  "body_es_text": "en la totalidad del texto\n\n                    -\n\n                        Texto Completo Norma 288\n\n                        Reforma acuerdo que establece las tallas legales de primera captura para\npeces\n\nTexto Completo acta: 11AA06\n\nINSTITUTO COSTARRICENSE DE PESCA Y\nACUICULTURA\n\nAJDIP/288-2017.-Puntarenas, a los trece\ndías del mes de julio de dos mil diecisiete.\n\nConsiderando:\n\n1º-Que el 24 de febrero del año en curso, se\naprobó el Acuerdo AJDIP-102-17, mediante el cual se establecieron las Tallas\nLegales de Primera Captura (TLPC), respondiendo a las tallas de primera madurez\nsexual de conformidad con las recomendaciones emanadas por la Dirección General\nTécnica del INCOPESCA.\n\n2º-Que el artículo 5 de dicho acuerdo establece \"Para la\nimplementación de los controles en las embarcaciones pesqueras, se deberá\nrealizar sobre el producto existente en neveras o bodega de almacenamiento del\nproducto\".\n\n3º-Que con la promulgación del Acuerdo AJDIP/158-2017, publicado\nen el Diario Oficial La Gaceta N° 93 del 18 de mayo de 2017, regulación\nque establece el retiro de la flota pesquera semi-industrial\ncamaronera de arrastre en el Océano Pacifico Costarricense, su implementación\nconlleva el alejamiento de esta flota a un promedio de profundidades cercano a\nlos 50 metros, lo que significaría una menor probabilidad de captura de\nindividuos juveniles con tallas menores a la TLPC. Lo anterior se complementa\ncon la instalación de las balizas, que permitirá conocer la ubicación exacta de\nlos barcos, durante las faenas de pesca.\n\n4º-Que según informa el Biól. Berny Marín, cuando se realizó la investigación:\ncomparación de las capturas entre dos tipos de dispositivos excluidores de\ntortugas (DET), en la pesca del Camarón Rosado Penaeus\nbrevirostris en el Océano Pacífico Norte de Costa\nRica (Marín, 2009), investigación realizada en conjunto entre el INCOPESCA y la\nNOAA, la pesca de adultos o juveniles de pargo seda y pargo mancha, como FACA,\nfue casi nula, aun cuando, se realizaron 40 lances de pesca, de día y de noche,\na lo largo de la costa del Pacífico Norte de nuestro país. Por otro lado, en\notra investigación realizada por el Departamento de Desarrollo e Investigación\ny durante varios años en la zona 203 del Golfo de Nicoya: informe de la\nPesquería en el Área Marina de Pesca Responsable de Tárcoles\ny su Zona Contigua durante los años 2005 al 2013 (Marín, 2013) se encontró que\nlos juveniles de especies tales como las corvinas reina, coliamarilla\ny agria, los robalos, macarela y el pargo mancha, se encontraban dentro del\nÁrea Marina y Continental de Pesca Responsable de Tárcoles,\nmientras que los adultos estaban en su zona contigua, en aguas más profundas.\n\n5º-Que con la inclusión de controles sobre el producto pesquero\nobtenido durante las faenas de pesca existente en cubierta, el proceso de\ninspección se vuelve más efectivo, razón por la cual, la Junta Directiva; Por\ntanto;\n\nACUERDA:\n\n1º-Modificar el artículo 5 del Acuerdo N°\nAJDIP/102-2017, para que se lea de la siguiente manera: \"Para la implementación\nde los controles en las embarcaciones pesqueras, se deberá realizar sobre el\nproducto existente en cubierta, neveras o bodega de almacenamiento del\nproducto\".\n\n2º-Acuerdo firme.   "body_en_text": "in the entirety of the text\n\n                    -\n\n                        Full Text of Regulation 288\n\n                        Reform of the agreement that establishes legal sizes at first capture for\nfish\n\nFull Text of Record: 11AA06\n\nCOSTA RICAN INSTITUTE OF FISHERIES AND\nAQUACULTURE\n\nAJDIP/288-2017.-Puntarenas, on the thirteenth\nday of the month of July of two thousand seventeen.\n\nConsidering:\n\n1º-That on February 24 of this year,\nAgreement AJDIP-102-17 was approved, by which the Legal Sizes at First Capture (Tallas Legales de Primera Captura, TLPC) were established, corresponding to the sizes at first sexual maturity in accordance with the recommendations issued by the Technical General Directorate of INCOPESCA.\n\n2º-That Article 5 of said agreement establishes: \"For the\nimplementation of controls on fishing vessels, it must be carried out\non the product present in refrigerators or the product storage hold.\"\n\n3º-That with the promulgation of Agreement AJDIP/158-2017, published\nin the Official Gazette La Gaceta No. 93 of May 18, 2017, a regulation\nthat establishes the removal of the semi-industrial shrimp trawler\nfishing fleet in the Costa Rican Pacific Ocean, its implementation\nentails the relocation of this fleet to an average depth close to\n50 meters, which would mean a lower probability of capturing\njuvenile individuals with sizes below the TLPC. The foregoing is complemented\nby the installation of beacons, which will allow knowing the exact location\nof the boats during fishing operations.\n\n4º-That according to the report by Biologist Berny Marín, when the research:\ncomparison of catches between two types of turtle excluder devices\n(DET), in the fishery for Pink Shrimp Penaeus\nbrevirostris in the North Pacific Ocean of Costa\nRica (Marín, 2009) was conducted, research carried out jointly between INCOPESCA and\nNOAA, the catch of adults or juveniles of spotted snapper and red snapper, as bycatch (FACA),\nwas almost nil, even though 40 fishing hauls were conducted, day and night,\nalong the North Pacific coast of our country. On the other hand, in\nanother research project carried out by the Development and Research Department\nand over several years in zone 203 of the Gulf of Nicoya: report on the\nFishery in the Tárcoles Marine Area of Responsible Fishing\nand its Contiguous Zone during the years 2005 to 2013 (Marín, 2013), it was found that\nthe juveniles of species such as the queen croaker, yellowfin croaker,\nand shortfin weakfish, the snooks, Pacific sierra, and the spotted snapper, were found within the\nMarine and Continental Area of Responsible Fishing of Tárcoles,\nwhile the adults were in its contiguous zone, in deeper waters.\n\n5º-That with the inclusion of controls on the fishery product\nobtained during fishing operations present on the deck, the\ninspection process becomes more effective, for which reason, the Board of Directors; Therefore;\n\nAGREES:\n\n1º-To modify Article 5 of Agreement No.\nAJDIP/102-2017, so that it reads as follows: \"For the implementation\nof controls on fishing vessels, it must be carried out on\nthe product present on the deck, in refrigerators, or the product storage hold.\"\n\n2º-This agreement is final. It takes effect upon its publication."
