Se modifica la Resolución N° 0541-2016-MINAE publicada en el Alcance número 4 a\nLa Gaceta número 5 del seis de enero del dos mil diecisiete, para establecer al Fondo Nacional de\nFinanciamiento Forestal, la cantidad de hectáreas a financiar para la subactividad de Plantaciones\nForestales con Turnos de Rotación Reducidos (PFTRR), en el Programa de Pago por Servicios\nAmbientales, el monto a pagar con base en los recursos asignados en el Presupuesto Nacional y\naprobados por la Contraloría General de la República al citado Fondo, las Políticas Nacionales de\nConservación y los criterios de priorización definidos por el Sistema Nacional de Áreas de\nConservación y oficializados por el Poder Ejecutivo.\n\nResultando:\n\n1º-Que el día seis de enero de 2017, se publica en el Alcance N° 4 a La Gaceta N° 5, la resolución\nnúmero R-0541-2016 MINAE, la cual tiene como finalidad determinar una serie de factores relevantes\npara el Programa de Pago por Servicios Ambientales para el año dos mil diecisiete, según dispone el\nartículo 38 del Reglamento a la Ley Forestal 7575, Decreto Ejecutivo 25721-MINAE y sus reformas.\n\n2º-Que ante la disminución de proyectos de pago por servicios ambientales en la actividad de\nreforestación, la Oficina Nacional Forestal propone\nuna nueva subactividad que ofrezca condiciones más ventajosas y atractivas, para\nutilizar esquemas científicos y tecnológicos\npara lograr reducir los turnos de corta de ciertas especies, las cuales serán dedicadas\na embalajes y proyectos dendro energéticos.\n\nConsiderando:\n\n1º-Que el artículo 38 del Reglamento a la Ley Forestal N° 7575, Decreto Ejecutivo N° 25721-MINAE del\ndía 17 de octubre de 1996 y sus reformas, dispone que el Ministro de Ambiente y Energía como\nJerarca, emitirá anualmente mediante Resolución Ministerial, las actividades a financiar en el\nPrograma de Pago por Servicios Ambientales y los montos a pagar con base en los recursos asignados\nen el Presupuesto Nacional del Fondo Nacional de Financiamiento Forestal.\n\n2º-Que para el año 2016, se estima según estadísticas llevadas por la Oficina Nacional Forestal, que\nla industria de transformación primaria de madera, entre estacionarias y portátiles, procesaron\n965.602 metros cúbicos de madera en rollo (m3-r). De este volumen, 745.267 m3-r (77,2%) provienen de\nplantaciones forestales, 171.017 m3-r de terrenos de uso agropecuario (17,7%) y 49.318 m3-r de\nbosques (5,1%). La madera procesada en las industrias forestales se destina principalmente a los\nsiguientes usos: embalajes 46,7%, construcción 25,1%, mueblería 9,0%, exportación en bruto y\naserrado 18,9% y un 0,3% en otros usos (fabricación de tableros, carrocerías, entre otros.)\n\n3º-Que pese a los esfuerzos realizados por el Fondo Nacional de\nFinanciamiento Forestal en los últimos años se ha experimentado una baja en la\ntasa de reforestación nacional, impidiendo cumplir la meta del Plan Nacional de\nDesarrollo Forestal de alcanzar al menos 6200 hectáreas de reforestación en el\naño 2017, debido a una serie de factores que inciden en\nla decisión de los dueños de finca de no realizar estos proyectos, con el perjuicio\npara la producción del país, que reduce en parte el abastecimiento\nde madera para diversos usos y aumenta las importaciones de madera de\nplantación de otras partes del mundo entre otros aspectos.\n\n4º-Que la Oficina Nacional Forestal preocupada por esta pérdida de interés de los productores en\nestablecer plantaciones forestales, propone a la Junta Directiva del Fondo Nacional de\nFinanciamiento Forestal la creación de un nuevo modelo o esquema de plantación forestal, que permite\nser más atractiva a los productores, pues pueden cosechar en un plazo menor, ello en virtud de\ntécnicas más eficientes y un paquete tecnológico preparado con ayuda de los ingenieros forestales\nregentes de los proyectos. Para cubrir el costo de inscripción del contrato ante el Registro\nNacional, el Fondo Nacional de Financiamiento Forestal retendrá en el primer\ndesembolso del monto total del contrato, un 0,6% para las Plantaciones\nForestales con Turnos de Rotación Reducidos (PFTRR).\n\n3.15. El beneficiario del proyecto PFTRR deberá contar durante todo el plazo del contrato, con un\nregente forestal debidamente inscrito en el Colegio de Ingenieros Agrónomos, quien deberá informar\nde previo a cada pago, el estado de la plantación y sus crecimientos en diámetro y altura.\n\n3.16. Previo a cada pago de cada proyecto PFTRR, se debe contar con una certificación de un regente\nforestal, donde se detalle el estado de la plantación y que se cumplen las condiciones mínimas\nindicadas en el artículo 1 de esta resolución y lo establecido en el Manual de Procedimiento para el\nPago de Servicios Ambientales 2009 y sus modificaciones.\n\n3.17. This proposal was accepted by the Board of Directors of the National Forest Financing Fund, through the tenth agreement of ordinary session No. 07-2017 held on Tuesday, July 18, two thousand seventeen, generating a recommendation to the Office of the Minister of Environment and Energy to issue the resolution creating and regulating the new activity in the payment for environmental services program called Forest Plantations with Reduced Rotation Cycles (PFTRR).\n\n5º-That the new reforestation activity will allow established forest plantations to better supply the wood necessary for industries, both for the production of pallets and packaging for agricultural products and for export, as well as for novel activities such as energy production, or other purposes required in the market.\n\n6º-That for the year 2017, an initial goal of establishing up to two thousand hectares under this reforestation activity is considered, which will be financed with resources duly budgeted for payment for environmental services activities under the reforestation modality. Therefore,\n\nTHE MINISTER OF ENVIRONMENT AND ENERGY,\n\nHEREBY RESOLVES,\n\nArticle 1º-To amend Resolution No. 0541-2016-MINAE, published in Supplement number 4 to La Gaceta number 5 of Friday, January 6, 2017, and to add a point 1.2.1.A,\n\nWhich shall read: Sub-activity called Forest Plantations with Reduced Rotation Cycles (Plantaciones Forestales con Turnos de Rotación Reducidos) (PFTRR). The conditions governing the processing of applications, for the recognition of environmental services in the activity of Forest Plantations with Reduced Rotation Cycles, shall be the following:\n\na) Payment amounts per activity and other conditions:\n\nFor the year 2017, the sub-activity of Forest Plantations with Reduced Rotation Cycles (PFTRR) shall be included within the modality of Recovery of Forest Cover (Recuperación de la Cobertura Forestal), for a maximum amount of 2,000 hectares, which are part of the 6,210 hectares planned for the reforestation activity in 2017 with fast-growing species.\n\nb) The amount to be paid for Forest Plantations with Reduced Rotation Cycles (PFTRR) shall be three hundred sixty-one thousand five hundred thirty-one colones 00/100 (361,531 colones with 00/100) per hectare. Payments shall be distributed as follows: 50% the first year, 25% the second year, and 25% the fourth year.\n\nc) The National Forest Financing Fund shall use the following minimums to process the corresponding payments each year:\n\nMinimum reference values for diameter (DBH cm) and total height (m), expected per year for Forest Plantations with Reduced Rotation Cycles (PFTRR) for the species Gmelina arborea and species of the fast-growing group:\n\n| Age (years) | VRM DBH* (cm) | VRM Tot Ht** (m) |\n| --- | --- | --- |\n| 1 | - | 3.29 |\n| 2 | 8.88 | 6.65 |\n| 3 | 13.35 | 9.73 |\n| 4 | 14.69 | 10.69 |\n| 5 | 17.55 | 12.48 |\n| 6 | 19.53 | 13.80 |\n\n* DBH, minimum reference diameter at breast height in centimeters\n\n** Ht, minimum reference total height in meters\n\nFor plantations for Dendroenergy production, densities may vary between 2,000 trees/ha and 5,000 trees/ha; likewise, the final harvest may not be carried out before six years.\n\nArticle 2º-To amend article two of resolution No. 0541-2017-MINAE to add a subparagraph f) which shall read: f):\n\nf) The contracts corresponding to the sub-activity of Forest Plantations with Reduced Rotation Cycles (PFTRR) shall have a term of six years.\n\nArticle 3º-To amend article three of resolution 541-2017-MINAE and to add subparagraphs 3.14, 3.15, 3.16, and 3.17, as indicated below:\n\nSpecial Considerations. Conditions established for the amounts and activities of Payment for Environmental Services (Pago de Servicios Ambientales, PSA) applications under the Forest Plantations with Reduced Rotation Cycles (PFTRR) modality.\n\n3.14. To cover the cost of registering the contract with the National Registry, the National Forest Financing Fund shall withhold, from the first disbursement of the total contract amount, 0.6% for Forest Plantations with Reduced Rotation Cycles (PFTRR).\n\n3.15. The beneficiary of the PFTRR project must have, during the entire term of the contract, a forestry manager (regente forestal) duly registered with the College of Agronomists, who must report, prior to each payment, the status of the plantation and its growth in diameter and height.\n\n3.16. Prior to each payment for each PFTRR project, a certification from a forestry manager is required, detailing the status of the plantation and confirming that the minimum conditions indicated in Article 1 of this resolution and those established in the 2009 Procedure Manual for the Payment of Environmental Services and its modifications are met.\n\n3.17. FONAFIFO, to verify the data presented, shall in all cases require the submission of individual measurement data for the trees included in the measurement plots, which must be established for these purposes within the forest plantation projects.\n\nArticle 4º-Shall be effective upon its publication." }
