Ley de Biodiversidad Nº 7788 del 30 de abril de 1998.\n\nConsiderando:\n\nI.-Que desde el\naño 1945 Costa Rica forma parte de los Estados Miembros de las Naciones Unidas\ny es integrante activo de la Organización de las Naciones Unidas para la\nEducación, la Ciencia y la Cultura (UNESCO).\n\nII.-Que la misión\nde la UNESCO es \"(...) contribuir a la consolidación de la paz, la\nerradicación de la pobreza, el desarrollo sostenible y el diálogo intercultural\nmediante la educación, las ciencias, la cultura, la comunicación y la\ninformación\".\n\nIII.-Que el\nPrograma sobre el Ser humano y la Biosfera (MAB), fue creado por la UNESCO\nsegún Resolución Nº 2313 en el año 1971, como un programa interdisciplinario a\nlargo plazo.\n\nIV.-Que la visión\ndel Programa MAB es \"Un mundo en el que las personas sean conscientes de su\nfuturo común y de la interacción con nuestro planeta, y actuar de manera\ncolectiva y responsable para construir una sociedad próspera en armonía con la\nbiosfera. El Programa MAB y su Red Mundial de Reservas de Biosfera trabajan por\nesta visión dentro y fuera de las reservas de biosfera\".\n\nV.-Que el\nPrograma MAB, en su Estrategia de Sevilla, adoptado bajo la Resolución Nº 28\nC/2.4 de la Conferencia General de la UNESCO en noviembre de 1995, recomienda a\nlos Estados \"Velar por que cada reserva de biosfera disponga de una política\no un plan de gestión y tenga una autoridad o un mecanismo para aplicarlos\" (Objetivo\nII.2), así como \"Establecer un órgano nacional de asesoramiento y\ncoordinación de las reservas de biosfera, tener plenamente en cuenta sus\nrecomendaciones y orientaciones\" (Objetivo IV.2).\n\nVI.-Que las Reservas\nde Biosfera constituyen una designación internacional avalada por el Estado,\nque otorga la UNESCO mediante el Programa MAB, a espacios de ecosistemas\nterrestres y marinos reconocidos así, como lugares de excelencia para la\ndemostración del desarrollo sostenible y en donde la gente comparte una forma\nde vivir con la naturaleza forjando un futuro del que se sientan orgullosos.\n\nVII.-Que la\nComisión Costarricense de Cooperación con la UNESCO (CCCU) sirve de enlace para\nla coordinación y el desarrollo de acciones de la UNESCO en Costa Rica, según\nlo señalado en el Decreto Nº 34276-MECJD-MICIT-MINAE-RE, valiéndose de\ncomisiones de trabajo multidisciplinarias voluntarias para el desarrollo de sus\nobjetivos como lo son la Comisión de Educación, Comisión de Juventud, Comité de\ntransformaciones sociales, Comité Ser humano y la Biosfera (MAB).\n\nVIII.-Que Costa\nRica participa en el Programa MAB, ante el cual ha solicitado la designación de\ntres Reservas de Biosferas: La Amistad designada en 1982, evaluada y ampliada\nen el año 2015; Cordillera Volcánica Central designada en 1988 evaluada y\nampliada en 2010, y, Agua y Paz designada en el año 2007.\n\nIX.-Que\nadicionalmente, el Consejo internacional de Coordinación del Programa sobre \"El\nHombre y biosfera\" de la UNESCO en junio de 2017, incluyó a la reserva de\nSavegre a la lista de Reservas de Biosfera de su red.\n\nX.-Que las\nreservas de Biosferas designadas por UNESCO constituyen un modelo que procura\nconciliar la conservación de la diversidad biológica con el desarrollo económico\ny social y el mantenimiento de valores culturales asociados, y es potestad de\nlos Gobiernos definir y desarrollar los instrumentos y las acciones necesarias\nque posibiliten un ambiente adecuado para sus habitantes, acorde con la\nlegislación nacional vigente y la orientación del Marco Estatutario de la Red\nMundial de Reservas de Biosferas.\n\nXI.-Que el Marco\nEstatutario de la Red Mundial de Reserva de Biosfera, aprobado por la\nConferencia General de la UNESCO en 1995 (Resolución Nº 28 C/2.4) establece las\ndisposiciones generales para la designación, el apoyo y la promoción de las\nreservas de biosfera, incluyendo la implementación de mecanismos de gestión\nmultisectoriales y participativos.\n\nXII.-Que durante\nla 38a reunión de la Conferencia General de la UNESCO, llevada a cabo en\nnoviembre del 2015, se aprobó la Estrategia del Programa MAB para el periodo\n2015-2025 y se insta a los Estados Miembros a comprometerse con su\nimplementación.\n\nXIII.-Que el\nConsejo Internacional de Coordinación del Programa MAB hizo un llamado, a\ntravés de la Declaración de Lima (2016), para impulsar las reservas de biosfera\ncomo modelos de demostración del desarrollo sostenible a escala nacional en el\nmarco de la Agenda 2030 y los Objetivos de Desarrollo Sostenible.\n\nXIV.-Que en Costa\nRica se tiene registro de la existencia del Comité Nacional MAB desde el 02 de\nenero del año 1989, cuando se firmó el Convenio de Cooperación entre el\nMinisterio de Recursos Naturales y Minas y la Comisión Costarricense de\nCooperación con la UNESCO en relación a la creación de la Secretaría del Comité\nCostarricense del Hombre y la Biosfera adjunta al Servicio de Parques\nNacionales.\n\nXV.-Que la\nadecuada gestión de las Reservas de Biosfera constituye una estrategia país\npara mitigar los impactos del Cambio Climático; la implementación del Plan\nEstratégico para la Diversidad Biológica, el cumplimiento de la Agenda 2030 y\nlos Objetivos de Desarrollo Sostenible. Por tanto,\n\nDecretan:\n\n\"EL\nRECONOCIMIENTO DE LAS RESERVAS DE BIOSFERA\n\nCOMO\nTERRITORIOS MODELO PARA EL DESARROLLO\n\nSOSTENIBLE Y\nEL ESTABLECIMIENTO DE LA\n\nESTRUCTURA\nORGÁNICA PARA SU GESTIÓN\n\nY\nDECLARATORIA DEL DÍA NACIONAL\n\nDE LAS\nRESERVAS DE BIOSFERA\n\nDE COSTA\nRICA\"\n\nCAPÍTULO I\n\nRegulación\ndel modelo de conservación\n\nArtículo 1º-Se otorga\na las Reservas de Biosfera la condición de territorios modelo para el\ndesarrollo sostenible vinculados al Ministerio de Ambiente y Energía, al\nSistema Nacional de Áreas de Conservación, las Instituciones Públicas y actores\ninteresados presentes en esos territorios; en la forma que determina el\npresente Decreto Ejecutivo.\n\nArtículo 2º-La\ngestión de las Reservas de Biosfera será efectuada con recursos y presupuesto\nque podrán designar las diferentes instituciones públicas, en la medida de sus\nposibilidades y sin perjuicio del cumplimiento de sus propios objetivos, así como\norganizaciones no gubernamentales, según los siguientes lineamientos:\n\na) El Comité\nNacional MAB promoverá y facilitará la vinculación de los responsables de las\nreservas de biosfera y los comités locales de gestión de las Reservas de\nBiosfera con los diferentes consejos regionales o territoriales de desarrollo (Consejos\nRegionales de Desarrollo (COREDES), Consejo Territorial de Desarrollo Rural\n(CTDR) a efectos de que se determinen las prioridades, la articulación de esfuerzos\ny se coordine con cada institución para la planificación y asignación de\npresupuesto a proyectos específicos.\n\nb) El\nfinanciamiento que pueda generarse a través de Convenios de Cooperación\nespecíficos serán suscritos por la Comisión Costarricense de Cooperación con la\nUNESCO y ejecutados a través de los responsables y comités de gestión locales\nde Reserva de Biosfera con el apoyo del Comité Nacional MAB.\n\nc) Se autoriza a\ntodas la Instituciones Públicas para que, a partir de la publicación del\npresente decreto, consideren la programación de presupuesto con el fin de\napoyar acciones estratégicas para el cumplimiento de la gestión de las Reservas\nde Biosfera, como parte del compromiso internacional asumido por el Gobierno de\nCosta Rica.\n\nArtículo 3º-Las instituciones\npúblicas, principalmente el Ministerio de Planificación y Política Económica\n(MIDEPLAN), y Ambiente y Energía (MINAE), el Instituto Costarricense de Turismo\n(ICT) y el Instituto de Desarrollo Rural (INDER), coordinarán acciones e\nintegrarán los principios de sostenibilidad del modelo Reserva de Biosfera en\nlas políticas y planes de desarrollo que se impulsen en estos territorios con\ndesignación la UNESCO.\n\nArtículo 4º-El\nComité Nacional MAB hará los esfuerzos necesarios para instar a las instituciones\nde gobierno y municipalidades, para que, dentro de sus posibilidades, incluyan acciones\nque promuevan las reservas de biosfera en sus programas anuales o planes de\ntrabajo, apoyen con recursos financieros las gestiones que se desarrollan en el\nmarco del territorio de biosfera, participen en los comités de gestión de las\nreservas de biosfera y faciliten la información que sea requerida para la\nelaboración de los informes país; así como utilizar el nombre y logo de la\nreserva de biosfera para fines de promoción a nivel regional, nacional o internacional.\n\nCAPÍTULO II\n\nEstructura\norgánica para la gestión\n\nde las\nreservas de biosfera\n\nArtículo 5º-Para\nla adecuada gestión de las Reservas de Biosfera se establecen los siguientes\nórganos:\n\na) Comité\nNacional sobre el Ser humano y la Biosfera (CNMAB).\n\nb) Comités\nLocales de Gestión de las Reservas de Biosfera.\n\nc) Responsable de\nReserva de Biosfera.\n\nSECCIÓN I\n\nIntegración\ny funcionamiento del Comité Nacional\n\nsobre el\nSer Humano y la Biosfera (CNMAB)\n\nArtículo\n6º-Créase el Comité Nacional sobre el ser humano y la biosfera (CNMAB), como un\nórgano de asesoramiento y coordinación del Programa MAB a nivel nacional,\nadscrito técnicamente a la Comisión Costarricense de Cooperación con la UNESCO\ny vinculado con las instituciones gubernamentales que inciden en la gestión de\nlos territorios designados como reservas de biosfera.\n\nArtículo 7º-El\nComité Nacional MAB estará constituido por una Asamblea General de miembros y\nuna Junta Directiva.\n\nArtículo 8º-La\nAsamblea General estará integrada por organizaciones no gubernamentales,\ninstituciones públicas y privadas, municipalidades, instituciones de educación\nsuperior y ciudadanos interesados presentes en las áreas geográficas designadas\ncomo Reservas de Biosfera, un representante de los Comités Locales de gestión\nde cada Reserva de Biosfera y los responsables de las Reservas de Biosfera\ndeclaradas para el país. Se reunirá ordinariamente una vez al año para el\ninforme de laborales y el nombramiento de miembros de la Junta Directiva. La convocatoria\nserá efectuada por el presidente en ejercicio de la Junta Directiva\nconjuntamente con la Comisión Costarricense de Cooperación con la UNESCO.\n\nArtículo 9º-La\nJunta Directiva se integrará con al menos un representante de cada uno de los\nsectores convocados, y su funcionamiento se realizará según el Reglamento\nOperativo que se elabore y que debe ser aprobado por la Comisión Costarricense\npara la Cooperación con UNESCO.\n\nArtículo\n10.-Serán funciones de la Junta Directiva del CNMAB:\n\na) Colaborar con\nel desarrollo de actividades y programas enmarcados en los diversos campos de\nacción del Programa MAB.\n\nb) Brindar\nsoporte y apoyo logístico a los Comités Locales de Gestión de las Reservas de\nBiosfera para el cumplimiento de sus funciones.\n\nc) Establecer con\nbase en la visión y los planes de acción del Programa MAB, los lineamientos\nestratégicos para la gestión nacional de las Reservas de Biosfera.\n\nd) Garantizar el\ndesarrollo de las acciones de gestión estratégica de los territorios de las\nreservas de biosfera.\n\ne) Proponer al\nConsejo Nacional de Áreas de Conservación, en conjunto con el Comité Local\nrespectivo, una terna de nombres para la designación del coordinador\nresponsable de la Reserva de Biosfera.\n\nf) Recomendar la\nasignación de recursos y el acompañamiento de las instituciones públicas e\ninstituciones académicas para el cumplimiento de las funciones de las reservas\nde biosfera.\n\nSECCIÓN II\n\nIntegración\ny funcionamiento de los Comités\n\nLocales\nde Gestión de las Reservas de Biosfera\n\nArtículo\n11.-Créanse los Comités Locales de Gestión de las Reservas de Biosfera como\nórganos para el asesoramiento, planificación y coordinación de la gestión de\nestos territorios a nivel local.\n\nArtículo 12.-Su\nfuncionamiento estará regido por lo que se disponga en el Reglamento Operativo\ndel Comité Nacional MAB.\n\nArtículo 13.-Los\nComités Locales de Gestión de Reservas de Biosfera estarán constituidos por una\nJunta Directiva nombrada en una Asamblea Local que estará integrada por\norganizaciones no gubernamentales, instituciones públicas y privadas,\nmunicipalidades, instituciones de educación superior, representantes de\nempresas privadas y actores individuales interesados, presentes en el área geográfica\ndesignada como Reservas de Biosfera.\n\nSECCIÓN III\n\nNombramiento\ny funciones del responsable\n\nde\nReservas de Biosfera\n\nArtículo 14.-El\nMinisterio de Ambiente y Energía deberá nombrar un responsable de la\ncoordinación de Reserva de Biosfera en cada territorio designado, considerando\nla propuesta de terna que envíe el Comité Nacional MAB y el Comité Local\nrespectivo.\n\nArtículo 15 .- (Nota de Sinalevi: En la presente norma no\naparece este artículo. The MAB Programme and its World Network of Biosphere Reserves work towards this vision within and outside biosphere reserves.\"\n\nV.-That the MAB Programme, in its Seville Strategy, adopted under Resolution Nº 28 C/2.4 of the UNESCO General Conference in November 1995, recommends that States \"Ensure that each biosphere reserve has a management policy or plan and has an authority or mechanism to implement them\" (Objective II.2), as well as \"Establish a national advisory and coordination body for biosphere reserves, fully taking into account their recommendations and guidance\" (Objective IV.2).\n\nVI.-That Biosphere Reserves constitute an international designation endorsed by the State, granted by UNESCO through the MAB Programme, to areas of terrestrial and marine ecosystems recognized thus, as sites of excellence for the demonstration of sustainable development and where people share a way of living with nature, forging a future of which they feel proud.\n\nVII.-That the Costa Rican Commission for Cooperation with UNESCO (CCCU) serves as a liaison for the coordination and development of UNESCO actions in Costa Rica, as indicated in Decree Nº 34276-MECJD-MICIT-MINAE-RE, utilizing voluntary multidisciplinary work commissions for the development of its objectives, such as the Education Commission, Youth Commission, Social Transformations Committee, and Man and the Biosphere (MAB) Committee.\n\nVIII.-That Costa Rica participates in the MAB Programme, before which it has requested the designation of three Biosphere Reserves: La Amistad, designated in 1982, evaluated and expanded in 2015; Cordillera Volcánica Central, designated in 1988, evaluated and expanded in 2010; and Agua y Paz, designated in 2007.\n\nIX.-That additionally, the International Coordinating Council of the \"Man and the Biosphere\" Programme of UNESCO in June 2017 included the Savegre reserve in the list of Biosphere Reserves of its network.\n\nX.-That the Biosphere Reserves designated by UNESCO constitute a model that seeks to reconcile the conservation of biological diversity with economic and social development and the maintenance of associated cultural values, and it is the authority of Governments to define and develop the instruments and actions necessary to enable an adequate environment for their inhabitants, in accordance with current national legislation and the guidance of the Statutory Framework of the World Network of Biosphere Reserves.\n\nXI.-That the Statutory Framework of the World Network of Biosphere Reserves, approved by the UNESCO General Conference in 1995 (Resolution Nº 28 C/2.4), establishes the general provisions for the designation, support, and promotion of biosphere reserves, including the implementation of multisectoral and participatory management mechanisms.\n\nXII.-That during the 38th meeting of the UNESCO General Conference, held in November 2015, the MAB Programme Strategy for the period 2015-2025 was approved and Member States are urged to commit to its implementation.\n\nXIII.-That the International Coordinating Council of the MAB Programme made a call, through the Lima Declaration (2016), to promote biosphere reserves as demonstration models of sustainable development at the national scale within the framework of the 2030 Agenda and the Sustainable Development Goals.\n\nXIV.-That in Costa Rica there is a record of the existence of the National MAB Committee since January 2, 1989, when the Cooperation Agreement was signed between the Ministry of Natural Resources and Mines and the Costa Rican Commission for Cooperation with UNESCO regarding the creation of the Secretariat of the Costa Rican Man and the Biosphere Committee attached to the National Parks Service.\n\nXV.-That the adequate management of Biosphere Reserves constitutes a country strategy to mitigate the impacts of Climate Change; the implementation of the Strategic Plan for Biological Diversity, the fulfillment of the 2030 Agenda and the Sustainable Development Goals. Therefore,\n\nDecree:\n\n\"THE RECOGNITION OF BIOSPHERE RESERVES\n\nAS MODEL TERRITORIES FOR SUSTAINABLE\n\nDEVELOPMENT AND THE ESTABLISHMENT OF THE\n\nORGANIC STRUCTURE FOR THEIR MANAGEMENT\n\nAND DECLARATION OF THE NATIONAL DAY\n\nOF THE BIOSPHERE RESERVES\n\nOF COSTA RICA\"\n\nCHAPTER I\n\nRegulation of the conservation model\n\nArticle 1.-The status of model territories for sustainable development is granted to the Biosphere Reserves, linked to the Ministry of Environment and Energy, the National System of Conservation Areas, the Public Institutions and interested actors present in those territories; in the manner determined by this Executive Decree.\n\nArticle 2.-The management of the Biosphere Reserves will be carried out with resources and budget that the different public institutions may designate, to the extent of their possibilities and without prejudice to the fulfillment of their own objectives, as well as non-governmental organizations, according to the following guidelines:\n\na) The National MAB Committee will promote and facilitate the linkage of those responsible for the biosphere reserves and the local management committees of the Biosphere Reserves with the different regional or territorial development councils (Regional Development Councils (COREDES), Territorial Council for Rural Development (CTDR)) for the purpose of determining priorities, articulating efforts, and coordinating with each institution for the planning and allocation of budgets to specific projects.\n\nb) The financing that may be generated through specific Cooperation Agreements will be signed by the Costa Rican Commission for Cooperation with UNESCO and executed through those responsible for and the local management committees of the Biosphere Reserve with the support of the National MAB Committee.\n\nc) All Public Institutions are authorized to, upon the publication of this decree, consider budget programming in order to support strategic actions for the fulfillment of the management of the Biosphere Reserves, as part of the international commitment assumed by the Government of Costa Rica.\n\nArticle 3.-Public institutions, mainly the Ministry of Planning and Economic Policy (MIDEPLAN), and Environment and Energy (MINAE), the Costa Rican Tourism Institute (ICT) and the Rural Development Institute (INDER), will coordinate actions and integrate the sustainability principles of the Biosphere Reserve model into the development policies and plans promoted in these territories with UNESCO designation.\n\nArticle 4.-The National MAB Committee will make the necessary efforts to urge government institutions and municipalities to, within their possibilities, include actions that promote biosphere reserves in their annual programs or work plans, support with financial resources the efforts developed within the framework of the biosphere territory, participate in the management committees of the biosphere reserves and facilitate the information required for the preparation of country reports; as well as to use the name and logo of the biosphere reserve for promotional purposes at the regional, national, or international level.\n\nCHAPTER II\n\nOrganic structure for the management\n\nof the biosphere reserves\n\nArticle 5.-For the adequate management of the Biosphere Reserves, the following bodies are established:\n\na) National Committee on Man and the Biosphere (CNMAB).\n\nb) Local Management Committees of the Biosphere Reserves.\n\nc) Person Responsible for the Biosphere Reserve.\n\nSECTION I\n\nIntegration and operation of the National Committee\n\non Man and the Biosphere (CNMAB)\n\nArticle 6.-The National Committee on Man and the Biosphere (CNMAB) is created, as an advisory and coordination body for the MAB Programme at the national level, technically attached to the Costa Rican Commission for Cooperation with UNESCO and linked with the governmental institutions that influence the management of the territories designated as biosphere reserves.\n\nArticle 7.-The National MAB Committee will be constituted by a General Assembly of members and a Board of Directors.\n\nArticle 8.-The General Assembly will be composed of non-governmental organizations, public and private institutions, municipalities, higher education institutions and interested citizens present in the geographical areas designated as Biosphere Reserves, one representative from the Local Management Committees of each Biosphere Reserve and those responsible for the Biosphere Reserves declared for the country. It will ordinarily meet once a year for the activities report and the appointment of members of the Board of Directors. The convocation will be made by the sitting president of the Board of Directors jointly with the Costa Rican Commission for Cooperation with UNESCO.\n\nArticle 9.-The Board of Directors will be composed of at least one representative from each of the convened sectors, and its operation will be carried out according to the Operating Regulations to be drawn up and which must be approved by the Costa Rican Commission for Cooperation with UNESCO.\n\nArticle 10.-The functions of the Board of Directors of the CNMAB will be:\n\na) To collaborate with the development of activities and programs framed within the various fields of action of the MAB Programme.\n\nb) To provide support and logistical backing to the Local Management Committees of the Biosphere Reserves for the fulfillment of their functions.\n\nc) To establish, based on the vision and action plans of the MAB Programme, the strategic guidelines for the national management of the Biosphere Reserves.\n\nd) To guarantee the development of strategic management actions for the territories of the biosphere reserves.\n\ne) To propose to the National Council of Conservation Areas, together with the respective Local Committee, a shortlist of three names for the designation of the coordinator responsible for the Biosphere Reserve.\n\nf) To recommend the allocation of resources and the accompaniment of public institutions and academic institutions for the fulfillment of the functions of the biosphere reserves.\n\nSECTION II\n\nIntegration and operation of the Local\n\nManagement Committees of the Biosphere Reserves\n\nArticle 11.-The Local Management Committees of the Biosphere Reserves are created as bodies for the advice, planning and coordination of the management of these territories at the local level.\n\nArticle 12.-Their operation will be governed by what is provided in the Operating Regulations of the National MAB Committee.\n\nArticle 13.-The Local Management Committees of Biosphere Reserves will be constituted by a Board of Directors appointed in a Local Assembly which will be composed of non-governmental organizations, public and private institutions, municipalities, higher education institutions, representatives of private companies and interested individual actors, present in the geographical area designated as Biosphere Reserves.\n\nSECTION III\n\nAppointment and functions of the person responsible\n\nfor Biosphere Reserves\n\nArticle 14.-The Ministry of Environment and Energy must appoint a person responsible for the coordination of the Biosphere Reserve in each designated territory, considering the shortlist proposal sent by the National MAB Committee and the respective Local Committee.\n\nArticle 15 .- (Note from Sinalevi: This article does not appear in this norm.
