  "body_es_text": "en la totalidad del texto\n\n                    -\n\n                        Texto Completo Norma 289\n\n                        Lista de especies de interés pesquero y acuícola\n\nINSTITUTO\nCOSTARRICENSE DE PESCA Y ACUICULTURA\n\nAJDIP/289-2017.-Puntarenas, a los trece días del mes de julio de dos mil\ndiecisiete.\n\nConsiderando\n\n1-Que la Ley de Pesca y Acuicultura, Nº 8436 en su artículo 2º, define\nlos recursos marinos pesqueros, como todos los organismos vivos cuyo medio y\nciclo de vida total, parcial o temporal se desarrolle dentro del medio acuático\nmarino y que constituyan flora y fauna acuáticas susceptibles de ser extraídas\nsosteniblemente y cuyo recurso pesquero, a aquellos productos o derivados\nprovenientes de la captura y de la fauna marinas, o bien de la cosecha de la\nacuicultura siendo todos estos recursos de interés pesqueros y acuícolas.\n\n2-Que a partir de las leyes Nº7384 y N°8436, se desprenden las\ncompetencias técnicas y administrativas de INCOPESCA, en relación con el\naprovechamiento de aquellas especies de interés pesquero y acuícola, con\nfacultades tales como vigilar y dar seguimiento a la legislación vigente,\nnormar el aprovechamiento racional de los recursos pesqueros, ordenar el\ndesarrollo de la pesca, la acuicultura, así como la investigación. Asimismo, la\nconservación, el aprovechamiento y uso sostenible de los recursos biológicos\ndel mar y de la acuicultura deben sustentarse sobre la base de criterios\ntécnicos y científicos.\n\n3-Que la Ley Nº7384 estableció expresamente la competencia legal en\nfavor del INCOPESCA para emitir aquellas opiniones de carácter técnico y\ncientífico en todo lo relacionado con la flora y la fauna marinas y de acuicultura,\ncompetencia que se encuentra, en la misma medida, sustentada por la excepción\ndispuesta en el párrafo 4º del artículo 1º de la Ley de Conservación de la Vida\nSilvestre, Ley N° 7317, que indica que \"La presente ley no se aplicará a\nlas especies de interés pesquero o acuícola, cuya regulación específica se\nestablecen en la Ley N°7384, de 16 de marzo de 1994, y la ley N°8436, de 1 de\nmarzo de 2005, y cuya competencia como entidad ejecutora corresponde a\nIncopesca\".\n\n4-Que el INCOPESCA debió entonces avocarse a dar fiel y exacto\ncumplimiento de las leyes Nº7384, N°8436 y a la Ley N° 7317, precisamente a lo\nestipulado en su artículo 1°, iniciando un proceso de reuniones y consultas a\nsus biólogos de todo el país, para preparar la lista de especies de interés\npesquero y acuícola.\n\n5-Que los biólogos de la antigua Dirección de Pesca del MAG, que luego\npasaron a formar parte del Departamento de Desarrollo e Investigación del\nINCOPESCA, han venido realizando un monitoreo a las descargas pesqueras desde\nlos años setentas, identificando a la mayoría de especies pesqueras del Litoral\nPacífico Costarricense.\n\n6-Que entre los años 2002 al 2007, la Agencia de Cooperación del Japón\n(JICA), la Universidad Nacional y el INCOPESCA, ejecutaron juntos el Programa\nde Manejo Sostenible de las Pesquerías del Golfo de Nicoya, en el cual,\nbiólogos de las 3 instituciones realizaron muestreos biológicos a las descargas\nprovenientes de las flotas pesqueras que operan en el Litoral Pacífico\ncostarricense, principalmente en el Golfo de Nicoya, identificando la mayoría\nde especies de interés pesquero. La lista de estas especies fue publicada en el\nLibro Estadísticas Pesqueras del Golfo de Nicoya, Costa Rica 1994-2005,\nprecisamente en las páginas 283 al 286.\n\n7- Que los biólogos de la Dirección de Pesca de Guanacaste también ha\nrealizado muestreos biológicos a las descargas de productos pesqueros de esa\nzona, identificando las especies de la zona norte de nuestro país, incluidas\nlas especies ornamentales.\n\n8-Que el Departamento de Investigación también ha realizado muestreos\nbiológicos a las descargas que se realizan en los puestos de acopio ubicados en\nQuepos y Golfito, en coordinación con las Oficinas de Pesca ubicadas en ambas\nciudades, identificando las especies de interés pesquero que se encuentran en\nla región sur de nuestro país.\n\n9-Que en el Litoral Caribe Costarricense, biólogos del Departamento de\nInvestigación, en conjunto con los biólogos de la Dirección de Pesca de Limón,\ntambién han realizado muestreos biológicos a las descargas de productos\npesqueros provenientes de ese Litoral.\n\n10-Que una vez que se colectó toda la información de las fuentes antes\nanotadas, se realizaron reuniones entre los biólogos de las Direcciones y\nOficinas de Pesca del INCOPESCA antes anotadas, para preparar la lista de las\nespecies de interés pesquero de nuestro país, la cual se presenta a\ncontinuación, para su debida aprobación, por lo que la Junta Directiva, POR\nTANTO;\n\nAcuerda\n\n1-Aprobar la siguiente lista de especies de interés pesquero y acuícola,\nsegún fiel y exacto cumplimiento de las leyes Nº7384, N°8436 y a la Ley   "body_en_text": "in the entirety of the text\n\n                    -\n\n                        Full Text of Norm 289\n\n                        List of species of fishing and aquaculture interest\n\nCOSTA RICAN INSTITUTE OF FISHERIES AND AQUACULTURE\n\nAJDIP/289-2017.-Puntarenas, on the thirteenth day of July, two thousand seventeen.\n\nConsidering\n\n1-That the Law of Fisheries and Aquaculture, No. 8436 in its Article 2, defines marine fishery resources as all living organisms whose total, partial, or temporary life cycle and environment develops within the marine aquatic environment and which constitute aquatic flora and fauna susceptible to being extracted sustainably, and whose fishery resource, those products or derivatives originating from marine capture and fauna, or from aquaculture harvest, all of these being resources of fishing and aquaculture interest.\n\n2-That from Laws No. 7384 and No. 8436, the technical and administrative competencies of INCOPESCA derive, in relation to the utilization of those species of fishing and aquaculture interest, with powers such as monitoring and following up on current legislation, regulating the rational utilization of fishery resources, ordering the development of fishing, aquaculture, as well as research. Likewise, the conservation, utilization, and sustainable use of the biological resources of the sea and of aquaculture must be based on technical and scientific criteria.\n\n3-That Law No. 7384 expressly established the legal competency in favor of INCOPESCA to issue those technical and scientific opinions in everything related to marine and aquaculture flora and fauna, a competency that is, to the same extent, supported by the exception provided in paragraph 4 of Article 1 of the Wildlife Conservation Law, Law No. 7317, which indicates that \"This law shall not apply to species of fishing or aquaculture interest, whose specific regulation is established in Law No. 7384, of March 16, 1994, and Law No. 8436, of March 1, 2005, and whose competency as executing entity corresponds to Incopesca.\"\n\n4-That INCOPESCA had to then engage in faithfully and exactly complying with Laws No. 7384, No. 8436, and Law No. 7317, precisely with what is stipulated in its Article 1, initiating a process of meetings and consultations with its biologists from all over the country, to prepare the list of species of fishing and aquaculture interest.\n\n5-That the biologists of the former Fisheries Directorate of the MAG, who later became part of the Department of Development and Research of INCOPESCA, have been monitoring fisheries landings since the seventies, identifying the majority of fishery species of the Costa Rican Pacific Coast.\n\n6-That between the years 2002 to 2007, the Japan Cooperation Agency (JICA), the National University, and INCOPESCA jointly executed the Program for the Sustainable Management of the Fisheries of the Gulf of Nicoya, in which biologists from the 3 institutions carried out biological sampling of landings from the fishing fleets operating on the Costa Rican Pacific Coast, mainly in the Gulf of Nicoya, identifying the majority of species of fishing interest. The list of these species was published in the Book Fisheries Statistics of the Gulf of Nicoya, Costa Rica 1994-2005, precisely on pages 283 to 286.\n\n7- That the biologists of the Guanacaste Fisheries Directorate have also carried out biological sampling of fishery product landings from that area, identifying the species of the northern zone of our country, including ornamental species.\n\n8-That the Research Department has also carried out biological sampling of landings made at the collection centers located in Quepos and Golfito, in coordination with the Fisheries Offices located in both cities, identifying the species of fishing interest found in the southern region of our country.\n\n9-That on the Costa Rican Caribbean Coast, biologists from the Research Department, together with the biologists of the Limón Fisheries Directorate, have also carried out biological sampling of fishery product landings originating from that Coast.\n\n10-That once all the information from the aforementioned sources was collected, meetings were held between the biologists of the aforementioned Directorates and Fisheries Offices of INCOPESCA, to prepare the list of species of fishing interest of our country, which is presented below, for its due approval, therefore the Board of Directors, THEREFORE;\n\nAgrees\n\n1-To approve the following list of species of fishing and
