  "body_es_text": "en la totalidad del texto\n\n                    -\n\n                        Texto Completo Norma 40616\n\n                        Creación del Consejo Consultivo Ciudadano de Cambio Climático\n\nTexto Completo acta: 11A9E8\n\nN° 40616- MINAE\n\nEL PRESIDENTE DE LA REPÚBLICA\n\nY EL MINISTRO DE AMBIENTE Y ENERGÍA\n\nEn uso de las facultades conferidas en los artículos 140, incisos 3) y\n18), 50 y 146 de la Constitución Política; la Ley Orgánica del Ambiente N° 7554,\ndel 4 de octubre de 1995; la Ley General de la Administración Pública N° 6227\ndel 2 de mayo de 1978; la Convención Marco de las Naciones Unidas sobre Cambio\nClimático, Ley N° 7414 del 13 de junio de 1994;el Acuerdo de París, Ley N° 9405\ndel 4 de octubre de 2016, el Reglamento Orgánico del Ministerio de Ambiente y\nEnergía, Decreto Ejecutivo Nº35669-MINAET, del 4 de diciembre de 2009; el\nReglamento Orgánico del Poder Ejecutivo, Decreto EjecutivoN°38536-MP-PLAN, del\n25 de julio de 2014; el Decreto que oficializa el Plan de Acción de la\nEstrategia Nacional de Cambio Climático, Decreto Ejecutivo N°39114- MINAE del\n25 de julio de 2015; el Decreto de Fomento del Gobierno Abierto en la\nAdministración Pública y Creación de la Comisión Nacional para un Gobierno Abierto,\nDecreto N°38994-MP-PLAN-MICITT del 29 de abril de 2015, y en condición de\nEstado signatario de la Declaración de Río sobre Medio Ambiente y el Desarrollo\ndesde 1992.\n\nConsiderando:\n\n1. Que Costa Rica ha asumido el compromiso de participar en los esfuerzos\npara fortalecer el régimen establecido por la Convención Marco de Naciones\nUnidas sobre Cambio Climático, en adelante CMNUCC, a fin de contribuir a\ngarantizar una respuesta global y oportuna, con base en la información\ncientífica aportada por el Panel Intergubernamental sobre Cambio Climático\n(IPCC) y sobre la base de los principios que rigen la CMNUCC, basados en los\nprincipios de ambición y transparencia, con enfoque de derechos humanos y\ngénero.\n\n2. Que Costa Rica se reconoce, dentro del conjunto de la comunidad\ninternacional, como un país líder en mostrar modelos de desarrollo sostenible,\ny que actualmente busca consolidarse como un laboratorio para la descarbonización de la economía.\n\n3. Que Costa Rica sometió a la Conferencia de las Partes 21 (COP21) de la\nCMNUCC, realizada en París durante diciembre de 2015, su Contribución Prevista\ny Determinada a Nivel Nacional o INDC, por sus siglas en inglés, donde se\ncomprometió a establecer un Consejo Consultivo Ciudadano de Cambio Climático.\n\n4. Que en el Plan Nacional de Desarrollo 2015-2018 se establece dentro de\nlos objetivos estratégicos del Sector Ambiente, Energía, Mares y Ordenamiento\nTerritorial, fomentar las acciones frente al cambio climático global, mediante\nla participación ciudadana, el cambio tecnológico, procesos de innovación,\ninvestigación y conocimiento para garantizar el bienestar, la seguridad humana\ny la competitividad del país.\n\n5. Que para lograr ese objetivo se determinó concretamente el impulso de\nacciones de reducción de emisiones en sectores clave (transporte, energía,\nagricultura, residuos sólidos), para catalizar el proceso de transformación\nhacia un desarrollo bajo en emisiones y la meta de - Carbono Neutralidad del\npaís en el marco de las Contribuciones Nacionales ante la CMNUCC.\n\n6. Que mediante Ley N° 9405 del 4 de octubre del 2016 se ratificó el\nAcuerdo de París de la CMNUCC y por tanto los compromisos presentados en la\nContribución Prevista y Determinada a Nivel Nacional, pasaron a ser Compromisos\nNacionalmente Determinados o NDCs, por sus siglas en\ninglés.\n\n7. Que en acatamiento a los mandatos del artículo 13 del Acuerdo de París,\nCosta Rica actualmente trabaja en el diseño y puesta en marcha del marco de\ntransparencia nacional, mediante el Sistema Nacional de Métrica en Cambio Climático\n(SINAMECC), y dentro del cual, el Consejo Consultivo Ciudadano de Cambio\nClimático, en adelante 5C, cumple roles estratégicos. Este marco de\ntransparencia climática, es consistente con la política promovida por la\nAdministración Solís Rivera, basada en el objetivo de desarrollo sostenible 16,\nen el cual se promueve la Agenda 2030 de las Naciones Unidas, que establece la\nnecesidad de: 1) Promover sociedades pacíficas e inclusivas, para el desarrollo\nde herramientas y mecanismos sostenibles; 2) Facilitar el acceso a la promoción\nde justicia para todos; 3) Crear instituciones eficaces, responsables e\ninclusivas en todos los niveles; y 4) Garantizar la participación ciudadana en\nlas diferentes materias del quehacer administrativo, mediante la adopción de\ndecisiones inclusivas, participativas y representativas que respondan a las\nnecesidades a todos los niveles\"\n\n8. Que atendiendo al cumplimiento de un desarrollo sostenible en forma\nintegral, la Administración Solís Rivera, ha plasmado en su Plan Nacional de\nDesarrollo 2015- 2018, garantizar el desarrollo y bienestar humano promoviendo\nun uso adecuado de los recursos naturales y una repartición justa y equitativa\nde sus beneficios con una participación local, que asegure la transparencia y\nlucha contra la corrupción. Lo anterior ligado a los Objetivos de Desarrollo\nSostenible (ODS) establecidos en la Agenda 2030 por las Naciones Unidas en el\n2015 y al Pacto Nacional por los Objetivos de Desarrollo sostenible firmado el\npasado 9 de setiembre de 2016 por los Poderes Supremos de la República. En\nparticular, el objetivo 13 que llama a adoptar medidas urgentes para combatir\nel cambio climático y sus efectos.\n\n9. Que el Principio 10 de la Declaración de Río establece que el mejor modo\nde tratar las cuestiones del desarrollo sostenible, es con la participación de\ntodos los ciudadanos interesados, en el nivel que corresponda. \"En el plano\nnacional, toda persona deberá tener acceso adecuado a la información sobre el\nmedio ambiente de que dispongan las autoridades públicas, incluida la\ninformación sobre los materiales y las actividades que encierran peligro en sus\ncomunidades, así como la oportunidad de participar en los procesos de adopción\nde decisiones. Los Estados deberán facilitar y fomentar la sensibilización y la\nparticipación de la población poniendo la información a disposición de todos.\nDeberá proporcionarse acceso efectivo a los procedimientos judiciales y\nadministrativos, entre éstos el resarcimiento de daños y los recursos\npertinentes\". Este principio fue reafirmado mediante la Ley 7414 del 13 de\njunio de 1994 (artículo 4, inciso i)\n\n10. Que la acción climática, que incluye enfoques de mitigación y\nadaptación, es un eje transversal para la economía, la sociedad, y de un nuevo\nmodelo de desarrollo, basado en la descarbonización y\nen la generación de resiliencia, como pilares para garantizar competitividad y\ncrecimiento incluyente.\n\n11. Que la planificación y puesta en marcha de este nuevo modelo de\ndesarrollo requiere  de un trabajo\nmultisectorial y multidimensional, en donde el trabajo articulado con actores\nsociales y productivos, se convierte en una necesidad.\n\nPor tanto,\n\nDecretan:\n\n\"Creación del Consejo Consultivo Ciudadano de Cambio Climático\"\n\nArtículo 1. Créase el Consejo Consultivo Ciudadano de Cambio Climático (en adelante\n5C), como una plataforma de participación ciudadana que se enmarca en la\npolítica nacional de gobierno abierto, con la que se procura reforzar los\nmecanismos de rendición de cuentas, de disposición y acceso a la información.\n\nArtículo 2. El 5C es un espacio consultivo deliberativo, que aspira colaborar con el\ndiseño y aplicación de las políticas nacionales de cambio climático, en\nparticular la implementación de la Contribución Prevista y Determinada a Nivel Nacional\npresentada por Costa Rica ante la Conferencia de las Partes 21, celebrada en\nParís en diciembre 2015.\n\nArtículo 3. El 5C tendrá las siguientes funciones:\n\n1. Deliberar de forma independiente acerca del diseño, aplicación y\nevaluación de las políticas de cambio climático que proponga y opere el\ngobierno, por medio de sus diferentes instituciones.\n\n2. Podrán formar parte del 5C:\n\n1. Las organizaciones sociales, sectoriales y productivas (asociaciones,\nfundaciones, cooperativas, cámaras) debidamente inscritas ante el Registro Nacional,\ncon más de tres años de existencia, interesadas en la acción climática y en\ncapacidad de aportar al proceso nacional de acción climática.\n\n2. El Ministro de Ambiente y Energía o el representante que este designe,\nquien tendrá derecho a voz, pero no a voto y no puede ocupar un puesto en el\ncomité directivo.\n\n3. El director o directora de la Dirección de Cambio Climático quien tendrá\nderecho a voz, pero no a voto, y no puede ocupar un puesto en el comité\ndirectivo.\n\nArtículo 5. La participación en el 5 C de los miembros será voluntaria y ad-honorem.\n\nArtículo 6. El Consejo Consultivo Ciudadano de Cambio Climático, estará conformado\npor representantes de los siguientes sectores:\n\n1. Comunitario (ASADAS y Asociaciones de Desarrollo) (tres representantes).\n\n2. Biodiversidad-Ecosistemas (tres representantes).\n\n3. Agropecuario-forestal-pesca (tres representantes).\n\n4. Industrial-comercial (tres representantes).\n\n5. Infraestructura-Transporte (tres representantes).\n\n6. Indígena-mujeres- organizaciones laborales (tres representantes).\n\n7. Movilidad y sostenibilidad urbana (tres representantes)\n\nLa Dirección de Cambio Climático del MINAE convocará de manera pública y\nabierta a todos los interesados en conformar el 5C a asambleas generales de\ncada uno de los siete sectores indicados en este artículo. Para participar cada\ninteresado deberá acreditarse ante la Dirección de Cambio Climático,\ndemostrando que cumple con lo indicado en el artículo 4, inciso 1, de este\ndecreto. En cada una de las siete asambleas generales los representantes\nacreditados podrán nominar a cualquiera de los presentes a ser representantes\nante el 5C.\n\nUna vez agotada la nominación se procederá a una votación directa que\ndefinirá a los representantes por un periodo de dos años.\n\nLa Dirección de Cambio Climático levantara actas de cada una de las\nasambleas indicando los nombres de los representantes, las nominaciones\nrealizadas y los resultados de las votaciones de elección de los participantes.\nEstas actas estarán a abierta disposición del público.\n\nDe conformidad con la Ley N°8901 y el voto 004630-2014 de la Sala\nConstitucional la diferencia entre la representación de hombres y mujeres no\npuede ser superior a uno.   "body_en_text": "de la totalidad del texto\n\n                    -\n\n                        Full Text of Norma 40616\n\n                        Creation of the Citizen Consultative Council on Climate Change\n\nFull Text of record: 11A9E8\n\nN° 40616- MINAE\n\nTHE PRESIDENT OF THE REPUBLIC\n\nAND THE MINISTER OF ENVIRONMENT AND ENERGY\n\nIn exercise of the powers conferred by articles 140, subsections 3) and\n18), 50 and 146 of the Political Constitution; the Organic Environmental Law No. 7554,\nof October 4, 1995; the General Law of Public Administration No. 6227\nof May 2, 1978; the United Nations Framework Convention on Climate\nChange, Law No. 7414 of June 13, 1994; the Paris Agreement, Law No. 9405\nof October 4, 2016, the Organic Regulation of the Ministry of Environment and\nEnergy, Executive Decree No. 35669-MINAET, of December 4, 2009; the\nOrganic Regulation of the Executive Branch, Executive Decree No. 38536-MP-PLAN, of\nJuly 25, 2014; the Decree formalizing the Action Plan of the\nNational Climate Change Strategy, Executive Decree No. 39114-MINAE of\nJuly 25, 2015; the Decree for the Promotion of Open Government in the\nPublic Administration and Creation of the National Commission for Open Government,\nDecree No. 38994-MP-PLAN-MICITT of April 29, 2015, and in the capacity of\na State signatory of the Rio Declaration on Environment and Development\nsince 1992.\n\nConsidering:\n\n1. That Costa Rica has assumed the commitment to participate in the efforts\nto strengthen the regime established by the United Nations Framework Convention\non Climate Change, hereinafter UNFCCC, in order to contribute to\nguaranteeing a global and timely response, based on the scientific\ninformation provided by the Intergovernmental Panel on Climate Change\n(IPCC) and based on the principles governing the UNFCCC, founded on the\nprinciples of ambition and transparency, with a human rights and\ngender focus.\n\n2. That Costa Rica recognizes itself, within the international community\nas a whole, as a leading country in showcasing sustainable development models,\nand that it currently seeks to consolidate itself as a laboratory for the decarbonization of the economy.\n\n3. That Costa Rica submitted to the 21st Conference of the Parties (COP21) of the\nUNFCCC, held in Paris during December 2015, its Intended Nationally\nDetermined Contribution, or INDC, where it\ncommitted to establishing a Citizen Consultative Council on Climate Change.\n\n4. That the 2015-2018 National Development Plan establishes within\nthe strategic objectives of the Environment, Energy, Seas, and Land-Use Planning\nSector, to promote actions to address global climate change, through\ncitizen participation, technological change, innovation processes,\nresearch, and knowledge to guarantee well-being, human security,\nand the country's competitiveness.\n\n5. That to achieve this objective, the promotion\nof emission reduction actions in key sectors (transportation, energy,\nagriculture, solid waste) was specifically determined, to catalyze the transformation process\ntoward low-emission development and the goal of - Carbon Neutrality for the\ncountry within the framework of the National Contributions before the UNFCCC.\n\n6. That through Law No. 9405 of October 4, 2016, the\nParis Agreement of the UNFCCC was ratified, and therefore the commitments submitted in the\nIntended Nationally Determined Contribution became Nationally\nDetermined Commitments, or NDCs.\n\n7. That in compliance with the mandates of Article 13 of the Paris Agreement,\nCosta Rica is currently working on the design and implementation of the national\ntransparency framework, through the National System of Climate Change Metrics\n(SINAMECC), and within which, the Citizen Consultative Council on Climate\nChange, hereinafter 5C, fulfills strategic roles. This climate\ntransparency framework is consistent with the policy promoted by the\nSolís Rivera Administration, based on sustainable development objective 16,\nwhich promotes the United Nations 2030 Agenda, establishing the\nneed to: 1) Promote peaceful and inclusive societies for the development\nof sustainable tools and mechanisms; 2) Facilitate access to the promotion\nof justice for all; 3) Create effective, accountable, and\ninclusive institutions at all levels; and 4) Guarantee citizen participation in\nthe different matters of administrative work, through the adoption of\ninclusive, participatory, and representative decisions that respond to the\nneeds at all levels\"\n\n8. That attending to the fulfillment of sustainable development in an integral\nmanner, the Solís Rivera Administration has enshrined in its 2015-2018 National\nDevelopment Plan, to guarantee human development and well-being by promoting\nan adequate use of natural resources and a fair and equitable distribution\nof its benefits with local participation, ensuring transparency and\nthe fight against corruption. The foregoing linked to the Sustainable Development\nGoals (SDGs) established in the 2030 Agenda by the United Nations in\n2015 and the National Pact for the Sustainable Development Goals signed on\nthe past 9th of September 2016 by the Supreme Powers of the Republic. In\nparticular, goal 13 which calls for adopting urgent measures to combat\nclimate change and its effects.\n\n9. That Principle 10 of the Rio Declaration establishes that the best way\nof dealing with sustainable development issues is with the participation of\nall interested citizens, at the corresponding level. \"At the national\nlevel, every individual shall have appropriate access to information concerning the\nenvironment that is held by public authorities, including\ninformation on hazardous materials and activities in their\ncommunities, and the opportunity to participate in decision-making\nprocesses. States shall facilitate and encourage public awareness and\nparticipation by making information widely available.\nEffective access to judicial and\nadministrative proceedings, including redress and remedy,\nshall be provided.\" This principle was reaffirmed through Law 7414 of June 13,\n1994 (article 4, subsection i)\n\n10. That climate action, which includes mitigation and\nadaptation approaches, is a transversal axis for the economy, society, and a new\ndevelopment model, based on decarbonization and\non the generation of resilience, as pillars to guarantee competitiveness and\ninclusive growth.\n\n11. That the planning and implementation of this new development\nmodel requires multisectoral and multidimensional work, where articulated work with social\nand productive actors becomes a necessity.\n\nTherefore,\n\nThey Decree:\n\n\"Creation of the Citizen Consultative Council on Climate Change\"\n\nArticle 1. The Citizen Consultative Council on Climate Change (hereinafter\n5C) is created, as a citizen participation platform framed within the\nnational open government policy, through which it seeks to reinforce\naccountability mechanisms, and the availability and access to information.\n\nArticle 2. The 5C is a deliberative consultative space, aspiring to collaborate with the\ndesign and implementation of national climate change policies, in\nparticular the implementation of the Intended Nationally Determined Contribution\npresented by Costa Rica to the 21st Conference of the Parties, held in\nParis in December 2015.\n\nArticle 3. The 5C shall have the following functions:\n\n1. To deliberate independently on the design, implementation, and\nevaluation of climate change policies proposed and operated by the\ngovernment, through its different institutions.\n\n2. To respond to consultations submitted by MINAE or other public\nentities on the design, implementation, and evaluation of their climate policies, programs, and\nmetrics.\n\n3. To generate activities deemed necessary to increase the\nlevel of information and awareness of the citizenry regarding Climate\nChange.\n\n4. To improve the levels of coordination and communication between the\npublic administration and the citizenry.\n\n5. To serve as a citizen oversight (auditoría ciudadana) space responsible for analyzing, discussing, and\nsupporting the implementation of the Intended Nationally Determined\nContribution presented by Costa Rica to the 21st Conference of the Parties\nheld in Paris in December 2015.\n\n6. To interact with the governance bodies established for the\nUnited Nations Sustainable Development Goals (Decree No.\n40203-PLAN-REMINAE), generating input on progress in fulfilling Objective\n13 (on combating climate change and its effects), of the\nSustainable Development Goals within the framework of the 2030 Agenda, providing\nfeedback to the corresponding institutions.\n\nArticle 4. The following may form part of the 5C:\n\n1. Social, sectoral, and productive organizations (associations,\nfoundations, cooperatives, chambers) duly registered before the National Registry,\nwith more than three years of existence, interested in climate action and\ncapable of contributing to the national climate action process.\n\n2. The Minister of Environment and Energy or the representative designated by him/her,\nwho shall have the right to speak, but not to vote, and may not hold a position on the\nsteering committee (comité directivo).\n\n3. The director of the Climate Change Directorate (Dirección de Cambio Climático), who shall have\nthe right to speak, but not to vote, and may not hold a position on the\nsteering committee (comité directivo).\n\nArticle 5. The participation of members in the 5C shall be voluntary and ad-honorem.\n\nArticle 6. The Citizen Consultative Council on Climate Change shall be composed of\nrepresentatives from the following sectors:\n\n1. Community (ASADAS and Development Associations) (three representatives).\n\n2. Biodiversity-Ecosystems (three representatives).\n\n3. Agricultural-livestock-forestry-fishery (three representatives).\n\n4. Industrial-commercial (three representatives).\n\n5. Infrastructure-Transportation (three representatives).\n\n6. Indigenous-women-labor organizations (three representatives).\n\n7. Mobility and urban sustainability (three representatives)\n\nThe Climate Change Directorate (Dirección de Cambio Climático) of MINAE shall publicly and openly convene all interested parties in forming the 5C to general assemblies for\neach of the seven sectors indicated in this article. To participate, each\ninterested party must be accredited before the Climate Change Directorate (Dirección de Cambio Climático),\ndemonstrating compliance with the provisions of article 4, subsection 1, of this\ndecree. In each of the seven general assemblies, the accredited\nrepresentatives may nominate any of those present to be representatives\nbefore the 5C.\n\nOnce the nomination process is complete, a direct vote shall be held to\ndefine the representatives for a period of two years.\n\nThe Climate Change Directorate (Dirección de Cambio Climático) shall draft minutes (actas) of each of the\nassemblies indicating the names of the representatives, the nominations\nmade, and the results of the elections for the participants.\nThese minutes (actas) shall be openly available to the public.\n\nIn accordance with Law No. 8901 and ruling 004630-2014 of the Constitutional\nChamber (Sala Constitucional), the difference between the representation of men and women may\nnot be greater than one. The different sectors are urged\nto integrate young people (under 35 years of age) into their representations before\nthe 5C.\n\nArticle 7. The plenary of the 5C shall be composed of 21 representatives, three for each\nof the 7 sectors mentioned above. The plenary shall elect the steering committee (comité directivo)\nof the 5C, which shall be the spokesperson for the Council and shall represent the Council before MINAE\nand other State institutions, as well as at activities to which the\nCouncil is invited.\n\nArticle 8. The steering committee (comité directivo) of the 5C shall be composed of a president, a\nvice-president, and a secretary. The president shall prepare the agenda for each\nmeeting and the follow-up on agreements reached in previous meetings. The\nsecretary shall draft the minutes (minuta) of each of the sessions.\n\nArticle 9. The 5C may internally establish a Statute that facilitates regulating its\ninternal procedures and mechanisms. It shall contemplate mechanisms for\nentry and exit of its membership, as well as schemes for revocation and\nnullity, election and voting mechanisms, and the mechanism for follow-up\nand monitoring of agreements; as well as other relevant aspects for the\nfulfillment of the purposes for which the 5C was established.\n\nArticle 10. The United Nations Development Programme (UNDP) shall provide logistic\nand secretarial support for the formation and operation of the 5C, through\none of its projects, for a term of two years.\n\nArticle 11. It shall come into effect upon its publication in the Official Gazette La Gaceta\n\nGiven at the Presidency of the Republic. - San José, on the seventh of August\nof the year two thousand seventeen."
