  "body_es_text": "en la totalidad del texto\n\n                    -\n\n                        Texto Completo Norma 407\n\n                        Reforma Acuerdo AJDIP 437-2016 \"Obligatoriedad para embarcaciones de portar\ncon licencia comercial de mediana escala y comercial avanzada el Libro de Registro de Operaciones de\nPesca, aprueba tarifas para Libro Registro Operaciones Pesca...\n\nINSTITUTO\nCOSTARRICENSE DE PESCA Y ACUICULTURA\n\nAJDIP/407-2017.-Puntarenas,\na los veintinueve días del mes de setiembre de dos mil diecisiete.\n\nConsiderando:\n\n1º-Que en vista\nque el Departamento de Asesoría Jurídica institucional ha observado defectos de\nfondo en el acuerdo AJDIP 437-2016 y que deben ser subsanados con el fin que\nquede plasmado claramente las consecuencias penales, civiles y administrativas\npor el no uso o por no portar los libros donde se debe registrar las\noperaciones de la actividad pesquera de cada embarcación de la flota pesquera\ncomercial mediana escala y la flota pesquera comercial avanzada , que realicen\nlas actividades o faenas de pesca de atún y especies afines, se remite a Junta\nDirectiva para su respectiva valoración, la propuesta de acuerdo mediante el\noficio AL 208-09- 2017 (2).\n\n2º-Que una vez\npresentado el oficio y analizado por los señores Directores, la Junta\nDirectiva, Por tanto,\n\nACUERDA:\n\nArtículo\n1º-Modifíquese considerando 2 y 3 del Acuerdo de Junta Directiva Nº AJDIP 437-2016\ny léase de la siguiente manera:\n\n2- De acuerdo con\nel Decreto Ejecutivo Nº 34681-MAGMINAE referente al \"Ordenamiento para el\naprovechamiento de atún y especies afines en la zona económica exclusiva del\nocéano pacífico-costarricense\", publicado en La Gaceta N° 213 del 05 de\nnoviembre 2014, se establece en su artículo 11 que las embarcaciones de la\nflota pesquera comercial mediana escala y la flota pesquera comercial avanzada,\nque realicen las actividades o faenas de pesca de atún y especies afines dentro\nde las áreas establecidas en el Artículo 2 incisos a), b), c) y d), de dicho\nDecreto; deberán obligatoriamente portar una bitácora de pesca y registrar toda\nla información de las operaciones de pesca que en ella se solicite objetivo del\nviaje de pesca, los equipos y alistos de la embarcación al momento del zarpe,\nun registro por lance donde se consigne las fechas, las posiciones de los\nlances de pesca, incluyendo el inicio y el fin de cada uno, la cantidad de\ncapturas y el tipo de especie capturado realizados por lance de pesca, un\nregistro de los Transbordos en Viaje de pesca que se realice para conocer el\ndestino que se le dio a la captura y cantidades transbordadas por especie en el\npuerto de arribo, nombre del capitán y la tripulación y cualquier otra información\nimportante del viaje de pesca), por lo que la información de sus operaciones de\npesca deberán verse reflejadas y detalladas en los libros llamados libro de\nRegistro de Operaciones de Pesca, el Libro de Registro Por Lance, y el Registro\nde Transbordo.\n\n3- Que los\nartículos 41 y 105, y 152 de la Ley de Pesca y Acuicultura señala que quienes\nposean una licencia, autorización, permiso o concesión, deberán llevar un libro\nde registro de operaciones de su actividad; en tal sentido se deberá llevar a\nbordo el libro de Registro de Operaciones de Pesca, el Libro de Registro Por\nLance, y el Registro de Transbordo con la información completa y correcta.\n\nArtículo\n2º-Modifíquese el artículo 1 del por tanto el Acuerdo de Junta Directiva AJDIP\n437-2016 para que se lea de la siguiente manera:\n\n\"1- Establecer la\nobligatoriedad de portar en todo momento para las embarcaciones con licencia comercial\nde mediana escala y comercial avanzada los Libros de Registro de Operaciones de\nPesca, de Registro por Lance, Registro de Transbordo en viaje de pesca, sin\nperjuicio de la obligatoriedad de portar el libro de bitácora de uso ordinario\nque otorga el Ministerio de Obras Públicas y Transportes; señalados en los\nartículos Artículo 41 y 105, 102 de la Ley de Pesca y Acuicultura, así como en\nel artículo 114 del Decreto Ejecutivo N° 36782-MINAET-MAG-MOPT-TUR-SPS-MTSS y\nel artículos 11 y 2 del Decreto Ejecutivo Nº 34681-MAGMINAE.\"\n\nArtículo\n3º-Adiciónese al Acuerdo AJDIP 437-2016 los artículos 4 y 5:\n\n4.   "body_en_text": "in the entirety of the text\n\n                    -\n\n                        Complete Text of Norm 407\n\n                        Reform of Agreement AJDIP 437-2016 \"Obligatoriedad para embarcaciones de portar\ncon licencia comercial de mediana escala y comercial avanzada el Libro de Registro de Operaciones de\nPesca, aprueba tarifas para Libro Registro Operaciones Pesca...\n\nCOSTA RICAN\nINSTITUTE OF FISHERIES AND AQUACULTURE\n\nAJDIP/407-2017.-Puntarenas,\non the twenty-ninth day of the month of September, two thousand seventeen.\n\nConsidering:\n\n1º-That in view\nthat the institutional Legal Advisory Department has observed substantive\ndefects in agreement AJDIP 437-2016 and that they must be corrected so that\nthe criminal, civil, and administrative consequences for not using or not carrying\nthe books where the operations of the fishing activity of each vessel of the commercial\nmedium-scale fishing fleet (flota pesquera comercial mediana escala) and the advanced commercial fishing fleet (flota pesquera comercial avanzada), that carry out\nthe activities or fishing tasks for tuna and related species, must be recorded, it is referred to the Board\nof Directors for its respective assessment, the proposed agreement via\nofficial letter AL 208-09-2017 (2).\n\n2º-That once\nthe official letter was presented and analyzed by the Directors, the Board\nof Directors, Therefore,\n\nAGREES:\n\nArticle\n1º-Modify considering 2 and 3 of Board of Directors Agreement Nº AJDIP 437-2016\nand it shall read as follows:\n\n2- In accordance with\nExecutive Decree (Decreto Ejecutivo) Nº 34681-MAGMINAE regarding the \"Ordenamiento para el\naprovechamiento de atún y especies afines en la zona económica exclusiva del\nocéano pacífico-costarricense\", published in La Gaceta N° 213 of November 05,\n2014, it is established in its article 11 that vessels of the\ncommercial medium-scale fishing fleet and the advanced commercial fishing fleet,\nthat carry out fishing activities or tasks for tuna and related species within\nthe areas established in Article 2, subsections a), b), c) and d), of said\nDecree; must obligatorily carry a fishing logbook (bitácora de pesca) and record all\nthe information on the fishing operations requested therein, including the objective\nof the fishing trip, the equipment and readiness of the vessel at the time of departure,\na record per set (lance) stating the dates, the positions of the\nfishing sets, including the start and end of each one, the quantity of\ncatches and the type of species caught per fishing set, a\nrecord of the Transshipments (Transbordos) during the Fishing Trip carried out to know the\ndestination given to the catch and quantities transshipped per species at the\nport of arrival, name of the captain and the crew, and any other important\ninformation about the fishing trip), therefore the information on their fishing\noperations must be reflected and detailed in the books called the Fishing Operations Logbook (libro de\nRegistro de Operaciones de Pesca), the Logbook by Set (Libro de Registro Por Lance), and the Transshipment Log (Registro\nde Transbordo).\n\n3- That articles 41 and 105, and 152 of the Fisheries and Aquaculture Law (Ley de Pesca y Acuicultura) indicate that those who\nhold a license, authorization, permit, or concession must keep a logbook\n( libro de registro de operaciones) of their activity; in this sense, the Fishing Operations Logbook, the Logbook by Set, and the Transshipment Log must be kept\non board with complete and correct information.\n\nArticle\n2º-Modify article 1 of the therefore section of Board of Directors Agreement AJDIP\n437-2016 so that it reads as follows:\n\n\"1- Establish the\nobligation to carry at all times, for vessels with a commercial medium-scale\nand advanced commercial license, the Fishing Operations Logbook (Libros de Registro de Operaciones de\nPesca), the Logbook by Set (Registro por Lance), and the Transshipment Log during a Fishing Trip (Registro de Transbordo en viaje de pesca), without\nprejudice to the obligation to carry the ordinary use logbook (libro de bitácora)\nissued by the Ministry of Public Works and Transport (Ministerio de Obras Públicas y Transportes); indicated in\narticles Article 41 and 105, 102 of the Fisheries and Aquaculture Law, as well as in\narticle 114 of Executive Decree N° 36782-MINAET-MAG-MOPT-TUR-SPS-MTSS and\narticles 11 and 2 of Executive Decree Nº 34681-MAGMINAE.\"\n\nArticle\n3º-Add articles 4 and 5 to Agreement AJDIP 437-2016:\n\n4. The\naforementioned books must be renewed annually together with the\nfee (canon) for their license; otherwise, there will be an immediate suspension of the services\nand benefits derived from the license, permit, or authorization, and administrative proceedings will be initiated,\nfollowing due process, for the sanction established in\narticle 152 of the Fisheries and Aquaculture Law.\n\n5. The\nobligation to comply with the use and carrying of these books is\nestablished as a provision or regulation of a technical nature for carrying out\nthe fishing tasks or work, and the non-observance or non-compliance with the same\nentails criminal liability in accordance with article 148 of the Fisheries and Aquaculture Law and liability in administrative and civil matters in\naccordance with article 116 of the Fisheries and Aquaculture Law.\n\nArticle\n4º-Modify the numbering of article 4 so that it reads as article 6.
