Asimismo, se establece\nque el Instituto Geográfico Nacional será la dependencia científica y técnica\nrectora de la cartografía nacional, destinada a la ejecución del Mapa básico\noficial y la Descripción básica geográfica de la República de Costa Rica y a\nlos estudios, las investigaciones o labores y el desarrollo de políticas\nnacionales de carácter cartográfico, geográfico, geodésico, geofísico y de\níndole similar que tenga relación con dichas obras, con el fin de apoyar los\nprocesos de planificación.\n\n2º-Que\nla Ley de Creación del Instituto Geográfico Nacional, N° 59, lo constituye de\nmanera permanente y en representación del Estado, como la autoridad oficial en\nmateria geodésica y de la representación espacial de la geografía de la\nRepública, extendiéndose su autoridad a las actividades de cualquier orden que\ntengan por origen los trabajos confiados a su cargo.\n\n3º-Que\nde conformidad con la Ley de Creación del Instituto Geográfico Nacional (IGN),\nN° 59, en el artículos 62 del Reglamento a la Ley N° 6043, se reconoce la\ncompetencia del Instituto Geográfico Nacional para la delimitación de la zona\npública de la Zona Marítimo Terrestre, y su oficialización a través de\npublicación en el Diario Oficial La Gaceta, mientras que el artículo 63\ndel mismo Reglamento, señala que \"El Instituto Geográfico Nacional deberá\npublicar aviso en el Diario Oficial, de cada porción de la zona\nmarítimo-terrestre en que haya demarcado la zona pública\".\n\n4°-Que\nen el Decreto Ejecutivo N° 36642-MP-MOPT-MINAET \"Reglamento de Especificaciones\npara la Delimitación de la zona pública de la Zona Marítimo Terrestre\", se\nestablece según el artículo 18° que para la delimitación de la zona pública de\nla Zona Marítimo Terrestre, el IGN podrá acudir a dos metodologías de ejecución,\nque se indican en los artículos 19 y 20, correspondientes a la delimitación de\nla zona pública de la Zona Marítimo Terrestre a través de la colocación de\nmojones y/o a la delimitación digital georreferenciada, esto con el fin de\nagilizar las delimitaciones y proporcionar mayor seguridad técnica a los\ninteresados.\n\n5°-Que\nen el Decreto Ejecutivo N° 33797-MJ-MOPT, el cual entre otros aspectos\ndetermina, a la Red Geodésica Nacional de Referencia Horizontal CR05, y su\nproyección cartográfica asociada CRTM05, como el sistema oficial al cual deben\nestar referidas las coordenadas de todos los trabajos geodésicos, cartográficos\ny catastrales que se ejecuten en nuestro país, señalando específicamente en\nartículo 11 que: \"La Red Geodésica Nacional de Referencia Horizontal CR05 y\nel sistema de proyección cartográfica CRTM05, constituirán el único sistema\noficial de coordenadas para la República de Costa Rica a partir del cual se\ndebe referenciar todos los levantamientos y actividades cartográficos y geodésicos\nque desarrollen en el Territorio Nacional toda dependencia pública, persona o\nentidad privada nacional o extranjera.\" ; mientras que el artículo 7 indica que\n\"Conforme se produzcan datos cartográficos en el nuevo sistema de proyección\ncartográfica CRTM05, el Instituto Geográfico Nacional publicará por los medios\nadecuados aquella información que se ha oficializado.\"\n\n6°-Que\nla georreferenciación al sistema nacional de coordenadas como mecanismo para\ndelimitar la zona pública de la Zona Marítimo Terrestre, posibilita la correcta\ndelimitación de la zona pública a los efectos de la elaboración de planes\nreguladores, el visado de planos de agrimensura, el otorgamiento de concesiones\nen la Zona Restringida y otros aspectos de ordenamiento territorial costero.\n\n7°-El Instituto Geográfico Nacional, utilizó en playa Negra ubicada en\nel distrito 03 Cahuita, cantón 04 Talamanca -\nprovincia de Limón, la metodología de \"Delimitación Digital Georreferenciada\"\npara delimitar la zona pública de la Zona Marítimo Terrestre en sectores\ncosteros específicos, donde no existe a la fecha, delimitación de la zona\npública a través de la colocación de mojones oficializados vía respectiva\npublicación en el Diario Oficial La Gaceta;   "body_en_text": "of the entire text\n\n                    -\n\n                        Full Text of Standard 02\n\n                        Delimitation of the public zone of Playa Negra, Cahuita district, canton of Talamanca\n\nFull Text of record: 1182CA\n\nNATIONAL GEOGRAPHIC INSTITUTE\n\nTOPOGRAPHIC DEPARTMENT\n\nAND TERRITORY OBSERVATION\n\nMARITIME TERRESTRIAL ZONE\n\nDelimitation of the public zone of Playa Negra,\n\nCahuita district, canton of Talamanca\n\nNotice No. 2017-02\n\nBased on the powers conferred by Article 140 and Article 240, subsection 1, of General Public Administration Law No. 6227, and the provisions of Law No. 59 creating the National Geographic Institute, Law No. 8905 transferring the National Geographic Institute to the National Registry, and Law No. 6043 on the Maritime Terrestrial Zone, and Public Tender No. 2013LN-000010-00100 called \"Delimitation of the public zone on the Caribbean coast of Costa Rica\"\n\nConsidering:\n\n1º-That by means of Law No. 8905, the National Geographic Institute is established as a dependency of the National Registry and that the Administrative Board of the National Registry shall administer the Institute's budget and sign the contracts and agreements necessary for the exercise of its functions. Likewise, it is established that the National Geographic Institute shall be the scientific and technical agency governing national cartography, responsible for the execution of the official Basic Map and the basic geographic description of the Republic of Costa Rica and for studies, research, work, and the development of national policies of a cartographic, geographic, geodetic, geophysical, and similar nature related to such works, in order to support planning processes.\n\n2º-That the Law Creating the National Geographic Institute, No. 59, establishes it permanently and in representation of the State as the official authority in geodetic matters and the spatial representation of the geography of the Republic, its authority extending to activities of any nature originating from the works entrusted to it.\n\n3º-That in accordance with the Law Creating the National Geographic Institute (IGN), No. 59, Article 62 of the Regulations to Law No. 6043 recognizes the competence of the National Geographic Institute for the delimitation of the public zone of the Maritime Terrestrial Zone, and its officialization through publication in the Official Gazette La Gaceta, while Article 63 of the same Regulations states that \"The National Geographic Institute must publish a notice in the Official Gazette for each portion of the maritime-terrestrial zone in which it has demarcated the public zone.\"\n\n4º-That Executive Decree No. 36642-MP-MOPT-MINAET \"Regulations of Specifications for the Delimitation of the public zone of the Maritime Terrestrial Zone\" establishes, according to Article 18, that for the delimitation of the public zone of the Maritime Terrestrial Zone, the IGN may employ two execution methodologies, as indicated in Articles 19 and 20, corresponding to the delimitation of the public zone of the Maritime Terrestrial Zone through the placement of boundary markers (mojones) and/or through georeferenced digital delimitation, in order to expedite delimitations and provide greater technical certainty to interested parties.\n\n5º-That Executive Decree No. 33797-MJ-MOPT, which, among other aspects, designates the National Geodetic Network Horizontal Reference CR05 and its associated cartographic projection CRTM05 as the official system to which the coordinates of all geodetic, cartographic, and cadastral work executed in our country must be referenced, specifically stating in Article 11 that: \"The National Geodetic Network Horizontal Reference CR05 and the cartographic projection system CRTM05 shall constitute the sole official coordinate system for the Republic of Costa Rica, from which all cartographic and geodetic surveys and activities carried out in the National Territory by any public agency, person, or private national or foreign entity must be referenced.\"; while Article 7 indicates that \"As cartographic data are produced in the new cartographic projection system CRTM05, the National Geographic Institute shall publish, through appropriate means, that information which has been officialized.\"\n\n6º-That georeferencing to the national coordinate system as a mechanism to delimit the public zone of the Maritime Terrestrial Zone enables the correct delimitation of the public zone for the purposes of preparing regulatory plans, approving survey plans, granting concessions in the Restricted Zone, and other aspects of coastal land-use planning.\n\n7º-The National Geographic Institute used, at Playa Negra located in district 03 Cahuita, canton 04 Talamanca - Limón province, the \"Georeferenced Digital Delimitation\" methodology to delimit the public zone of the Maritime Terrestrial Zone in specific coastal sectors where, to date, no delimitation of the public zone exists through the placement of boundary markers (mojones) officialized via the respective publication in the Official Gazette La Gaceta; based on Public Tender No. 2013LN-000010-00100 called \"Delimitation of the public zone on the Caribbean coast of Costa Rica.\"\n\n8º-That the georeferenced digital information on the delimitation of the public zone of the Maritime Terrestrial Zone held by the IGN is called the Digital Georeferenced Geodatabase (Geodatabase Digital Georreferenciada, GDG) of the National Geographic Institute (IGN) on the Maritime Terrestrial Zone (ZMT).\n\n9º-That the Digital Georeferenced Geodatabase (GDG) of the National Geographic Institute (IGN) on the Maritime Terrestrial Zone (ZMT) is technically based on the application of the regulations established by: a) Executive Decree No. 7841-P \"Regulations to Law No. 6043 on the Maritime Terrestrial Zone\", b) Executive Decree No. 33797-MJ-MOPT \"Declares the official horizontal datum for Costa Rica as CR05, and its associated cartographic projection, CRTM05\", and c) Executive Decree No. 36642-MP-MOPT-MINAET \"Regulations of Specifications for the Delimitation of the public zone of the Maritime Terrestrial Zone\".\n\n10º-That Article 140 of General Public Administration Law No. 6227 states that \"the administrative act shall produce its effect after it has been communicated to the administered party, except if it grants only rights, in which case it shall produce it from its adoption,\" a provision that must necessarily be related to numeral 204) of the same regulatory body, which defines the appropriate instrument for communicating acts of a general nature by stating: \"General acts shall be communicated by publication and specific acts by notification.\"\n\nCommunicates:\n\n1º-The National Geographic Institute used, at Playa Negra located in district 03 Cahuita, canton 04 Talamanca - Limón province, the \"Georeferenced Digital Delimitation\" methodology to delimit the public zone of the Maritime Terrestrial Zone in specific coastal sectors where, to date, no delimitation of the public zone exists through the placement of boundary markers (mojones) officialized via the respective publication in the Official Gazette La Gaceta; and also georeferenced the boundary markers (mojones) on site according to the official and current publications in the sector.\n\n2º-The public zone of the Maritime Terrestrial Zone of Playa Negra located in district 03, canton 04 Talamanca - Limón province, determined by the National Geographic Institute with georeferenced digital delimitation, was carried out in 2014 and corresponds to the coastal sectors whose extreme point coordinates are indicated below, both in the official cartographic projection system of Costa Rica CRTM05, Map MBCR-1/50,000 Cahuita, namely:\n\n \n\n3º-The coastal sectors of Playa Negra located in district 03 Cahuita, canton 04 Talamanca - Limón province, that to date have a delimitation of the public zone of the Maritime Terrestrial Zone through the placement of boundary markers (mojones) and respective publication in the Official Gazette La Gaceta, maintain their official status; for which the IGN assigned them a position in the national coordinate system CRTM05; resulting in the following coordinates:\n\n \n\n4º-The official technical data of the georeferenced digital delimitation of the public zone of the Maritime Terrestrial Zone, corresponding to Playa Negra located in district 03 Cahuita, canton 04 Talamanca - Limón province, have been recorded in the Digital Georeferenced Geodatabase (GDG) of the National Geographic Institute (IGN) on the Maritime Terrestrial Zone (ZMT), in a file with vector shape format, under the coding: RN/ IGN_GDG-IGN- ZMT_704/Geolínea_Versión_01_05/05/2017.-\n\nSan José, on the 22nd day of the month of May 2017.-"
