  "body_es_text": "en la totalidad del texto\n\n                    -\n\n                        Texto Completo Norma 40428\n\n                        Amplía para la Comisión para el Ordenamiento y Manejo de la Cuenca del Río\nReventazón (COMCURE), el gasto presupuestario máximo fijado para el 2017\n\nN° 40428-H\n\nEL PRESIDENTE DE LA\nREPÚBLICA\n\nY EL MINISTRO DE HACIENDA\n\nCon fundamento en las\natribuciones que les confieren los artículos 140 incisos 3) y 18) y 146 de la\nConstitución Política; los artículos 25 inciso 1), 27 inciso 1) y 28 inciso 2) acápite\nb) de la Ley N° 6227, Ley General de la Administración Pública de 2 de mayo de\n1978 y sus reformas; la Ley N° 8131, Ley de la Administración Financiera de la\nRepública y Presupuestos Públicos de 18 de setiembre de 2001 y sus reformas; su\nReglamento, el Decreto Ejecutivo N° 32988-H-MP-PLAN de 31 de enero de 2006 y\nsus reformas; Ley N° 8023 del 27 de setiembre de 2000, Ley de Ordenamiento y\nManejo de la Cuenca del Río Reventazón y su reforma; el Decreto Ejecutivo N°\nDecreto Ejecutivo N° 30331-MINAE del 8 de marzo de 2002, Reglamento a la Ley\ndel Ordenamiento y Manejo de la Cuenca Alta del Río Reventazón; el Decreto\nEjecutivo N° 32452-H de 29 de junio de 2005 y sus reformas; y el Decreto\nEjecutivo N° 39613-H de 3 de marzo de 2016 y sus reformas.\n\nConsiderando:\n\n1º-Que mediante la\nLey N° 8023, publicada en La Gaceta N° 203 de 24 de octubre de 2000, se\ncrea la Comisión para el Ordenamiento y Manejo de la Cuenca del Río Reventazón,\nen adelante COMCURE, como un órgano de máxima desconcentración del Ministerio\nde Ambiente y Energía, la cual tendrá personalidad jurídica instrumental para\nla administración de sus recursos materiales, humanos, presupuestarios y\nfinancieros; para definir, ejecutar y controlar el Plan de ordenamiento y\nmanejo de la cuenca del río Reventazón, con el apoyo de su estructura\nfuncional.\n\n2º-Que mediante el oficio COMCURE 501-2016\nrecibido el 15 de diciembre de 2016; COMCURE 055-2017 recibido el 16 de enero\nde 2017, el Gerente del COMCURE solicitó incrementar el gasto presupuestario\nmáximo de dicha institución para el 2017, por un monto total de ¢102.600.000,50\n(ciento dos millones seiscientos mil colones con 50/100), con la finalidad de\ncumplir con lo establecido en el Presupuesto y el Plan Operativo Institucional\npara el año 2017. Dicha solicitud cuenta con el aval del señor Ministro de\nAmbiente y Energía, otorgado mediante los oficios DM-1163-2016 de fecha 21 de\ndiciembre de 2016 y DM-0069-2017 de fecha 23 de enero de 2017.\n\n3º-Que de dicho monto, corresponde ser\nampliado por la vía de Decreto Ejecutivo la suma de ¢39.000.000,00 (treinta y\nnueve millones de colones exactos), la cual será sufragada con recursos\nprovenientes de superávit libre, que se utilizarán para solventar necesidades\ninstitucionales en áreas específicas de mantenimiento y reparación de equipo,\nimpartir talleres de Educación Ambiental, compra de maquinaria y equipo para la\nproducción, requerido para la ejecución del Programa de Ganadería\nConservacionista, requerimientos adicionales de Bienes Duraderos, que son\nfundamentales para ejecutar el Proyecto de Invernaderos Hortícolas en la Cuenca\nbaja, así como la compra de un vehículo de trabajo.\n\n4º-Que se imprueba la ampliación por la suma\n¢6.000.000,00 (seis millones de colones exactos) incorporados en la subpartida\nde \"Servicios de Ingeniería\", por cuanto contraviene lo dispuesto en el inciso\nf) del artículo 7 del Decreto Ejecutivo N° 32452-H, publicado en La Gaceta N°\n130 de 6 de julio de 2005 y sus reformas, el cual establece que con recursos\nprovenientes del superávit libre no se podrán financiar gastos de la subpartida\nde \"Servicios de gestión y apoyo\".\n\n5º-Que mediante el Decreto Ejecutivo N°\n39613-H, publicado en el Alcance N° 46 a La Gaceta N° 61 de 30 de marzo\nde 2016 y sus reformas, se emitieron las Directrices Generales de Política\nPresupuestaria, Salarial, Empleo, Inversión y Endeudamiento, para el año 2017,\nestableciéndose en el artículo 12, que para las entidades públicas y órganos\ndesconcentrados, el gasto presupuestario máximo del año 2017, se establecerá\ncon base en la proyección de ingresos totales (corrientes, capital y\nfinanciamiento) 2017, definida por las entidades públicas y órganos\ndesconcentrados en coordinación con la Secretaría Técnica de la Autoridad\nPresupuestaria (STAP). Para tal efecto, la STAP utilizará como insumo la serie\nhistórica de ingresos del periodo 2013-2015, así como la estimación de ingresos\npara los años 2016 y 2017 que suministren las entidades y órganos\ndesconcentrados a más tardar el último día del mes de marzo del año 2016.\n\n6º-Que en correspondencia con dicha\ndisposición, el monto de gasto presupuestario máximo para el año 2017\nresultante para la COMCURE, fue establecido en la suma de ¢251.700.000,00\n(doscientos cincuenta y un millones setecientos mil colones exactos), el cual\nfue comunicado en el oficio STAP-0587-2016 del 26 de abril de 2016; cifra que\nno contempla el gasto indicado previamente en este decreto.\n\n7º-Que mediante el Decreto Ejecutivo N°\n32452-H, se emite el \"Lineamiento para la aplicación del artículo 6 de la Ley\nN° 8131, Ley de la Administración Financiera de la República y Presupuestos\nPúblicos y la regulación de la clase de ingresos del Sector Público denominada\nFinanciamiento\".\n\n8º-Que el artículo 7° del Decreto citado en\nel considerando anterior, dispone que los recursos de financiamiento que\nprovienen de vigencias anteriores -superávit libre- son parte del patrimonio de\nlos órganos y las entidades y pueden utilizarlos en períodos subsiguientes para\nfinanciar gastos que se refieran a la actividad ordinaria de éstas, con los\ncuales se atienda el interés de la colectividad, el servicio público y los\nfines institucionales, siempre que no tengan el carácter permanente o generen\nuna obligación que requiera financiarse a través del tiempo, como la creación\nde plazas para cargos fijos, o cualquier otro compromiso de la misma\nnaturaleza.\n\n9º-Que por lo anterior, resulta necesario\nampliar el gasto presupuestario máximo fijado a la COMCURE para el año 2017,\nincrementándolo en la suma de ¢39.000.000,00 (treinta y nueve millones de\ncolones exactos).   "body_en_text": "in the entirety of the text\n\n                    -\n\n                        Complete Text of Standard 40428\n\n                        Expands for the Commission for the Management and Administration of the Reventazón River Basin (COMCURE), the maximum budgetary expenditure set for 2017\n\nN° 40428-H\n\nTHE PRESIDENT OF THE\nREPUBLIC\n\nAND THE MINISTER OF FINANCE\n\nBased on the\npowers conferred by articles 140 subsections 3) and 18) and 146 of the\nConstitution; articles 25 subsection 1), 27 subsection 1) and 28 subsection 2) paragraph\nb) of Law N° 6227, General Law of Public Administration of May 2,\n1978 and its amendments; Law N° 8131, Law of Financial Administration of the\nRepublic and Public Budgets of September 18, 2001 and its amendments; its\nRegulation, Executive Decree N° 32988-H-MP-PLAN of January 31, 2006 and\nits amendments; Law N° 8023 of September 27, 2000, Law for the Management and\nAdministration of the Reventazón River Basin and its amendment; Executive Decree N°\nExecutive Decree N° 30331-MINAE of March 8, 2002, Regulation to the Law\nfor the Management and Administration of the Upper Reventazón River Basin; Executive Decree N° 32452-H of June 29, 2005 and its amendments; and Executive Decree N° 39613-H of March 3, 2016 and its amendments.\n\nConsidering:\n\n1º—That through\nLaw N° 8023, published in La Gaceta N° 203 of October 24, 2000,\nthe Commission for the Management and Administration of the Reventazón River Basin was created,\nhereinafter COMCURE, as a body of maximum deconcentration of the Ministry\nof Environment and Energy, which shall have instrumental legal personality for\nthe administration of its material, human, budgetary, and\nfinancial resources; to define, execute, and control the Plan for the management and\nadministration of the Reventazón river basin, with the support of its functional\nstructure.\n\n2º—That through official letter COMCURE 501-2016\nreceived on December 15, 2016; COMCURE 055-2017 received on January 16,\n2017, the Manager of COMCURE requested to increase the maximum budgetary expenditure\nof said institution for 2017, by a total amount of ¢102,600,000.50\n(one hundred two million six hundred thousand colones and 50/100), for the purpose of\ncomplying with what is established in the Budget and the Institutional Operational Plan\nfor the year 2017. Said request has the endorsement of the Minister of\nEnvironment and Energy, granted through official letters DM-1163-2016 dated December\n21, 2016, and DM-0069-2017 dated January 23, 2017.\n\n3º—That of said amount, the sum of ¢39,000,000.00 (thirty-nine million colones exactly) is to be\nexpanded by means of an Executive Decree, which shall be covered by resources\nfrom free surplus (superávit libre), to be used to address institutional\nneeds in specific areas of maintenance and equipment repair,\nconducting Environmental Education workshops, purchase of machinery and equipment for\nproduction, required for the execution of the Conservationist Livestock Program,\nadditional requirements for Durable Goods, which are\nfundamental to execute the Horticultural Greenhouses Project in the lower basin (Cuenca\nbaja), as well as the purchase of a work vehicle.\n\n4º—That the expansion of the sum\n¢6,000,000.00 (six million colones exactly) incorporated in the sub-item\nof \"Engineering Services\" is disapproved, because it contravenes the provisions of paragraph\nf) of article 7 of Executive Decree N° 32452-H, published in La Gaceta N°\n130 of July 6, 2005, and its amendments, which establishes that resources\nfrom free surplus (superávit libre) may not finance expenses under the sub-item\nof \"Management and support services\".\n\n5º—That through Executive Decree N°\n39613-H, published in Supplement N° 46 to La Gaceta N° 61 of March 30,\n2016, and its amendments, the General Policy Guidelines for Budgetary, Salary, Employment, Investment, and Indebtedness for the year 2017 were issued,\nestablishing in article 12 that for public entities and deconcentrated\nbodies, the maximum budgetary expenditure for the year 2017 shall be established\nbased on the projection of total revenues (current, capital, and\nfinancing) for 2017, defined by public entities and deconcentrated\nbodies in coordination with the Technical Secretariat of the Budgetary Authority (STAP). For this purpose, the STAP shall use as input the historical\nseries of revenues for the period 2013-2015, as well as the revenue estimate\nfor the years 2016 and 2017 provided by the entities and deconcentrated\nbodies no later than the last day of March 2016.\n\n6º—That in correspondence with said\nprovision, the amount of the maximum budgetary expenditure for the year 2017\nresulting for COMCURE was established at the sum of ¢251,700,000.00\n(two hundred fifty-one million seven hundred thousand colones exactly), which\nwas communicated in official letter STAP-0587-2016 of April 26, 2016; a figure\nthat does not contemplate the expenditure previously indicated in this decree.\n\n7º—That through Executive Decree N°\n32452-H, the \"Guideline for the application of article 6 of Law\nN° 8131, Law of Financial Administration of the Republic and Public Budgets, and the regulation of the class of Public Sector revenues called\nFinancing\" is issued.\n\n8º—That article 7 of the Decree cited in\nthe previous considering clause provides that financing resources\ncoming from prior periods—free surplus (superávit libre)—are part of the equity of\nthe bodies and entities and may be used in subsequent periods to\nfinance expenditures related to their ordinary activity, with\nwhich the interest of the community, the public service, and the\ninstitutional goals are addressed, provided they do not have a permanent nature or generate\nan obligation requiring financing over time, such as the creation\nof permanent positions, or any other commitment of the same\nnature.\n\n9º—That due to the foregoing, it is necessary\nto expand the maximum budgetary expenditure set for COMCURE for the year 2017,\nincreasing it by the sum of ¢39,000,000.00 (thirty-nine million\ncolones exactly).
