De conformidad con lo dispuesto\nen el presente manual aquellas personas físicas y jurídicas que deseen\nparticipar en ventas de productos pesqueros deberán estar inscritos en el\nRegistro de Compradores de Productos Pesqueros, para lo cual deben presentar\nlos siguientes requisitos:\n\nPersonas físicas\n\n1)- Nombre y\napellidos\n\n2)- Profesión u\noficio.\n\n3)- Nacionalidad.\n\n4)- Dirección exacta.\n\n5)- Teléfono, fax y dirección\nelectrónica.\n\n6)- Fotocopia de la\nCédula.\n\n7)- Lugar para ser\nNotificado.\n\nPersonas jurídicas\n\n1)- Calidades del\napoderado generalísimo. (Aportar el Contrato de Mandato).\n\n2)- Certificación de\npersonería jurídica con menos de un mes de expedición.\n\n3)- Teléfono, fax y\ndirección electrónica.\n\n4)- Dirección exacta.\n\n5)- Lugar para ser\nNotificado.\n\nArtículo\n5º-Conflictos de Interés. Los funcionarios del INCOPESCA, las instituciones y\norganizaciones no gubernamentales que intervengan en el proyecto de\ninvestigación, así como familiares directos en primer grado o personas físicas\no jurídicas con deudas que no hayan prescrito con el INCOPESCA, estarán\nimposibilitadas de participar en la venta del producto ofertado.\n\nArtículo 6º-El titular del permiso de\ninvestigación deberá designar una persona responsable el cual comunicará\nformalmente y por escrito al Director General Técnico del Incopesca y con al\nmenos 3 días hábiles de antelación, el desembarco de la embarcación que trae el\nproducto a vender, la fecha de arribo, la solicitud de inspección del producto\ny las cantidades estimadas del producto por especie, así como cualquier otra\ninformación útil para el proceso de comercialización por vía venta que se\npretende.\n\nArtículo 7º-Convocatoria. Se hará del\nconocimiento de todos los interesados la intención de realizar la venta, por\nlos medios de notificación que la administración del Incopesca determine y a\nquienes estén inscrito en el Registro de Compradores de Productos Pesqueros, en\nel sitio que éstos precisaron con antelación; se detallará la descripción del\nproducto objeto de venta y la información esencial del mismo, la invitación\nserá para todos aquellos interesados en especial a quienes formen parte del\nRegistro de Proveedores del Departamento de Protección y Registro.\n\nArtículo 8º-Productos objeto de Venta.\nÚnicamente lo serán aquellos productos pesqueros capturados, como parte del\nproceso de investigación.\n\nArtículo 9º-Evaluación de Ofertas. La\nJefatura del Departamento de Protección y Registro designará un funcionario,\nconforme a la Delimitación de Funciones y Responsabilidades que exige la Ley\nGeneral de Control Interno, el cual ejercerá el rol de representación por parte\ndel INCOPESCA y será el encargado de la recepción de las ofertas sobre el\nproducto objeto de venta, a efectos de comunicarla a la Jefatura del\nDepartamento de Protección y Registro.\n\nLos interesados deberán presentar sus ofertas\nde compra que resulten seleccionables y cumplan con lo previsto en este Manual.\n\nLos precios y parámetros correspondientes se\ndefinirán en función de las ofertas de compra presentadas y tomará como base el\nprecio de mercado del día que deberá establecer del Departamento de Mercadeo\ndel Incopesca.\n\nArtículo 10.-Venta. Se efectuará la venta del\nproducto pesquero de manera pública y directa, el mismo se adjudicará a quien\nofrezca las mejores condiciones económicas, conforme al artículo 13 de la Ley\nN° 6227, con pago inmediato en efectivo o cualquier otro medio aceptado por el\nIncopesca.\n\nDel proceso de venta se levantará el acta\ncorrespondiente donde quede consignada la venta y por ende finiquitada la\nventa, todo de conformidad con los artículo 270 y 271 de la Ley General de la Administración\nPública N° 6227.\n\nEl funcionario del INCOPESCA que partícipe de\ntodo el proceso de venta, deberá en el acta levantada al efecto informar sobre\nlas diligencias llevadas a cabo, hasta el cierre de la venta, del cual se\nretroalimentaran sugerencias y recomendaciones para adoptar medidas correctivas\ny así administrar el riesgo interno o externo que podría afectar la\noptimización de los objetivos.\n\nArtículo 11.-Fallo de la venta y\nadjudicación. Se adjudicará el bien ofrecido al postor que haga la mejor oferta\nconforme al procedimiento aquí establecido; sin embargo, en caso de no hacerlo,\npor razones debidamente justificadas, se podrá decidir convocar a una nueva\nventa; o en su defecto, proceder a donarlo, destruirlo en caso que las\ncondiciones del producto lo ameriten o ante la falta de oferentes durante la\ncelebración de la venta, desistir del proceso.\n\nNo se podrá adjudicar la venta cuando el\nprecio sea ruinoso a criterio del funcionario responsable de hacer la venta\n\nArtículo 12.-Requisitos para el Oferente\nAdjudicado. El adjudicatario deberá realizar el pago en el lugar de la\ncelebración de la venta siempre y cuando cumpla con los requisitos y\ncondiciones que para ello se establecen el presente Manual. Deberá identificarse\nmediante el documento nacional de identidad o pasaporte vigentes. Quien\nparticipe en la venta por cuenta de terceros o personas jurídicas deberá\nacreditar la representación con que se actúe, mediante el respectivo contrato\nde mandato.\n\nArtículo 13.-Donación. Es el acto mediante el\ncual se procede a legar el producto pesquero a quien el Incopesca determine\nmediante el acta correspondiente, todo conforme a los artículos 270 y 271 de la\nLey General de la Administración Pública N° 6227.\n\nArtículo 14.-Destrucción. Cuando el producto\npesquero recaiga en una inutilización total, según lo declare por escrito\nSENASA, el INCOPESCA ordenará su destrucción integral, mediante el respectivo\nacto administrativo e igualmente levantará el acta pertinente que acredite lo\nactuado, conforme a los artículos 270 y 271 de la Ley N° 6227.\n\nArtículo 15.-Manejo de documentación. Para\ncada gestión, se abrirá un expediente administrativo individualizado, el cual\ndeberá contener todas las diligencias efectuadas en el proceso de venta,\ndestrucción o donación; consecuentemente, se hará incluir el acta de venta, el\nproceso de destrucción o la respectiva donación.\n\nToda la documentación que presente el SENASA\nsobre el producto en caso de destrucción deberá formar parte del legajo\ncorrespondiente.\n\nArtículo 16.-Costos administrativos. De la\nventa total del producto se deberá rebajar los gastos en que el INCOPESCA haya\nincurrido para mantener en estado inocuo el producto pesquero, por lo que\ndeberán estar debidamente acreditados en el expediente administrativo. Del\nsaldo restante, se podrá permitir por parte del Incopesca, los pagos\ncorrespondientes para cubrir costos de la investigación, conforme a lo\nestablecido para estos efectos, en la Ley N° 8436, Ley de Pesca y Acuicultura,\nartículo 18, si resultaren excedentes, estos pasarán a ser patrimonio del\nIncopesca.\n\nArtículo 17.-La dirección general\nAdministrativa, deberá establecer la cuenta bancaria administrativa, parca la\ncorrecta administración de los fondos, así como lo mecanismos necesarios para\nefectuar los pagos al titular del permiso de investigación cuando corresponda\nasí como los gastos de mantenimiento del producto.\n\nArtículo 18.-En todo momento deberá valorarse\neste procedimiento en cada ocasión que se ponga en práctica, asistido por los\nPrincipios de Adaptabilidad, Igualdad, Eficiencia, Celeridad, Economía y\nSimplicidad de trámites, por tratarse de la disposición de productos\nperecederos.\n\nArtículo 19.-Acuerdo firme.\n\nArtículo 20.-Publíquese.", "body_en_text": "in the entirety of the text\n\n -\n\n Complete Text of Norm 327\n\n Procedure manual for the sale of fishery products deriving from\nresearch permits granted by INCOPESCA\n\nCOSTA RICAN INSTITUTE OF FISHERIES AND AQUACULTURE\n\nAJDIP/327-2017.-Puntarenas,\non the eleventh day of August, two thousand seventeen.\n\nConsidering:\n\n1º-Whereas the presentation by Mr. Heiner Méndez Barrientos, Institutional Legal Advisor, of the proposal for the Procedure Manual for the Sale of Fishery Products deriving from the catch generated as part of Research Permits granted by Incopesca has been received, and whereas in the judgment of the Members of this Board, it meets the requirements; the Board of Directors, Therefore;\n\nRESOLVES:\n\n1º-To acknowledge and approve the Procedure Manual for the Sale of Fishery Products deriving from the catch generated as part of Research Permits granted by Incopesca, presented by Mr. Heiner Méndez Barrientos, Institutional Legal Advisor, under the following terms and conditions:\n\nPROCEDURE MANUAL FOR THE SALE\nOF FISHERY PRODUCTS DERIVING\nFROM THE CATCH GENERATED AS PART\nOF RESEARCH PERMITS\nGRANTED BY INCOPESCA\n\nArticle 1º-Nature, purpose, and content. The purpose of this manual is to establish the procedures, rules, instructions, and calculation principles to be followed to carry out the commercialization of fishery products through the direct sale mechanism, as they are perishable products.\n\nArticle 2º-Object. In accordance with this manual, the object is to carry out an organized sale of fishery products generated as a result of the catch or catches made under a granted research permit and which, according to the provisions of Law No. 8436, the Fisheries and Aquaculture Law, Chapter IV, articles 165 to 22, with the purpose of making feasible the utilization and commercialization of the product caught during the validity of the research permit.\n\nThe sale shall be of a public nature, in accordance with the foregoing; therefore, the product shall be sold to the buyer making the best offer following the parameters instituted by this manual and always pursuing the highest public interest, in clear accordance with article 113 of the General Public Administration Law, and subsequent and concordant articles.\n\nArticle 3º-Legitimation; participation. Any subject of law, whether a natural or legal person, may participate in the sales of fishery products as an offeror to acquire the quantity of product that is the object thereof.\n\nLikewise, Incopesca may create a Fishery Products Buyers Registry, which must be attached to the Marketing Department of the Directorate of Fisheries and Aquaculture Operations of the Costa Rican Institute of Fisheries and Aquaculture.\n\nArticle 4º-Registration requirements for the Fishery Products Buyers Registry. In accordance with the provisions of this manual, those natural and legal persons wishing to participate in sales of fishery products must be registered in the Fishery Products Buyers Registry, for which they must submit the following requirements:\n\nNatural persons\n\n1)- Full name and surnames\n\n2)- Profession or trade.\n\n3)- Nationality.\n\n4)- Exact address.\n\n5)- Telephone, fax, and email address.\n\n6)- Photocopy of the Identity Card.\n\n7)- Place for Notification.\n\nLegal persons\n\n1)- Qualifications of the generalissimus agent. (Provide the Mandate Contract).\n\n2)- Certification of legal status issued less than one month prior.\n\n3)- Telephone, fax, and email address.\n\n4)- Exact address.\n\n5)- Place for Notification.\n\nArticle 5º-Conflicts of Interest. Officials of INCOPESCA, the institutions and non-governmental organizations involved in the research project, as well as direct first-degree relatives or natural or legal persons with unexpired debts to INCOPESCA, shall be barred from participating in the sale of the offered product.\n\nArticle 6º-The holder of the research permit must designate a responsible person who will formally communicate in writing to the Technical General Director of Incopesca, at least 3 business days in advance, the landing (desembarco) of the vessel bringing the product to be sold, the arrival date, the request for inspection of the product, and the estimated quantities of the product by species, as well as any other information useful for the commercialization process via the intended sale.\n\nArticle 7º-Call. The intention to conduct the sale shall be made known to all interested parties, through the means of notification determined by the administration of Incopesca and to those registered in the Fishery Products Buyers Registry, at the place they previously specified; the description of the product offered for sale and its essential information shall be detailed; the invitation shall be for all those interested, especially those who are part of the Supplier Registry of the Department of Protection and Registry.\n\nArticle 8º-Products offered for Sale. Only those fishery products caught as part of the research process shall be offered.\n\nArticle 9º-Evaluation of Offers. The Head of the Department of Protection and Registry shall designate an official, in accordance with the Delimitation of Functions and Responsibilities required by the General Law on Internal Control, who shall exercise the role of representation on behalf of INCOPESCA and shall be responsible for receiving the offers for the product offered for sale, for the purpose of communicating them to the Head of the Department of Protection and Registry.\n\nInterested parties must submit their purchase offers that are selectable and comply with the provisions of this Manual.\n\nThe corresponding prices and parameters shall be defined based on the purchase offers submitted and shall take as a basis the market price of the day, which must be established by the Marketing Department of Incopesca.\n\nArticle 10.-Sale. The sale of the fishery product shall be carried out publicly and directly; it shall be awarded to whoever offers the best economic conditions, in accordance with article 13 of Law No. 6227, with immediate payment in cash or any other means accepted by Incopesca.\n\nFrom the sale process, the corresponding record (acta) shall be drawn up where the sale is recorded and therefore finalized, all in accordance with articles 270 and 271 of the General Public Administration Law No. 6227.\n\nThe INCOPESCA official participating in the entire sale process must, in the record drawn up for that purpose, report on the steps taken, up to the closing of the sale, from which suggestions and recommendations will be fed back to adopt corrective measures and thus manage the internal or external risk that could affect the optimization of the objectives.\n\nArticle 11.-Conclusion of the sale and award. The offered good shall be awarded to the bidder making the best offer in accordance with the procedure established herein; however, in the event of not doing so, for duly justified reasons, it may be decided to call a new sale; or failing that, to proceed to donate it, destroy it in the event that the conditions of the product warrant it, or in the absence of offerors during the holding of the sale, to desist from the process.\n\nThe sale may not be awarded when the price is ruinous in the judgment of the official responsible for making the sale.\n\nArticle 12.-Requirements for the Awarded Offeror. The awardee must make the payment at the place where the sale is held, provided they comply with the requirements and conditions established for this purpose in this Manual. They must identify themselves by means of a valid national identity document or passport. Anyone participating in the sale on behalf of third parties or legal persons must prove the representation under which they act, by means of the respective mandate contract (contrato de mandato).\n\nArticle 13.-Donation. It is the act by which the fishery product is bequeathed to whomever Incopesca determines through the corresponding record (acta), all in accordance with articles 270 and 271 of the General Public Administration Law No. 6227.\n\nArticle 14.-Destruction. When the fishery product results in total uselessness, as declared in writing by SENASA, INCOPESCA shall order its integral destruction, by means of the respective administrative act and shall also draw up the pertinent record (acta) that certifies what has been done, in accordance with articles 270 and 271 of Law No. 6227.\n\nArticle 15.-Document management. For each process, an individualized administrative case file (expediente) shall be opened, which must contain all the steps taken in the sale, destruction, or donation process; consequently, the sale record (acta de venta), the destruction process, or the respective donation shall be included.\n\nAll documentation submitted by SENASA regarding the product in the event of destruction must form part of the corresponding file.\n\nArticle 16.-Administrative costs. From the total sale of the product, the expenses incurred by INCOPESCA to maintain the fishery product in a harmless state must be deducted, for which reason they must be duly credited in the administrative case file (expediente administrativo). From the remaining balance, Incopesca may allow the corresponding payments to cover research costs, in accordance with the provisions for these purposes in Law No. 8436, the Fisheries and Aquaculture Law, article 18; if any surplus results, these shall become the property of Incopesca.\n\nArticle 17.-The General Administrative Directorate must establish the administrative bank account for the proper administration of the funds, as well as the necessary mechanisms to make payments to the holder of the research permit when applicable, as well as the product maintenance expenses.\n\nArticle 18.-At all times, this procedure must be evaluated on every occasion it is put into practice, assisted by the Principles of Adaptability, Equality, Efficiency, Speed (Celeridad), Economy, and Simplicity of procedures, because it involves the disposal of perishable products.\n\nArticle 19.-Final agreement (Acuerdo firme).\n\nArticle 20.-Publish." }
