms. These programs shall contain, among other aspects, the regulations for the acquisition of equipment, luminaires, and fixtures with high energy efficiency requirements.\n\nTherefore;\n\nThey issue the following:\n\nDIRECTIVE\n\nADDRESSED TO THE INSTITUTIONS COMPRISING\n\nTHE TRANSPORT AND INFRASTRUCTURE SECTOR\n\nArticle 1- All institutions of the Transport and Infrastructure Sector are urged, in accordance with the provisions of Article 3 of the Regulation for the Preparation of Institutional Environmental Management Programs in the Public Sector of Costa Rica, to prepare the \"Institutional Environmental Management Program\" (PGAI) established by said regulation, which shall include its strategic components, such as: environmental quality management, energy management, and climate change management, and cross-cutting themes, such as: awareness-raising, training and communication, metrics and procurement of goods, and technology transfer. They are also reminded of the obligation to comply with the provisions of the cited Regulation in everything related to the cited Plan.\n\nArticle 2- Based on the provisions of numeral 7 of the Regulation for the Preparation of Institutional Environmental Management Programs in the Public Sector of Costa Rica, the Heads of each of the institutions that comprise the Transport and Infrastructure Sector are urged to form the Institutional Environmental Management Commission established by said regulation and to designate the official responsible for coordinating the cited Commission.\n\nArticle 3- The Sectoral Planning Secretariat, through the Environmental and Social Management Process for the projects of the Transport and Infrastructure Sector, will advise the managers of the Institutional Environmental Management Commission of the institutions that comprise said Sector, for the preparation, implementation, and monitoring of the PGAI.\n\nArticle 4- The environmental management managers of the institutions that comprise the Transport and Infrastructure Sector are exhorted to submit semi-annual reports to the Sectoral Planning Secretariat detailing the preparation, implementation, and monitoring of their Environmental Management Programs, so that this Secretariat can determine the state of environmental management at the Sector level.\n\nArticle 5- The Sectoral Planning Secretariat shall report annually to the National Sectoral Council on the results and progress achieved in this matter.\n\nArticle 6- This Directive shall be effective upon its publication.\n\nGiven in the Republic of the Republic. -San José, on the 25th day of January 2017." }
