San José a las nueve horas del diecinueve de\ndiciembre de dos mil dieciséis. Se establece al Fondo Nacional de\nFinanciamiento Forestal la cantidad de hectáreas a financiar por actividad en\nel Programa de Pago por Servicios Ambientales, y el monto a pagar con base en\nlos recursos asignados en el Presupuesto Nacional y aprobados por la\nContraloría General de la República al citado Fondo, las Políticas Nac1onales\nde Conservación y los criterios de priorización definidos por el Sistema\nNacional de Áreas de Conservación y oficializados por el Poder Ejecutivo.\n\nRESULTANDO\n\nÚnico: Que el presupuesto asignado para ejecución de los proyectos del Programa\nde Pago por Servicios Ambientales que se formalicen en el año 2017, es por un\nmonto 3.511.817.446,00 (tres mil quinientos once millones ochocientos\ndiecisiete mil cuatrocientos cuarenta y seis colones). Dicho plan de gastos fue\naprobado por la Contraloría General de la República.\n\nCONSIDERANDO\n\nPrimero: Que el artículo 38 del Reglamento a la Ley Forestal Nº 7575, Decreto\nEjecutivo Nº 25721-MINAE del 17 de octubre de 1996 y sus reformas, dispone que\nel Ministro de Ambiente y Energía como Jerarca, emitirá anualmente mediante\nResolución Ministerial, las actividades a financiar en el Programa de Pago por\nServicios Ambientales y los montos a pagar con base en los recursos asignados\nen el Presupuesto Nacional.\n\nSegundo: Que la administración Solís Rivera a través del Plan Nacional de\nDesarrollo Alberto Cañas Escalante 2014-2018, establece la economía social\nsolidaria, como una forma de lograr la reducción de la pobreza. Bajo este\nprincipio, los instrumentos financieros deben orientarse a apoyar los pilares\ndel Plan Nacional de Desarrollo; no estableciendo discriminación, sino la\norientación prioritaria a las organizaciones de productores que apoyan los\npequeños y medianos productores forestales; y quienes se ubican en los cantones\nde mayor rezago social, considerando los objetivos de la creación del Fondo\nNacional de Financiamiento Forestal según la citada Ley Forestal, sin dejar de\nlado los criterios de orden técnico establecidos.\n\nTercero: Que el Plan Nacional de Desarrollo citado considera corno una de las\nmetas nacionales mantener bajo el Programa de Pago por Servicios al menos\ntrescientas mil hectáreas, en sus diferentes modalidades. Además, dispone como\nuno de sus desafíos: desan-ollar instrumentos\nfinancieros novedosos y fortalecer los existentes, orientados al manejo\nforestal sostenible, incluyendo la Protección, Regeneración, y el\nestablecimiento de Sistemas A&rroforestales y\nPlantaciones Forestales· así como. la industrialización y comercialización de\nlos bienes y servicios generados por los ecosistemas forestales.\n\nPOR TANTO:\n\nEL MINISTRO DE AMBIENTE Y ENERGÍA\n\nRESUELVE\n\nArtículo 1. En todo caso, los recursos\nutilizados para estos fines, deberán ser incorporados en el presupuesto\ninstitucional y ser aprobados por la Contraloría General de la República.\n\n1.2.De los montos de pago por actividad y otras condiciones:\n\n1.2.1. Actividad de Reforestación: Las condiciones que regirán para el trámite\nde solicitudes, para el reconocimiento de los servicios ambientales en la\nactividad de Reforestación, son las siguientes:\n\na) El monto a pagar para las especies de rápido crecimiento referidas a:\nGmelina arbórea, Acacia mangium,\nVochysia guatemalensis y Vochysia hondurensis, será de seiscientos cuarenta y\ntres mil ciento siete colones con 00/100 (¢643.107) por hectárea, desembolsados\ndurante un período de cinco años. Los pagos serán distribuidos de la siguiente\nforma: 50% el primer año, 20% el segundo año, 15% el tercer año, 10% el cuarto\naño y 5% el quinto año.\n\nb) El monto a pagar para las especies de mediano crecimiento referidas a: Tectona grandis, Pinus sp,\nCordia alliodora, Vochysia ferruginea, WEucalyptus sp y Cedrela odorata,  será de setecientos\ncincuenta y siete mil seiscientos treinta y cuatro colones con 00/100 (¢757.634) por hectárea,\ndesembolsados durante un período de cinco años.\n\nLos pagos serán distribuidos de la siguiente forma: 50010 el primer año,\n20% el segundo año, 15% el tercer año. 10% el cuarto año y 5% el quinto\naño.\n\nc) El monto a pagar para especies nativas contenidas en los Decretos\nEjecutivos N° 25663-MINAE del 8 de octubre de 1996 y N° 25700-MINAE del 15 de\nnoviembre de 1996, será de un millón ciento treinta y seis mil cuatrocientos\ncincuenta y un colones (¢1.136.451) por hectárea, desembolsados durante\nun período de cinco años. Los pagos serán distribuidos de la siguiente forma:\n50% el primer año, 20% el segundo año, 15% el tercer año, 10% el cuarto año y 5%\nel quinto año.\n\nd) Se instruye al Fondo Nacional de Financiamiento Forestal para que\nincorpore en los contratos de Pago por Servicios Ambientales en la actividad de\nReforestación y Sistemas Agroforestales en bloque, los valores mínimos aceptables para realizar los\npagos.\n\nEl Fondo Nacional de Financiamiento Forestal\nutilizará los siguientes valores de referencia para tramitar los pagos\ncorrespondientes a cada año:\n\nCuadro 1. Dichos pagos corresponden al total de años del plazo convenido; no\nobstante, a fin de permitir el establecimiento de la plantación y su\nmantenimiento, se adelantará durante los primeros cinco años.\n\ng) El Fonafifo podrá modificar cuando así se solicite, aquellos\ncontratos suscritos antes del año 2006, que demuestren haber alcanzado una\nproducción mínima de 13 metros cúbicos de volumen anual por hectárea. Para\ntales efectos, el Fonafifo podrá solicitar la información que considere\npertinente.\n\nh) El Fonafifo para constatar los datos presentados en todos los casos\nrequerirá la presentación de los datos de las mediciones individuales de los\nárboles incluidos en las parcelas de medición que para sus efectos se tienen\nque establecer en los proyectos de reforestación.\n\ni) El Sistema Nacional de Áreas de Conservación, deberá establecer un\nplan para el fomento de las plantaciones forestales de manera que las seis mil\ndoscientas hectáreas de reforestación, incluidas en la presente resolución se\ndistribuyan de la siguiente manera: Región Brunca\n375 hectáreas, Región Central 160 hectáreas. Región Chorotega 2755\nhectáreas, Región Huetar Atlántica 504 hectáreas.\nRegión Huetar Norte 1 779 y Región Pacífico Central\n908 hectáreas. De conseguirse la meta en alguna Región, el Fonafifo podrá\ndestinar los recursos a otras regiones.\n\n(*)1.2.1.A.  Sub-actividad denominada Plantaciones Forestales con Turnos de Rotación Reducidos\n(PFTRR). Las condiciones que regirán para el trámite de solicitudes, para el reconocimiento de los\nservicios ambientales en la actividad de Plantaciones Forestales con turnos de rotación reducidos\nserán las siguientes:\n\na) De los montos de\npago por actividad y otras condiciones:\n\nPara el año 2017, se incluirá dentro de la modalidad de Recuperación de la Cobertura Forestal, la\nsubactividad de Plantaciones Forestales con Turnos de Rotación Reducidos (PFTRR), hasta por una\ncantidad máxima de 2,000 hectáreas, las cuales son parte de las 6,210 hectáreas previstas para la\nactividad de reforestación en 2017 con especies de rápido crecimiento.\n\nb) El monto a pagar\npara las Plantaciones Forestales con Turnos de Rotación Reducidos (PFTRR), será\nde trecientos sesenta y un mil quinientos treinta y\nun colones 00/100 (361.531 colones con 00/100) por hectárea. Actividad de Regeneración Natural: Las condiciones que\nregirán para el trámite de solicitudes, para el reconocimiento de los servicios\nambientales en la actividad de Regeneración Natural, se detallan a\ncontinuación.\n\na) El monto a pagar en Regeneración Natural. será de ciento nueve mil\nciento seis colones con 00/1 00 (¢109.106) por hectárea, desembolsados en cinco\npagos anuales de 20% durante un período de cinco años.\n\n1.2.3. Actividad de Sistemas Agroforestales: Las condiciones que\nregirán para el trámite de solicitudes, para el reconocimiento de los servicios\nambientales en la actividad de Sistemas Agroforestales, se detallan a\ncontinuación.\n\na) El monto a pagar será de novecientos treinta y un colones con 00/100\n(¢931)) por árbol. integrados a Sistemas Agroforestales y desembolsados durante\nun período de cinco años. Los pagos serán distribuidos de la siguiente forma: 50%\nel primer año. 25% el tercero año y 25% el año quinto.\n\nb) El monto a pagar será de mil trescientos setenta y nueve colones con 00/100 (¢1.379) por árbol,\nintegrados a Sistemas Agroforestales, estrictamente con especies nativas contenidas en los Decretos\nEjecutivos N° 25663-MINAE del 8 de octubre de 1996 y N° 25700-MINAE del 15 de noviembre de 1996,\ndesembolsados durante un período de cinco años. Los pagos serán distribuidos de la siguiente forma:\n50% el primer año. 25% el tercer año y 25% el año quinto.\n\nc) El monto a pagar será de mil trescientos setenta y nueve colones con 00/100 (¢1.379) por árbol\nbajo la actividad de Sistemas Agroforestales establecidos en Plantaciones de Aprovechamiento\nForestal (PPAF), financiados mediante el crédito forestal. Los pagos serán distribuidos de la\nsiguiente forma: 80% a la firma del contrato, una vez que los árboles hayan alcanzado los 36 meses\nde edad y 200/0 restante en el año quinto del proyecto cuando los árboles hayan alcanzado los 60\nmeses de edad.\n\n1.2.4. Actividad de Protección de Bosque: Las condiciones que regirán\npara el trámite de solicitudes, para el reconocimiento de los servicios\nambientales en la actividad de Protección de Bosque. se detallan a\ncontinuación:\n\na) El monto a pagar será de ciento setenta mil trescientos doce colones\ncon 00/100 (¢170.312) desembolsados en cinco pagos anuales de 20% durante un\nperíodo de cinco años. Cuando se trate de solicitudes que se ubiquen dentro de\nlas zonas de importancia hídrica, identificadas por el Instituto Costarricense\nde Acueductos y Alcantarillados, la Dirección de Aguas y el Fonafifo, se\nreconocerá un monto adicional de cuarenta y dos mil quinientos setenta y nueve\ncolones con 00/100 (¢42.579) siendo el monto total a pagar por hectárea\ndoscientos doce mil ochocientos noventa y un colon (¢212,891) desembolsados en\ncinco pagos anuales de 20% durante un período de cinco años. Este monto\nadicional se aplicará hasta agotar el presupuesto asignado en esta actividad.\n\n1.2.5. Actividad de Manejo de Bosque. Las condiciones que regirán para el trámite\nde solicitudes para el reconocimiento de\nlos servicios ambientales en la actividad de Manejo de Bosque se detallan a\ncontinuación:\n\na) El monto a pagar\nserá de ciento treinta y tres mil cincuenta siete colones con 00/100\n\n(¢133.057) por hectárea, desembolsados en cinco pagos anuales de 20%\ndurante un período de cinco años.\n\n1.3.Actuaiización de los montos a pagar:\n\nLos montos establecidos por actividad dentro del Programa de Pago por\nServicios Ambientales, se actualizarán anualmente con el Índice de Precios al\nConsumidor (IPC). calculado por el Instituto Nacional de Estadística y Censo\n(INEC), al cierre del período del año anterior.\n\nArtículo 2. Se instruye al Fondo Nacional de Financiamiento Forestal para que\nincorpore en los contratos de Pago por Servicios Ambientales las siguientes\ncondiciones:\n\n2.1.De los plazos de vigencia de los contratos:\n\nLos plazos de vigencia de los contratos de Pago por Servicios\nAmbientales, generados por las actividades que corresponden a las modalidades\nde recuperación y/o mantenimiento de cobertura forestal serán los siguientes:\n\na) Los contratos correspondientes a la actividad de Reforestación\nmediante el establecimiento de las especies de rápido crecimiento, tendrán una\nvigencia de diez años a partir de su firma. Los que incorporen especies de\nmediano crecimiento y las especies nativas contenidas en los Decretos N° 25663-MINAE\ndel 8 de octubre de 1996 y N° 25700-MINAE del 15 de noviembre de 1996, su\nvigencia será de dieciséis años, a partir de su firma y aquellos que incorporen\nvarias especies forestales y con diferentes turnos de cosecha, la vigencia del\ncontrato será igual a la de la especie que tenga el turno más largo de cosecha\ny que éste no exceda de dieciséis años, en cuyo caso éste sería el lapso máximo\nde vigencia.\n\nb) Los contratos correspondientes a la actividad de establecimiento de\nárboles en Sistemas Agroforestales tendrán una vigencia de cinco años a partir\nde su firma. Los contratos correspondientes al programa de Sistemas bajo la\nactividad de Sistemas Agroforestales establecidos en Plantaciones de\nAprovechamiento Forestal (PPAF) tendrán la misma\n\nvigencia sin embargo, dado que ya están plantados se les reconocerán\nretroactivamente tres años por su establecimiento previo.\n\nc) Los contratos correspondientes a la actividad de Protección de Bosque\ntendrán una vigencia de cinco años a partir de su firma.\n\nd) Los contratos correspondientes a la actividad de Regeneración Natural\ntendrán una vigencia de cinco años a partir de su firma.\n\ne) Los contratos correspondientes a la actividad de Manejo de Bosque,\ntendrán una vigencia de cinco años a partir de su firma. De previo a la firma\ndel contrato, deberá constar en el expediente la certificación de que fue\naprobado el plan de manejo, según los Estándares de Sostenibilidad para Manejo\nde Bosques Naturales: Principios, Criterios e Indicadores, Código de Prácticas\ny Manual de Procedimientos, Decreto Ejecutivo N° 27388-MINAE publicado el 2 de\nnoviembre de 1998, y el Decreto Ejecutivo N° 34559-MINAE publicado en La Gaceta\nN° 115, del día 16 de junio de 2008.\n\nf) Los contratos\ncorrespondientes a la subactividad de Plantaciones\nForestales con Turnos de Rotación Reducidos (PFTRR), tendrán una vigencia de seis\naños.\n\n(Así adicionado el inciso anterior por el artículo\n2° de la resolución R-0316 del 31 de agosto de 2017)\n\nArtículo 3. Consideraciones\nEspeciales. Condiciones establecidas para los montos y actividades de las\nsolicitudes PSA:\n\n3.1. Se faculta al Fondo Nacional de Financiamiento Forestal a establecer\nactividades y montos diferenciados a los señalados en esta resolución, de\nconformidad con acuerdos, convenios o contratos o proyectos específicos con\nentidades, que aporten recursos financieros al Programa de Pago por Servicios\nAmbientales, que reconozcan montos y condiciones diferentes a los establecidos\npara los diferentes servicios ambientales; para estos proyectos no aplicarán\nlos criterios de priorización que se detallaron anteriormente, sino los\npactados en cada convenio. Los pagos se realizarán siempre y cuando se tenga\ndisponibilidad presupuestaria para cubrir los compromisos adquiridos mediante\nel Programa de Pago por Servicios Ambientales.\n\n3.2. Los montos pendientes por pagar por contratos de años anteriores,\nse regirán según lo establecido en los Decretos Ejecutivos respectivos para\ncada año.\n\n3.3. Para cubrir el costo de inscripción del contrato ante el Registro\nNacional, el Fondo Nacional de Financiamiento Forestal retendrá en el primer\ndesembolso del monto total del contrato un 0,6%.\n\n3.4. Los recursos correspondientes al pago por servicios ambientales no\nutilizados por el Fonafifo y los recursos recuperados en virtud de los\nincumplimientos de contratos de pago por servicios ambientales, o los\ncorrespondientes a los pagos prescritos, serán depositados en una cuenta, que\nal efecto establezca el Fondo Nacional de Financiamiento Forestal y serán\npresupuestados para la ejecución de nuevas actividades de fomento; tales como\ncréditos forestales.\n\n3.5. El beneficiario de cada contrato deberá contar durante todo el\nplazo del mismo, con un regente forestal debidamente inscrito en el Colegio de\nIngenieros Agrónomos. Salvo en aquellos casos que se haya determinado que el\nproyecto será supervisado directamente por el Fondo Nacional de Financiamiento Forestal.\nSin perjuicio de otras disposiciones, el o los beneficiarios deberán aportar\nuna certificación anual, o un informe de regencia anual emitido por un regente\nforestal para el trámite de pago.\n\nAdicionalmente. para los contratos de Reforestación de rápido\ncrecimiento, deberá presentar los informes de visita, donde certifique el\nestado de los proyectos en los años 8 y 10, a partir de su fecha de plantación\npara los proyectos de mediano crecimiento y otras especies, deberán presentar\ndichos informes al año 8. 12 y 16, a partir de su fecha de plantación.\n\n3.6. Sin perjuicio de otras acciones que representen incumplimiento a\nlas obligaciones del contrato, para los contratos de Reforestación de rápido\ncrecimiento o bloques a partir de los 12 meses y para las plantaciones de\nmediano crecimiento o bloques a partir de los 24 meses de establecida la\nplantación, se considera incumplido el contrato si la plantación no presenta el\ncrecimiento mínimo establecido en el inciso d del punto 1 .2.1 de esta\nresolución, o el indicado de previo en el estudio técnico respectivo para otras\nespecies. Como consecuencia de este incumplimiento, el productor no recibirá el\npago correspondiente a este año, siendo que el Fondo Nacional de Financiamiento\nForestal debe suspender los pagos respectivos y dar por terminado el contrato\ncon responsabilidad para el beneficiario, previo cumplimiento del debido\nproceso.\n\n3.7. Serán motivo de eximente de responsabilidad por incumplimiento del\ncontrato, el caso fortuito, la fuerza mayor, el hecho de un tercero como\neximentes generales. De igual forma, se procederá cuando el propietario de la\nplantación demuestre que una plaga o enfermedad afectó la plantación y que las\nacciones oportunamente realizadas no lograron erradicarla. Se procederá de\nigual manera, cuando el daño sea producto de un incendio que no pudo ser\ncontrolado a pesar de las medidas preventivas reportadas.\n\n3.8. No podrán ejecutarse proyectos en fincas que hayan sido objetos de\nplagas, enfermedades, o incendios y que por esas causas se haya finiquitado el\ncontrato con responsabilidad, el tal supuesto, la finca no podrá ser objeto de\ncontratos en Reforestación y/o SAF en un plazo de 3 años, a partir del último\ncontrato finalizado por esta causa.\n\n3.9. El Fonafifo, será el responsable de monitorear las plantaciones\nforestales que ingresen al Programa, debiendo no solo hacer un seguimiento a\nnivel regional, sino un protocolo de control, mediante un mecanismo aleatorio\nde visitas según su capacidad técnica y administrativa. De igual forma, deberá\ncustodiar la información de las parcelas permanentes de mediciones de las\nplantaciones, a fin de sustentar los pagos y respaldar las fijaciones de\ncarbono y otros gases de efecto invernadero.\n\n3.10. En caso de que en las solicitudes presentadas se determinara la\nexistencia de traslapes o desplazamiento entre ellas y/o con otras fincas, el\nFonafifo valorará de acuerdo a criterios técnicos y legales la aprobación o no\nde las solicitudes de ingreso.\n\n3.11. En el caso de las solicitudes de ingreso presentadas en la\nactividad de protección y que presenten varias fincas; la calificación\ndependerá de la finca de mayor tamaño que se incluya en la solicitud.\n\n3.12. En el caso de las solicitudes de ingreso de\nReforestación y Sistemas Agroforestales que involucren mezclas de especies de\nrápido, mediano y/o en vías de extinción, el valor del contrato dependerá del\nmonto menor establecido en estos tipos de especies.\n\n3.13. Los arreglos de los Sistemas Agroforestales que involucren\nespecies de uso múltiple y maderables deberán realizarse con al menos un 20 %\nde los árboles de especies maderables.\n\n3.14. Para cubrir el\ncosto de inscripción del contrato ante el Registro Nacional, el Fondo Nacional\nde Financiamiento Forestal retendrá en el primer desembolso del monto total del\ncontrato, un 0,6% para las Plantaciones Forestales con Turnos de Rotación\nReducidos (PFTRR).\n\n(Así adicionado el inciso anterior por el artículo\n3° de la resolución R-0316 del 31 de agosto de 2017)\n\n3.15. San José, at nine o'clock on the nineteenth of\nDecember, two thousand sixteen. The amount of hectares to be financed per activity in\nthe Payment for Environmental Services Program, and the amount to be paid based on\nthe resources allocated in the National Budget and approved by the\nComptroller General of the Republic to the aforementioned Fund, the National Conservation\nPolicies, and the prioritization criteria defined by the National\nSystem of Conservation Areas and formalized by the Executive Branch, are established for the National Forest\nFinancing Fund.\n\nWHEREAS\n\nOnly: That the budget allocated for the execution of projects of the Payment for Environmental Services Program to be formalized in the year 2017, is for an\namount of 3,511,817,446.00 (three thousand five hundred eleven million eight hundred\nseventeen thousand four hundred forty-six colones). Said spending plan was\napproved by the Comptroller General of the Republic.\n\nCONSIDERING\n\nFirst: That Article 38 of the Regulation to the Forest Law No. 7575, Executive\nDecree No. 25721-MINAE of October 17, 1996, and its amendments, provides that\nthe Minister of Environment and Energy, as the head of the institution, shall annually issue, by means of a\nMinisterial Resolution, the activities to be financed in the Payment for Environmental Services Program and the amounts to be paid based on the resources allocated\nin the National Budget.\n\nSecond: That the Solís Rivera administration, through the National Development\nPlan Alberto Cañas Escalante 2014-2018, establishes the social solidarity\neconomy as a way to achieve poverty reduction. Under this\nprinciple, financial instruments must be oriented to support the pillars\nof the National Development Plan; not establishing discrimination, but rather\npriority orientation to producer organizations that support\nsmall and medium-sized forest producers; and those located in the cantons\nwith the greatest social lag, considering the objectives of the creation of the National\nForest Financing Fund according to the cited Forest Law, without neglecting\nthe established technical criteria.\n\nThird: That the cited National Development Plan considers as one of the\nnational goals to maintain at least three hundred thousand hectares under the Payment for Environmental Services Program, in its different modalities. Furthermore, it establishes as\none of its challenges: developing innovative\nfinancial instruments and strengthening existing ones, oriented toward sustainable\nforest management, including Protection, Regeneration, and the\nestablishment of Agroforestry Systems and\nForest Plantations, as well as the industrialization and commercialization of\nthe goods and services generated by forest ecosystems.\n\nTHEREFORE:\n\nTHE MINISTER OF ENVIRONMENT AND ENERGY\n\nRESOLVES\n\nArticle 1. To establish the spending limit for the National Forest Financing\nFund, for new projects to be financed by activity and to determine the\npayment amounts per activity.\n\n1.1. Activities to be financed:\n\nFor the year 2017, two modalities will be considered for financing:\na-Recovery of Forest Cover, which includes the activities of\nReforestation, Regeneration, and Agroforestry Systems, and b-Maintenance of\nForest Cover, which includes Protection and Forest Management. In any case, the resources\nused for these purposes must be incorporated into the institutional\nbudget and be approved by the Comptroller General of the Republic.\n\n1.2. Of the payment amounts per activity and other conditions:\n\n1.2.1. Said payments correspond to the total years of the agreed term;\nhowever, in order to allow the establishment of the plantation and its\nmaintenance, payment will be advanced during the first five years.\n\ng) Fonafifo may modify, when so requested, those\ncontracts signed before the year 2006, that demonstrate having achieved a\nminimum production of 13 cubic meters of annual volume per hectare. For\nsuch purposes, Fonafifo may request the information it deems\npertinent.\n\nh) Fonafifo, to verify the data presented in all cases,\nwill require the submission of data from the individual measurements of the\ntrees included in the measurement plots that for such purposes must\nbe established in the reforestation projects.\n\ni) The National System of Conservation Areas must establish a\nplan for the promotion of forest plantations so that the six thousand\ntwo hundred hectares of reforestation, included in this resolution, are\ndistributed in the following manner: Brunca Region\n375 hectares, Central Region 160 hectares, Chorotega Region 2,755\nhectares, Huetar Atlántica Region 504 hectares,\nHuetar Norte Region 1,779, and Central Pacific Region\n908 hectares. If the goal is achieved in any Region, Fonafifo may\nallocate the resources to other regions.\n\n(*)1.2.1.A. Sub-activity called Forest Plantations with Short Rotation Periods\n(PFTRR). The conditions that will govern the processing of requests, for the recognition of\nenvironmental services in the activity of Forest Plantations with short rotation periods,\nwill be the following:\n\na) Of the payment amounts\nper activity and other conditions:\n\nFor the year 2017, the sub-activity of Forest Plantations with Short Rotation Periods (PFTRR) will be included within the Recovery of Forest Cover modality, up to a\nmaximum quantity of 2,000 hectares, which are part of the 6,210 hectares planned for the\nreforestation activity in 2017 with fast-growing species.\n\nb) The amount to be paid\nfor Forest Plantations with Short Rotation Periods (PFTRR), will be\nthree hundred sixty-one thousand five hundred thirty-\none colones 00/100 (361,531 colones with 00/100) per hectare. Natural Regeneration Activity: The conditions that\nwill govern the processing of requests, for the recognition of environmental\nservices in the Natural Regeneration activity, are detailed\nbelow.\n\na) The amount to be paid in Natural Regeneration will be one hundred nine thousand\none hundred six colones with 00/100 (¢109,106) per hectare, disbursed in five\nannual payments of 20% over a five-year period.\n\n1.2.3. Agroforestry Systems Activity: The conditions that\nwill govern the processing of requests, for the recognition of environmental\nservices in the Agroforestry Systems activity, are detailed\nbelow.\n\na) The amount to be paid will be nine hundred thirty-one colones with 00/100\n(¢931) per tree integrated into Agroforestry Systems and disbursed over\na five-year period. The payments will be distributed in the following manner: 50%\nthe first year, 25% the third year, and 25% the fifth year.\n\nb) The amount to be paid will be one thousand three hundred seventy-nine colones with 00/100 (¢1,379) per tree,\nintegrated into Agroforestry Systems, strictly with native species contained in Executive\nDecrees No. 25663-MINAE of October 8, 1996, and No. 25700-MINAE of November 15, 1996,\ndisbursed over a five-year period. The payments will be distributed in the following manner:\n50% the first year, 25% the third year, and 25% the fifth year.\n\nc) The amount to be paid will be one thousand three hundred seventy-nine colones with 00/100 (¢1,379) per tree\nunder the activity of Agroforestry Systems established in Forest Harvest\nPlantations (PPAF), financed through forest credit. The payments will be distributed in the\nfollowing manner: 80% upon signing the contract, once the trees have reached 36 months\nof age, and the remaining 20% in the fifth year of the project when the trees have reached 60\nmonths of age.\n\n1.2.4. Forest Protection Activity: The conditions that will govern\nthe processing of requests, for the recognition of environmental\nservices in the Forest Protection activity, are detailed\nbelow:\n\na) The amount to be paid will be one hundred seventy thousand three hundred twelve colones\nwith 00/100 (¢170,312) disbursed in five annual payments of 20% over a\nfive-year period. In the case of requests located within\nareas of water importance, identified by the Costa Rican Institute\nof Aqueducts and Sewers, the Water Directorate, and Fonafifo, an\nadditional amount of forty-two thousand five hundred seventy-nine\ncolones with 00/100 (¢42,579) will be recognized, making the total amount to be paid per hectare\ntwo hundred twelve thousand eight hundred ninety-one colones (¢212,891) disbursed in\nfive annual payments of 20% over a five-year period. This additional\namount will be applied until the budget allocated for this activity is exhausted.\n\n1.2.5. Forest Management Activity. The conditions that will govern the processing\nof requests for the recognition of\nenvironmental services in the Forest Management activity are detailed\nbelow:\n\na) The amount to be paid\nwill be one hundred thirty-three thousand fifty-seven colones with 00/100\n\n(¢133,057) per hectare, disbursed in five annual payments of 20%\nover a five-year period.\n\n1.3. Updating of payment amounts:\n\nThe amounts established per activity within the Payment for Environmental Services Program will be updated annually using the Consumer Price Index (CPI), calculated by the National Institute of Statistics and Census (INEC), at the close of the previous year's period.\n\nArticle 2. The National Forest Financing Fund is instructed to\nincorporate the following conditions into the Payment for Environmental Services contracts:\n\n2.1. Of the validity periods of the contracts:\n\nThe validity periods of the Payment for Environmental Services\ncontracts, generated by the activities corresponding to the modalities\nof recovery and/or maintenance of forest cover, will be the following:\n\na) Contracts corresponding to the Reforestation activity\nthrough the establishment of fast-growing species will have a\nvalidity of ten years from their signing. Those incorporating medium-growing\nspecies and native species contained in Decrees No. 25663-MINAE\nof October 8, 1996, and No. 25700-MINAE of November 15, 1996, their\nvalidity will be sixteen years from their signing, and for those that incorporate\nseveral forest species with different harvest rotation periods, the validity of the\ncontract will be equal to that of the species with the longest harvest rotation period,\nwhich must not exceed sixteen years, in which case this would be the maximum\nvalidity period.\n\nb) Contracts corresponding to the activity of establishing\ntrees in Agroforestry Systems will have a validity of five years from\ntheir signing. Contracts corresponding to the Systems program under the\nactivity of Agroforestry Systems established in Forest Harvest\nPlantations (PPAF) will have the same\n\nvalidity; however, given that they are already planted, they will be recognized\nretroactively for three years for their prior establishment.\n\nc) Contracts corresponding to the Forest Protection activity\nwill have a validity of five years from their signing.\n\nd) Contracts corresponding to the Natural Regeneration activity\nwill have a validity of five years from their signing.\n\ne) Contracts corresponding to the Forest Management activity\nwill have a validity of five years from their signing. Prior to signing\nthe contract, the file must contain certification that the\nmanagement plan was approved, according to the Sustainability Standards for\nNatural Forest Management: Principles, Criteria and Indicators, Code of Practices\nand Procedures Manual, Executive Decree No. 27388-MINAE published on November\n2, 1998, and Executive Decree No. 34559-MINAE published in La Gaceta\nNo. 115, of June 16, 2008.\n\nf) Contracts\ncorresponding to the sub-activity of Forest\nPlantations with Short Rotation Periods (PFTRR) will have a validity of six\nyears.\n\n(The foregoing subsection thus added by Article\n2 of Resolution R-0316 of August 31, 2017)\n\nArticle 3. Special Considerations. Conditions established for the amounts and activities of the\nPSA requests:\n\n3.1. The National Forest Financing Fund is empowered to establish\nactivities and amounts different from those indicated in this resolution, in\naccordance with agreements, covenants, contracts, or specific projects with\nentities that provide financial resources to the Payment for Environmental Services Program, recognizing amounts and conditions different from those established\nfor the various environmental services; for these projects, the\nprioritization criteria detailed above will not apply, but rather those\nagreed upon in each covenant. Payments will be made provided there is\nbudgetary availability to cover the commitments acquired through\nthe Payment for Environmental Services Program.\n\n3.2. The amounts pending payment for contracts from previous years\nwill be governed by the provisions set forth in the respective Executive Decrees for\neach year.\n\n3.3. To cover the cost of registering the contract with the National\nRegistry, the National Forest Financing Fund will withhold 0.6% from the first\ndisbursement of the total contract amount.\n\n3.4. The resources corresponding to the payment for environmental services\nnot used by Fonafifo and the resources recovered due to\nnon-compliance with payment for environmental services contracts, or those\ncorresponding to prescribed payments, will be deposited into an account\nestablished for this purpose by the National Forest Financing Fund and will be\nbudgeted for the execution of new promotion activities; such as\nforest credits.\n\n3.5. The beneficiary of each contract must have, throughout the entire\nterm of the contract, a forest regent duly registered with the College of\nAgronomists. Except in those cases where it has been determined that the\nproject will be supervised directly by the National Forest Financing Fund.\nWithout prejudice to other provisions, the beneficiary or beneficiaries must provide\nan annual certification, or an annual regency report issued by a forest regent\nfor the payment process.\n\nAdditionally, for fast-growing Reforestation contracts,\nthe beneficiary must submit visit reports certifying the\nstatus of the projects in years 8 and 10 from their planting date;\nfor medium-growing and other species projects, they must submit\nsuch reports in year 8, 12, and 16 from their planting date.\n\n3.6. Without prejudice to other actions that represent non-compliance with\nthe contract obligations, for fast-growing Reforestation contracts or blocks,\nfrom 12 months onward, and for medium-growing\nplantations or blocks, from 24 months after the plantation is established,\nthe contract is considered breached if the plantation does not present the\nminimum growth established in subsection d of point 1.2.1 of this\nresolution, or that previously indicated in the respective technical study for other\nspecies. As a consequence of this non-compliance, the producer will not receive the\npayment corresponding to that year, and the National Forest Financing\nFund must suspend the respective payments and terminate the contract\nwith liability for the beneficiary, after due\nprocess has been followed.\n\n3.7. Grounds for exemption from liability for breach of\ncontract shall be fortuitous events, force majeure, and the act of a third party\nas general exemptions. Similarly, action will be taken when the plantation\nowner demonstrates that a pest or disease affected the plantation and that the\nactions taken in a timely manner failed to eradicate it. The same procedure\nwill apply when the damage is the result of a fire that could not\nbe controlled despite reported preventive measures.\n\n3.8. Projects may not be executed on farms that have been subject to\npests, diseases, or fires and where, for such causes, the\ncontract was terminated with liability; in such a case, the farm may not be subject to\ncontracts for Reforestation and/or SAF for a period of 3 years from the last\ncontract finalized for this cause.\n\n3.9. Fonafifo will be responsible for monitoring the forest plantations\nthat enter the Program, and must not only conduct follow-up\nat the regional level, but also implement a control protocol, through a random\nvisitation mechanism according to its technical and administrative capacity. Similarly, it must\nsafeguard the information from the permanent measurement plots of the\nplantations, in order to support the payments and back the carbon\nfixation and other greenhouse gas determinations.\n\n3.10. In the event that the submitted requests are found to have\noverlaps or displacement among them and/or with other farms,\nFonafifo will assess the approval or rejection\nof the entry requests according to technical and legal criteria.\n\n3.11. In the case of entry requests submitted for the\nprotection activity that include several farms, the qualification\nwill depend on the largest farm included in the request.\n\n3.12. In the case of entry requests for\nReforestation and Agroforestry Systems that involve mixtures of fast-growing, medium-growing, and/or endangered\nspecies, the contract value will depend on the\nlowest amount established for these types of species.\n\n3.13. The arrangements of Agroforestry Systems that involve\nmultiple-use and timber species must be carried out with at least 20%\nof the trees being timber species.\n\n3.14. To cover the\ncost of registering the contract with the National Registry, the National Forest\nFinancing Fund will withhold 0.6% from the first\ndisbursement of the total contract amount for Forest Plantations with Short Rotation\nPeriods (PFTRR).\n\n(The foregoing subsection thus added by Article\n3 of Resolution R-0316 of August 31, 2017)\n\n3.15. The beneficiary of the PFTRR project must have,\nthroughout the entire contract period, a forest regent duly\nregistered with the College of Agronomists,\nwho must report, prior to each payment, the status of the plantation and\nits growth in diameter and height.\n\n(The foregoing subsection thus added by Article\n3 of Resolution R-0316 of August 31, 2017)\n\n3.16. Prior to each\npayment for each PFTRR project, a\ncertification from a forest regent is required, detailing\nthe status of the plantation and confirming that the minimum conditions indicated in\nArticle 1 of this resolution and those established in the Procedure Manual\nfor the Payment of Environmental Services 2009 and its\namendments are met.\n\n(The foregoing subsection thus added by Article\n3 of Resolution R-0316 of August 31, 2017)\n\n3.17. Fonafifo, to verify the data\npresented, will in all cases require the submission of data from the individual\nmeasurements of the trees included in the\nmeasurement plots, which for these purposes must be established in the\nforest plantation projects.\n\n(The foregoing subsection thus added by Article\n3 of Resolution R-0316 of August 31, 2017)\n\nArticle 4.
