1980.\n\nCONSIDERANDO:\n\n1°-Que el artículo 50\nde la Constitución Política establece que el Estado debe garantizar el derecho\nde toda persona a un ambiente sano y ecológicamente equilibrado.\n\n2°- El Parque Nacional Corcovado del Área de Conservación Osa, fue\ncreado mediante Decreto Ejecutivo Nº 5357 del 24 de octubre de 1975, siendo el\nobjetivo principal de su creación, conservar los ecosistemas marinos y terrestres\nexistentes en él, con el fin de mantener el valor ecológico de una de las áreas\nde mayor riqueza en flora y fauna del país. Además asegurar que esta importante\nparte del Patrimonio Cultural suministre beneficios permanentes en educación,\ninvestigación, inspiración y recreación para las actuales y\nfuturas generaciones de costarricenses.\n\n3°- Que nuestro país ha asumido diferentes obligaciones en materia\nambiental por ser signatario de diversos convenios internacionales, tales como\nla Convención sobre el Comercio Internacional de Especies Amenazadas de Fauna y\nFlora Silvestres (CITES), Ley Nº 5605 del 30 de octubre de 1974, Convención\nRelativa a los Humedales de Importancia Internacional especialmente como\nHábitat de A ves Acuáticas (RAMSAR), Ley Nº 7224 del 9 de abril de 1991,\nConvenio sobre Diversidad Biológica y Anexos (Río de Janeiro, 1992), Ley\nNº 7416 del 30 de junio de 1994, Convenio de Conservación de Biodiversidad y\nProtección Áreas Silvestres, Ley Nº 7433 del 14 de setiembre de 1994, Convenio\npara la Protección del Patrimonio Mundial, Cultural y Natural, Ley Nº\n5980 del 16 de noviembre de 1976, Convenio de las Naciones Unidas sobre el\nDerecho del Mar, Ley Nº 7291 del 23 de marzo de 1992, y la Convención para la\nProtección de la Flora, Fauna y Bellezas Escénicas Naturales de los Países de\nAmérica, Ley Nº 3763 del 19 de octubre de 1966.\n\n4°-Que de conformidad con el artículo 30 inciso 6 de la Ley de\nBiodiversidad Nº7788, el Consejo Regional del Área de Conservación Osa, en\nSesión Ordinaria Nº O 1-2013 del 24 de enero de 2013, mediante el Acuerdo Nº\n02, aprobó el Reglamento de Uso Público para el Parque Nacional Corcovado.\n\n5°-Que de conformidad al artículo 12 inciso d) del Reglamento a la Ley\nde Biodiversidad, Decreto Ejecutivo Nº 34433-MINAE, el Consejo Nacional de\nÁreas de Conservación en Sesión Ordinaria Nº 12-2014 del 09 de diciembre del\n2014, mediante Acuerdo Nº 05, aprobó el Reglamento de Uso Público para el\nParque Nacional Corcovado.\n\n6°- Que es obligación del Estado proteger los ecosistemas marinos y\nterrestres de la zona del Pacífico Sur de nuestro país, los cuales presentan\ngran diversidad biológica a lo largo de todo el territorio, especialmente en el\nParque Nacional Corcovado.\n\n7º- Que el Parque Nacional Corcovado es de importancia en cuanto a sus\náreas para la investigación, educación y recreación de sus visitantes.\n\n8º- Que para mantener los diferentes ecosistemas inalterados, se debe\nejercer mayor control del uso público del Parque Nacional Corcovado.\n\n9°- Que en los últimos años la afluencia de visitantes al Parque, se ha\nincrementado considerablemente, lo que amerita una reglamentación urgente sobre\nlas actividades y conductas de los visitantes y guías de turismo.\n\n10º- Que de conformidad con el artículo 3 de la\nLey del Servicio de Parques Nacionales Nº 6084, serán funciones y atribuciones\ndel SINAC, respecto a los Parque Nacionales, todas las que correspondan de la\naplicación de leyes, reglamentos y resoluciones aplicables\n\n11º-Que el Reglamento de Uso Público· del Parque Nacional Corcovado fue\nemitido mediante Decreto Ejecutivo Nº 22477-MIRENEM del 24 de agosto de 1993,\nel cual debe ser derogado para emitir regulación actualizada para el Área\nSilvestre Protegida.\n\n12º- Que de conformidad con el Reglamento a la Ley\nde Protección al Ciudadano del Exceso de Requisitos y Trámites Administrativos,\nDecreto Ejecutivo Nº 37045-MP-MEIC y sus reformas, la presente propuesta cumple\ncon los principios de mejora regulatoria según el informe positivo\nDMR-DAR-INF-146-17 del 11 de octubre de 2017, emitido por el· Departamento de\nAnálisis Regulatorio de la Dirección de Mejora Regulatoria del MEIC. Por tanto,\n\nDECRETAN:\n\n\"Reglamento de uso público del Parque Nacional Corcovado y\nDerogatoria del\n\nDecreto Ejecutivo Nº 22477-MIRENEM del 24 de agosto de 1993\"\n\nCapítulo I\n\nObjeto, Horario y Cierre\n\nArtículo 1° . El presente Reglamento, regula lo referente a las\náreas de uso público en el Parque Nacional Corcovado, siendo obligatorio su\nacatamiento .por los visitantes nacionales y extranjeros, guías de turismo,\nempresarios turísticos, tour operadores, investigadores y otros relacionados\ncon la actividad eco-turística. Así como también; voluntarios, estudiantes y\nfuncionarios del Sistema Nacional de Áreas de Conservación que se encuentren\nfuera de sus labores.\n\n Ficha articulo\n\nArtículo 2º. La atención al público es de las 8:00 a las 16:00 horas; sin embargo,\npuede haber excepciones generadas por las condiciones climáticas, de mareas y\ndistancias, previa autorización de la Administración.\n\n \n\n Ficha articulo\n\nArtículo 3°.Para los efectos del presente reglamento se enlistan las siguientes\ndefiniciones:\n\na) Actividad eco turística: Modalidad ambientalmente responsable\nconsistente en viajar o visitar áreas naturales con el fin de disfrutar y\napreciar la naturaleza (así como cualquier manifestación cultural del presente\ny del pasado), que promueve la conservación, tiene bajo impacto de visitación y\npropicia un involucramiento activo y socioeconómico, en beneficio de las\npoblaciones locales.\n\nb) Administración del Parque: Responsable de aplicar las normas que rigen\nla materia, en lo concerniente a .manejo de Áreas Silvestres Protegidas, así\ncomo de implementar políticas nacionales y ejecutar directrices del Sistema\nNacional de Áreas de Conservación (SINAC).\n\nc) Área Marina: Es la zona geográfica del Parque conformada por\nmar.\n\nd) Área Silvestre Protegida: Espacio geográfico definido, declarado\noficialmente y designado con una categoría de manejo en virtud de su\nimportancia natural, cultural y/o socioeconómica, para cumplir con determinados\nobjetivos de conservación y de gestión.\n\ne) Baqueano: Persona con un amplio conocimiento empírico de un lugar o área determinada,\nque sabe interpretar las características físicas del terreno, esto le permite\nmantenerse orientado para identificar caminos y atajos.\n\nf) Biodiversidad: Variabilidad de organismos vivos de cualquier\nfuente, ya sea que se encuentra en ecosistemas terrestres, aéreos, marinos,\nacuáticos o en otros complejos ecológicos. Comprende la diversidad· dentro de\ncada especie, así como entre las especies y los ecosistemas de los que forma\nparte.\n\ng) Capitán: Persona física con capacidades y conocimientos de motores y embarcaciones,\nencargado de la conducción en los espacios acuáticos\n\nh) Centro Operativo: Instalación necesaria para desarrollar la actividad\nde control y protección, se brinda información al visitante, mediante mapas,\nfolletos, rótulos y otros medios sobre el área protegida.\n\ni) Ecosistema: Complejo dinámico de comunidades de plantas,\nanimales, hongos o microorganismos y su medio físico, interactuando como una\nunidad funcional.\n\nj) Ecosistema dulceacuícola: Complejo dinámico conformado por un\nsistema de agua dulce con ambientes lénticos (aguas quietas como lagos y\nlagunas) y lóticos (aguasen movimiento como ríos y quebradas) donde la\ncomunidad biótica y su medio ambiente abiótico, interactuando como una unidad\nfuncional.\n\nk) Ecosistema marino: Complejo dinámico entre la comunidad marina biótica\ny su medio  ambiente marino\nabiótico, interactuando como una unidad funcional.\n\nl) Embarcaciones de uso administrativo: Conjunto de embarcaciones\npropiedad del Estado o amparadas bajo convenios de cooperación, utilizadas para\nel patrullaje del área marina protegida, la investigación y atención de\nemergencias.\n\nm) Flujo de visitantes: El grado en el cual los visitantes son regulados y\ncontrolados al igual que el nivel de información y los servicios proveídos\npara su disfrute dentro del área silvestre protegida.\n\nn) Guía Local: Es aquella persona que tiene conocimientos básicos\nsobre los sitios turísticos de su localidad, así como de su flora y fauna\nsilvestre y patrimonio cultural de la región. Desarrolla como función principal\nla de mostrarles a los visitantes las riquezas naturales del área protegida,\nacompañándolas y velando por su bienestar.\n\no) Productos: Todo aquello generado directamente por la fauna y\nflora silvestres.\n\np) Programa de Turismo Sostenible de ACOSA (PTS): Programa encargado\nde planificar y ordenar la actividad turística en las áreas silvestres\nprotegidas del ACOSA (Área de Conservación Osa) y coordinar con los\nactores locales el turismo en la zona de influencia de dichas áreas.\n\nq) Residuo: material sólido, semisólido, líquido o gas, cuyo generador o poseedor debe\no requiere deshacerse de él, y que puede o debe ser valorizado o tratado responsablemente\no, en su defecto, ser manejado por sistemas de disposición final adecuados.\n\nr) Ruta: Es un camino que une diferentes lugares geográficos y que le permite a\nlas personas desplazarse de un lugar a otro.\n\ns) Sendero de uso turístico: Es un camino estrecho utilizado para el\ntránsito de personas que puede estar señalado o no y busca acercar a las\npersonas al medio natural y al conocimiento de la zona a través del patrimonio\nnatural.\n\nt) Subproductos: Lo que se deriva de un producto de la fauna o\nflora silvestre mediante un proceso de transformación.\n\nu) Uso Público: El conjunto de actividades y prácticas llevadas a\ncabo por personas locales y visitantes, relacionadas con el recreo, la cultura\ny la educación que son apoyadas por un conjunto de programas, servicios e\ninstalaciones que, independientemente de quien los gestione, deben garantizar\nel manejo adecuado del área silvestre protegida; todo ello con la finalidad de\nacercar a los visitantes a sus valores naturales y culturales de una forma\nordenada, segura y que garantice la conservación y la difusión de tales valores\npor medio de la información, la educación y la interpretación ambiental\n\nv) Tour Operador: Empresa o persona que confecciona y ofrece\npaquetes, productos y servicios turísticos, a personas individuales o grupales.\n\nw) Visitante: Toda\npersona que se desplaza de su lugar habitual de residencia por un periodo, cuya\nfinalidad es la de realizar actividades de ocio, esparcimiento, recreación y\naventura.\n\nx) Zona de Uso Público: Espacios establecidos dentro del Área Silvestre\nProtegida, destinados para que los visitantes realicen actividades de\nrecreativas o de esparcimiento bajo regulaciones definidas por la\nAdministración. En estas zonas se permite la infraestructura de servicios\nnecesaria para el acceso, estadía y disfrute de los visitantes.\n\n \n\n Ficha articulo\n\nArtículo 4º. La colaboración y acatamiento del presente reglamento ayudarán a\nla\n\nprotección de su\nbiodiversidad y al manejo de los recursos por parte de los funcionarios\ndel Parque.\n\nTodas las actividades que se realicen en Ja zona de uso público del\nParque deberán ajustarse a las condiciones contenidas en el Plan General de\nManejo de dicha área silvestre protegida, al presente reglamento de uso\npúblico, a las directrices e instrucciones técnicas y administrativas\nemanadas por el Sistema Nacional de Áreas de Conservación y en general a la\nnormativa jurídica vigente a nivel nacional e internacional en materia\nambiental.\n\n \n\n Ficha articulo\n\nArtículo 5°-Es obligatorio para todo visitante, guía o tour operador, informar de\nsu ingreso al Parque en las casetas de control ubicadas en los siguientes\nsectores: La Leona, Los Patos, San Pedrillo, Estación Sirena, Los Planes. Además,\ndeberá previamente realizar una reservación según se detalle en el Capítulo II\nde éste reglamento y cancelar la tarifa de admisión y los demás rubros\npor concepto del disfrute dentro del Parque contenidos en el Decreto Ejecutivo\nNº 38295-MINAE, sobre tarifas por derechos de ingreso y otros servicios ofrecidos\nen las Áreas Silvestres Protegidas bajo la administración del Sistema Nacional\nde Áreas de Conservación.\n\nDurante su permanencia en el Parque deberá conservar el tiquete de\nadmisión en caso de ser requerido por algún funcionario del área silvestre\nprotegida.\n\n \n\n Ficha articulo\n\nArtículo 6°- La Administración del Parque está facultada para cerrar el ingreso al\npúblico general, parcial o completamente, previa comunicación a los usuarios\ndurante cualquier periodo del año. Justificará esta decisión el mantenimiento\nde la infraestructura, restauración de ecosistemas, condiciones climáticas\nadversas y otros factores que pongan en riesgo la seguridad de los visitantes y\nfuncionarios, o afecten la flora y fauna del Parque, así como el manejo de\néste.\n\n \n\n Ficha articulo\n\nCapitulo II\n\nReservaciones y Condiciones de Visita\n\nArtículo 7º. Los visitantes para ingresar al Parque, deben solicitar la\nreservación de ingreso y de los servicios requeridos por el medio del Área de\nConservación Osa (ACOSA).\n\n \n\n Ficha articulo\n\nArtículo 8º. Para que el visitante ingrese al Parque se establecen las siguientes\ncondiciones:\n\na. Tramitar la reservación respectiva extendida a través de la Oficina\nde reservaciones establecida en el Área de Conservación Osa.\n\nb. Efectuar el pago completo y exacto indicado en la Boleta de\nReservación\n\nc. Todo visitante ingresará al área silvestre protegida (ASP) por los\npuestos de acceso oficiales, preferiblemente acompañado con un guía de turismo\ndebidamente registrado en la oficina de reservaciones del ASP. Los recorridos\nde los senderos Centro Operativo La Leona -Estación Biológica Sirena y\nviceversa, así como Centro Operativo Los Patos -Estación Biológica Sirena y\nviceversa deberá todo visitante hacerse acompañar por un guía de turismo.\n\n(Así reformado el\ninciso anterior por el artículo 1° del decreto ejecutivo N° 41497 del 19 de\nnoviembre del 2018)\n\nd. El tiempo máximo de permanencia es de 5 días, excepto investigadores\ny estudiantes que realicen estudios autorizados por el SIN A C.\n\ne. Reportarse con el personal del Centro Operativo correspondiente,\nprocediendo a su registro y entrega de comprobantes de pago y confirmación de\nreservación antes de iniciar las caminatas. Las excepciones de pago serán\nexclusivamente las contempladas en el Decreto \"Tarifas por derechos de\ningreso y otros servicios ofrecidos en las Áreas Silvestres Protegidas bajo la\nadministración del Sistema Nacional de Áreas de Conservación\" Decreto\nEjecutivo N º 38295-MINAE o la normativa vigente que regule las tarifas de\ningreso al Área Silvestre Protegida (ASP) correspondiente.\n\nf. Se deben portar en todo momento y durante la permanencia en el\nParque, los comprobantes de ingreso cancelados, los cuales podrán exigirse en\ncualquier momento por parte de las autoridades correspondientes.\n\ng. Se permite acampar únicamente en los sitios identificados contiguo a\nlos Centros Operativos o en la Estación Sirena, previa reservación.\n\nh. El visitante sólo podrá transitar por las rutas y senderos destinados\npor la Administración al uso público, debiendo acatar las instrucciones de los\nfuncionarios y que se indique en la rotulación. Sólo los Investigadores,\nfuncionarios o quien la administración considere necesario podrán transitar por\notros sitios, previamente autorizados.\n\ni. Los funcionarios destacados en los Centros Operativos, están\nfacultados para restringir el horario de las caminatas de los visitantes en\ntodos los senderos y rutas, cuando existan condiciones climáticas adversas o\npor disposiciones administrativas.\n\nj. Por la seguridad del visitante no se permitirán los desplazamientos\nnocturnos hacia y para otros Centros Operativos dentro del ASP\n\nk. Ningún visitante o grupo organizado, tendrá derecho a exclusividades\no privilegios, relacionados con la utilización de sitios, servicios o el\ndesarrollo de actividades admitidas.\n\nl. Todo visitante que ingrese al Parque, debe retirar los residuos producidos\npor su persona y los que lo acompañen, condición con la que deberá colaborar el\ntour operador o el guía que preste su servicio.\n\nm. El arribo por mar y el anclaje de embarcaciones sólo se permite\nfrente al Centro Operativo San Pedrillo y Los Naranjos\nen Sirena. En caso de emergencia y al amparo de las leyes internacionales, se\nharán las correspondientes excepciones.\n\nn. La filmación dentro del Parque estará regulada por los\ncorrespondientes reglamentos y decretos tarifarios. Se deberán acatar las disposiciones\nque la Administración del Parque considere pertinentes debidamente comunicados\nmediante circulares del ACOSA.\n\n Ficha articulo\n\nCapítulo III\n\nRutas, Senderos disponibles y Manejo de Flujo de visitantes\n\nArtículo 9°. Se declaran de uso público las siguientes rutas y senderos de uso\nturístico establecidas por la Administración del Parque Nacional Corcovado,\nconsiderando lo dispuesto en el Plan General de Manejo del Parque:\n\na) Ruta La Leona - Sirena y viceversa.\n\nb) Ruta Los Patos - Sirena y viceversa.\n\nc) Senderos de la Estación Biológica Sirena: Río\nClaro, Río Sirena, Los Espaveles, El Guanacaste, Los Naranjos, Sendero\nCorcovado.\n\nd) Senderos del Centro Operativo San Pedrillo: La Catarata, Río Pargo\n(arriba y bajo), Sendero Costero a Río Pargo, Llorona, El Mirador, Sendero\nCostero Los Pavones.\n\ne) Senderos del Centro Operativo Los Patos:\nPlayón del Río Rincón, El Vaco, La Catarata.\n\nf) Senderos del Centro Operativo La Leona: Rio Madrigal, El Barco y La\nChancha.\n\ng) Sendero el Tigre con 8 km, los cuales pasan\npor fincas privadas.\n\nh) Sendero Los Planes con 4 km, pasa por fincas del Instituto Nacional\nde Desarrollo Rural (INDER).\n\nLa Administración del Parque podrá realizar cambios y crear nuevos\nservicios y productos turísticos a ofertar, según lo determinen los resultados\nde la medición del impacto turístico o según la identificación de necesidades\nde la actividad turística dentro del área silvestre protegida, esto bajo\nresolución administrativa la cual conforme a lo dispuesto en los artículos 12 y\n12 bis del Decreto Ejecutivo Nº 37045, será sometida a Control Previo de la Dirección\nde Mejora Regulatoria del Ministerio de Economía, Industria y Comercio, previo\na su implementación.\n\n \n\n Ficha articulo\n\nArtículo 10°. Con el objetivo de asegurar la protección de los\nprocesos ecológicos esenciales del Parque, el administrador del área silvestre\nprotegida mediante resolución administrativa podrá regular el ingreso y el\ndesarrollo o no de ciertas actividades según la medición del impacto de la\nactividad turística en cada sitio.\n\n \n\n Ficha articulo\n\nCapítulo IV\n\nProhibiciones\n\nArtículo 11 º. Dentro de los límites del Parque quedan prohibidas\npara los visitantes, tour operadores y guías de turismo, las siguientes\nactividades:\n\na. Introducir caballos u otros animales de tiro.\n\nb. Utilizar radios u otros equipos de sonido que sobre pase los 65\ndecibeles durante el día y 45 decibeles durante la noche. Esta prohibición se\ncomprobará mediante medidores de nivel de sonido con que cuente el área\nprotegida.\n\nc. Ingresar y consumir licor, drogas, u otra sustancia análoga y fumar.\n\nd. Ingresar con mascotas de cualquier tipo, excepto\nperros guía para no videntes con su respectiva correa.\n\ne. Cocinar o encender fogatas, estará permitido únicamente bajo las\ncondiciones establecidas por la Administración del Parque en situaciones de\nemergencia.\n\nf. Salirse de los senderos para cualquier propósito.\n\ng. Practicar la pesca deportiva, artesanal, de subsistencia y comercial\nen los ecosistemas marinos y dulceacuícolas del Parque.\n\nh. El ingreso con armas de fuego, machetes y otras, así como\nherramientas, arpones, arbaletas, cañas de pescar, explosivos, sustancias\ntóxicas y todo tipo de redes. Para el caso de los guías de turismo están\nautorizados para portar un machete de seguridad no mayor a 20 pulgadas de\ntamaño.\n\ni. Navegar en embarcaciones de cualquier tipo en\nlos ríos del Parque, incluyendo sus desembocaduras. Excepto en casos de\ninvestigaciones aprobados por el SINAC u otros casos específicos que la\nadministración considere, esto bajo resolución administrativa.·\n\nj. Realizar las actividades de snorkeling, kayak, sarf y nadar en las\ndesembocaduras de los ríos y otros lugares identificados.\n\nk. Rayar, marcar, manchar o provocar cualquier\ntipo de daño o deterioro a las plantas, árboles, rótulos, rocas, equipos e\ninstalaciones del Parque Nacional.\n\nl. Recolectar o extraer rocas, corales, conchas\no cualquier otro producto o subproducto existentes en el Parque Nacional.\n\nm. Introducir animales o plantas exóticas.\n\nn. Realizar cualquier tipo de actividad comercial no autorizada por la\nAdministración.\n\no. Extraer material biológico, mineral, animal, plantas productos o\nsubproductos de ellos.\n\np. Acosar a la fauna o realizar cualquier actividad o\nacción que perturbe o altere el comportamiento de los animales.\n\nq. Manipular animales o plantas, provocando cualquier\ncambio que altere su hábitat o comportamiento.\n\nr. Dejar cualquier tipo de residuos.\n\ns. Alimentar los animales.\n\nt. Entrar con vehículos motorizados y bicicletas, a\nexcepción de lanchas y aeronaves en las áreas definidas y autorizadas por la\nAdministración del Parque para este fin.\n\nu. Sobrevolar el Parque a menos de 500 pies (150m) de altura, excepto en\nel área de aproximación del aeropuerto en Sirena.\n\nv. Realizar filmaciones con fines comerciales, sin previa autorización\ndel Área de Conservación Osa.\n\nw. Ingresar con alimentos y/o bebidas de cualquier tipo,\ncon las excepciones y bajo las condiciones -que establezca la Administración\ndel Parque vía resolución administrativa.\n\nx. Consumir alimentos en sitios no autorizados por la Administración.\n\ny. Ingresar a centros operativos del Parque Nacional Corcovado con\nreservaciones autorizadas de otros centros de operativos del Parque u otras\nÁreas Protegidas. Excepto en casos de emergencias o fuerza mayor, debidamente\nautorizados por el Jefe del Centro Operativo o el Administrador del Parque\nNaciona1.\n\nz. Otras que en su momento la Administración considere\npertinentes y establezca vía resolución administrativa debidamente\nfundamentada.\n\n \n\n Ficha articulo\n\nCapítulo V\n\nFunciones, obligaciones y responsabilidad civil de los tour operadores\nde turismo y\n\nguías\n\nArtículo 12 º . Funciones y Obligaciones.\n\nl. FUNCIONES DE CONSERVACIÓN:\n\na) Cumplir y hacer del conocimiento a los visitantes o visitantes a su\ncargo, de las reglamentaciones vigentes en la legislación del Parque.\n\nb) Motivar en los visitantes una actitud de respeto y aprecio hacia la\nnaturaleza en general y hacia las áreas protegidas en particular.\n\nc) Difundir los objetivos e importancia del Parque\nNacional Corcovado y del Sistema Nacional de Áreas de Conservación.\n\nd) Motivar el interés de los visitantes en los recursos naturales,\nmarinos y culturales del área de influencia.\n\ne) Velar porque los visitantes mantengan una conducta adecuada, evitando\nla alteración de la flora, fauna y de los sitios arqueológicos y marinos,\nmediante la aplicación de usos y prácticas de impacto mínimo.\n\nf) No transitar ni abrir áreas, senderos o recorridos\nno autorizados por la Administración del área.\n\n2. OBLIGACIONES DE SERVICIO:\n\na) Portar en un lugar visible la Credencial Identificadora otorgada por\nel lCT cuando corresponda, y mostrarla a los funcionarios del Parque\nNacional para ser incluido en el registro oficial del área protegida, cuando\nsea requerido notificar de inmediato al ICT su pérdida.\n\nb) Acompañar al grupo en forma permanente durante todo el transcurso del\nrecorrido.\n\nc) El Guía, como colaborador de la protección del ambiente, se encuentra\nobligado a informar fehacientemente a la Administración del Parque toda\nanormalidad, irregularidad o circunstancia que considere relevante o cometida\npor las personas a su cargo.\n\nd) Aportar información relativa a las actividades que\ndesarrolla y/o vinculadas al avistamiento de flora y fauna y/o sobre otros\naspectos de interés para la Administración del Parque.\n\ne) Colaborar en la recolección de residuos que se\ngeneren durante el desarrollo de su actividad, debiéndose retirar los mismos\nfuera del Parque.\n\nt) Emplear una vestimenta que los distinga de los\nfuncionarios del SINAC y vestirla de modo decoroso. Queda prohibido a los guías\nde turismo, tour operadores u otro, el uso de insignias, colores de uniformes u\notros distintivos similares a los oficiales de los funcionarios del SINAC\n\ng) Será obligación para guías, baquianos, tour operadores, estar\ninscritos como contribuyente en el Ministerio Hacienda y como asegurado o\npatrono en la Caja Costarricense de Seguro Social y estar al día en las cuotas\ncorrespondientes.\n\nh) Contar con la póliza de riesgos requerida.\n\n \n\n Ficha articulo\n\nArtículo 13°. Furthermore, to ensure that this important\npart of the Cultural Heritage provides permanent benefits in education,\nresearch, inspiration, and recreation for current and\nfuture generations of Costa Ricans.\n\n3°— That our country has assumed various obligations in environmental\nmatters as a signatory to diverse international conventions, such as\nthe Convention on International Trade in Endangered Species of Wild Fauna and\nFlora (CITES), Law No. 5605 of October 30, 1974, the Convention\non Wetlands of International Importance especially as\nWaterfowl Habitat (RAMSAR), Law No. 7224 of April 9, 1991,\nthe Convention on Biological Diversity and Annexes (Rio de Janeiro, 1992), Law\nNo. 7416 of June 30, 1994, the Convention for the Conservation of Biodiversity and\nProtection of Wilderness Areas, Law No. 7433 of September 14, 1994, the Convention\nfor the Protection of the World Cultural and Natural Heritage, Law No.\n5980 of November 16, 1976, the United Nations Convention on the\nLaw of the Sea, Law No. 7291 of March 23, 1992, and the Convention for the\nProtection of the Flora, Fauna, and Natural Scenic Beauties of the Countries of\nAmerica, Law No. 3763 of October 19, 1966.\n\n4°—That in accordance with Article 30 subsection 6 of the Biodiversity Law\nNo. 7788, the Regional Council of the Osa Conservation Area, in\nOrdinary Session No. 01-2013 of January 24, 2013, through Agreement No.\n02, approved the Public Use Regulations for Corcovado National Park.\n\n5°—That in accordance with Article 12 subsection d) of the Regulations to the Biodiversity Law,\nExecutive Decree No. 34433-MINAE, the National Council of\nConservation Areas in Ordinary Session No. 12-2014 of December 9,\n2014, through Agreement No. 05, approved the Public Use Regulations for\nCorcovado National Park.\n\n6°— That it is the obligation of the State to protect the marine and\nterrestrial ecosystems of the South Pacific zone of our country, which present\ngreat biological diversity throughout the entire territory, especially in\nCorcovado National Park.\n\n7º— That Corcovado National Park is important regarding its\nareas for research, education, and recreation for its visitors.\n\n8º— That to keep the different ecosystems unaltered, greater\ncontrol over the public use of Corcovado National Park must be exercised.\n\n9°— That in recent years, the influx of visitors to the Park has\nincreased considerably, which warrants urgent regulation on\nthe activities and conduct of visitors and tourism guides.\n\n10º— That in accordance with Article 3 of the\nNational Parks Service Law No. 6084, the functions and powers\nof SINAC, regarding National Parks, shall be all those corresponding to the\napplication of applicable laws, regulations, and resolutions.\n\n11º—That the Public Use Regulations for Corcovado National Park were\nissued through Executive Decree No. 22477-MIRENEM of August 24, 1993,\nwhich must be repealed to issue updated regulation for the Protected Wilderness Area.\n\n12º— That in accordance with the Regulations to the Law\nfor the Protection of Citizens from Excessive Requirements and Administrative Procedures,\nExecutive Decree No. 37045-MP-MEIC and its amendments, this proposal complies\nwith the principles of regulatory improvement according to the positive report\nDMR-DAR-INF-146-17 of October 11, 2017, issued by the Regulatory\nAnalysis Department of the Regulatory Improvement Directorate of MEIC. Therefore,\n\nDECREE:\n\n\"Public Use Regulations for Corcovado National Park and\nRepeal of\n\nExecutive Decree No. 22477-MIRENEM of August 24, 1993\"\n\nChapter I\n\nObjective, Hours, and Closure\n\nArticle 1°. These Regulations regulate matters concerning the\npublic use areas in Corcovado National Park, and compliance is mandatory\nfor national and foreign visitors, tourism guides,\ntourism entrepreneurs, tour operators, researchers, and others related\nto the eco-tourism activity. As well as volunteers, students, and\nofficials of the National System of Conservation Areas who are\noff-duty.\n\n Article record\n\nArticle 2º. Public service hours are from 8:00 a.m. to 4:00 p.m.; however,\nthere may be exceptions due to weather, tide, and\ndistance conditions, with prior authorization from the Administration.\n\n \n\n Article record\n\nArticle 3°. For the purposes of these regulations, the following\ndefinitions are listed:\n\na) Eco-tourism activity (Actividad eco turística): An environmentally responsible modality\nconsisting of traveling to or visiting natural areas for the purpose of enjoying and\nappreciating nature (as well as any cultural manifestation of the present\nand past), which promotes conservation, has a low visitation impact, and\nfosters active and socio-economic involvement for the benefit of\nlocal populations.\n\nb) Park Administration (Administración del Parque): The entity responsible for applying the norms governing\nthe matter, regarding the management of Protected Wilderness Areas, as well\nas implementing national policies and executing guidelines from the National\nSystem of Conservation Areas (SINAC).\n\nc) Marine Area (Área Marina): The geographical zone of the Park comprised of\nsea.\n\nd) Protected Wilderness Area (Área Silvestre Protegida): A defined geographical space, officially declared\nand designated with a management category by virtue of its\nnatural, cultural, and/or socio-economic importance, to fulfill specific\nconservation and management objectives.\n\ne) Baqueano: A person with extensive empirical knowledge of a specific place or area,\nwho knows how to interpret the physical characteristics of the terrain, allowing them\nto stay oriented to identify paths and shortcuts.\n\nf) Biodiversity (Biodiversidad): The variability of living organisms from any\nsource, whether found in terrestrial, aerial, marine,\naquatic, or other ecological complexes. It includes the diversity within\neach species, as well as between species and the ecosystems they are part\nof.\n\ng) Captain (Capitán): A natural person with the skills and knowledge of engines and vessels,\nresponsible for navigation in aquatic spaces.\n\nh) Operating Center (Centro Operativo): A facility necessary for developing control\nand protection activities; information is provided to the visitor through maps,\nbrochures, signs, and other means about the protected area.\n\ni) Ecosystem (Ecosistema): A dynamic complex of communities of plants,\nanimals, fungi, or microorganisms and their physical environment, interacting as a\nfunctional unit.\n\nj) Freshwater ecosystem (Ecosistema dulceacuícola): A dynamic complex formed by a\nfreshwater system with lentic (still waters like lakes and\nlagoons) and lotic (moving waters like rivers and streams) environments where the\nbiotic community and its abiotic environment interact as a\nfunctional unit.\n\nk) Marine ecosystem (Ecosistema marino): A dynamic complex between the marine biotic community\nand its abiotic marine environment, interacting as a functional unit.\n\nl) Vessels for administrative use (Embarcaciones de uso administrativo): A set of vessels\nowned by the State or covered under cooperation agreements, used for\npatrolling the protected marine area, research, and emergency\nresponse.\n\nm) Visitor flow (Flujo de visitantes): The degree to which visitors are regulated and\ncontrolled, as well as the level of information and services provided\nfor their enjoyment within the protected wilderness area.\n\nn) Local Guide (Guía Local): That person who has basic knowledge\nabout the tourist sites of their locality, as well as its wild flora and\nfauna and cultural heritage of the region. Their main function is\nto show visitors the natural riches of the protected area,\naccompanying them and ensuring their well-being.\n\no) Products (Productos): Everything generated directly by wild fauna and\nflora.\n\np) ACOSA Sustainable Tourism Program (Programa de Turismo Sostenible de ACOSA, PTS): The program responsible\nfor planning and organizing tourism activity in the protected wilderness\nareas of ACOSA (Osa Conservation Area) and coordinating with\nlocal actors tourism in the zone of influence of said areas.\n\nq) Waste (Residuo): Solid, semi-solid, liquid, or gaseous material, which its generator or possessor must\nor needs to dispose of, and which can or should be responsibly valorized or treated,\nor failing that, managed by adequate final disposal systems.\n\nr) Route (Ruta): A path that connects different geographical locations and allows\npeople to move from one place to another.\n\ns) Tourist trail (Sendero de uso turístico): A narrow path used for\nthe transit of people, which may or may not be marked, and seeks to bring\npeople closer to the natural environment and knowledge of the area through natural\nheritage.\n\nt) By-products (Subproductos): That which is derived from a product of wild fauna or\nflora through a transformation process.\n\nu) Public Use (Uso Público): The set of activities and practices carried\nout by local people and visitors, related to recreation, culture,\nand education, which are supported by a set of programs, services, and\nfacilities that, regardless of who manages them, must guarantee\nthe adequate management of the protected wilderness area; all with the purpose of\nbringing visitors closer to its natural and cultural values in an orderly,\nsafe manner that guarantees the conservation and dissemination of such values\nthrough information, education, and environmental interpretation.\n\nv) Tour Operator (Tour Operador): A company or person that creates and offers\ntourist packages, products, and services to individuals or groups.\n\nw) Visitor (Visitante): Any\nperson who travels from their usual place of residence for a period, whose\npurpose is to carry out leisure, recreation, and\nadventure activities.\n\nx) Public Use Zone (Zona de Uso Público): Spaces established within the Protected Wilderness\nArea, intended for visitors to carry out\nrecreational activities under regulations defined by the\nAdministration. In these zones, the service infrastructure\nnecessary for access, stay, and enjoyment of visitors is permitted.\n\n \n\n Article record\n\nArticle 4º. Collaboration and compliance with these regulations will aid in the\n\nprotection of its\nbiodiversity and the management of resources by Park\nofficials.\n\nAll activities carried out in the public use zone of the\nPark must conform to the conditions contained in the General Management\nPlan of said protected wilderness area, to these public use\nregulations, to the technical and administrative guidelines and instructions\nissued by the National System of Conservation Areas, and in general to the\ncurrent legal regulations at the national and international level on environmental\nmatters.\n\n \n\n Article record\n\nArticle 5°—It is mandatory for every visitor, guide, or tour operator to report\ntheir entry to the Park at the control posts located in the following\nsectors: La Leona, Los Patos, San Pedrillo, Estación Sirena, Los Planes. Furthermore,\nthey must previously make a reservation as detailed in Chapter II\nof these regulations and pay the admission fee and other charges\nfor the enjoyment within the Park contained in Executive Decree\nNo. 38295-MINAE, on fees for entry rights and other services offered\nin the Protected Wilderness Areas under the administration of the National System\nof Conservation Areas.\n\nDuring their stay in the Park, they must keep the admission\nticket in case it is required by any official of the protected wilderness\narea.\n\n \n\n Article record\n\nArticle 6°— The Park Administration is empowered to close entry to the\ngeneral public, partially or completely, with prior communication to users\nduring any period of the year. This decision will be justified by\ninfrastructure maintenance, ecosystem restoration, adverse\nweather conditions, and other factors that jeopardize the safety of visitors and\nofficials, or affect the flora and fauna of the Park, as well as its\nmanagement.\n\n \n\n Article record\n\nChapter II\n\nReservations and Visitation Conditions\n\nArticle 7º. Visitors, to enter the Park, must request the\nentry reservation and required services through the Osa\nConservation Area (ACOSA).\n\n \n\n Article record\n\nArticle 8º. For the visitor to enter the Park, the following\nconditions are established:\n\na. Process the respective reservation issued through the Reservation\nOffice established in the Osa Conservation Area.\n\nb. Make the full and exact payment indicated on the Reservation\nVoucher.\n\nc. Every visitor shall enter the protected wilderness area (ASP) through\nthe official access posts, preferably accompanied by a tourism guide\nduly registered with the ASP reservation office. The hikes\non the trails La Leona Operating Center -Sirena Biological Station and\nvice versa, as well as Los Patos Operating Center -Sirena Biological Station and\nvice versa, every visitor must be accompanied by a tourism guide.\n\n(Thus amended the\nprevious subsection by Article 1 of Executive Decree No. 41497 of November 19,\n2018)\n\nd. The maximum length of stay is 5 days, except for researchers\nand students conducting studies authorized by SINAC.\n\ne. Report to the staff of the corresponding Operating Center,\nproceeding to register and submit proof of payment and reservation\nconfirmation before starting the hikes. Payment exceptions shall be\nexclusively those contemplated in the Decree \"Fees for entry rights\nand other services offered in the Protected Wilderness Areas under the\nadministration of the National System of Conservation Areas\" Executive\nDecree No. 38295-MINAE or the current regulations governing the entry\nfees for the corresponding Protected Wilderness Area (ASP).\n\nf. The paid entry receipts must be carried at all times and during the stay in the\nPark, which may be demanded at\nany time by the corresponding authorities.\n\ng. Camping is only permitted in the identified sites adjacent to\nthe Operating Centers or at Sirena Station, with a prior reservation.\n\nh. The visitor may only transit on the routes and trails designated by\nthe Administration for public use, and must obey the instructions of the\nofficials and those indicated on signage. Only Researchers,\nofficials, or whoever the administration deems necessary may transit through\nother sites, with prior authorization.\n\ni. Officials stationed at the Operating Centers are\nempowered to restrict the visiting hours for hikes on\nall trails and routes, when there are adverse weather conditions or\nby administrative provisions.\n\nj. For the visitor's safety, nighttime movements\nto and from other Operating Centers within the ASP are not permitted.\n\nk. No visitor or organized group shall have the right to exclusivities\nor privileges related to the use of sites, services, or the\ndevelopment of permitted activities.\n\nl. Every visitor entering the Park must remove the waste produced\nby themselves and their companions, a condition with which the\ntour operator or guide providing their service must collaborate.\n\nm. Arrival by sea and vessel anchoring is only permitted\nin front of the San Pedrillo Operating Center and Los Naranjos\nin Sirena. In case of emergency and under the protection of international laws, the\ncorresponding exceptions shall be made.\n\nn. Filming within the Park shall be regulated by the\ncorresponding regulations and fee decrees. The provisions\nthat the Park Administration deems pertinent, duly communicated\nthrough ACOSA circulars, must be obeyed.\n\n Article record\n\nChapter III\n\nRoutes, Available Trails, and Visitor Flow Management\n\nArticle 9°. The following routes and tourist trails are declared for public use,\nestablished by the Administration of Corcovado National Park,\nconsidering the provisions of the Park's General Management Plan:\n\na) La Leona - Sirena Route and vice versa.\n\nb) Los Patos - Sirena Route and vice versa.\n\nc) Sirena Biological Station Trails: Río\nClaro, Río Sirena, Los Espaveles, El Guanacaste, Los Naranjos, Sendero\nCorcovado.\n\nd) San Pedrillo Operating Center Trails: La Catarata, Río Pargo\n(upstream and downstream), Sendero Costero to Río Pargo, Llorona, El Mirador, Sendero\nCostero Los Pavones.\n\ne) Los Patos Operating Center Trails:\nPlayón del Río Rincón, El Vaco, La Catarata.\n\nf) La Leona Operating Center Trails: Rio Madrigal, El Barco, and La\nChancha.\n\ng) El Tigre Trail, 8 km long, which passes\nthrough private farms.\n\nh) Los Planes Trail, 4 km long, passes through farms of the National Institute\nof Rural Development (INDER).\n\nThe Park Administration may make changes and create new\ntourist services and products to offer, as determined by the results\nof measuring tourism impact or based on the identification of needs\nof the tourism activity within the protected wilderness area, this by\nadministrative resolution which, in accordance with the provisions of Articles 12 and\n12 bis of Executive Decree No. 37045, shall be submitted for Prior Control by the Regulatory\nImprovement Directorate of the Ministry of Economy, Industry, and Commerce, prior\nto its implementation.\n\n \n\n Article record\n\nArticle 10°. In order to ensure the protection of the\nessential ecological processes of the Park, the administrator of the protected wilderness\narea, by administrative resolution, may regulate the entry and the\ndevelopment or not of certain activities based on the measurement of the impact of\ntourist activity at each site.\n\n \n\n Article record\n\nChapter IV\n\nProhibitions\n\nArticle 11º. Within the limits of the Park, the following\nactivities are prohibited for visitors, tour operators, and tourism guides:\n\na. Introducing horses or other draft animals.\n\nb. Using radios or other sound equipment exceeding 65\ndecibels during the day and 45 decibels at night. This prohibition shall\nbe verified by sound level meters available in the protected\narea.\n\nc. Entering with and consuming liquor, drugs, or other analogous substances, and smoking.\n\nd. Entering with pets of any kind, except\nguide dogs for the blind with their respective leash.\n\ne. Cooking or lighting campfires is only permitted under the\nconditions established by the Park Administration in\nemergency situations.\n\nf. Leaving the trails for any purpose.\n\ng. Practicing sport, artisanal, subsistence, and commercial fishing\nin the marine and freshwater ecosystems of the Park.\n\nh. Entry with firearms, machetes, and other weapons, as well as\ntools, harpoons, spearguns, fishing rods, explosives, toxic\nsubstances, and all types of nets. In the case of tourism guides, they are\nauthorized to carry a safety machete no larger than 20 inches in\nsize.\n\ni. Navigating vessels of any type on\nthe rivers of the Park, including their mouths. Except in cases of\nresearch approved by SINAC or other specific cases that the\nadministration deems necessary, this by administrative resolution.\n\nj. Carrying out snorkeling, kayaking, surfing, and swimming activities at the\nmouths of rivers and other identified locations.\n\nk. Scratching, marking, staining, or causing any\ntype of damage or deterioration to plants, trees, signs, rocks, equipment, and\nfacilities of the National Park.\n\nl. Collecting or extracting rocks, corals, shells,\nor any other product or by-product existing in the National Park.\n\nm. Introducing exotic animals or plants.\n\nn. Conducting any type of commercial activity not authorized by the\nAdministration.\n\no. Extracting biological, mineral, animal, or plant material, or products or\nby-products thereof.\n\np. Harassing wildlife or performing any activity or\naction that disturbs or alters the behavior of animals.\n\nq. Handling animals or plants, causing any\nchange that alters their habitat or behavior.\n\nr. Leaving any type of waste.\n\ns. Feeding the animals.\n\nt. Entering with motor vehicles and bicycles, with the\nexception of boats and aircraft in the areas defined and authorized by the\nPark Administration for this purpose.\n\nu. Flying over the Park at less than 500 feet (150m) altitude, except in\nthe approach area of the airport in Sirena.\n\nv. Making films for commercial purposes, without prior authorization\nfrom the Osa Conservation Area.\n\nw. Entering with food and/or beverages of any type,\nwith the exceptions and under the conditions established by the Park\nAdministration via administrative resolution.\n\nx. Consuming food in sites not authorized by the Administration.\n\ny. Entering operating centers of Corcovado National Park with\nauthorized reservations from other Park operating centers or other\nProtected Areas. Except in cases of emergencies or force majeure, duly\nauthorized by the Head of the Operating Center or the Administrator of the National\nPark.\n\nz. Other activities that the Administration deems\npertinent at the time and establishes via a duly substantiated administrative\nresolution.\n\n \n\n Article record\n\nChapter V\n\nFunctions, Obligations, and Civil Liability of Tourism Tour Operators\nand\n\nGuides\n\nArticle 12º. Functions and Obligations.\n\n1. CONSERVATION FUNCTIONS:\n\na) Comply with and inform the visitors or visitors in their\ncharge of the regulations in force in the Park's legislation.\n\nb) Motivate in visitors an attitude of respect and appreciation towards\nnature in general and towards protected areas in particular.\n\nc) Disseminate the objectives and importance of Corcovado\nNational Park and the National System of Conservation Areas.\n\nd) Stimulate visitors' interest in the natural,\nmarine, and cultural resources of the zone of influence.\n\ne) Ensure that visitors maintain appropriate behavior, avoiding\nthe alteration of flora, fauna, and archaeological and marine sites,\nthrough the application of minimal impact uses and practices.\n\nf) Not to transit or open areas, trails, or routes\nnot authorized by the Administration of the area.\n\n2. SERVICE OBLIGATIONS:\n\na) Wear in a visible place the Identification Credential granted by\nthe ICT when applicable, and show it to the National Park\nofficials for inclusion in the official registry of the protected area. When\nrequired, immediately notify the ICT of its loss.\n\nb) Accompany the group permanently throughout the entire\ntour.\n\nc) The Guide, as a collaborator in environmental protection, is\nobligated to reliably inform the Park Administration of any\nanomaly, irregularity, or circumstance they deem relevant or committed\nby the persons in their charge.\n\nd) Provide information relating to the activities they\ncarry out and/or linked to the sighting of flora and fauna and/or other\naspects of interest to the Park Administration.\n\ne) Collaborate in the collection of waste\ngenerated during their activity, which must be removed\noutside the Park.\n\nf) Wear attire that distinguishes them from\nSINAC officials and dress it in a decorous manner. Tourism guides,\ntour operators, or others are prohibited from using insignias, uniform colors, or\nother distinctive items similar to the official ones of SINAC officials.\n\ng) It shall be an obligation for guides, baqueanos, tour operators to be\nregistered as taxpayers with the Ministry of Finance and as insured or\nemployer with the Costa Rican Social Security Fund (Caja Costarricense de Seguro Social) and to be up to date on the corresponding\nquotas.\n\nh) Have the required risk insurance policy.\n\n \n\n Article record\n\nArticle 13°. Civil liability. Corcovado National Park and the National\nSystem of Conservation Areas are not responsible for the damages and\nlosses that persons or their belongings may suffer as a\nconsequence of practicing the activities carried out within their jurisdictional\nscope.\n\nThe Administration of the area is unrelated to the private legal relationship\nestablished between the tour operator or Guide and whoever contracts their services, as well as\nto the civil, commercial, criminal, and/or any other legal\nand/or administrative consequences that may derive from it.\n\nRegardless of administrative sanctions, tourism tour operators\nand guides shall be criminally and civilly liable for damages and\nlosses caused to the natural heritage of the State.\n\n \n\n Article record\n\nArticle 14°. Every visitor, tourism guide, captain, or tour\noperator must comply, within the limits of the Park, with any other\nregulation or request from officials that is established in order to protect\nthe natural resources or the physical integrity of the visitors.\n\n \n\n Article record\n\nChapter VI\n\nFinal Provisions\n\nArticle 15°. Repeal. Executive Decree No.\n22477-MIRENEM of August 24, 1993 is hereby repealed.\n\n Article record\n\nTransitory I. The mechanism for\nrequesting the reservation established in Article 7, for entry and\nrequired services, shall be established via administrative resolution within\none month following the publication of this executive decree, which,\nin accordance with the provisions of Articles 12 and 12 bis of Executive Decree\nNo. 37045, shall be submitted for Prior Control by the Regulatory Improvement Directorate\nof the Ministry of Economy, Industry, and Commerce. Once approved by said\nDirectorate, it shall be signed and published in the Official Gazette La Gaceta and on\nthe website of the National System of Conservation Areas www.sinac.go.cr and\nother electronic means as determined.\n\n Article record\n\nTransitory II. The Administration\nof the Conservation Area, together with the Financial Department of the\nExecutive Secretariat of SINAC, shall establish the conditions and the mechanism for\nthe process of refunding money resulting from reservations. The resolution\nfor this purpose, in accordance with the provisions of Articles 12 and 12 bis of Executive\nDecree No. 37045, shall be submitted for Prior Control by the Regulatory Improvement\nDirectorate of the Ministry of Economy, Industry, and Commerce.
